Most of Dan Rather's Lawsuit Dismissed

Thu, Apr 10, 2008 at 11:13:15 am PDT

According to TVNewser, the judge in Dan Rather’s lawsuit against CBS has dismissed most of the case, leaving just the contract dispute. (Hat tip: Allahpundit.)

In his lawsuit Rather claimed that the investigation into the Killian memos was biased, and that it did not prove the documents to be fakes. This dismissal is a tacit acknowledgment that Rather’s claims were ludicrous.

As if any person with more than two brain cells needed any more evidence than this:

Danny Boy

Oh Danny boy, the loony bin is calling;
You’ve dug your grave, yet still you dig some more.
Your mind is gone, and all the folks are laughing;
To Bedlam you must go, forevermore.
But still you claim the memos are legitimate,
And now your fame, to infamy has changed.
Or did you say that they are fake, but accurate?
Oh Danny boy, oh Danny boy, you are deranged.

And when you claim, though all the folks are laughing,
That you were wrongly scuttled from your throne,
You just compound the level of your blundering,
And strike us harder in the funny bone.
And when in court, you testify so righteously
That CBS did treat you so unfair,
The throbbing proof will ruin you, litigiously,
And so, of flying countersuits you’d best beware.

Oh Danny boy, Ms. Mapes, Ms. Mapes is calling;
The two of you, a lovely couple make,
For Mary girl is equally delusional,
And such dementia’s very hard to fake.
And so your waltz of lunacy goes whirling on,
Your dissolution, plain for all to see.
Or could it be you really know what’s going on,
And simply lack all vestige of integrity?

Oh Danny boy, your courage is incredible;
You have the nerve to play the victim card.
And even though fake memos aren’t admissible,
You still maintain this comical canard.
And though you failed to inculpate the President,
And you engaged in journalistic fraud,
You seek a multi-million-dollar settlement;
Oh Danny boy, such courage leaves us overawed.
Oh Danny boy, your “courage” leaves us overawed.

Well, Viacom and the CBS head honchos named in the suit must be having quite the laugh at watching Rather's suit get mostly dismissed. While they may want to gloat by having Couric include a spot on the suit, I doubt it will make the news.

I love it when the court system works.

True, but the entertainment value of discovery in this case is shortchanged because the suit was dismissed. No chance to see what evidence Rather had that the memos were verifiable, or any of the other kooky claims he was making. They may still make it in as part of the contract claim, but if I were Rather, I'd be settling the remaining action for fear of looking like a complete loon. If I were CBS, I'd be saying no dice - we'll see you in court to watch you lose.

Yay! Throbbing memo! Ocular exercise! My favorite.

Dan Rather and Mary Mapes are just freakin' insane. I heard an interview with her on the radio once where she just kept insisting that since they didn't have the originals of the memo it couldn't be proven to be a fake and therefore had to be assumed to be real.

What a bizarre and dangerous world they live in.

Dangerous to honest people that is.

That's news to CBS, or so CBS claims.

"We are very proud of the 'CBS Evening News,' particularly our political coverage, and we have no plans for any changes regarding Katie or the broadcast," a spokeswoman said in a statement.

Now whether that's the truth or not has yet to be seen, but it's what CBS is claiming right now.

re: #51 Ben Hur

Maybe not.

CBS is playing down renewed reports that Katie Couric will step down as anchor of "The CBS Evening News" after the election.
Couric and CBS execs have been discussing the possibility of her departure in the light of the newscast's continued disappointing performance in the ratings, according to stories in the Wall Street Journal and the Washington Post. The Journal was the first to report the alleged talks via a story on its website Wednesday night.

Latest round of rumors come nearly a year to the date after a similar report by the Philadelphia Inquirer. Eye officials vehemently batted down that story, but were more muted in their response to Wednesday's report.

re: #90 Shug

That's nothing, when I was in college I invested $1000 in the cattle futures market and in one month I made $100,000

was that before or after sprinting through the first round of sniper fire?

And John McCain was flying an F-4 dropping (not firing) laser-guided missiles that weren't even created by Al Gore yet.

McCain flew A-4 Skyhawks, not F-4 Phantoms.

John McCain was flying an A-4 Skyhawk, dropping unguided bombs from a fairly low altitude. Probably so low he could see the individual AA gunners. Jay Rockefeller is so full of it that his eyes are brown.

I heard that or a very similar interview. My head was spinning like Linda Blairs in the Exorcist.

Ok, enough with all this 'throbbing'.. I get enough of that on 'other' websites. :) -tm
