BREAKING: 6th Circuit reverses on TRO (devastation, humiliation for Jennifer Brunner)

A 3-judge panel of the 6th Circuit Court of Appeals recently vacated a temporary restraining order which would effectively make Ohio Secretary of State Jennifer Brunner follow the law - and do her job - in preventing election fraud. Tonight, the full court decided to hear the case en banc, and has reimposed the TRO. This is great news.

Here are some highlights:

"So far as this record is concerned, the Secretary has given no tenable exlanation why her current interpretation of the statute, as opposed to the office's prior implementation of the law, remotely furthers the anti-fraud objective of the law."

The Ohio Republican Party's position is "not only sensible but it is also fair - and it also furthers both objectives of HAVA ..."

The court mocks Brunner's defense as "[t]he bureaucrats' lament - that this will be difficult to do."

UPDATE: In looking at the decision, it appears the full court voted 9-6 to hear the case en banc (which means all of them). I'd say the 9-6 vote is a good sign, but doesn't necessarily mean the case will end that way. Tonight's decision has been described as the opportunity to "live and fight another day." But in the world of temporary restraining orders, if you have it, that's all that matters for the time being. And the time being is what is crucial right now.

Second point - the initial district court decision got some press because the judge found that Brunner was actually violating the law. That dialogue was snuffed out by the subsequent reversal. But now it's back. When you run into Jennifer Brunner on the street, you can ask her why she's violating federal election laws.

ABC News is the one who broke the Mahoney story in the national media; they're also the same crew that broke the Foley story (same Congressional district).

Seems that a good old fashioned sex scandal, hush money, and Democrats covering for Democrats doesn't get quite the same level of national media attention as when a GOPer does it.

And the leadership for both parties has essentially done the same exact thing - to deny and avoid knowledge that they knew much earlier of what was going on, and to attempt to cover up the details... it was the coverup that got the GOP in hot water in 2006, but with a disinterested media covering in 2008, it's possible that the Democrats in Congress will skate despite the parallels.

As a student of film, and a critic in the local newspaper, I did what I usually do when critiquing a short film; I watched it with the sound turned off.
After doing the complete review, I compared my notes from before, and after sound. I must say that the video itself leaves us with a wonderful, positive emotion. And while the lyrics seem to convey a message of hope, the larger picture demonstrates the struggles for a need of true love.
It is wonderful. Hats of to Tom on this one.

I someone call me from a call center wanting to lower my credit card rates. I asked him what cards did I have. He said he didn't know. I told him I don't have any card so why the hell are you clling me idiot.

The candidate has been placing in-game adverts in the Xbox 360 game ‘Burnout Paradise’, featuring a billboard with Obama’s image and a message that players should make sure they register to vote.

Obama may be the first politician to use in-game advertising but the practice is becoming increasingly common for businesses.

Analyst firm Yankee Group reported recently that the worldwide in-game advertising industry is expected to be worth around $971.3m by 2011.

He's pushing into new territory here, and it remains to be seen whether those buys translate into votes.

My username which I'm sure you all know, refers to Maximilian Kolbe, the Catholic Saint who gave his life for a Jewish father at Auschwitz. Kolbe would say that God in his great love gave human beings free will so they could accept God or reject him. God is not on a business trip. Suffering has meaning though we do not understand it as creatures. This is very Catholic, but it's true, all the answers to life are in the cross of Christ. Hope this is not too "Christian" for this forum but I get really tired of the "God is on a business trip" BS.

God Bless Tom Waits irregardless of whom he is at this point of the ride. On a sandy beach there will be a few grains of truth. Besides that sits what you choose to hear. Music. Beautifully subjective. Now go pick up an instrument of your choice. Make me listen. I listen to Tom. Alcohol helps translate Mr Waits tunes, and cigarettes lend a hand. Along with roadhouses and cheap hotels. Fast cars and faster women come in handy. Quick rides are so much simpler. Then again the stark open eyed punch in the face cudda shudda wudda? Tom knows. Yes he do.

Why? I like other things that suck- Jackson Pollock was a hack but I can stare at his stuff for hours. For some reason I keep eating frozen burritos even though they taste terrible and give me gas. I'm listening to "Crown" by Mason Jennings right now (and for the 50th time today), I'm addicted- but he can't sing either. It's not that I am a purist who thinks everybody should be perfect at what they do in some sort of arbitrary acceptable way, quite the opposite. I consume that which entertains me... It's just that to me Waits is so crappy, so obviously talentless in every way- (except apparently marketing himself to artsy types who hold their cigarettes backwards and wear turtlenecks) and yet I see people who seem to genuinely enjoy the noise he makes. That's why I try...I'm open-minded. I hate him, and yet I try to like him, to see what others see- And when I can't find a good song on my own, I ask for a little helpski-So who is hopeless philosophically Elvulva?

God goes on business trips. The universe is large. He has staff (angels) but like all staff they get it wrong sometimes. And those that will argue God is supposed to be all knowing and all seeing, omnipotent etc. Like any good parent/boss he lets them make mistakes so they learn. Commonly known as "free will".

A loving God gave us free will to choose or reject him. What kind of love would it be if he created us as robots, if we had no choice but to love him? He gives us free will and intellect so we can make choices and we suffer consequences for our choices. However his Mercy if we repent is infinite...and His Justice is also infinite. If we reject Him at the time of our death we will go to Hell. This is Catholic teaching.

I'm only asking: what kind of love gives a one-sided gift? And what real choice is there if the result of not loving God is eternal punishment? Sounds like a theology of "Love me or else."

A truly loving being does not keep a scorecard, or broadly and rigidly define "rejection" as many Christian theologies do. True justice takes into consideration variables; not just absolutes.

Timbre, I understand your point. Christians see it as a "mystery," something that we do not understand but is true because it is revealed by God. Jesus spoke of Hell many times. God crucifed his Son to save us. None of this makes sense from a purely human perspective. I like what C.S. Lewis says about Christianity. Something to the effect that the story of Jesus is so incredibly odd that it has to be true. Noone could make up such a fantastic story.
