World Court Orders US

Fresh from their absurd botching of the case against Slobodan Milosevic, the World Kangaroo Court is now ordering the United States to delay death sentences for five Mexicans—including one convicted of the gang rape and murder of two teenage girls: World Court: U.S. must delay Mexican death sentences.

THE HAGUE (Reuters) - The World Court on Wednesday ordered the United States to do everything necessary to ensure five Mexicans on death row are not executed before the court makes a judgment in a dispute between the two countries.

One of the five on death row, Jose Medellin, is due to die on August 5 in Texas.

I just saw this in the El Paso Times. Sorry, it's an AP article. The Reuters one linked above ends with this statement:

The ICJ is responsible for handling disputes between U.N. member states. Its rulings -- which often take years -- are binding and not subject to appeal.

The AP one ends with this statement:

Informally known as the World Court, the tribunal is the U.N.'s judicial arm for resolving disputes among nations. Its decisions are binding and final, but it has no enforcement powers.

That's the article in question from the Vienna Convention on Consular Relations. Unfortunately, we can't comply with it, because it's beyond our means to do so, thanks to the fact that millions of Mexican nationals are in the United States illegally. We simply can't afford to notify Mexico every time one of its citizens is detained in the U.S. It would cost too much, and it would bring our justice system to a crashing halt.

We should notify the Security Council, the ICJ and the Mexican government that since Mexico is allowing, and indeed encouraging, its citizens to enter the United States illegally, and some of those citizens are then carrying out armed attacks against citizens of the United States, that unless they do something about it, we will start regarding such attacks on our citizens as acts of war against the United States and we will begin exercising our right to self-defense under article 51 of the United Nations Charter by commencing military operations against Mexico.

Either that, or they can drop their silly case.

The states holding these vile prisoners should speed up the executions, say to this weekend. Every moment of delay is a moment when some meddling fed official might actually take the World Commie Court seriously. This is also the problem with holding terrorists in regular civilian criminal courts, you'll get some foreign scum Court claiming that we have to turn them free, or get some other terrrorists who kidnap and hold hostage someone of high or moderate level value and demand freedom for his/her terrorist colleagues (ala today in Israel). Dead terrorists/enemy combatants are of little value, despite misplaced fears of martyrdom. A dead martyr is still dead and might cool other martyrdom desires as much as others claim that it would enhance such desires. (I hate to use the term martyr, because Christian martyrs never behaved in the depraved way that muslim so called martyrs, routinely engage in. The whole point of Christian martyrs was to accept death at another's hand rather than engage in brutal or un Christian conduct).

This isn't the first time: the World (Food) Court issued much the same meaningless "order" back in 2004. For some bizarre reason (hitherto unknown French ancestry?) President Bush "ordered" the TX courts to comply - but they refused, and SCOTUS ruled back in March of this year (6-3) that he lost that authority when he ceased to be Governor of TX. This ruling is the result of Mexico going back to the joke court asking it to issue another "order" in the hope this one might somehow succeed where the previous one failed.

What makes no sense about Mexico's argument is that these animals were living in the US as if Houston was their home. They had residences. They weren't here on a little 2 week holiday and got mixed up in a little misunderstanding. They were residents (illegalyl, but residents all the same), not vacationers.

I think endorsing a person't right to talk to the consulate is pretty important, just in case Americans abroad get caught (or framed for) doing something untoward in another country. For example, my dad used to work in Saudi Arabia (yes, for the oil ticks) off and on. Sometimes, when he would come "in country," the morality police there would rip off the covers of his technical magazines -- publications with names like "Petroleum Engineering Today" and "The Plastics Engineer." Or just confiscate them. It was not like he was trying to bring Maxim or Hustler into the country; the photos on the covers were usually of piping systems, or a refinery, and never even had any people in them! They were geeky technical publications that a Chem E would read. Now, let's say some zealot hauled him off to a Saudi jail for having a graven image or some crap like that in his possession. I would want him to have the right to talk to the consulate. So if somebody asks to talk to the consulate, I think they should have the right, no matter what they are accused of doing.

Here's the thing - the animals involved in this case never asked to talk to the consulate. My guess is because they considered themselves residents of the US, even though they weren't here legally. (there is a difference between resident and citizen, I am not saying they thought they were US citizens, I'm saying they thought their home was Texas not Mexico).
