Canada's 'Human Rights Commission' Dismisses Charges Against Levant

Ezra Levant’s bizarre Kafkaesque ordeal at the hands of the Alberta Human Rights Commission has ended—with a complete dismissal of all the trumped up “charges:” Punished first, acquitted later.

Hope Mark Steyn comes out well from his similar troubles in Canada.

If you have been reading Maclean's magazine this year you will realize that Canada has such a thing as a Human Rights Court, which is not really a court in a standard legal system, but a court where any individual whatsoever can bring charges that you have somehow written or published hate literature against some group.

Mark Steyn, one of the more colourful and interesting writers to grace the pages of said magazine seems to no longer be able to publish with them after a months long battle over a quote he published in an article from his own book, America Alone. In short form the quote said that Britain would have to become subject to Islamic law because the Muslims living there would not give it up without bloodshed.

A group of Muslim law students in Canada brought charges and in an amazing travesty of justice tried to ruin his career because of perceived bias.

Here are some rough figures.
-America drives: 1,000,000,000 miles per day
-Gas mileage: 20 mpg
-Equals 50,000,000 gallons of gasoline per day
-3% (max efficiency I've heard) increase in gas mileage from inflating tires: 20.6 mpg
-Equals 48,500,000 gallons of gasoline per day
-Savings if everybody's tires are underinflated: 1,500,000 gallons per day
-Savings if 25% of country is underinflated: 375,000 gallons per day

-Barrels in ANWR (Obama's quote includes all drilling, not just ANWR): 5,000,000,000
-Gasoline from those barrels: 250,000,000 gallons

-Days to equate tire inflation to ANWR assuming everyone's underinflated: 166
-Days to equate tire inflation to ANWR assuming 25% underinflated: 666
-Days to equate tire inflation to ANWR assuming 10% underinflated: 1666

Plenty of room for questioning these numbers. I didn't do extensive research for total accuracy, I just googled the data. Definitely open for scrutiny.

The mere fact that this man had the burden of defending against this preposterous legal action is a sad commentary.
This is the legal strategy of the jihad to force Western societies into submission. This is a clear attack on freedom of the press & therefore Western Values.
It sounds like the burdens were inverted & this guy had the onus of establishing that what he did is permissible

As Levant himself points out, this is a Phyrric victory, at best:

The two complaints cost Alberta taxpayers in excess of $500,000 and, according to access to information documents, involved no fewer than 15 government bureaucrats. What a scam – on the part of the complainants, who were able to wage “lawfare” against an infidel without paying a cent; and on the part of the HRC, as a make-work project...

Is this a victory? I suppose, in a narrow technical sense, it is. I’m off the hook now for both of the HRC complaints. That’s two legal battles done – though I’m still up to my eyeballs fighting defamation suits and other legal actions that the human rights industry piled on top of these complaints.

But I’ve read the dismissal letter three times now, and each time it makes me more angry. Because I haven’t been given my freedom of the press. I’ve simply had the government censor approve what I said. That’s a completely different thing.

The fact that they didn't establishes that the court thought that it was a credible action.

This has been looked at throroughly.

Briefly, the fact is that most Americans are already driving on properly inflated tires, and with gas at $4.00 a gallon, most of the ones that weren't 6 months ago are doing so now. People aren't stupid.

While there may be some people who don't know about this yet, the majority of individuals who haven't already put their tires into spec aren't likely to, no matter what Obama says. . .eg, there are still people who refuse to put on their seatbelts too.

Even in a best-case scenario, this isn't going to save that much fuel.

Even if it *DID* save lots of fuel, that *Still* doesn't justify idiotic policies like not drilling in a postage-stamp sized spot of artic tundra specifically set aside for the purpose of oil exploration.

Organizations, like this 'Council of Edmoton Communities & CAIR are very litigious and even when they lose they force their target to go through the expense & stress of putting up a defense.
It is way past time to turn the tables on these Muslim "Civil Rights" groups. They need to be litigated against. Bury them with paper.
Let them whine & play victim, it would keep them busy & protect our liberties.

I've been doing tire inflation spot checks in parking lots at work and about town. Honestly, I have not yet seen a single car that has severely deflated tires (to get the 3% boost, you need to go from grossly underinflated to properly inflated). Being very generous, maybe 5% of the cars are in that situation.

Furthermore, the ones who drive most are more likely to have properly inflated tires. So even the 5% estimate overstates the issue.

The "argument" that the Obama campaign is making is silly - the first assertion that Obama mad was that tune ups and tire pressure would roughly equal what we would get from drilling.

They have now stated that any admission that proper tire pressure improves MPG as conceding the entire assertion.

The press is willingly going along.

Obama has yet to defend his first assertion - because he can't.

But like all of these situations he is off of the hook.

I love the arguements against drilling, "It would take 5 years, no wait 10 years." So you see it would not help in the short run.
But, wait! lets go for alternate sources even without the technology, yeah thats it.
We could get that oil out of the ground in 18 months or less with a full blown effort. Lets do everything, drill, wind , solar & drill some more.

Yesterday while looking at Google Earth I learned as a child that via a shortcut my elementary school was only 3/4 mile away as opposed to the 2-3 mile bus ride. Only problem, the shortcut was through a forest. Guessing my parents would have had a problem with that.

My Wife is having a problem with letting our Son walk through an open, grass covered park, next to a busy community center, from which you can see the school, alone on his way to school. I went to a parochial school, but my friends all cut through the canyon short cuts to get to the elementary school in TierraSanta, a suburb of San Diego. Times have changed.

Most states have special licenses (in IL they're known as 911 licenses I believe - nothing to do with 911) that allow law students to do certain public service work under the supervision of a licensed attorney.

1. Is the "accused" assumed guilty or innocent first? In other words, is there a presumption of innocence or a presumption of guilt?

2. If presumption of innocence, what burden of proof is necessary to prove guilt? Beyond a reasonable doubt, clear and convincing evidence, preponderance of evidence? What is the approximate percentage related to the burden of proof?

3. Could Ezra have remained silent or does the HRC have the "right" to force people to talk?

In other words, was Ezra already guilty and he had to prove he's innocent OR
was Ezra innocent and HRC had to prove him guilty?

/I'm going to keep using the phrase, "They Ezra'd him" as a lead-in to letting people know the absurdity of Canadian "law."

Regardless of the fact that Ezra has been already "punished by the process", despite being found innocent, the process did have the inestimable value of waking up many in Canada to the evils of the HRC system.

We had editorials in mainstream media that never before had taken on such issues, and many prominent Canadian voices, not all conservative, spoke against the HRC process.

So, overall the fact that Ezra was put through this ordeal was a huge plus for the anti-political correctness, pro-free speech, anti-Jihadi, anti-liberal fascist crowd.

What rankled more than anything else, though, was how our prime minister Stephen Harper completely ignored the issue. People keep making the explanation of political expediency for his silence on an issue that should have been front and centre, but it still shows that for the time being political correctness and liberal fascism remain strong in this country, even when an supposedly conservative administration is in power.

Lots more work to do. I have donated several hundred dollars to Mr. Levant in the past year, and I urge people to do what they can in this regard. There are lots of big talkers and brave people hiding behind anonymous blog posts, but there has been a shortage of brave people willing to take on these issues in real life, and someone like Mr. Levant cannot be replaced. Whatever we can do to encourage him to fight on, we should do.

2) It uses the word "flavour"--i.e., British spelling, for an American brand--which makes the ad a little suspect.

In Canada, we are blessed with 14 HRCs - the federal Canadian HRC, 10 provincial and 3 territorial. In Ezra's case, it is the Alberta HRC that he has been dealing with.

My parents were anti-sugar freaks...Although i snuck some as a kid..It was seriously a banned product in our home..
It has always been banned with our kids..We have never allowed a sugar product in our home.. It used to be really hard years ago because sugar subs were non existant..But that changed with the advent of sweetener...
I'll never forget when our family was at the chicago auto show years ago and i was like 10 years old and i hung out at a cooking show there and this guy kept talking about how bad sugar was for the body.. and i barely remember thinking ' i guess mom and dad aren't as stupid as i thought'
funny..when you grow up..you're parents become friggin geniuses...

Thing that bothers me is that every job (over 300) I've applied for in the last year, hasn't wanted me.

Keep plugging away Mars. I was out for 21 Months in '02-'03, and had similar numbers of ignored applications that generated about 5 interviews.

I finally was offered a job after respectfully pestering the head of Engineering from one of those interview companies once every two weeks for about 3 months.

It actually was intended for a Greek audience. I think it backfires big time in the USA, but it might not have the same "this looks like an under age girl" thing going in Greece - who knows. BMW's USA ads have used a little girl too, but in a family-friendly wholesome way.

If they'd used a more obviously grown up woman, some people would still say "this is sexist." Personally, I don't care about that - it's the child ho aspect that disturbs me.

In Miami, this guy was arrested for threatening remarks about Obama. But notice later in the article, threatening Bush was basically met with a yawn.

A Secret Service affidavit charges that Geisel made the threat during a training class for bail bondsmen in Miami in late July. According to someone else in the 48-member class, Geisel allegedly referred to Obama with a racial epithet and continued, "If he gets elected, I'll assassinate him myself.

Another person in the class quoted Geisel as saying that "he hated George W. Bush and that he wanted to put a bullet in the president's head," according to the Secret Service.

Geisel denied in a written statement to a Secret Service agent that he ever made those threats, and the documents don't indicate that he ever took steps to carry out any assassination. I have a couple of places I really want to work. Unfortunately, the computer company I just heard from, is one of them. The other is a Business Intelligence firm that is getting ready to expand. I found out that the CEO has had my resume in hand for quite a while now, he pulled it from the file and has kept it in his office.

You may not see a child in the ad, but others obviously do. I'd suggest you check the comments on the BMW site's thread, but it appears to be down now. Many males see her as a child sperm depository. I hope they take out their aggressions on Rosy Palm rather than some little girl.

My wife is leaving town for a week and a half with the kids. I'm afraid I'll get depressed if I just stay home and do LGF for 24 hours a day. But if I'm not working there's not much else to do. Can't afford gas to drive, too hot to walk, can't afford to do anything I enjoy, apartment not straightened up enough to do any hobbies (and my wife and I are having a standoff over the cleaning. LOL)

I think the ad was targeted at Greek men, and I'll give them the benefit of the doubt, since the age of consent in Greece is 15.

BMW, however, may notice a drop in sales to women, since the Greek ho is out of the bag. :D There is a big buzz about this ad on women-oriented and especially women in advertising blogs right now. They are not amused.

Would it be impossible to just cave these tunnels in? How many miles of border are there between Gaza and Egypt? I'm guessing that with infrared imaging the tunnels could possibly be seen from the air. Then a long parade of heavy equipment back and forth to cave in the tunnels. That the Gazans are so brazen and the Israelis let it go on doesn't make any sense to me.

A chain is only as strong as its weakest link and it doesn't make any sense to have tight security at border crossings while these tunnels are there to smuggle in everything the border crossings try to keep out.

I spent 2 years as a volunteer at a mental institute during college...not a big call for Internet access there..could be wrong..doubt it.
3rd.. There isn't a big movement towards training kids on PC's..
Kids get it..they need nor want training..they may ask you for guitar lessons..don't count on computer training..

but since you aspire to training on computers...
There is a wide open field for training adults in excel,word, Internet ect. for adults.. there is money working for a company that trains adults..probably even in MT.

Actually there really aren't any companies doing that here. As for DD adults the ones I've worked with love using computers, and some of them are very efficient at data entry. Most of the rest are great at pc bowling and watching funny videos. If you were working in a mental institution its more likely the people there were largely either low functioning or had a combination of DD and ED.

Children love working with computers. There are a ton of after school training programs around here for kids, but they are largely volunteer.

Regardless of the fact that Ezra has been already "punished by the process", despite being found innocent, the process did have the inestimable value of waking up many in Canada to the evils of the HRC system.

We had editorials in mainstream media that never before had taken on such issues, and many prominent Canadian voices, not all conservative, spoke against the HRC process.

that should have been front and centre, but it still shows that for the time being political correctness and liberal fascism remain strong in this country, even when an supposedly conservative administration is in power.

Lots more work to do. I have donated several hundred dollars to Mr. Levant in the past year, and I urge people to do what they can in this regard. There are lots of big talkers and brave people hiding behind anonymous blog posts, but there has been a shortage of brave people willing to take on these issues in real life, and someone like Mr. Levant cannot be replaced. Whatever we can do to encourage him to fight on, we should do.

Mr. Levant still owes $10,000 for the original HRC suit brought against him, however, it's not the only one. He has other nuisance (SLAPP) suits brought against him by Richard Warman, and Ginancomo Vigna. Thank heavens Mr. Levant is a smart man and lawyer himself. Other people in his situation would have been bankrupted and told to sit down, shut up and dissappear.
The fight is far, far from over.

I've worked with DD long enough to know that the idea of state hospitals was just evil. So many good people wound up screwed up by an uncaring and sometimes abusive system. Thank god there were good people like you there, or things could have been so much worse.
Here we are 20 some years after de-institutionalization, and I still have worked with clients that are terrifed that someone is just going to come along and take all their property away. These state hospitals destroyed the trust of a type of people that are the most trusting.

Sorry, pet peeve. (I know one guy that was frequently given "firehose therapy" at a state hospital when he was only a teen)

And yet so many in this career field are liberals and many have no problem with going back to that system. They look at the homeless, blame Reagan, and say we need to have hospitals set up to force them to take their meds.

He is still single, and knows that it is very tough in the NY metro area right now.

That's where the company I've been trying to get on with is interesting. AboutBI is trying to sign up as many major companies in this country as possible to outsource to MT. They ran the numbers and concluded that it was almost the same price to outsource to the third world nation of MT as it is to outsource to real third world nations.

In essence the company developed software (based on a famous business software they purchased) that displays all the company info in a simple dashboard format. They then support this software with tech support and training.

I've worked with DD long enough to know that the idea of state hospitals was just evil. So many good people wound up screwed up by an uncaring and sometimes abusive system. Thank god there were good people like you there, or things could have been so much worse.
Here we are 20 some years after de-institutionalization, and I still have worked with clients that are terrified that someone is just going to come along and take all their property away. These state hospitals destroyed the trust of a type of people that are the most trusting.

Sorry, pet peeve. (I know one guy that was frequently given "firehose therapy" at a state hospital when he was only a teen)

And yet so many in this career field are liberals and many have no problem with going back to that system. They look at the homeless, blame Reagan, and say we need to have hospitals set up to force them to take their meds.

And I say: I worked at the state hospital at Napa during Jr. college for 2 years..During those days...
the Hospital was never evil..poor souls would arrive with serious mental issues every day and the state of California took care of them.. the best they could...Those techs did the best they could to really care about our lost souls...And I'm am so proud of Americans that put everything above their life to help others..
I've seen the commitment..and cali stopped funding alot of mental heath care and by the time i graduated..thousands were released on th street because of budget cuts...
you know folks.. I'm all for gov't backing out of our lives..we can't really solve poverty by giving away money..ect..
but some people we have to help or put away..We have to.

I'm glad you had a good experience.

I've seen too much of the dark side of that situation. All I'll say is that those who can should be with their families and "normalized" as much as possible. The ones who can't, we have a nice system of group homes around this country. They receive a nice mixture of state, federal, private, and self-generated funding. If you know of any of these organizations that are having a fund raiser of one kind or another I would reccomend anyone donate what the feel they can. You never know when an accident can put you in a facility like that.

Most homeless are there by choice. They have a lot of resources available now and anyone who doesn't use them chooses not to. There are people constantly canvassing homeless hangouts trying to involve them in programs that would help them (meds, food, housing, jobs) but I've been informed by those I know that the refusal rate is around 90%.

I'd have to say that were I in Yochanan's district, I would be initially torn, on the grounds that Schakowsky is a Jew and her opponent, Michael Younan, is clearly an Arab.

That threshold prejudice being openly stated, Schakowsky is also clearly a flaming moonbat of the worst sort, and Younan seems to have good positions--including supporting Jerusalem as the undivided capital of Israel, an issue which appears to be beneath Schakowsky's notice.

In context, I do not see Younan's attack on Schakowsky for not recognizing Christmas to be in any way a problem. First, if he is a Christian Arab (as it would certainly appear) he is entitled to bring this up as a concern on those grounds alone--and one has to applaud his willingness to do so in a largely Jewish district (which also includes a substantial number of Muslims), so it may not win him that many friends. I'd rather support someone who wants Christmas recognized but wants Jerusalem undivided than support someone who is interested in sloughing religious holidays and will vote with the dividers.

All very well, but for someone as insightful as yourself (suck up), I am surprised that you see a need for political recognition, by vote, of Christians and Christmas, as opposed to all the Scandinavian Odinists and the like out there.

What has changed in all these years that anyone needs a vote reminder of one faith or another? I'm an atheist, and I love the season of Christmas. Traditions are a good thing, and I don't need politicians to tell me which ones I should respect over others.

Elected Officials: Elected officials should recognize all religions, traditions and cultures. In December 2007, Jan Schakowsky failed to recognize the Christian faith and Christmas! Aside from this action being completely unethical, the 9th District, whom has elected Schakowsky for the past 10 years, consists of people from every race, ethnicity, and faith. This is certainly not the way an elected official should use their authority. We need to correct this problem and vote her out!

i would have agreed with about 80% of his positions BUT THIS PARAGRAPH MAKES HIM LOOK RATHER BIGOTED.

He said nothing about his opponent's Jewish background--merely that she had participated in some non-declaration in favor of Christmas. I personally think that such votes to recognize holidays are silly. But Congress does it for most mainstream religious holidays, Mother's Day, Father's Day, national holidays, National Libarary Week, National Sausage Week--you name it. That Schakowsky opted out of one of these votes points up, not the existence of a "religious test" for being in Congress, but her own hostility to religion generally--which, as a Jew who takes his religion seriously, should perhaps give you pause when contemplating a Jewish politician who is campaigning for your vote.

The point, I thought, was that there are a gazillion other religions, or not, for which one could have silly ass votes which you presumably think are silly but would vote for regardless, which is not what most people would have voted you in for.

I do not argue from an anti religious standpoint, whatever you may like to think. I argue from an equal religious standpoint, as you should know from our constitutional principles.

The simple fact of that is that there is no way to recognize one without slighting, if only by omission, another.

The only people who bring up resolutions like this are those with a biased agenda to begin with, and for you to suggest that when someone else decides to not vote for it, silly as it is according to you, then it is they who are being bigoted in some way, is convoluted logic.

The simple fact is that it is crass and moronic for anyone in government to have to propose a resolution to recognize Christmas, as if they had nothing better to do than recognize "Good Morning", and then for a politician to suggest that not complying with this mindless expression of religious pandering is in itself a form of religious discrimination is something I expect from Saudi Arabia, not the USA.

It took too long, but it's still messed up. It's a sad state of affairs that this ever came before the HRC, but that is the best reason for why the HRC's need to fade away into the sunset.

Freedom of speech is fundamental. Without it, democracy cannot exist. If some people don't like it . . . leave.

I'm glad for Mr. Levant's acquittal, but the personal jabs at Mr. Gundara -- although not really a big deal -- struck me as a little tacky and irrelevant. So what if Gundara truly is a "second-rate bureaucrat, a nobody"?

Would Levant have been HAPPIER to see a panel of Nobel laureates empowered to prevent him from publishing if they agreed among themselves that the cartoons might offend "vulnerable" Muslims? Obviously not.

It seems to me that Levant should be outraged not that he was at the mercy of an insignificant apparatchik, but by the vagueness and overbreadth of the laws that the bureaucrat was tasked with interpreting/enforcing.

I have followed this situation for a long time, and it is all together absurd, fascinating, and suspenseful.

Levant is fighting a law which punishes thought which someone else can take as hurtful, even though it is true. It is hard to believe the madness and absurdity that exists in Canada with this law.

It is a system which is used to guarantee work for useless bureaucrats who make laws without going through legislative process.

This system is hard to believe.

There was a case of a woman winning the right not to have to wash her hands after going to the bathroom even though she works in a fast-food place. Read that again. Pure madness, decided by petty government workers with unlimited powers.

I think Ezra was only pointing out Gundara's second rate-ness to show how spectacularly unqualified he was to make this judgement. Little is known about him, but somehow I doubt he's schooled in journalism (yeah, I know) or constitutional law.

Recently, a job posting for the AHRC was circulated on the Net - "the successful candidate will have an interest in human rights" was about the only qualification needed.

The reason for the dismissal is so wrong that it wouldn't matter who wrote it - second-rate flunky, Nobel laureate or Shakespeare - wrong is still wrong.

And while Ezra's been plenty outraged by every aspect of this farce, I can only imagine that the insignificance of Gundara just added insult to injury.

But now Levant tells Pajamas Media, “My lawyers say there is no redress allowed in terms of suing my HRC antagonists — the statute forbids it. I may have that option in some of the 17 other legal assaults I’m facing."
