“…The Congress that wrote the 14th Amendment… rejected the “colorblind” theory, and instead wrote a landmark civil rights statute that explicitly requires the government to consider race when deciding whether a nonwhite individual’s rights were fully respected. And the Civil Rights Act of 1866 is only one of many such laws enacted by Reconstruction-era lawmakers.

Now, the Supreme Court is about to decide whether Roberts or Jackson is correct about the Constitution and “colorblindness.” Given that Republicans appointed two-thirds of the justices, it would be shocking if a majority of the justices do not side with Roberts — even if Jackson is correct about how the Constitution was originally understood.

But, lest there be any doubt, the overwhelming weight of historical evidence suggests that Jackson is correct.

Biden’s Iran envoy placed on leave after security clearance suspended amid investigation into possible mishandling of classified material, sources say

Rob Malley, the US special envoy on Iran, has been placed on leave without pay, which occurred after his security clearance was suspended earlier this year amid an investigation into his handling of classified material, multiple sources told CNN.

A US official said that Malley’s clearance was suspended amid a State Department diplomatic security investigation into the possible mishandling of classified information. Another source familiar with the matter said he was placed on unpaid leave on Thursday afternoon.

“I have been informed that my security clearance is under review. I have not been provided any further information, but I expect the investigation to be resolved favorably and soon. In the meantime, I am on leave,” Malley told CNN.

We had some discussion downstairs about term limits for the Supremes. I wrote this about the need for a Constitutional Amendment.

Pelosi just asked for term limits for Justices. The relevant sentence in an article about this says “It would require a constitutional amendment, or Congress could pass legislation requiring justices to retire, take “senior” status with lesser duties or move to an appeals court.”

A bill detailing how legislation could do this has been submittted a couple of times.

An Amendment would be more definitive but legislation would also work. And Congress can add an amendment saying it is not reviewable by the Supreme Court. That is in the Constitution. Article III Section 2 - “…the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make”

the modern contemporary conservative* legal movement’s disdain for the 14th Amendment runs deep. They also like to misrepresent the intention behind the birthright citizenship clause. This was one of Eastman’s hobby horses when I was in law school 20 years ago - arguing that it didn’t actually apply to everyone through a very pre-modern view of allegiances owed by citizens (and even more weirdly, of newborns). But of course, it is also very wrong:

Significantly, congressional critics of the Amendment recognized the broad sweep of the birthright citizenship language. Senator Edgar Cowan of Pennsylvania, a leading opponent, asked: “is the child of the Chinese immigrant in California a citizen? Is the child born of a Gypsy born in Pennsylvania a citizen?” Senator John Conness of California responded yes, and later lost his seat due to anti-Chinese sentiment in his state. The original public meaning of the 14th Amendment—which conservatives properly believe to be the lodestar of constitutional interpretation—affirms birthright citizenship.

That is an argument made by, of all fucking people, John Yoo.

This confuses the colloquial definition of “conservative” (cautious, measured, &c) with the political definition conservatives themselves have used for three hundred years (acquisition of power, sorting groups in hierarchies of “lesser” and “better,” &c).

Doesn’t seem like there’s anything illegal about a policy that helps lower income, inner city/Appalachia/reservation domiciles, or first in family to attend college, etc.
Colleges can get creative with this; no reason for it to affect much.

I have read that term limits for Supreme Court Justices is fairly broadly popular across political lines, so that is probably a better place to start than increasing the size of the court.

Biden had a committee that looked at this and it covers all bases and does mention that the efforts are bipartisan.

It mentions using an amendment for term limits or using legislation. There was disagreement on the committee which was best. so it is not a slam dunk that legislation would pass scrutiny. But there are good arguments.

Essentially, based on precedent from the Supreme Court , the legislation says they keep their office but have different duties after 18 years. Congress can define the duties of Judges. We already have precedent that retired Juidges still maintain their offices and can particiapte if judicial decsions.

So if retired judges can “voluntarily” change their duties on the Court, then Congress can legislatively change them also.

So I’m pumped on a legislative approach.

It strikes me as plausible that the supposedly “moderate” donor class Republicans are quietly pursuing this agenda while the Trump circus distracts everyone.

A law which could be challenged by this court. It’s constitutional to expand the court. Forcing them to retire is unconstitutional right now, forcing them to move to other things will be questionable.

they’re not reactionaries. they’re radicals. they are literally trying to tear government up by the roots. In fact, the proper term for them is radical agrarian populists. They are almost exclusively from rural areas, thinking that rural values represent “true” values; they make use of mob instincts and force; and they wish to effectively end institutions of authority.

The point of “diversity” in college admissions isn’t just to help out the diversity admits. It’s to give everyone a better education. College isn’t just about the prof’s lecture and the reading list, if that were all of it anybody could do it at home on-line. It’s the varying perspectives you hear during class discussion, or in your study group, or at clubs and events and with the group in the TV room watching and commenting on this year’s hot show.

TL:DR - WFH will change the economics of many rural and Red areas, as the extractive industries most rely on die. The values that make these industries potent are not Red state ones but ones driven by diversity, etc.

I think there is one timeline this could happen but I am not convinced it is ours. Here are my thoughts.

Those 26 hell holes would not have enough economic activity to satisfy the Wall Street/ Main Street “moderates”. Those states are takers not givers. Also, as WFH really takes off (and high housing costs continue upwards), we will see high paying jobs move to the really nice and cheap rural areas that many of those Red states possess. This will revitalize and change rural areas from extractive industries to service industries (This is why Biden’s infrastructure billl with high speed internet is so important). And they will all want to chase the money that IT and WFH provide.

As William Gison said, “The future is here it is just not evenly distributed”. WFH will do that distribution.

For example, West Virginia has parts of it that are within 90 minutes of Baltimore, DC, Pittsburgh, and Columbus. And it has cheap land. I see WV moving more blue as they move from coal-based industries to industries supporting high tech and WFH. There is a lot of money there.

Similarly, we are seeing in my state (Washington) a lot of people moving from Seattle into the Red areas of the state for WFH. Thus is beginning to chaneg those areas as they begin to chase those IT dollars. Places like Tallahassee and Colorado Springs (both conservative areas) are becoming tech hubs themselves and will be competing with nearby hubs like Denver and Atlanta.

IT (and eventually most things will be drien by IT) requires diversity to be successful. And collaborations from diverse groups. These are views ethat will spread from Blue to red areas as the economics change.

I understand but Apple is also trying to engage with a lot of people on Twitter that might be reachable. I view it as an experiment. Not all are horrible people. Silo is not the usual fodder of right wing nutballs. If Apple can pull over some of those on Twitter, and expose them to something else, it is a win-win. I would like to believe. This court is becoming more and more like the Plessy/Lochner courts. And I think its decisions will eventually be tossed on the ash heap of history. Much of rhe damage they are doing can be fixed once this transition is over.

There is only one side whose organizational structure is savvy enough to deal with the complex social environment we inhabit. It makes wiser decisions more often..It is begining to win. Not every battle but enough of them for me to be confident it will win.

The other side cannot deal with the real world and continues to make stupid decisions that cannot support the complexity we see today. Their decisions support a world that no longer exists.That way lies collapse.

Just as it did for the South. And for Nazi Germany.

As with natural selection, there are selective economic pressures that will drive the savvy side to success. The open question is how long. I think we are closer to the end than the begining.

Unless they plan on actively passing legislation giving white Americans priority by either hostile government pressures or blatant racist immigration blocks. But no- they would never do that. Not in a million years.

Colleges can still do all sorts of things to encourage DEI for people on campus, thus making them more attractive to those applicants who WANT more diversity (which are most Gen Z). And they can do a lot of outreach, recruiting to attract more diversity. Those universities pushing epistemic closure (where everyone thionks alike and comes to the same conclusions) or are too lazy to work on diversity will fall behind.

I conpletely agree. Caltech has no affirmative action program and has 44% Asians. And Hispanics are 22%. There will not be a large increase in whites at Harvard. The new enrollees will be of Asian descent.

And it’s about the friendships and networking connections you make. At elite schools you’re likely to be doing class projects with children of senators, CEOs, and billionaires.

They viewed the power shift and diversity as a symbolic but meaningful rebuke of the Islamophobic rhetoric that was a central theme of then Republican presidential candidate Donald Trump’s campaign.

This week many of those same residents watched in dismay as a now fully Muslim and socially conservative city council passed legislation banning Pride flags from being flown on city property that had - like many others being flown around the country - been intended to celebrate the LGBTQ+ community.

Muslim residents packing city hall erupted in cheers after the council’s unanimous vote, and on Hamtramck’s social media pages, the taunting has been relentless: “Fagless City”, read one post, emphasized with emojis of a bicep flexing.

In a tense monologue before the vote, Councilmember Mohammed Hassan shouted his justification at LGBTQ+ supporters: “I’m working for the people, what the majority of the people like.”

It is amazing to watch minority populations, when they get power, being disrminatory against minorities. No self-awareness. What they say about gays was said about them. But now that they have power they ignore history. I expect it will bite them in the ass.

Former Round Rock pastor pleads guilty child pornography charges (KXAN-TV)

AUSTIN (KXAN) — A former Round Rock pastor pleaded guilty in federal court Tuesday to an “enhanced charge of possession of child pornography,” according to a news release from the U.S. Department of Justice.

David Lloyd Walther, 57, knowingly searched for, downloaded, distributed and possessed child sexual abuse material, including child pornography—some of which depicted prepubescent minors—using BitTorrent, a peer-to-peer file sharing network, according to the DOJ.

Two large computers were found during a search of Walther’s home and vehicle in November 2022 that contained more than 100,000 images and more than 5,000 videos of child sex abuse material, the release said.

Not sure how they could stop it. It is independently funded so they cannot prevent it from being paid. And the AG is the only one who can fire him and it has to be for good cause.

Because it is all controlled by DOJ procedures. The Congress let the legislaton for independent prosecutors that it controlled lapse.
