Plame Case Tossed

In the latest episode of one of our longest-running trumped up political scandals, the lawsuit by Valerie Plame has been tossed out.

This is going to drive the Nutroots insane. (It’s a short drive.)

WASHINGTON - A federal judge on Thursday dismissed former CIA operative Valerie Plame’s lawsuit against members of the Bush administration in the CIA leak scandal.

Plame, the wife of former Ambassador Joseph Wilson, had accused Vice President Dick Cheney and others of conspiring to leak her identity in 2003. Plame said that violated her privacy rights and was illegal retribution for her husband’s criticism of the administration.

U.S. District Judge John D. Bates dismissed the case on jurisdictional grounds and said he would not express an opinion on the constitutional arguments. Bates dismissed the case against all defendants: Cheney, White House political adviser Karl Rove, former White House aide I. Lewis “Scooter” Libby and former Deputy Secretary of State Richard Armitage.

Plame’s attorneys had said the lawsuit would be an uphill battle. Public officials are normally immune from such lawsuits filed in connection with their jobs.

No Fitzmas for you! Still, I'm just a wee bit disappointed that the suit couldn't proceed so that the defense team could get to cross Wilson and Plame directly. Instead, we'll get treated to lots of footage of Wilson saying how he knows that the Administration lied, covered up, and otherwise sought to destroy his family, when the truth is quite different.

Armitage leaked the name. Not Cheney, Rove, or even Libby. Libby's conviction was because he couldn't keep his facts straight (and neither could Russert or some of the other witnesses).

Umm, so they thing Valerie Plame is a beloved figure in the CIA? I should think they are more interested in getting the stink of the whole affair off of them, not assasinating someone who didn't make the leak in the first place.

Update on the Oak Ridge nuclear secrets case:

He just pled not guilty. If convicted, he faces what I consider a small punishment of 10 years or fines to $250,000.

Sorry for my moaning on the last thread. Maybe there's not actually much more to be said about this case at this point. The fun will be in watching the melt-down on the left in the next three weeks. And the looks on the Plame's faces when they realize their little show has been cancelled and the hungry worm has turned and taken notice of their foolish commotion.

Follow the money trail. This whole affair had two ideas.

1: Get someone in the Bush Administration, preferably Karl Rove, and possibly a perjury trap for Cheney and impeachment for Bush, but they had to settle for Scooter Libby, and whether he stays permanently in the gotcha column remains to be seen with appeals coming forthwith.

2: Money for Val and Joe. Not nearly what they wanted but their bank accounts have been bolstered nonetheless. Never mind Libby's life has been put on hold and he's 250,000 dollars poorer because of these two who have been encouraged in their quest by powers behind the curtains.

They are going to have to go up the food chain. Early reports said the Judge had no standing, but that clearly is not the case. The judge is saying that even if Plame was to win they could not receive any redress.
Next up would be a panel from the First Circuit, I think. And if I am not mistaken at this point the suit could be quashed by Justice Roberts unless a majority of SCOTUS wants to take it up.

Kerry has never, to my knowledge, set foot in the Little Saigon area of Orange County. He doesn't dare go near the place... no one would ever find his body.

Really eye-opening. They said they had a prop plane with an SV Major and his family land on the carrier and a bunch of our guys stood out on the deck to stop it since he wasn't set up for carrier landings.

I'd suggest you get a copy of the book No Place to Hide by Gerry Carroll. It's a novel that focuses on the last four weeks of the Republic of Vietnam's existence, including the evacuation of Saigon just ahead of the invading NVA.

Some of the scenes in the book are horrific. Unfortunately, they're also true.

Really eye-opening. They said they had a prop plane with an SV Major and his family land on the carrier and a bunch of our guys stood out on the deck to stop it since he wasn't set up for carrier landings.

When you watch the footage of the Fall of Saigon, or talk to a few V Vets and get their stories it breaks your heart...my own family fled Communism but from Europe, and the Soviets held death warrants on my grandparents until the day it collapsed. Imagine if you would, leaving everything you had at your house knowing that a military force is closing in on your homestead...you pack your small belongings and flee toward the city, encountering thousands on foot fleeing with you. Once your in the city you rest, but then you are told of your impending doom and see the rising smoke from the suburbs... As you take to the streets they fill up, making all vehicular traffic impossible...you take a few possessions and run with the crowd trying to flee a panic stricken city, where the streets are jammed shut with human and vehicle traffic. Refugees are running in every direction, panic written on each face, children screaming and crying in mothers arms... sleeper teams of VC are off attacking government installations and executing officials (police, ARVAN, city officials). In the distance you hear automatic rifle fire, and you see American choppers circling, landing, and taking off at what seems to be at random. Fire rampages through a shop that was hit by an artillery shell and the smoke burns your eyes...you sprint down the street hoping your not hit by another shell, all your possessions left behind dropped in your mad panic to survive...Running with the fear of G_D in you, hoping that you can make it out before the NVA makes it in...people are panicked as rumors of this street and that street are closed due to VC activity...as you run further your lungs ache for breath and you slow to stop, just to see where you are...nearby in an alley the bodies of people lay heaped upon the ground, bleeding and broken...the death squad that did the damage is on the roof of a small cafe, taking shots at a low flying helicopter that is hovering a few blocks away...

Sounds like hell...

When I see the footage of people desperately grabbing on to skids, or hear the tear choked stories of pilots that knew they were leaving people to their death it makes me angry. But to the moonbats it was a unjustified war, and all their rhetoric about helping the Vietnamese people by getting the murderous Americans out of there was just that...rhetoric. They turned a blind eye as thousands (and eventually millions) screamed for mercy...as their death rattles faded out, the millions of hippies that "cared" for the people turned to one another and started talking about how nice the weather was...

South Vietnam had problems yes, but we let an entire country slide into oblivion. And the NVA made sure that people would pay the ultimate price for ever questioning them.

'I hoped to be a glorious martyr'

A woman who was inside Islamabad's Red Mosque when it was stormed by Pakistani troops on 10 July has given the BBC one of the first accounts of the final hours of the siege. Unwilling to be named, the survivor said she was not held hostage by militants inside.

More than 100 people died in the army operation - she was one of only 30 women to walk out alive after soldiers went in. Following are excerpts from the interview with Rafia Riaz of the BBC's Urdu service.

(NB note the BBC, which gives a decent enough headline, begins by describing her as a survivor and says the "militants" did not hold her hostage, as if this is a positive. But then see what she has to say:)

I was not in contact with my family. The last time I contacted them, I told them that the army would not start an operation.

They asked me to come back home, but I said that I would never come back as I wished to be martyred. My brother said that he would force me to return, but I told him that he could be beaten up if he came near the seminary...

A girl who came with us was taken home forcibly. She was crying and told the teacher that she didn't want to go back. The teacher asked her to go back with her parents.

We felt sorry for her as we came here with the passion of jihad [holy war] and to preach Islam, and now because there was a problem the girls had gone back. We did not appreciate the parents behaviour. (ie the girls should have been martyred)

The teacher said that no one was being stopped from going home, and she asked parents to go and find their children to take them home. Very few girls left because they were afraid - those who left were either minors or they were forced to leave by their parents...

We were shocked that they cut off the electricity and also cut off the water and gas supply. What could we do? We were only praying to God to show them the right path.

We wanted to carry out suicide attacks. We didn't have enough ammunition to fight face to face. We had a small number of arms with which our mujahideen brothers were fighting.

We asked the teacher to provide us with arms necessary for suicide attacks. She said that we didn't have sufficient explosives.

We had been told by our teacher that they had put explosives in the building and that we shouldn't die in this manner, but that we should come outside to face the bullets or even surrender. It was better to come out rather than die under the debris...

We came outside with our hands raised and saw that the doors were closed and they were on the roof. There was no way to leave. We told them that we had surrendered and they should not shoot at us. A policeman showed us the way out and finally, we were taken outside...

They took us to another room and gave us food. We were crying a lot because Korans were burning inside the Red Mosque which was on fire.

What we have here is the ongoing struggle of the past two decades about what branch of government controls foreign policy. The Donks have been trying with the legislative branch when a Republican is in the White House since before Iran/Contra.

I'm just a dumb ol' country boy but in my opinion the Congress has no jurisdiction on when to withdraw/retreat/surrender troops, but only controls the purse strings. The LLLs are saying the Donks want a controlled and orderly withdrawal, but to me that is not in realm of Congress to decide. If Congress wants to stop the war, cut the money out. The Donks don't want to do that though, as they are enjoying switching Bush on the legs everyday for the next 17 months. Never mind they are playing with national security with their games.

a) Plame's position was not covert;

b) therefore, she could not be, or have been, "outed";

c) if she had been covert at one time, she was long past any holdover secrecy period;

d) her place of employment was an open secret in Washington, so any accusation of "outing" should be evaluated in light of such public knowledge;

e) if any "outing" can be said to have taken place, the person who actually did it (Armitage) got off scot-free;

f) accordingly, her suit against people who (i) did not "out" her, and (ii) were legally protected from her suit on grounds of having acted in performance of their duties, was entirely bogus, and rightfully dismissed.

I suspect that if an actual covert CIA agent had in fact been outed while engaging in covert activity, most of the people here--despite the deservedly low esteem in which the CIA is held--would be calling for the head of the person who did it, regardless of the party affiliation of the administration in power. But that did not happen here; the entire thing was a media firestorm over even less "nothing" than the Seinfeld show.

Buzz...

And yet... one man was sentenced to do time in prison. Not for "outing" her but for "lying" to the investigators.

Why didn't the Bush admin get tough with Plame or Wilson? Why have they been given carte blanche to run amok?

It looks as though the AP report saying that the case was tossed for jurisdictional reasons is wrong. The details are in comments in a t5hread at HotAir - but in fact the judge tossed the case for lack of merit. I think the last part of the Fox report has a better summation of the decision :

At HotAir down in the comments there is chapter and verse text from the main paragraphs of the judgment. Plame/Wilson argued that the defendants were acting outside their responsibilities. The judge states that they were acting WITHIN their responsibilities - it was their DUTY to rebut the public criticisms that Wilson had made.

If an outing had actually occurred, this might be a good point. Unfortunately, it didn't. Unfortunately, it wasn't the administration that even told the name to a reporter. It was done by a known critic of the war.

Ask yourself this. Why was no one ever charged for an actual crime of leaking, if there was an "outting"? I think you'll realize where I'm going with this if you answer truthfully.
