On dividends the story is about as bad, with rates rising from 50.4% to 65.6%, and after-tax returns falling over 30%. Even a small response of work and investment to these lower returns means such tax rates, sooner or later, would seriously damage the economy.

On economic policy, the president proposes and Congress disposes, so presidents often wind up getting the favorite policy of powerful senators or congressmen. Thus, while Mr. Obama also proposes an alternative minimum tax (AMT) patch, he could instead wind up with the permanent abolition plan for the AMT proposed by the Ways and Means Committee Chairman Charlie Rangel (D., N.Y.) -- a 4.6% additional hike in the marginal rate with no deductibility of state income taxes. Marginal tax rates would then approach 70%, levels not seen since the 1970s and among the highest in the world. The after-tax return to work -- the take-home wage for more time or effort -- would be cut by more than 40%

Some of the more difficult exams I took during my college years were open book or open note. I had a Finance professor that allowed one sheet of paper for a "cheat sheet." His exams were brutal, even with the help.

Mother lode time.

Take a gander at the 1997 exam. Then take a look at the adjacent memo.

First thing that caught my eye was the name of the school in Part II.

Ujamaa.

That struck me as odd. Then, I did some digging.

He was going with what he knew and was taught at the feet of his socialist mentors:

Ujamaa was the concept that formed the basis of Julius Nyerere's social and economic development policies in Tanzania just after it gained independence from Britain in 1964. In 1967, President Nyerere published his development blueprint titled the Arusha Declaration, in which Nyerere pointed out the need for an African model of development and which formed the basis of African socialism.

Is it just me, or does that opening paragraph read like an undergrad wrote it? Where is goddessoftheclassroom? I would love to see that thing corrected grammatically. I would have slashed all the superfluous words, and not apologize in the FIRST sentence for my class!

James Ujaama, the Seattle man who pleaded guilty in 2003 to aiding the Taliban, admitted to a federal judge in New York on Monday that he fled to Belize last year to avoid testifying against his alleged co-conspirators.

Ujaama, 41, also pleaded guilty Monday to three terrorism charges, including a conspiracy charge related to Ujaama's efforts to establish a jihad-training camp in Bly, Ore., in 1999.

The government had dropped the terrorism charges against Ujaama in 2003 after he agreed to cooperate with federal investigators in exchange for a two-year prison term.

Ujaama now faces up to 30 years in prison on the new charges against him. He is scheduled to be sentenced Dec. 12 in New York.

Ujaama has negotiated a new plea agreement with the government, according to federal officials, but the terms of the deal were placed under seal. A spokeswoman for the U.S. Attorney's Office for the Southern District of New York declined to comment.

Ujaama's lawyer, Peter Offenbecher, did not return a call seeking comment.

The new charges are a stark turnaround for Ujaama, who pleaded guilty in 2003 to a lesser charge of conspiring to aid the outlaw Taliban government in Afghanistan in the late 1990s. Federal officials have called Ujaama's help crucial in the 2004 indictment of Muslim cleric Abu Hamza al-Masri on charges of trying to establish the training camp and providing aid to al-Qaida.

I believe Obama explicitly said that he wanted to appoint activist (ie liberal) judges.

The damage from those sorts of appointments would long outlast the economic damage from his confiscatory taxes, or ruined foreign policy.

The syllabus didn't look too bad, but he's not committing to anything with pro and con arguments. Who knows what would actually be taught in the class.

I did get a laugh out of the reference to the "wine and brie crowd" using cocaine vs. poor blacks using crack. Which group does he think he's in?

Same here. I had a Constitutional Interpretation prof who was fond of that "technique". His exams were real knee-knockers. I have to admit, though, I learned a lot from him.

The comments are pretty interesting. They seem to be divided between those who claim the Obama isn't a real tenured professor (doesn't matter to the faithful and they are angry if you point it out) and those who claim that John McCain graduated at the bottom of his class, implying he isn't intelligent enough to teach, even as a mere lecturer.

But I see only one point to having such issues tested with an open book where case law and dictum can be looked up.

If a professor wanted some free research done on issues he planned to pursue for his own purposes.

I recall having both open and closed book law exams. Depends on the professors. Some wanted to see how you reacted to memorizing fact and logic patterns, while others wanted to see how well you could organize yourself for exams.

I am not a lawyer, and I didn't stay at a Holiday Inn Express last night.

I read Professor Obama's answer memo for the 1996 exam. I'm not qualified to answer the questions of law, but he was personally scathing of Justices Scalia and Kennedy and complimentary of the 9th Circus Court of Appeals.

The one thing he doesn't flip-flop on is being a liberal.

A careful reading of Obama's first memoir, "Dreams From My Father," reveals that his childhood mentor up to age 18 — a man he cryptically refers to as "Frank" — was none other than the late communist Frank Marshall Davis, who fled Chicago after the FBI and Congress opened investigations into his "subversive," "un-American activities."

As Obama was preparing to head off to college, he sat at Davis' feet in his Waikiki bungalow for nightly bull sessions. Davis plied his impressionable guest with liberal doses of whiskey and advice, including: Never trust the white establishment.

"They'll train you so good," he said, "you'll start believing what they tell you about equal opportunity and the American way and all that sh**."

After college, where he palled around with Marxist professors and took in socialist conferences "for inspiration," Obama followed in Davis' footsteps, becoming a "community organizer" in Chicago.

His boss there was Gerald Kellman, whose identity Obama also tries to hide in his book. Turns out Kellman's a disciple of the late Saul "The Red" Alinsky, a hard-boiled Chicago socialist who wrote the "Rules for Radicals" and agitated for social revolution in America.

The Chicago-based Woods Fund provided Kellman with his original $25,000 to hire Obama. In turn, Obama would later serve on the Woods board with terrorist Bill Ayers of the Weather Underground. Ayers was one of Obama's early political supporters.

After three years agitating with marginal success for more welfare programs in South Side Chicago, Obama decided he would need to study law to "bring about real change" — on a large scale.

While at Harvard Law School, he still found time to hone his organizing skills. For example, he spent eight days in Los Angeles taking a national training course taught by Alinsky's Industrial Areas Foundation. With his newly minted law degree, he returned to Chicago to reapply — as well as teach — Alinsky's "agitation" tactics.

(A video-streamed bio on Obama's Web site includes a photo of him teaching in a University of Chicago classroom. If you freeze the frame and look closely at the blackboard Obama is writing on, you can make out the words "Power Analysis" and "Relationships Built on Self Interest" — terms right out of Alinsky's rule book.)

Amid all this, Obama reunited with his late father's communist tribe in Kenya, the Luo, during trips to Africa.

Especially Constitutional Law professors put emphasis on those cases that help them sell their particular political philosophy to the students.

It would be interesting to find out which cases he emphasized.

And is he attempting by this question, asking them to cite such cases, to get feedback as to the success of his indoctrination.

Saying that one should not be afraid to take a personal position is merely a way of underscoring that one should not try and argue the position one feels will curry favor with the instructor. Not only do I have no problem with that--it is what the exam should say.

Not very good practice for an aspiring defense attorney. ;)

Not much of a surprise there either.

You'd think that the Constitution was written to reflect only on race relations.

Nothing about federalism. Nothing about the 1st Amendment; 2d Amendment; dormant commerce clause, etc.

Again, he's going with what got him there - race. He probably wasn't comfortable on those other subject areas and focused his questions on areas he knew best.

I was reading Morris Dees' book about the militia movement--The Gathering Storm. It was written in the late 90s, and he holds forth very forcefully at the end about how it's settled constitutional law that the 2nd Amendment only applies to state National Guard units.

Great story. I took an ME course, (Design 351?) from the dreaded Milton Koenig. Someone asked him before an exam if there was partial credit. He said when the bridge falls down you don't get partial credit.

Question for anyone who wishes to take it.

I have been trying to get more information about Obama's trip to Pakistan the summer he transferred from Occidental to Columbia.

One of the names that comes up in the information is, Sohale Siddiqi.

From what I can tell, he had a drug problem, shared a place to live with Obama, was not a student at Columbia, and became illegal after over-staying on a tourist visa.

This would mean he had contact with this person after his trip to Pakistan.

Many sights refer to him knowing this person before arriving in New York.

Does anyone know anything else about this person?

Wow.

These papers have convinced me that I should really go to law school, as I considered doing some 30-odd years ago.

Why? Because, if this is the state of "final exam" questions these days, I can ace these things without even halting my alcohol consumption for the duration of the tests. I mean, seriously, if this is the level of testing done in today's law schools - and I strongly suspect that Obama was hardly unique in his test formats - not only do we have too many lawyers in our society, but the vast majority of them are complete idiots.

Of course, my answers would piss off my professors, but they would also be rock-solid in terms of case law and legislation - as would have to be proven in appeal (since the "piss off" would be... um... huge, and would require such an action for me to avoid getting a failing grade).

My hardest classes:

#1 Point Set Theory -- no book; no exams; just a 45 minute lecture and 1 big stinking proof every class that you had to turn in by the next class.

#2 Mechanics -- had book (a little better); no exams -- just open book class-long pop quizzes written on the board whenever the Prof felt like it.

#3 Symbolic Logic -- no books; no exams; Prof would ask one question and not say anything until someone made an attempt at a proof. Then he "constructively criticize" during the proof. When he felt they were "spinning" he gave them the hook and waited for the next victim. All grades based on participation (meaning you had to get up there and face the man).

I still have memories of many sleepless nights.

My kids are so dependent on calculators. At least I can do most calculations in my head, even though I went to college when calculators reigned. My kids, though, have a tendency to reach for their calculators. This will eventually sink them, I'm afraid.

While I was reading something, I just had a thought.

If anyone has noticed, many banks over the past couple of years have instituted "interest free" checking.

No monthly fees, etc.

One problem, there has been a huge influx of cash to the banks via fees generated from free overdraft protection.

Insomuch as, even when you have a debit in pending status, and the transaction is not posted, and you were planning to cover the debit perhaps the following day with a deposit, they still take a fee for covering this draft.

Do we already have Sharia banking?

The short story on this, is in Sharia, the bank owns the debt, does not charge interest, but the particular item has an inflation rate relative to intrinsic value.

Your check you wrote for $75.00 is now a $105.00 dollar note the bank was covering.

Calculating 8.25% in my head is too much for me.

But since I did memorize all those tables, I can do approximations pretty quickly. And I did once know some "Number Sense" tricks.

I always do a "sanity check" calculation to make sure I get order-of-magnitude where it belongs. There's a lot of log-based display data in my specialty, and if you are careless, you may get .00825 instead of .0825 and a bogus answer without realizing it.

yes, I think you are right. Women tend to do most of the shopping. -We can figure out which toilet paper is cheapest--accounting for in-store specials and coupons etc.

It's rather complex. One has to account for the ply of the roll, # sheets per roll, #rolls per package etc.

The property tax is pure socialism at its finest.

The government has the ability to acquire someone else's wealth at a nominal value related to the total worth.

They also set the nominal value despite the value in an up or down market, and have taken none of the risk paid into such property over years and years.

A person's home is their biggest investment.

The idea, a school district can confiscate something someone has paid hundreds of thousands of dollars for over time, all for pennies on the dollar due them is incomprehensible.

I'm actually pretty bad at doing math in my head unless it's easy (figuring 10% or 20% for tips), but I never use a calculator. I do any math I can't figure in my head on paper. Keeps the brain limber.

This is par for the course in law schools. Most professors have slants or bias. The best ones are the ones that can move past that and still press you to think from either side of an issue. Many can. Some cannot.

I recall one professor acting like the Lopez case in which the USSC drew a line in the ground as to the limits of the interstate commerce clause was a horrible injustice. It never occurred to her that our federal government's power has limits--is finite and enumerated. The Lopez case struck down the federal ban on guns within something like 500 feet of schools.

I wonder how Barack feels about the Lopez decision?

I mean, when I was an adjunct Associate Professor - graduate student level, I worked harder and longer days than he did an I gotta tell ya his stuff is pretty lame. I admit that I only read - very quickly, his 2007 final exam and I dunno, a final exam that is Open Book, gives you 8 hours to take (including travel time!) but should only take 3 hours) was, well, not particularly complex - contrary to what the NYTimes seems to think - and I didn't even major or minor (!) in Con Law and practised and taught Real Estate Law and Finance.
In short, I are not impressed.

I took an engineering course under T. K. Sherwood at MIT, one of the great men of Chemical Engineering. He announced that there would be a quiz on Friday, and that it would be closed book. A chorus of groans went up. He looked around the room, and after a long pause, said, "Some day, it may happen that some of the best engineering you will ever do will be on the back of an old envelope while you're standing on the corner of a wind-blown piece of equipment out in the middle of nowhere. [long pause] And it will be closed book."

As with most things in life there is a hierarchy to final examinations. The easiest exams were always multiple guess. In class essays are harder but but if you know how to organize and use the limited time available you should be able to grind out several hundred words on almost any topic. An open book exam is a trap for the weak. Do they know where the answers are? Did they take useful notes? Will they waste time looking up answers that they should have ready? Take home examinations are much more brutal than a simple term paper.

Once I suffered through some Teacher's Ed classes. The best moment was when the Professor, a fine man getting ready to retire and eager to unload a truth, spoke on standards. "One day you will be wheeled into surgery and as the Anesthesiologist is putting that mask over your face you will look into his eyes. You will want to know that he took the real Physics class, the one where they failed a third of the students."

The House of Representatives on Tuesday passed a resolution apologizing to African-Americans for slavery and the era of Jim Crow.

The nonbinding resolution, which passed on a voice vote, was introduced by Rep. Steve Cohen, a white lawmaker who represents a majority black district in Memphis, Tennessee.

While many states have apologized for slavery, it is the first time a branch of the federal government has done so, an aide to Cohen said.

In passing the resolution, the House also acknowledged the "injustice, cruelty, brutality and inhumanity of slavery and Jim Crow."

He was honorable for his years as a POW, why did he have to make something up that everyone in the military and naval academy knows is not true? McCain admitted in his own book that he knew he could never have reached that position due to his failing grades.
