Holy Land Foundation, Round Two

Sun, Sep 21, 2008 at 5:25:34 pm PDT

Coming up: the second round in the Holy Land Foundation Hamas funding trial, in which the Council on American Islamic Relations (CAIR) and the Islamic Society of North America (ISNA) are both listed as unindicted co-conspirators, despite their repeated attempts to be removed from the list: Terrorism Financing Case Back in Court.

The government’s largest terrorism financing case returned to a courtroom in Dallas this week as prosecutors once again try to secure criminal convictions against five men for allegedly raising more than $12 million in what investigators call “blood money” to support overseas suicide bombings.

The case against former leaders of the Holy Land Foundation, a Texas charity that authorities shuttered seven years ago because of its alleged links to the militant Palestinian group Hamas, comes nearly a year after a previous trial ended in disappointment for the government. Jurors acquitted one man outright on 31 charges and deadlocked on charges against the others. Senior U.S. District Judge A. Joe Fish declared a mistrial in October 2007.

The turbulent jury deliberations ignited debate about the strength of the government’s evidence and its pursuit of financiers who back terrorist groups. In the years since the Sept. 11, 2001, attacks, authorities increasingly have accused suspects of providing “material support” to hostile groups, but the Justice Department’s trial record in such cases has been mixed.

It'd certainly be nice if CAIR was indicted this time.

Just thinking of the whining and seething that would spark makes me feel kinda warm inside.....

National security experts are watching the retrial as a possible bellwether for government efforts to hold accountable the people who raise money for overseas terrorism operations.

It boggles the mind that there are people who wouldn't want to hold those who raise money for terrorists accountable. Besides those money-raisers and terrorists themselves, of course. But the world is filled with fools.

And for all of the attorneys reading this, what do you think of the gag order? Good or bad idea?

It seems like the government always goes so far with their case & no further. They have to protect sources & intelligence.
A lot of thes guys walk on technicalities etc. & then crow about being innocent. Being dismissed for lack of prosecution is not the same as innocent.
I hope that they have them this time.

I speak peace when peace is spoken, But I speak war when your hate is provoking, The season is open 24-7-365, Man up yo time to ride, No need to hide behind slogans of deceit, Claiming that you're a religion of peace, We just don't believe you, We can clearly see through, The madness that you're feeding your people, Jihad the cry of your unholy war, Using the willing, the weak and poor, From birth drowning in propaganda, rhetoric and slander, All we can say is damn ya

My forefathers fought and died for this here
I'm stronger than your war of fear
Are we clear?
If you step in my hood
It's understood
It's open season

I don't need a faith that's blind, Where death and hate bring me peace of mind, With views that are stuck deep in the seventh century, So much sand in your eyes to blind to see, The venom that you leaders preach, Is the path to your own destruction, Your own demise, You might say that I don't understand but your disgust for me is what I realize, Surprise!
Your homicidal ways has got the whole world watching, Whole world scoping, So if you bring it to my home base, Best believe it, The season's open

I see you, Hell yeah I see you, Motherfucker naw, I don't wanna be you, If you come to my place, I'll drop more than just some bass, Yo you'll get a taste of a, Sick motherfucker from the Dirty, I ain't worrying not a fucking bit, I'm telescoping like Hubble, Yo you in trouble, Yo on the double, I'm wild with mine, Bring that style with mine, Fuck with my family I'll end your life, Just the way it is, Just the way it be, Do you understand? No matter if you're woman or man, or child, My profile is crazy, That shit you do doesn't amaze me, I'm ready to blaze thee

I don't give a damn what god you claim, I've seen the innocent that you've slain, On my streets you're just fair game, Like a pig walk to your slaughter, The heat here is so much hotter, And my views won't teeter totter or fluctuate, Step to me you just met your fate, And I'll annihilate, With the skill of a Shogun assassin, Slicing and dicing precise with a passion, In any shape form or fashion, Bring it to my home, Welcome to the danger zone, Cause your attitude's the reason, The triggers keep squeezing, The hunt is on and it's open season

It's Open Season

Jury.

Holy Land Foundation jury selection begins with some tears

The questioning brought tears to one woman's eyes Monday morning.

When was asked about where she lived, the woman, who is white, said that her Irving neighborhood was largely Middle Eastern. Have you had any negative experiences? asked defense attorney Linda Moreno. "I sometimes feel like a minority in my own community," the woman said, beginning to choke up. "I don't want to feel that way, but sometimes I just do."

Can you put aside your views and give the defendants a fair trial, Ms. Moreno asked? "Probably not."

She was excused.

But then again I ask myself why their are Islamic Fundamentalist Surrogates are working within our Federal Gov't this very day and we look the other way. For all of its aggressiveness on the "War on Terror" - the Bush Adminstration has some form of a systemic bureaucratic blind eye at times to treason in our midst seemingly for the sake of appeasement. Yes, a bit extreme, but he knows what words he can use and what words not to, all because he hears the use of extreme language doesnt mean he will adopt it. The point is, I feel, is that here is a group of guys that uses a music often associated with anarchy and anti-authoritarian undertones, yet this a song that captures the anger at what was perpetrated against the US and western freedom values. CAIR is still at war, not with guns, but your own legal system. We have gone soft on these bastards.

re: #2 The Other Les

So why not indict them?

In a nutshell, that's the problem with treating the WOT as a law enforcement issue. Maybe the government didn't have strong enough evidence to pursue its case; maybe by going after the HLF, it was compelled to release the information that it was watching a CAIR bigwig.

Once the government decides to press charges, it has to release all the information it has about a suspect to the suspect's defense attorneys. It's called "discovery." So, what happens if an informant is in play, and the government has to turn over all the relevant information it has about the case to the defendant's Lynn Stewart lawyer? The informant - or the informant's family - quite possibly will be at risk of being murdered.

Civil libertarians bemoan the lack of civil liberties given to terrorism suspects. Pity they don't bemoan the free flow of information to terrorists.

WashPost's Marc Fisher was trying to trash a Hillary Clinton supporting Democrat woman who came out for McCain-Palin and spoke at McCain-Palin's rally in Fairfax, Virginia last week. This brave woman said McCain's team held a meeting for her and other Democrats for McCain at which McCain listened to their demands/concerns wanting more women appointments and visibility. The campaign asked her if she'd speak at the rally, and this democrat prepared her speech, without any oversight or input from the campaign. She was amazed they would do that, and really energized about Palin, except on "choice" but she was willing to support a ticket that included women, and a tough woman at that.

Yes, indeed, her dignity is intact. It's the dignity of the MSM that's in question, at this point, imo.

Palin's dignity is still perfectly intact.

No one really cares that Palin's daughter is pregnant, EXCEPT THAT the pregnancy of her unwed daughter is a way for certain folks to make charges of "hypocrisy" of some sort of the other - and I don't think anyone buys that.

Palin is tough, and I think her family is too, and they will see their "smearing" for what it's worth (nada) and go on with their lives.

Look what I am saying is that the woman is under assault. Her dignity can't be taken away, but she is being treated in an undignified way. Is that better?"

Hi Taxfree-- yes they probably will but for the last several years, the rest of us should have been screaming about these housing giveaway programs, and reversing the Carter-Clinton easing of credit for government backed or seemingly government approved bad loan practices.

OT but anybody see/hear Sarah Palin talk today about kicking our $700 billion overseas energy habit that feeds islamic radicals? She bragged about her $40 billion dollar pipeline from Alaska to the mainland, to help us defend ourselves from jihadist enablers & financiers.

Woo hoo, I could listen to Palin speeches for four years!

We don't have enough domestic oil to kick that habit. Drill baby drill will make a dent, but it won't solve the problem. Palin's speech: ``as if we didn't know that already''.

Conservation can make a dent, too. Again, it won't solve the problem. Drilling and conservation together makes but a dent.

France gets something like 80% of its electricity from nuclear power. We get more like 25%, and some of the rest comes from natural gas. With more electric power, we could use heat pumps for both home heating and cooling. That would free up the oil we now use for home heating.

It wouldn't be all that hard to convert to running much of our traffic on NG. Wind, solar, and nuclear, wherever feasible. Natural gas in place of oil. Oil for petrochemicals, and as a stopgap fuel to tide us over. Even if we didn't have this middle east situation, the purely commercial side of the problem is serious. India and China have learned manufacturing and now they're in the market for oil. Rising demand, sinking discoveries and production---it's a recipe for trouble unless we turn to realistic alternatives.

Burning corn-derived ethanol is an unrealistic alternative. We would do better to sell the corn on the world food market and buy oil. On top of that, it doesn't help with the propaganda side of the war when we literally burn food. There is still hunger in the world, and food prices have risen even faster than fuel.

yes. She is being treated in an undignified way. And all I was trying to point out (poorly) was that it reflects badly on those who are treating her that way, not on her.

That kind of assault on your life and you family must be very difficult to deal with.
But I don't think a person gets to the position Palin is in life without being a strong person, including receiving strong support from her family as well as giving her family strong support back.

re: #162 Killian Bundy

If I recall correctly, Stewart is still free on bail - most likely hobnobbing with terror fund raisers.

I believe that as an officer of the Court she should have been given a much stiffer sentence.

The Stewart case:

[Wikipedia]

Stewart is free on bail pending decision of her appeal to the U.S. Court of Appeals for the Second Circuit (courthouse in Manhattan). Briefs from both sides have been filed

Stewart was convicted of providing material support (through a press conference and allowing access by her translator) to a terrorist conspiracy to kill persons outside of the United States [citation needed] and conspiring to defraud the U.S. government when acting as counsel to Sheikh Omar Abdel-Rahman, the blind Egyptian cleric who was convicted in 1996 of plotting terrorist attacks against various sites in the New York City area. Specifically, she was accused, in a federal grand jury indictment, of passing Rahman's blessing for a resumption of terrorist operations to his fundamentalist Muslim terrorist cell in Egypt after cell members inquired whether they should continue to honor a ceasefire that was in place

The evidence[clarify] showed that, after Stewart issued the press release, she was told that Rifai Taha, an individual convicted of terrorism in Egypt who was associated with Osama bin Laden, viewed the press release as support of Taha's desire to return the Islamic Group to violence[citation needed]. Nonetheless, Stewart disseminated another press release, reaffirming Abdel Rahman's withdrawal of support for the ceasefire…The disbarred attorney Lynne Stewart next week will seek to have overturned her conviction of acting as middleman between a terrorist she represented and his followers in Egypt...

See: Lynne Stewart

The Justice Department isn't pleased with the outcome of the case, either: It will be arguing that Stewart's sentence of 28 months, which prompted celebration among her supporters outside the courthouse in 2006, was much too lenient. Prosecutors are aiming for a sentence of several more decades.

Stewart's case, along with those of two co-defendants, her translator and law clerk, will be argued Tuesday afternoon before the U.S. 2nd Circuit Court of Appeals. The panel of three judges hearing the case will review whether the convictions should stand, and, if so, whether the trial judge should give new, lengthier sentences.

See: Stewart back in court
