Wilson Sisters Angry at the GOP

Watching the Republican Convention, I couldn’t help wondering whether all those left-wing musicians whose songs they were playing (Heart, Van Halen, etc.) had given permission for their work to be used. The answer: no.

Ann and Nancy Wilson are pissed at the Republican Party and have fired off a cease and desist letter to the McCain/Palin campaign.

Specifically, the Heart women are upset that the GOP has used their classic “Barracuda” as a theme song for Sarah Palin. TMZ obtained a statement from Heart’s rep, who says “The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission.”

The statement goes on: “We have asked the Republican campaign publicly not to use our music. We hope our wishes will be honored.”

Eh, this story comes up time and time again when the GOP uses songs in 'fair use.'

Because there is a decided disproportionate amount of moonbattiness in arts, and it is just likely that whatever song you pick will be a moonbat.

They make their little protest press release, and that's all we hear about it.

Singer Jackson Browne, who is apparently a supporter of Senator Obama's presidential campaign, has sued Senator McCain for allegedly using a Browne song in an advertisement without permission. Of course, this isn't as clear cut as you might believe. McCain's campaign points out that the ad isn't actually from the campaign. Amazing. They have been playing the county fair circuit the last few years. They'd see a resurgence in sales if they just went with it (they may anyway).

Just the same, an artist's work is a cultural contribution. They lose control of that and what it comes to mean upon releasing the work. Those that try to control the meaning of the work after it has been out for a while lose a bit of their legitimacy as "artists" IMO.

Legally, I'm pretty darn sure the GOP can use the songs, under the terms of fair use (Lizard lawyers, chime in if you wish)

But the LLL artist always feels the need to make a little press noise so that no one will even suspect that they (gasp) support those right-wingers.

It seems to me that the authors of books don't get to choose who reads them after publication.

What are the laws where the public performance of recorded music are concerned?

If they do have a case, I expect them to sue. If they don't, then I expect them to continue whining about it. The issue might even get picked up as a moonbat talking point (The Republican's are thieves! yearrrgh!)

Although I work as an intellectual property lawyer, I don't do much in the copyright licensing field any more. However, when I was doing this a few years ago, if a client of mine was going to have a convention or a trade show and wants to play ASCAP or BMI music at it's booth, it would approach ASCAP and/or BMI and buy a license to play ALL of that company's music at the event in question. Permission from any one of the artists was NOT required.

This is different from using songs as background on campaign videos.

Now, Heart may have some other claim about right of publicity (i.e., that using the music incorrectly implies permission or sponsorship), but as far as I know, on the copyright claim, the answer to their attorneys is "we got a license, so go pound salt."

ASCAP and BMI employ tons of investigators whose jobs involve going into bars which have live bands or PA systems and forcing them to buy licenses if ASCAP/BMI music is played....and they will sue at the drop of a hat if the bar does not cave in immediately.

Y'know, I don't much care.

I listen to what I like that's on the iPod (and right now that's Hillbilly Casino, as it happens) so this is really a non-event.

Of course, I don't confuse Herbie Hancocks' musical abilities with political wisdom. (ditto for Barbara Streisand, ditto for the Wilson Sisters....you get the idea)

The convention was probably fair use, but if a copyright isn't defended "vigorously and consistently" then the material can end up public domain, so this may just be pro-forma. More likely the Wilson Sisters are flaming moonbats who want nothing to do with a conservative woman... but we really don't know that yet.

BTW - has anyone asked The Pretenders about where they stand? Limbaugh uses the riff from "Ohio", after all...

I will check now, but I am pretty sure Wilson sisters and male band members headed up to Canada to avoid the draft back in the day and returned after amnesty was granted. They would have deep philosophical differences with the Repubs. To say the least.

While it may be true that they moved to Canada to avoid the draft, it's also true that there was no draft at the time. The draft eneded in 1973, as I recall. The band known as Heart didn't exist in its well-known form until 1974, and nobody outside of Seattle heard of them until 1976.

So, they're not just moonbats, they're deeply stupid moonbats (yes, I realize that many people woud conisder that redundant).

I think you are correct- if you buy the ASCAP license for this event, you get to play all of their music and the artists can whine all they want...but there is no copyright claim.

Everyone (musicians and just us regular Joes and Janes) has a "right of publicity" allowing them to control use of one's name or image that implies sponsorship of a product or service. Therefore, the only claim that the musicians might have is that use of the song implies that the musician is a supporter.

There could really be some copyright violations issues with using music without permission. According to the current copyright laws our church cannot play a CD of worship music before and after our worship services even though the church bought the CD. That is considered a public performance. It's absolutely ridiculous but that is the law.

I argued this a couple of weeks ago with a music publisher and he agreed it was stupid.

I attended a KISS concert a couple of years ago...which was awesome by the way! They were very patriotic, and slamming Islamic terrorists the whole time. Lots of American flags lit up with fireworks, and even red, white, and blue confetti (if I remember correctly).

If "artists" really had a say on who could play their "music" then they might find out that those whom they allow to play the stuff might not add up to enough do-re-mi to keep them in the style to which they are accustomed. by style, of course, I mean cocaine and other recreational refreshments.

ASCAP determines this, not the artist. Musicians might not like it, but if any organization pays the ASCAP fees -- the buyers have a right to use it. Period. And the ASCAP people? Wow. Talk about your barracudas! More like piranhas.

If you define the music you listen to by the politics of the performer, you will pretty much end up listening to the sound of silence.

It's stupid. It isn't a "statement" or a boycott. It merely means you are stubborn and depriving yourself of music you could otherwise enjoy. But go ahead if it knocks you out.

I'm as conservative and Republican as they come, but music is music. It's unfortunate that angry leftists make the best music, but that's the state of affairs. Sort of like how alcoholics make the best chefs and writers.

However, I won't listen to music with lyrics that are downright offensive. But not a whole lot offends me, so I can listen to pretty much anything.

And that "Raising McCain" song was absolutely freaking awful. That was one of the worst pieces of drivel I have heard in a long time. The lyrics, as much as I agreed with them, were terrible! It sounded like it was written by a 5th grader. I'm sorry, but I'd be embarrassed to be McCain with that song...

I mean come on... "Shot down over Vietnam town"?

*shudder.

Sarah Palin was amazing though, and thoroughly cleansed my ears of that awful song.

And I never knew that about Heart...interesting. Never been a fan anyway.

The convention was probably fair use, but if a copyright isn't defended "vigorously and consistently" then the material can end up public domain, so this may just be pro-forma. While it may be true that they moved to Canada to avoid the draft, it's also true that there was no draft at the time. The draft eneded in 1973, as I recall. The band known as Heart didn't exist in its well-known form until 1974, and nobody outside of Seattle heard of them until 1976.

First -
The fact of the matter is that the McCain campaign DOES NOT need to get permission from the artist. Permission is granted thru the music publishing company (generally either ASCAP or BMI).
I wouldn't think "fair use" is a legitimate argument since Heart could argue that McCain using their work "diminishes the song's value".
(PS I'm no lawyer, just "in the biz")
I would assume they paid the publishing license, if they did - they're covered.
Assuming that's true the Wilson's complaint should be with their publishers - not the McCainiacs!

Second - there's no reason to insult a musician's WORK based on their politics. ANd certainly no reason to stop listening based on their beliefs.

Heart is (was) a great band. They busted stereotypes and had tons of hits through the 70's 80's and 90's while doing it.
Look, 99.8% of "artists" are hypocritical, leftist nutjobs. If you only listened to musicians with whom you agreed- you'd end up listening to nobody except Nugent, Alice cooper and Country.

Concerning Rush's use of "My city was gone" by the Pretenders, back in the late 90s it did become an issue. i dont remember the details, but I believe that his term of use was expiring and he ran into a problem when he tried to renew (again, this is 10 years ago so I could be wrong on some facts). Hynde called him up and said he could use the song if he made a contribution to PETA. Rush of course refused, but I believe it was just a matter of him paying the ASCAP license fee.

By the way, Heart's "Dog and Butterfly" album is one of the most underated albums of 70s rock, IMHO. I'm not going to stop listening to it - hell, if a band's politics determined my listening habits, i'd have to toss most of my records. Might be able to hang on to my Zappa stuff as he was a self-described libertarian who hated democrats ALMOST as much as Republicans. Otherwise, most of my favorite bands are raving moonbats. So be it; its not like they have, like, actual influence or anything. The Wilson sisters can cry their tiny sick tears if they want. if they were smart, they could cry all the way to the bank

That is my understanding too. Once the artists have sold their work to somebody, the have relinquished control on the usage of it unless there is some fancy wording in in their contracts when they sold it. If I am a radio station and go license a work to play it on air, they have no say in if I do or not. Unlicensed usage is a different matter of course. It is the equivalent of I as an person constructing a car. Once I sell that car to a someone, I then have no say in who buys it from them. If I patent a process and then sell that patent to somebody for something, again I am entitled to the royalty stream or whatever is specified in my sale. I do not have control over who is the ultimate user. The people who I have sold my patent do within the restrictions of the sale contract. [E.g. the intellectual property reverts to me if an insufficient stream of royalties is not received clause.]

I presume that there were enough legal talents in the Republican party to make sure they covered themselves on the usage. If not, I am sure they will now.

Can you imagine the screams of protests from the moonbats if the drug companies decided that they would not sell their patented drugs to moonbats? Sorry, but you can't have the drug. Too bad moonbat. Of course they can't do that. This is in many ways similar to the clauses that were put in some deeds of sale of property that restricted the rights of the owner to sell to whomever they desired within the restrictions of the local zoning, etc. regulations. They have been struck down since they were often used to redline areas.

Blue Oyster Cult is huge among bikers, and had a very well-attended outdoor show at the Harleyfest in Milwaukee last weekend. They don't really have too many songs that would lend themselves to campaigns, but check out 1980's "Divine Wind" from Cultosaurus Erectus -- it was written about Khomeini and has the great line "if he really thinks we're the Devil, then let's send him to Hell."

BTW, the bass line in Barracuda is a blatant rip off of Zep's Achilles' Last Stand (which is incredibly boring). My favorite version of Barracuda is by Rasputina (which is now 2 corseted chicks and a male drummer). They rock.

Thanks to the massive lobbying power of music publishers and record labels, ompulsory licensing does not apply to music synchronization usage. That said, I doubt the RNC was negligent and didn't properly license the masters from the record labels for use in the convention. If they didn't, well, they deserve to get burned. Otherwise, the Wilsons will have to base their complaint on something else, such as right-of-publicity as was noted before. Not all states have right-of-publicity laws, however, so about the only place they'll have much luck wil be CA and maybe NY. Big maybe in both places, as they have to put forth a plausible explanation of how the use harmed them.

Actually the purpose of the Wilson Sisters' complaint may have more to do with publicity than an actual legal challenge (which they know is a joke). A simple press release stating "Barracuda" is their song will get no press coverage while a "cease and desist" letter from their lawyer (an hour of billable work) gets wide spread press coverage and re-identifies a thirty-year old song with a band whose prime was a quarter of a century ago so anyone who watched the Palin's speech (38 million plus the 10s of millions who have seen the press coverage of the story) knows who wrote and recorded the song if they should be so inclined to buy it on CD or by download. If only .5% of the 50 million+ exposed to "Barracuda" purchase the song this week that's 250,000 in sales. This has little to do with Moonbat politics, this is about old fashioned commerce.

I am thinking that the Xcel center pay licensing fee's to ASCAP, and or a trade as the like; giving the center the right to use music for entertainment.

And I would hire Attorney at Law Barack Obama to be my lawyer, or I would just offer the Wilson sister all the boxes of Chicken in a biscuit they could eat in three days. Here's where I draw the line.

If the artist does not want their music used in conjunction with a political campaign and that policy if for D or R or Independent, then no big deal. I would rather artists keep out of politics all together.

If the artist starts preaching to me how bad this country is, how bad the president is, etc. from the stage after I bought overpriced tickets for their show, then I have a big problem with that. I wouldn't spend any of my hard earned money on a Dixie Chicks concert and would seriously have to think about whether I would attend a Pretenders concert. Of course, I can't stand the Dixie Chicks, but I do like the Pretenders, so a much harder choice for sure.

I think you are correct- if you buy the ASCAP license for this event, you get to play all of their music and the artists can whine all they want...but there is no copyright claim.

Everyone (musicians and just us regular Joes and Janes) has a "right of publicity" allowing them to control use of one's name or image that implies sponsorship of a product or service. Therefore, the only claim that the musicians might have is that use of the song implies that the musician is a supporter.

They have no one to blame but themselves. When entertainers use their fame to pimp for a party or candidate, it's going to piss off a good chunk of their potential fans. If I had written and performed a song that a political campaign wanted to play during a convention, I'd say go ahead...as long as you pay me.

The entertainment industry is a business. The members of Heart aren't giving away their CDs and performing for free, they're selling their product.

Interesting that they only trace the paternal line. Incidentally, it is not inconceivable that there could be a little Jewish in there; some of the East African groups can be shown to have Jewish ancestry as indicated by sequences on the Y chromosome. Actually the purpose of the Wilson Sisters' complaint may have more to do with publicity than an actual legal challenge (which they know is a joke). A simple press release stating "Barracuda" is their song will get no press coverage while a "cease and desist" letter from their lawyer (an hour of billable work) gets wide spread press coverage and re-identifies a thirty-year old song with a band whose prime was a quarter of a century ago so anyone who watched the Palin's speech (38 million plus the 10s of millions who have seen the press coverage of the story) knows who wrote and recorded the song if they should be so inclined to buy it on CD or by download. If only .5% of the 50 million+ exposed to "Barracuda" purchase the song this week that's 250,000 in sales. This has little to do with Moonbat politics, this is about old fashioned commerce.

Well, they could achieve nearly the same result with a press release saying they are thrilled and delighted that Sarah Palin breaking through the glass ceiling as VP candidate, the way they did as rock musicians.

I work as an artists rights advocate, in addition to my other work in publishing. My advocacy work involves copyright issues.

If the Republican Party has paid the appropriate licensing fees, then Heart has no claim. They can't claim right of publicity, because no use was made of the likenesses and publicity of Heart outside the scope of the license.

If the Republican Party did not pay the fee, then Heart has a case.

It is not true that you have the legal right to play whatever you want in any venue. You may play whatever music you own for private events, but not for public ones.

The Republican Party Convention was not an event of the sort that makes use of copyrighted material fall under Fair Use provisions. Just because money is not made on copyright material, that does not mean it is automatically protected under the Fair Use provision. Either they paid for the license or they didn't. I suspect they did. If Heart doesn't like it, too bad. They sold those rights.

If people in the creative community really want to sound off about creators rights, then they would do well to go directly to Biden and Obama and make their opposition to the Orphan Works Bill as loud and long as they possibly can. This bill guts much of copyright law, and could make it nearly impossible for creators to protect their rights under the law.

Biden and Obama who are supposedly FOR creators and artists have set up a scenario that is a disaster for the arts community. This bill will make it very easy for businesses large and small to use the work of creators without their permission, and very difficult for artists and writers to get paid for their work after the fact, as if it isn't already hard enough to get paid. yeah, yeah, I know lots of people on this board think people in the arts community are a bunch of rich snobs, but most artists and writers are lower middle to middle class at best. Biden is a major, driving force behind this bill that is a disaster for the creative community.

My fellow creators are so blinded by political ideology, many can't bring themselves to believe that their shining lights Obama and Biden are about to gut the copyrights they live on.

If Obama were using some of my published works to promote himself, I'd be right out there making damned certain that no one thought the use of my work was an endorsement of his campaign.

As much as I disagree with Ann and Nancy Wilson, they have the right to let people know they don't support McCain. I also have the right to let them know that as much as I have enjoyed their music in the past, I will not be supporting a fellow creator who does not respect the rights of other creators and is supporting a candidate who is behind the insidious Orphan Works Bill.

And on a final note: Lizards, we are better than this. The Wilson sisters are not going to win any beauty contests, but if we don't want scurrilous attacks made against Sarah Palin's appearance, there's no reason to sink to the level of our opposition and dish out the same treatment to a couple of moderately talented musicians who are otherwise too stupid to realize they support a candidate who does not support their rights as creators.

Ann and Nancy Wilson will get what's coming to them if Obama and Biden succeed.

And if they don't, they will have lizards to thank, whether they realize it or not.

I think you're right on this. It's not much different than playing songs,
between bands at a club.
Ascap/BMI charge a fee to anyplace playing background or filler music with more than two speakers. Probably already covered by the venue.

The Orphan Works Bill supported by Obama and being hotlined RIGHT NOW in Congress by Biden is a direct hit at the small time creator who CANNOT AFFORD to protect their rights with high priced attorneys, to say nothing of the mockery it makes of the Berne Convention. Foreign creators will be stuck with this badly written legislation which will afford them little copyright protection under US law.

The supposed intent of the bill is to allow public institutions like libraries and museums to make freer use of works for exhibits and archives, but the wording of the bill makes it open season on copyright for ANYONE who wants to use creative works without getting prior permission. The fine print on this bill is a disaster. Please spread the word.

There are versions in the House and Senate, and both are terrible.

Biden and Obama are a joke. They can force this bill through because few know about it, and the arts community is small enough not to stop it. and these socialists will play right into the hands of big business, pushing through a bill that will leave creators - who are, by the way, small business people - without the means to defend their rights. The bill limits the amounts that a creator can collect for violating its terms to such a small amount it is not cost effective to sue.

It means that the person using the work makes the claim they cannot find the copyright holder. Hence the work is "orphaned".

The bill was supposed to help out museums, such as the Holocaust Museum. If the museum had the intent to use a letter or photograph, say, of someone who had died in the war, then they might be unable to use it if they were unable to track down the provenance of the piece. The Orphan Works Bill was intended to allow museums to go ahead and use the photos and documents without permission for non-profit purposes.

I have no problem with that. I don't see why anyone would.

Unfortunately, the bill as written would enable anyone to make this claim, nut just museums and libraries. Without a reliable, searchable database, there is no way to make a reliable visual or written copyright search. The copyright office has no intention of creating this database.

As copyright law is written now, a work is copyrighted the minute it is created. As the Orphan Works Bill is written, any work not in a searchable database can be considered orphaned, and anyone who wishes to use that work may do so (after registering their intent with the copyright office). If the copyright holder then comes forward and makes a claim, any payment after the fact is limited to terms like "net" and "reasonable". The way the law is written the person using the work without permission largely sets those terms. The creator doesn't have a lot of say in the matter of who, what, where, and how their work is used.

This makes it especially difficult for foreign artists and writers to protect their rights.

I do not appreciate having my work stolen in China and India. I do not want to see the US become a haven for pirates of foreign works, either.

You are right on the money. Once the BMI/ASCAP/SESAC fees are paid by the RNC, the Republicans can blast any recorded music they want, as much as they want, at their convention. Same as any organization producing a public event, or any broadcaster.

Such fees are very commonly and easily paid by the organizers of large-scale events such as a political convention.

Personally I would like to see the Republicans play "Barracuda" all over the place from now until election day. It absolutely captures the energy that the McCain campaign is projecting with Sarah Palin on the ticket.

It's obvious to me that the Wilson sisters are merely taking advantage of the sudden publicity. I'd venture to guess that last night was the biggest audience ever to hear a single playing of that song. I don't know how anyone could think the Wilson sisters have a legal leg to stand on for a cease-and-desist demand if the RNC paid its fees.

Also, people should be aware that the copyright office usually destroys registered works. Even if you have registered your copyright and sent a copy of your book to the Library of Congress, chances are they destroyed the book. There is no archive for the vast majority of written or visual works sent into the Library.

Consequently, anything that was registered before the passage of this bill would be impossible for the copyright office to archive, since they no longer have the works in the first place. That means almost every single solitary published work prior to now.

I hope I haven't derailed this thread to much, it just galls me that the creative community is so blinded by ideology that they are supporting a Democratic ticket that is selling them down the river.

As Limbaugh's three-hour gabfest continues, he routinely pumps up the show with snippets of music from past and present rock artists: Pearl Jam, Stone Temple Pilots, Jimi Hendrix, Blur, Depeche Mode, Bob Marley, Garbage. His aim, presumably, is to inject hipness into his conservatism. That he gets away with it so readily is proof of how depoliticized rock music has become.

A Christian Coalition-loving, family-values advocate playing T. Rex's licentious "Bang a Gong (Get It On)"? No problem. ("One of my favorites," says Limbaugh, a former DJ.) And neither does it seem to be a problem that Limbaugh, that fierce champion of property rights, has apparently expropriated Hynde's music as his theme song in violation of copyright law. He's a radio pirate.

Recently, Limbaugh discussed on air how he came to hijack Hynde's lament over the mallification of America ("My pretty countryside/Had been paved down the middle/By a government that had no pride"). Recalling the days when he was first firing up his show, Limbaugh noted that he tried a number of rock songs for his theme music. A few callers griped that a "conservative guy" should not be identified with a rock & roll sound. To "tweak" these fans, Limbaugh searched for "the hardest-pounding bass line" he could find and selected "My City Was Gone."

Was he aware he had picked the work of an animal rights activist and an ideological opponent?

He sure was. He relished that. "It was icing on the cake that it was [written by] an environmentalist, animal-rights wacko--and an anti-conservative song. ... It is anti-development, anti-capitalist. ... Here I am going to take a liberal song and make fun of [liberals] at the same time."

Musicman, my wife says that it's not a good idea to ask a Publisher a copyright question, lol. She used to work for a company called CCLI for over a decade. The company is the number one used resource in the US for Copyright Law & information as it pertains to churches. If you have any church music related questions you should contact THEM. (they're located in Portland, Oregon).
Actually, you ARE allowed to play a CD or song of a religious nature in the course of a religious service. The copyright law, as it pertains to churches, is different than the copyright law as it would pertain to a public performance.

I'm not yet 50 years old, and I grew listening to and playing all kinds of pop, rock, blues, and jazz music, and for the last 25 years I have worked as a tech for dozens of rock, blues, jazz, and country "artists", and yet I still don't like it when they use these pop and rock songs for their campaigns. Last night when it started right after McCain finished his speech it made me cringe! Even when they use songs I like or used to like (which is rare) it just seems to lessen the whole experience for me. It seems too much like "entertainment" at that point. I've yet to see one of these songs that is even appropriate for their campaign message. They always take a popular song that has one name or phrase or sentence they think is cool, and run with it without really looking into what the song is saying or what the artist really meant by it. From "Born in the USA" years ago to "Barracuda" last night, these songs aren't saying what these pols think (or hope) they are.

Please Sen. McCain, try and maintain a little dignity and decorum and maybe try some instrumental music or something different from the rest of the pack. I promise you aren't winning any votes by your song selection or what's on your iPod!

I think our current copyright laws really need to be reformed but that Orphaned Works Bill is outrageous. It reminds me of the kind of satirical government policy in Hitchhiker's Guide to the Galaxy, where Arthur's notice for the demolition of his house needed to be pro-actively searched out by the citizen rather than the government take the initiative.

The whole copyright scheme was instituted to protect the livlihood of artists, ultimately the goal being to promote the arts and the enrichment of culture. It worked.

My bone to pick, is the extension of a copyright in perpetuity, well beyond the lifetime of the original artists, distributors, publishers, and investors in any artistic endeavor. Looking at the history of copyright law, this certainly wasn't intentional. Copyrights are meant to make artists and their advocates/patrons (potentially) rich, or at the least make the entire endeavor financially worthwhile.

Making a record company/studio wealthy in perpetuity, for a hundred years, extending copyrights by proxy after everyone originally involved in creating the work of art is long dead, is completely outside of the bounds of the intention of the framers of those laws.

It is probable, as you say, that the necessary license for the original recording can be obtained from ASCAP, BMI, or SESAC without the artist's express permission. However, if this ends up being a problem, it is probable that any song the campaign wants to use can be recorded as a cover under the compulsory license provisions of the copyright law and, as long as the statutory licensing fee is paid, there is not a thing the original artist or the songwriter can do about it.

I have some passing connection to various IP issues, but more than that, have heard them discussed recently in connection with ... American Idol! Apparently, your obligations vary by song. Some are put up under ASCAP etc rules, and you deal with the bureaucracy. Others reserve this, that, or the other right, and a show like AI has to negotiate for each individually, and generally at *much* higher rates than scale - but the rate is whatever the owner cares to ask! For instance, this is why they couldn't sing Beatles songs on the show for years. From browsing the net this afternoon, it looks like the rights for Barracuda were sold long ago to someone else, and were probably available for scale - though the scale might be huge, a large public gathering with national broadcast. That's also why Paul Shaffer and such TV bands can only play a few notes of some popular songs, without incurring unlimited claims for performance fees.

NRO had a good articles a few years ago about the top 20 "conservative" songs. #1 was the the Who's "Won't get Fooled Again", which pretty much piss on the hippie feel good mantra of the '60's. And, in watching the Who when they first came to the US, they stood in stark contrast to the "Woodstock" generation. (Pete Townshend spent a night in jail for clocking Abbie Hoffman with his guitar when Hoffman tried to jump on stage.) Of course, Daltrey had to piss away all that common sense by coming out and claiming America had to vote for Obama, because John McCain would be four more years of George Bush.

Thank you RW! I love Heart, saw them at the Paramount Theater in Seattle two years ago this month. Nancy Wilson is one of the main reasons/inspirations for my playing the guitar for almost 30 years now. If I stopped listening to all the music I loved just because of politics, I'd be listening to: 'My horse died in the desert, and all I have left is my dog' kind of music. eeeccchhhh!

The comment from the Wilson sisters that they "hope" that their "wishes" would be respected screams loudly that the RNC paid for a license and can use whatever they heck they want to use. If they had a legal leg to stand on, they'd be screaming. I recall that music is subject to "compulsory licensing" - which means that the owners of the copyrights are paid for the use of their music, but they have no veto right over who can use it, so long as they pay.

I don't think that it is a fair use - there are specific statutory guidelines to fair use, and I think almost any use of music in a public gathering to entertain people would not be a fair use, unless, maybe, it were a parody, and even then ...

The trademark angle is intertesting, and closer to my area of law. The test is whether there is a likelihood of confusion that the Wilson sisters have sponsored or endorsed Sarah Palin, by the campaign's use of their song. I don't see how you can make that argument with a straight face, but, sadly, about 70% of IP litigation fails the 'straight face' test. I heard that Pat Benitar was really mad at Limbaugh for using her song, but he used it for years. In fact, if some other radio host used her song as an intro, HE might have a trademark case, based on someone else's music.

I've been a Heart fan for 31 years. I considered myself a pretty avant-garde guy who read three-week-old imported copies of Melody Maker. When I heard Barracuda in 1977 and was thrilled by it, I realized that plenty of other people were thrilled too, and that I wasn't better than any of them. I've seen them 28 times, including last week at Woodstock. I became a reactionary because when punk was forced (eventually) on us, its smear merchants in the defunct music industry and the soon-to-follow press targeted Heart. But if Heart is too goddamned grand for Sarah Palin, Heart is now too goddamned grand for me.

Simmons said the United Nations approach did not work and the west had to “speak softly and carry a big stick”.


Btw, the band Rush is good as well. Their song The Trees is pro-capitalist. I'm not big on the lead singer's voice, but they are excellent musicians.

Heart should learn the lesson of US weekly which has seen a spate of cancellation in the tens of thousands since its left wing hit job on Gov Palin hit the stands last Monday. Many of the fans of Heart are conservative republicans, and the loss of revenue to Heart for their crazy actions should not be underestimated. As for trying to separate an artist from their crazy leftwing stands (I guess this is a variant of loving the sinner but hating the sin) it is our First Amendment right not to support artists who use the celebrity the US public has given them, and the fame and fortune bestowed upon them by their fans (many who might also be repubs and conservatives), to tout anti american politics that offend that same fan base. If the artists feel so strongly about these misbegotten political beliefs then they will suffer the loss of income gladly just to maintain their politics. That's as it should be. They may also decided that they were way off the mainstream, and get an epiphany either to modify their politics to something less toxic, or to not use their fame platform to peddle their swill. That would also be a plus to political dialogue in the USA. But for offended fans not to do anything only allows commie artists to wipe their feet on us and spit on us. Not good for our self-esteem, and as libs tell us, if it's bad for our self esteem it should not be allowed to occur.

Here's the delicious part - apparently there is nothing stopping Ted Nugent etc. from making a cover version if he pays a Compulsory License Fee to the Publisher. I hope to Gd that is happening as we speak. The earliest the composers, if they were all in agreement to do so, could get their publishing back is 2012 (35 years)

This was/is untrue in other countries like the UK Canada where there is a "Moral Rights" copyright clause where a party of interest (Composer, Publisher) can prevent you

Just kind'a wondering out loud, wouldn't common sense tell you to use music from bands or singers which you knew actually SUPPORTED you, license needed or not? Especially if the artists are still around to make a public stink?

So there are Democratic songs and Republican songs now? Have we become that polarized as a nation that an artist can say, "You can listen to our songs, enjoy them, and dance to them--unless you disagree with our political views!"
