Google Will Change Creepy Browser License

Thu, Sep 4, 2008 at 2:38:44 pm PDT

Reacting to criticism, Google is going to change the EULA for their new browser, Chrome.

Google’s new web browser Chrome is fast, shiny, and requires users to sign their very lives over to Google before they can use it. Today’s Internet outrage du jour has been Chrome’s EULA, which appears to give Google a nonexclusive right to display and distribute every bit of content transmitted through the browser. Now, Google tells Ars that it’s a mistake, the EULA will be corrected, and the correction will be retroactive. ...

Here at Ars, our first thought on reading the EULA was that it looks a whole lot like the EULAs Google uses for other services, with the “content license” provision being an obvious example of this. In fact, that’s basically what it was.

Google’s Rebecca Ward, Senior Product Counsel for Google Chrome, now tells Ars Technica that the company tries to reuse these licenses as much as possible, “in order to keep things simple for our users.” Ward admits that sometimes “this means that the legal terms for a specific product may include terms that don’t apply well to the use of that product” and says that Google is “working quickly to remove language from Section 11 of the current Google Chrome terms of service. This change will apply retroactively to all users who have downloaded Google Chrome.”

Obama bundler stormed stage last night as Palin spoke

Who was that protester who stormed the stage last night? A mega-bundler for Barack Obama from the group Code Pink. Jim Hoft, proprietor of Gateway Pundit who is in St. Paul covering the convention, has the scoop. The protester who stormed the stage during Sarah Palin's speech last night was a mega-bundler for the Obama campaign who hosted a Hollywood fundraiser for him early in 2007. For those wo have questions regarding the source of support for Obama, Code Pink also has a history of anti-Israel activism.

1) Tear gas and baton rounds to get their cooperation;

2) They're bundled into C-130s, manacled and blindfolded;

3) They're dumped onto the tarmac at Mogadishu airport. Welcome to anarchy, kids! Bye, now!

I'm pretty sure it means that they try to use a basic "default" EULA, and minimize the tailoring they do to it when they apply it to a specific product. This can result in certain sections of the EULA being a poor fit for the product it is applied to. The thinking behind this is that you have a more uniform set of documentation across your product line, which will lower your costs since a tailored version of a default EULA costs less to produce than a new one from scratch. (That's the theory anyway.)

I thought you had to be incredibly, off-the-scale smart to work for Google. The quiz that they give applicants is legendary in its breadth and difficulty. It ought to have a question on it asking if the applicant thought it would be a good idea to read a proposed contract closely before offering it to a million people.

re: #103 ErnieG

"Greedy" and "brainy" aren't mutually exclusive. Of course, it's the toxic combination of greed and stupidity that comes to the attention of millions of customers.

Deadlines my friend...deadlines........

I would go for the arguement that they KNEW exactly what it said.....but wanted the "option" of taking the property just in case noone read it.

She just posted moonbat talking points, I don't think she violated any terms of commentary at the top of the comment page, except maybe the 'annoying' part. Given that we're having so much fun with it, I think Stinky may be giving it an 'annoyance waiver'.

LOL
I saw your sock puppet was wacking AF. It is fun isn't it?

re: #98 CyanSnowHawk

I'm pretty sure it means that they try to use a basic "default" EULA, and minimize the tailoring they do to it when they apply it to a specific product. This can result in certain sections of the EULA being a poor fit for the product it is applied to. The thinking behind this is that you have a more uniform set of documentation across your product line, which will lower your costs since a tailored version of a default EULA costs less to produce than a new one from scratch. (That's the theory anyway.)

This quiz?

re: #88 WrathofG-d

What they are saying is that they took a short cut when creating this contract and simply copy & pasted another prior "use agreement" for another product, and didn't read it to make sure it fit for this product.

What they are probably really saying is that they are trying the same old scam that has been tried before with content creation software and got caught. :)

re: #65 Slumbering Behemoth

Glad you're OK, are you tired and sore because you've been working out or something?

We're just drying out here (central Arkansas) from the remnants of Gustav. Lost power for about 12 hours, but that was pretty short compared to some of my friends. A few got their power on just a couple of hours ago, some are still without. The rain was something else. Literally non-stop for three days and nights. Localized flooding, lots of trees down, etc.

Other than that, I'm doing very well, thanks! :)

re: #104 quickjustice

"I own everything you fools input" isn't properly "tailored". Hmmm.

In the old days, we called this overreaching and greed, not "bad tailoring". The folks in Legal write it, and the guys at Headquarters love it.

Screwing customers while being thanked profusely for it is the goal here!

As I understand it, it is boilerplate text from other Google EULAs and those terms are in place to prevent Google being sued for content created or viewed by a user with Google's tools. It also does not state that Google owns the content the user creates, it simply gives them a license to use it without compensation. All copyright and ownership remains with the content creator/author.

I read the terms last night and am going from memory here, but it seems to be a "Cover Our Ass" clause that does reach too far by being somewhat vague or overly inclusive. I have no idea of the real legal meaning of the thing, not being well educated in law myself.

/probably should have thought of that earlier and been elsewhere, tonight's agenda hasn't been a mystery for some time now, pretty soon the price of leaving is going to be a minimum of an unlawful assembly ticket

re: #117 CyanSnowHawk

I was exaggerating to make a basic point. Taking a "license" to use someone's IP without compensating them for it, and burying that language in a haystack of legalese doesn't strike me as a simple "scrivener's error".
