OK, since this is an open thread, I'll repost this just once, then never again!

I’m Pro-Zombie and I Vote: our new mascot

This is NOT a picture of me. Nor is it a picture by me. It’s actually a real picture of a protester at a “zombie walk” in Seattle taken by fellow citizen journalist Byron Dazey. I just thought it was so appropriate for zomblog that I’m inaugurating Mr. “I’m Pro-Zombie and I Vote” here as the new zomblog mascot! I’m also sticking a miniature version of him permanently over in the sidebar. (Temporarily permanently, at least.)

I have no idea yet for what purpose I’ll ever use this photo (other than posting it here), but perhaps one day it will be exactly what I need. Until then: if anyone else has a reason to download and use this photo (or the mini version to the right), go right ahead (and credit should go to “Byron Dazey,” not me).

Welcome to our new mascot!

And a question for everyone to ponder: Are you pro-zombie, and do you vote?

Obama's anti-smear site relies on a phony document

For some time now Just One Minute's commenter jmh, Polarik at Townhall and others have examined the "birth certificate" for Obama published on the Daily Kos site as well as the site Obama has established to respond to the "smears" against him.

The documents are not identical and seem obviously phony.

I guess I back in the agnostic camp on BHO birth. How hard is it to get a FOIA on a birth record in Honolulu?

SCOTUS will deliver it's decision on the Heller case on Weds. From what little I've read about the arguments, it sounds like Kennedy will come down on the right side of this one.

Did you see the sun this afternoon and evening? Deep, dark red. Even though it was still high in the sky.

Every time I open a window or a door, I am struck physically by the strong smell of smoke and burning. But the nearest fire is dozens of miles away!

It seems all of Nothern California is under a thick pall of smoke. It's very apocalyptic.

My read is the DC Ban is struck down, the right to keep and bear arms will be affirmed as an individual right. However what will not be addressed is the definition of "reasonable restriction" striking the DC ban will mean blanket bans are out. So IL, NY and other restrictive state will have to modify there laws. Concealed carry, and "assault weapons" will not be addressed.

My reading of the tea leaves only.

I think her openness for VP was just a clever play to help maintain some resentment from her supporters when he passes her over. My money is on the Clintons providing an October surprise to sabotage Obama. You certainly didn't see them trying to help Kerry out so this cycle would be clear for her, and I don't think there's enough room in the White House for Clinton's and Obama's collective egos...

Regardless of who is pulling Obama's ropes (they're too obvious and thick to be strings), there is no way he is going to pick Hillary as VP. Even he is not *that* stupid -- he knows she wants the #1 spot and will do whatever is necessary to get there. That's what is quite confusing about this. It would seem that somewhere: in his run for Illinois state, or federal office, BHO would have had to provide a copy of his Birth Certificate to validate his qualifications to run. That application should be public record.

I hope you're right, but my "guess" is that SCOTUS will rule on this very, very narrowly and simply rule on the D.C. ordinance and NOT go to the right to keep and bear arms as an individual right.
SCOTUS had one other case similar to this one, oh probably 60 years or so ago and iirc from my Constitutonal Law class that case too ruled very strictly on the issue of the law or regulation at hand, not an all out affirmation of the individual's right to keep and bear arms.

Most State leg positions don't require natural born citizenship, only POTUS. Even the chair of JCS doesn't have that requirement, Gen. John M. Shalikashvil was Polish born IIRC.

a) she has won more of the popular vote than has Obama (albeit by a slight margin);
b) she has won more "heavy" electoral states (California, New York, New Jersey, Texas, Florida, Ohio and Michigan [it wasn't her fault that Obama didn't even bother to put his name on the Michigan ballot] than has Obama; and
c) she'd be more electable in the general election than would Obama who is already pissing off his base by trying to move to the center.
I woulnd't count Hillary out just yet; saw her on TV when she walked back into the US Senate and the Senate Dem's gave her two standing ovations for just showing up and she fairly pointedly ignored Dodd and Kerry.

Okay, I am pulling your chain a bit on that one.

I a pretty fundamentalist Christian. But I also have a B.S. in Bio-Chem, lots of biology, chemistry and genetics.

I repost what I've said in the past.

In all this and long prior to all the discussions here. I came to a few conclusions.

1) I believe the Bible is the Word of God, accurate and internally consistent as a spiritual text.

2) The physical evidence that science discovers, is what it is.

3) If my spiritual beliefs, and scriptures are what I believe them to be. Then God would not falsify, or place misleading material in nature.

That leaves only one place to go. That when there appears to be a disconnect with scripture and science. It is not scripture that needs to be questioned, or the science either. But our human interpretations of scripture and evidence. We get so wrapped up in OUR interpretations, that we cease to seek God and the truth.

Man throws flare in mole hole, ignites neighbor's house

VANCOUVER, Wash. - Paging groundskeeper Carl -- don’t try road flares to kill the varmints.

That’s what Vancouver Fire crews said lit up a single-wide trailer Monday at the Vancouver Mobile Terrace on E. Fourth Plain.

According to spokesman Jim Flaherty, a neighbor was trying to drop a flare down a mole hole when it ignited 91-year-old Irma Childers’ home.

Flames crept up through the metal skirting and the wall of the 1968 structure, and neighbors were able to control the fire until crews arrived.

The parks’ manager was also able to get inside and lead Childers to safety, crews said. She was unhurt.

“Without a doubt, in my 26 years it was pretty unique,” Flaherty said.

Crews were able to knock down the fire in about 20 minutes and prevent it from spreading to three nearby units.

There was no word on if the mole was harmed.

hubby and i visited san fran 30 yrs ago--he was on a biz trip--i trailed along--we were amazed at the beauty of the city and the friendliness of the people- while he was in meetings all day, i went sightseeing by myself--got lost a few times and was not afraid to ask for help--(as opposed to nyc where we lived near at the time)--i know times have changed--glad we saw it when we did-

Here's a story from our north

A crocodile walked into a bar.......

A CROC walked into a Territory pub for a quiet Sunday eve brew.

Gallery: Crazy crocs doing their thing.

And the male saltie nearly made it to the bar too -- but was bailed up by three punters in the car park of the tavern in Darwin's rural area last Sunday night.

The Territory's most feared icon was then wrestled in to Noonamah Tavern for a couple of happy snaps with the locals and tourists.

Noonamah Tavern barmaid Sarah Sparre, 22, said the toothy visitor was a momentary diversion from general beer swilling.

"It's not every day you see something like that,'' she said.

The 60cm beast (pictured above on the bar) was then subdued and the authorities called.

"The blokes taped the mouth up and put it in a chips box - it was put on the ground in the corner,'' Ms Sparre said.

By the time Parks and Wildlife came an half hour later, the locals were back to the business at hand -- wetting the whiskers

Well, you know, not the most recent one, the Tim Burton one, the one before with all the apes wearing jump-suits, and people keep them as pets, or slave labor, or whatever because all the cats and dogs died in a plague and, I don't think Charlton Heston was in it... Hmmm. Well, long story short-- the apes get smart and rise up and-...

Come to think of it, that's the one most people skipped, I mean the premise had really played out by that point, am I wrong? Even the first sequel with uber-ham James Fransiscus was kind of a stretch. Pizza-faced mutants singing to an atom bomb? I mean, why were they wearing those masks in the first place? In case guests dropped by the frikking Forbidden Zone? And then there was the one with that Fantasy Island guy. A couple of the apes swiped James Fransiscuses rocket and flew back to present-day earth. They probably offered to have Heston go along for the ride, keep the franchise going you know, but Chuck said "Heck no! I'm gonna get shot up and then I'm gonna trigger a goddamn nuke, got it? Nothing left of me for another sequel I don't know how I'll ever live down this movie! Damn you studio-munchkins to HELL!"

So, anyway, if they couldn't have made that movie better--not the Forbidden Zone/bomb choir one, the one alluded to earlier with the ape uprising--so that we all would have learned from it, and averted an ape apocalypse, what hope do we have, really?

So shoot Spain with a humongous clue-ray, is what I'm trying to say...

To be sure, there was a steady pressure maintained a la George Kennan, but containment is not a winner. It's a holding action. Containment exerts as much pressure on the vessel as on the substance, if you don't mind a clumsy metaphor. We had Presidents who gave ground and took ground, sometimes in the same Presidency, and I certainly don't expect anybody to be perfect--even a President. But more credit is due the irresistible energy of our Republican form of government and our Capitalist system of economics than is due to the average president until 1976. Those winning systems are where most of the real pressure came from.
Cumulative, it was not, however. Not in the balance, as we needed to pay even more than the Soviets did for ostensibly comparable military and associated systems, because of our relatively low tolerance for loss. A Soviet system mostly needed to work. An American system needed to work, to assure public safety, and to bring its crew home safely in equal measure. So we could build anything they could, but for a vastly increased cost.
Recall that the Soviets were seen as roughly on par with us going into the Carter administration, and while fears of a "Missile Gap" were more than the actual gap warranted, the Soviets had established a manned space station as early as 1971, had far more submarines and ships than we did, some of which were startlingly powerful (Kirov, Slava, and any of the -12 or -19 shooter subs). The Soviets had an incredible amount of conventional air and ground force poised to bash through the Fulda gap and lay waste to Western Europe in a way that the immense Soviet Union was largely immune to due to simple geography. We had the harder and more expensive job of defense, and much of the technological advantage in military systems which we now take as a given was on the drawing boards at the time.
Enter President Carter, who felt that the morally correct answer was to live and let live, that the privations and depredations of Communism were no worse than freedoms and potential of a Republic. He not only believed that we could not win, he felt that we *should not* win.
And so he pared the military, abandoned our allies, and gave away our nuclear parity to reduce the "instability" of a roughly even match (as usual for men who prefer stability to freedom). President Carter had attempted to settle for a tie in a win-or-lose contest. His preferred method of bringing about peace was to ensure that we could not win and therefore would not fight.
Whatever cumulative effects might have accrued were squandered by the Carter administration. His four years saw allied governments fall to Communists and Islamists, and in the case of Afghanistan, a merely unfriendly government was knocked over (in the name of shoring it up, of course) by our increasingly ascendant adversary. Everywhere you looked, the world had gone either from good to bad or from bad to worse.
Detente was dead, replaced by Soviet expansion. Containment was also dead. We were losing the Cold War, and with the stagflation produced by dubious collectivist economic theories of stewardship (dating back to LBJ in particular, and FDR in general, and revived with a tinker's interest by the Carter Admin), we were losing the economic power which was the only thing that might reverse the otherwise disastrous trend.
With 200 chars left, I'll simply point out that we had no cumulative advantage by 1980--we were screwed. President Reagan and Pope John Paul II brought down the Soviet Union.

Actually, yes, I did see it the first time.

While I agree Carter was a disaster, a lot of Presidents -- particularly Truman, Kennedy, Nixon and Reagan -- did contribute to the Soviet Union's downfall. We did have a cumulative advantage by 1980 -- it just wasn't apparent on the surface. The Soviets had spent so much of their declining GDP to keep military parity with us that their collapse was already on the horizon -- though we did not yet know it. I don't think we were losing the Cold War in 1980 at all. Carter had just squandered some of our advantage.

I'm not trying to argue for Carter and against Reagan, only saying that Reagan merely finished the Soviets off -- he didn't do it all by himself. He stood on the shoulders of giants. By the time Reagan took office, I think the Soviet Union was already an unsustainable system, and with a little extra pressure (which Reagan supplied), they'd implode.

Also, Carter was not entirely responsible for our economic woes in the late '70s. Yes, his policies exacerbated the situation, but it was already starting to turn sour during the Ford administration: Carter inherited a problem, and then made it worse. (Similar to how Hoover did not cause the Stock Market Crash in 1929, but his response to it only accelerated the Depression.)

This discussion probably will continue on through the decades. No way to resolve it here. And I know well that the academics will do anything to bash Reagan and prop up the reputations of Democrats if they can. I'm just trying to be completely impartial.

On the ID threads... have you considered that this may be part of a long process already underway in American polity? That is, with an increasingly diverse and growing populace the older associations (that for example have given us political parties) are being forced to define themselves in ways that have to deal with some of the real philosophical differences that exist between groups.

For example, I see no easy truce between the ID activists and the libertarian activists, yet certain elements of our civic organizations and political groups (post-Nixon Republican party) have relied on those two groups rowing in the same direction and under the same banner.

What I was trying to say, is that the underlying issues pre-existed the eruption of the topic on blogs (such as LGF). Part of the whole ID movement is still a reaction to the Scopes trial of many decades ago. That this issue is currently causing problems for the Republican party is part of a long simmering stew, not a recent development.

Everyone was ignoring him, but you know, that position is going to insult somebody, and that somebody was me.

In light of the Boumedine decision granting habeus rights to foreign terrorist suspects, and Kennedy finding executing child rapists unconstitutionally "disproportional," now I'm just waiting for the 5-4 majority on the U.S. Supreme Court to reject an individual rights interpretation of the 2nd Amendment in Heller, so it can complete the trifecta of undermining the Court's moral authority.

More likely, they'll just limit it to such an extent that violations of the "individual right" they find will only be subject to "rational basis" analysis, effectively making any gun control law short of the D.C. ban constitutional.

"Strained"... but Reuters won't say it's broken until Israel retaliates.

Nope, brake plate and a hub bearing assembly... I was lucky that I was only going about 2 mph, so there was really little damage beyond the brake plate...

Yes, I did and I'm as pleased as punch with the results. Danny did a marvelous job. Stylists normally don't point out the errors others have made but, he couldn't keep them to himself. The BIAW is the most powerful conservative lobby in the state.

What has Esser so upset is that the music in the video is the theme song from "The Sopranos," HBO's popular series about a New Jersey mob family. Rossi is Italian American.

Kennedy would have to break with Ginsberg to vote with the majority since he's the swing. He's turned into this iteration of the court's O'Connor. If Scalia wrote the opinion, I would almost expect a 5-4 ruling. If Alito or Roberts writes Heller, I think it might go 6-3 or 7-2. I do so out of a feeling that the split on the court will revolve around how narrowly or widely the court seeks to interpret the issues involved. A narrow interpretation would move closer to a 7-2, while a more wide ranging approach would move closer to 5-4. Pure speculation on my part.

Federal Election Commission (07-320), on whether the so-called “Millionaire’s Amendment” to campaign finance laws, which relaxes campaign finance limits for opponents of congressional candidates spending more than $350,000 of their own money, violates either the First or Fifth Amendments. The ruling below, which upheld the law, is reversed and remanded.

Justice Alito wrote the opinion. Justice Stevens dissented in part, joined by Justices Souter, Ginsburg and Breyer. We will provide a link to the decision as soon as it is available.

So I've been looking for a job the past 2 weeks and sent my resume out to various companies. I want to stay in the finance business and heard back from Bank of America. It's a manager position. I have no experience in banking however I was a branch manager of a mortgage broker shop for 3 years.

No, I don't, but you can drive home the point that you've had experience as a manager (proving your ability) but that you have no preconceived ideas of how THEY do business (you bring no baggage)--and you're eager to lean.

I'm actually interested in reading the dissent, and what those justices considered the Second Amendment to be if not an individual right to bear arms. Collectivists? I'm pretty sure that's what they were figuring - or they decided that the 2d Amendment gets trumped by a jurisdiction's need to rid the streets of guns.

Police reports show that three men arrested in a Phoenix home invasion and homicide Monday may have been active members of the Mexican Army.

While on the J.D. Hayworth show, Phoenix Law Enforcement Association President Mark Spencer said that the men involved were hired by drug cartels to perform home invasions and assassinations.

Long processes weed out the slackers and are more likely to reveal weaknesses in the candidate (it's harder to keep up any phoniness that long).

(I'm about to take over as your coach--please don't think me officious; it's just a natural instict!)

1. Make a list of why you would hire yourself at this company--research the company so that you know their philosophy, strengths, and weakness.

2. Know what you can add to their strengths and, more importantly, counter their weaknesses.

3. Know how they rank their priorities: the customer, the employee, the business. My personal philosophy is that if a company hires excellent people who take pride in their work and who are NOTICED AND REWARDED for their excellence (and who are fairly held accountable for their shortcomings), the customers and the business will thrive.

4. Invite some friends over and play some role-playing games. Invent some scenarios and characters.

5. Know why you want to work for THEM particularly.

protect the interests of individuals against government intrusion,
interference, or usurpation. We also note that the Tenth Amendment—“The powers not delegated to the United States
by the Constitution, nor prohibited by it to the states, are
reserved to the states respectively, or to the people”—indicates
that the authors of the Bill of Rights were perfectly capable of
distinguishing between “the people,” on the one hand, and “the
states,” on the other. The natural reading of “the right of the
people” in the Second Amendment would accord with usage
elsewhere in the Bill of Rights.

The District’s argument, on the other hand, asks us to read
“the people” to mean some subset of individuals such as “the
organized militia” or “the people who are engaged in militia
service,” or perhaps not any individuals at all—e.g., “the states.”
See Emerson, 270 F.3d at 227. These strained interpretations of
“the people” simply cannot be squared with the uniform
construction of our other Bill of Rights provisions.

It seems unlikely that the Supreme Court would have
lumped these provisions together without comment if it were of
the view that the Second Amendment protects only a collective
right. The Court’s discussion certainly indicates—if it does not
definitively determine—that we should not regard “the people”
in the Second Amendment as somehow restricted to a small
subset of “the people” meriting protection under the other
Amendments’ use of that same term.

In sum, the phrase “the right of the people,” when read
intratextually and in light of Supreme Court precedent, leads us
to conclude that the right in question is individual. This
proposition is true even though “the people” at the time of the
founding was not as inclusive a concept as “the people” today.

re: #814 jcm I think so, but I just took a quick look at the syllabus (the opinion itself is something like 157 PDF pages) and the court apparently did say that the States can limit the right of criminals or mentally defective people to own guns (paraphrasing here) so it looks like States can Still impose registration or licensing laws.
I'm personally NOT opposed to registration or licensing laws unless, as in NYC, they act as a de facto basis for denying the individual the right to own a gun - and specifically a handgun.

cussed), the interest-balancing inquiry results in the
constitutionality of the handgun ban. QED.
We know of no other enumerated constitutional right
whose core protection has been subjected to a freestanding
“interest-balancing” approach. The very enumeration of
the right takes out of the hands of government—even the Third Branch of Government—the power to decide on a
case-by-case basis whether the right is really worth insist-
ing upon. A constitutional guarantee subject to future
judges’ assessments of its usefulness is no constitutional
guarantee at all. Constitutional rights are enshrined with
the scope they were understood to have when the people
adopted them, whether or not future legislatures or (yes)
even future judges think that scope too broad. We would
not apply an “interest-balancing” approach to the prohibi-

This opinion has neatly demolished the "emanations and penumbras" arguments as well. The phrasing of the opinion looks like a powerful weapon for the Original Intent / Constructionist side of the house.

I'm still reading through the case, but Scalia drops nothing but heaping scorn on Breyer's separate dissent from pp. 59 through 64. Indeed, Scalia notes that Breyer misreads the law, tries to apply laws designed to keep homes safe from a fire threat (keeping gunpowder in a home could pose a fire/explosion risk), and a single law from a single jurisdiction in the face of overwhelming evidence to the contrary to claim that the right to bear arms is not an individual right and restrictions imposed by DC were reasonable.

From Scalia:

But the enshrinement of constitutional rights necessarily takes certain policy choices off the table. These include the absolute prohibition of handguns held and used for self-defense in the
home. Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our Nation, where well-trained police forces provide personal security, and where gun violence is a serious problem. That is perhaps debatable, but what is
not debatable is that it is not the role of this Court to pronounce the Second Amendment extinct.

5-4 has the same power and effect as 7-2 or 9-0. The majority opinion is the law of the land. It does, however, show the fragility of the majority in this instance and that a change in the makeup to the court can have a serious change in outcomes of a wide range of cases.

Note also that Obama complained yesterday about the Kennedy v. Louisiana case (child rape), based on the outcome. He, however, supports the activist judges who provide results such as those we saw yesterday. He knows better than to come out and say that he supported yesterday's decision because it is antithetical to so many Americans he's trying to curry favor with.

But the real issue is that he wouldn't mind filling the court with more Ginsbergs, Stevens, and Kennedys. Because that's his ultimate aim - to reinvent the Constitution rather than apply it as it was written.

Indeed, that's what the court's minority attempts to do here in Heller. They attempt to rewrite the Constitution rather than applying it as written.

Hey Top: when you line up the plusses versus the minuses, you'll see how clear it is. Four years of Obama could do some major damage to the country and the world. Four years of McCain means that we can still work out our differences and come to some kind of consensus.

I can whole-heartedly back someone I have some disagreements with, but whose heart is in the right place, and will eventually listen. I can't say that with an Obama as chief of state. Can you?
