Philip Berg appeared on the Michael Savage radio show yesterday, talking about his frivolous and unfounded lawsuit against Barack Obama to force him to disclose his birth certificate.

Yes, this again.

Following Berg’s radio appearance, we’ve received half a dozen angry emails blasting us for our position against repeating this stupid, stupid rumor, and demanding that we cover Berg’s lawsuit.

Here’s one simple fact that should be enough to show you why we believe this story is complete, unmitigated hooey.

Philip Berg is a 9/11 Truther.

Bloggers and others who feel no qualms about throwing their support behind a 9/11 Truther should just go right ahead and keep hyping this story. It’s your credibility, and you’re free to flush it down the drain if you like.

But it’s not going to fly at LGF, no matter how angry you get at us.

He's also a disappointed Clinton supporter AND his lawsuit relies on two separate legal arguments - if one argument against Obama's citizenship is disproved (not born in Hawaii), he falls back on the other one (gained Indonesian citizenship). And vice versa.

The City of Chicago is paying for the $2 million ...... Senator Government is going to reimburse the city ......I think I read somewhere that they are pretty even with funds right now if you include the RNC ....... I am thinking the DNC does not have that much money ........ Money cannot buy a vote now ......... I believe people have made up their minds even if they will not admit it .... unless there is something MAJOR ........which the msm will not report ....... Back in the primaries when McCain starting getting traction, there was a flap about whether he was qualified because he was born in the Canal Zone of two US parents. The NYT tried to make a big deal out of it. The Senate passed a resolution stating that he was indeed qualified.

It is a long-shot. I'm going into this project knowing fully that I'd say it has a 10% chance of succeeding, at best. But after much pondering, I think it's worth a try -- a day or two of my time.

You're right. It only still has legs because he hasn't made a big deal out of stamping out the rumor. He should've invited some reporters to accompany him to the state offices in Hawaii, and had them watch while he requested the BC, watch somebody type the request into the computer, watch it being printed, and stamped with the official seal.

My response was to think, "I'm irresistibly reminded of all those 'contactees' who wanted us all to Ban the Bomb, ban technology, ban everything else, wear togas, and swear Eternal Peace and Love with the Space Brothers when I was a kid." The rhetoric is remarkably similar to theirs.

Berg is a bit like Joe the Plumber. The issue isn't Joe - or Berg. The issue is Obama. The citizenship issue simply hasn't been officially resolved - and that's actually a little strange. The Campaign is being sued now - wouldn't it make sense for the campaign to simply pony up the documents?

But, instead, they're spending a lot of money pursuing motions-to-dismiss, etc (that's an approach that promises appeals, etc.). OK, there's an argument to be made they're jerking someone's chain just for ... well, I don't know ... who's chain is it they're jerking and why?

If I was a defendant in litigation (especially litigation that's popping up in a number of places now), and I had a slam-dunk winning position, I'd save the money and get on with other things - Where's the beef, Barry?

Given many states don't issue Birth Certificates, but Statements of Live Birth instead. I never needed a birth Certificate until I tried to get married in Germany while serving there and the Germans wanted one to prove I was an American and not a German trying to avoid their Compulsory Service. The point is my parents never had one on any of us kids.

Even chimpanzees get it right sometimes. I do not buy all of his stuff, but the fact that he as adopted/acknowledged by his step-father per an AP photograph of his school record did indeed cause a break in his American citizenship in my mind. Since there was no dual citizenship in Indonesia, his American citizenship was probably renounced. I do not pretend to understand the ins and outs of immigration law. It would be trivial for him to regain, but only as a naturalized citizen. As such he is not eligible to serve as the POTUS. If there was an error in not naturalizing him when his mother shipped him back, I think it was an innocent mistake on the part of his grandparents.

A lot of what Berg has in the suit is probable mush. The thing about not being known by another name is equivalent to being know as jr. when you are a kid and by your real name when you are an adult. I hardly consider it being a purger to say that you have gone by the name you have used for the past n years where n is a fairly reasonable number and earlier names were due to changes in family circumstance. It would be interesting to see his Kenyan birth certificate submitted as exhibit 3 a few submissions ago. Maybe its nothing. Maybe it states he was born in Kenya as his paternal grandmother maintains. I am agnostic on it till I see it.

But you know, there are some things that should be out in the open that are not. His college records and so forth. I know when I went for my secret clearance, they dug through me pretty hard. Even a license to carry in MA gets you a file with the FBI. although due to the clearance, I already had one so I could care less. I would like to know enough of any candidates background as the FBI knew of my background back then. As a lawyer, his first impulse is not to disclose stuff. But he is not running for lawyer, he is running for president. For that reason, I hope Berg prevails in getting his records out in the open for all to see.

Yes, Berg is a conspiracy nut and a troofer, but here I think he is rendering the public a service if he gets these documents disclosed. Maybe he makes a fool of himself. But maybe he gets some of 0bama's background filled in. If so, he has performed a service for all concerned.

I can practically guarantee that if you write in normal sentences and use single periods to end them that more folks will read and not skip over your posts.

You know how sometimes when listening to internet radio there can be a second or two where the reception drops out? That's what having six periods between sentences or fragments is like.

He had a bumper crop of zucchini in his garden and kept putting the onus on my mom to come up with various ways to fix it and store it.

Finally my mom said "Enough!".

The next day my mom found zucchini in her nightstand.

Subsequently my dad found it in his underwear drawer.

This went on for several weeks with zucchini appearing in cars, chairs, slippers, drink garnishment (as opposed to the usual olives and cocktail onions), dining room table arrangements (instead of flowers), etc.

Then one day my dad is traveling to Calgary and is confronted by a sign stating the general warning at customs not to bring agricultural products into Canada (with the usual statement of maximum penalties)...

That caused a frantic call by my dad to my mom to make sure that the zucchini was not snuck into his briefcase.

Thus ended the Great Family Zucchini War.

This story is intruiginng in that it's not really "politcal" in nature (i.e. it doesn't have anything to do with poltical rhetoric per se). It just some guy saying that O can't be POTUS becuase he's not qualified from the most basic of criteria (not that he has no experience or that he's a socialist, etc.)

Heck, I remember emailing the video of Berg to a few people who I was pretty sure were Obama supporters. I didn't get any nasty replies. It's was like the whole thing was just nuetral.

Well, OK. Sounds like his litigation enemies are already pretty well discredited. I heard his fundraising wasn't meeting goals the last month or so; true, they've got a lot more than McCain - but I wouldn't spend it this way.

But I'm not voting for Obama anyway, so this isn't a very critical issue. If he can win, then so could Biden or Hillary or AlGore or ... (on and on). Obama's probably not too much worse than any of the rest, so ...

If he were being hired to be President it would be a very serious issue. But whoever is elected President gets that clearance. And he already has some security clearances from being in the Senate and on Foreign Affairs. And is already receiving intelligence briefings as a major-party candidate.

I take the things that would disqualify him very seriously, but on this one our hands are tied. Whomever the people place their trust in, gets to be President and needs to know that intelligence.

As I mentioned yesterday, these birth certificate foilers have gone from deranged to depraved, posting what are claimed to be nude pictures of Obama's mother. Yes, it has come to that.
To be brief, I put on my haz-mat suit and waded into the cesspool long enough to apply my photoshoppe experience to the alleged images.
I can't explain my analysis without linking to them, which I would not do except at gunpoint, but if I have any credibility here at all, be assured that they are fakes. I have no doubt of that at all.
It would be bad enough if they were real, but degrading the man's dead mom with faked images? Is such an evil even possible? Apparently it is, apparently there is no limit to the depravity and cynicism of this element.

There is some bad disease spreading on our side of the fence and a major clean-up is in order. I suspect that this will be a major priority of the conservative and GOP leadership after the election.

My take on the birth certificate thing is that people are desperate for anything they think will bring Obama down. It comes from the frustration with the MSM openly campaigning for him. Of course these "rumors" are dead ends, and they are just a distraction from the real reasons Obama should not be POTUS. He is a big tax and spend liberal, weak on defense and huge on making Government control every aspect of our lives. Forget trying to "get" him with some scandal, get out and vote. Sounds like you had the same problem as my Dad.

He had a bumper crop of zucchini in his garden and kept putting the onus on my mom to come up with various ways to fix it and store it.

Finally my mom said "Enough!".

The next day my mom found zucchini in her nightstand.

Subsequently my dad found it in his underwear drawer.

This went on for several weeks with zucchini appearing in cars, chairs, slippers, drink garnishment (as opposed to the usual olives and cocktail onions), dining room table arrangements (instead of flowers), etc.

Then one day my dad is traveling to Calgary and is confronted by a sign stating the general warning at customs not to bring agricultural products into Canada (with the usual statement of maximum penalties)...

That caused a frantic call by my dad to my mom to make sure that the zucchini was not snuck into his briefcase.

Thus ended the Great Family Zucchini War.

Now, with so many engaging in this fantasy that Obama is not an American and likely perpetuating it into an Obama presidency will only make the next fantasy perpetuated by the other side more palatable and acceptable, and much less debunkable.

I never listened to Savage. I don't really listen to talk radio. I really can't stand talk TV either. The discussions just spiral out of control all the time. It may have something to do with my hearing but it just melds into one gob of shouting and it turns into the type of situation I just want to turn my eyes (and ears) away in disgust.

The thing I come back to is that anything with TV and radio is ultimately entertainment. That doesn't appear to be the case here (although I have read some darn entertaining stuff here).

So it really doesn't surprise me that Savage does not sanity check his guest -- the crazier they are the better entertainment value.

I tried listening to Savage a couple years ago. The problem was/is I listen to talk radio not only to be entertained, but also to learn, and Savage does neither of those things, IMHO. His "style" is very similar to Obermann's in that they both sound bitter and spiteful.

Yes, there is harm, a lot of it. It's damaging the McCain cause by making his supporters look like kooks and wackos. And no one who would have voted for Obama is ever going to change their mind based on this crap.

There's no upside to this.

The reason I wrote what I did is that I know two troofers here where I live and they're going to vote for McCain for the reason of his right-to-life stance. Even though I find their trooferism disgusting, I'm not going to talk them out of voting for McCain just because they're troofers.

They endorsed him, and according to their own by-laws such an endorsement required a signature, but without that signature there is no actual proof.

Throughout his career, Biden has been famous for blurting things out just to prove he's the smartest guy in the room. Half the time, what he blurts out is something the Dem leadership would far rather the rest of America didn't know about until after it was, or is, a done deal.

Every written medium has it's own rules. I write formally in a business letter, and less so it a birthday card to an old college roommate.

Internet chat rooms, blogs, emails, and bullentin boards all have varying levels of formality. Where a book is meant to read like a book, more often than not an email or blog post is meant to be conversation, yet it is missing all the sound. We cannot hear the pauses, the words stressed, the trailing out, and we really cannot see the facial expressions, the hand waving, and all the elements that a speaker combines to tell his message.

So, in typical human fashion, we adapt. We underline, we bold, we italize. Weeeee draw things out to indicate pauses...or even to separate very different thoughts in the same sentence.

We pull out important sentences by themselves.

There is Just. No. End. to the many ways we find to "stand in" for all the audio and visual clues of face-to-face speech that we are missing in text.

As childish as it may seem, how better to indicate you are smiling very big when you say something than :-) ? To prevent arguments and misunderstandings, the notification that the speaker is smiling is often very important, you worthless lowlife overly critical scum. :-)

When I correct grammar, punctuation or spelling, I'm usually at least a bit tongue-in-cheek. Or indulging my OCD tendencies, depending upon whose account you believe.

I was renowned throughout the office as the grammar checker. I could not help myself; it was like nails on a chalkboard to read what some people wrote.

That being said, I think being the office grammar police was just as annoying to my co-workers as their bad writing skills were to me.

Birth Certificates can be wrong. I know, my new one has the wrong name on it.

Last year I requested a copy of my birth certificate from Germany. My original copy that I have is falling apart because of the poor quality paper in post-war Germany. I received my new copy in the mail and didn't think to proof read it until I went to apply for my TWIC card [Transportation Worker Identification Credential issued by Homeland Security].here.
That's when I noticed that my name was spelled WRONG. One of my middle names is ROLF and they had it spelled RALF. I dug out my original certificate to make sure I wasn't crazy. Sure enough, the new one was wrong.

Seems minor, but this shows that DATABASE mistakes can crop up anywhere.

BTW... All I needed was my US Passport and LA drivers license to get the TWIC.

Actually, he's a dirtbag and a liar and a white supremacist, but he now reasonably credibly claims not to be a troofer. He says he was "investigating" troofer claims but ultimately decided they were crap (cite). If he were otherwise credible I'd say he's believable, but since he's not I'll just say there may be some doubt whether he's really a troofer and that if he is or was he's running from it as fast as he can.

Jewish law - on a rather sensible posit - determines ancestry through the MATRALINIAL line. Obvious reason. At the time of BIRTH,
the MOTHER is generally recognizable - the FATHER, not so much.
From this discussion we learn that Sen. Obama's MOTHER was a NATIVE BORN US CITIZEN - ergo - Sen. Obama is a US Citizen at the time of his birth. Who cares really - there are enough reasons that Sen. Obama should NOT be elected President to give this situation any weight.

I do have one question. Charles, maybe you can answer it for me.

Who is it exactly who verifies/validates that a candidate is qualified to run for the office of President of the United States?

Is it someone in the Congress? Is it the Supreme Court? Is it a specially selected/elected commission? Or do we simply go with the say so of the party the candidate represents?

If it is a specially selected person/group/organization, then why don't they speak up now and say definitively that proof has already been offered by all candidates running for POTUS. That would, I would think, put the matter to rest, once and for all. And if Berg was not satisfied with that person/group/organization's validation, he could pursue it with them.

The author of this lawsuit may be a crackpot, a democrat, and a former deputy sec state pennsylvania, however, why did the Obama campaign not immediately deal with this with the proper documentation. Why has it allowed the number of similar lawsuit to grow to eight. As a United States citizen, I am not convinced that Mr. Obama has proven his constitutional eligability. It is concerning to me that he has possibly also held Kenyan and Indonesian citizenship. Why wasn't this matter settled immediately if it has no merit. Why is the Obama campaign employing techniques of procedural delay? It would be better for our country if this was settled immediately in Obamas favor with a proper court proceding and the appropriate documents. It is estimated that 70-100 million people now know about this. Why wasn't it put to rest? I hope for all of our sake Mr. Obama is eligable. A constitutional crisis will spill into the streets in an ugly way.

His certificate of live birth or a passport probably would have served as evidence of citizenship. I know when I have had to prove citizenship for various government activities either the passport or birth certificate could be used.

i think the Berg case is going to stall because the judge is just going to sit on it till after the election, then we'll see if Berg can raise enough cash to keep it going.

Someone earlier mentioned the "Grandma Tape" that was his Kenyan Grandma who claims he was born there not the US Grandma. I have no clue how credible this claim may be, she could have lots of grandkids and a little bit fuddled memory hard to tell.

I certainly agree with Charles that there is little use perusing this tack since there is no hope of getting enough evidence to take his name off the ballot or impeach him if he wins. In this I area would include the Indonesian passport issue as well.

I hope enough people see that even given the issues of the Free Spending Republican congress under Bush and the recent financial difficulties, a socialist president and even more free spending Democratic congress would be much worse.

My advice is to find races you can help in and do something. I like supporting William Russell in his fight against Murtha, but that is just me.

His birth was registered in Hawaii, as evidence by the certificate of live birth and the news paper record. The newspaper is not really independent since it is just a list of names from the City records but does eliminate the issue of a later forgery.

There is some discussion that he may have been born in Kenya and his mother flew back right after and registered him as a home birth in Honolulu. From what I have read this was allowed under Hawaiian law. In either case he would be a natural US citizen just like McCain.

If it is indeed the Democratic Party and only the Democratic party who decides Obama is qualified, then I would think they would offer proof by way of a scanned document with an official seal embossed...for all to see. I couldn't find it. Maybe someone could point me to the official document, because I am curious.

I did view the birth certificate copy pointed to in Snopes, although through my own experience whenever you present a birth certificate for identification, you are warned that the certificate is NOT valid without an embossed seal and signed by someone in authority....I didn't see the seal or signature on the copy provided in Snopes.

I would think there would be someone who is independent of the candidates party who would confirm all of the candidates have submitted a valid copy of their birth certificate and ensure the other qualifications have been met.

I was born in Hawaii in 1963, and I have seen the birth certificate the obama campaign produced and it not even formatted the same as mine, and has missing information fields that are on ALL U.S birth certificates ... it is clearly a fake.
Now, was he born in Kenya?, I do not know, but if he was born in the U.S.A like he has said, he would produce a legitimate birth certificate, and answer the lawsuit.

I guess the way I look at this thing is the same way I look at the lottery. I can be entertained with the idea that I might "win big", but I really don't believe that I will.

OK, maybe I'm full of it, 'cause I don't actually play the lottery. But you get the idea. Besides, it raises the (I think) interesting question of whether you are still eligible to be POTUS if you were a natural born citizen, became a citizen of another country, and then came back and regained your US citizenship. (Not that I'm saying it actually happened in this case - but "what if"?)

That being said, nobody I talk to has heard of this, and I think it's mostly coming from the Hillary supporters (at least Berg is one), so I don't think it's hurting McCain.

I was curious if anybody happens to have saved off that link that de-bunks the claims, though. I know I've seen it here before.

Oh, and Zombie, you're my hero. Another "lottery", but with MUCH better (if still small) odds. I wish I were in Manhattan. Is it really credible that Obama did nothing at Columbia but wean himself off drugs and study in the library, when he supposedly didn't graduate with honors? Does anybody really know for sure that he even graduated? Sometimes people get away with just lying about that stuff - at least they used to. His missing thesis has been explained, but there's no excuse for hiding his transcript from his potential employers (the American voters) - it's the height of arrogance. Anyway, there must be some evidence of BHO's hanging with radicals (like maybe Ayers) somewhere in that town (you KNOW he had to have been doing that!)

His birth was registered in Hawaii, as evidence by the certificate of live birth and the news paper record. The newspaper is not really independent since it is just a list of names from the City records but does eliminate the issue of a later forgery.

There is some discussion that he may have been born in Kenya and his mother flew back right after and registered him as a home birth in Honolulu. From what I have read this was allowed under Hawaiian law. In either case he would be a natural US citizen just like McCain.

Kind of reminds me of a scam from a few years ago I got from a 'collection agency'. They claimed I didn't pay a bill from an electric company that I hadn't used in years and said that if I didn't respond to them, then I was admitting that I owed them the money. I called the old electric company and they said it was crap. I think Berg's lawsuit is crap, too.

Is there any kind of precedent for this? Is anyone aware of a past election where someone was elected to office only to be disqualified later due to insufficient screening of the candidate beforehand? Outside of Miss America contests and WWF matches, that is.

For birth between December 24, 1952 and November 13, 1986, a period of ten years, five after the age of fourteen are required for physical presence in the U.S. to transmit U.S. citizenship to the child.

The five years after 14 applies to Mrs. Obama since she was married at the time, between 52 and 86. Non-married women only require one year of residence in the US.

And for the record there is no actual proof that Obama was in the New Party, and Illinios never had fusion laws so there would have been no benefit for him to have been a member except for street cred. They endorsed him, and according to their own by-laws such an endorsement required a signature, but without that signature there is no actual proof.

Whether Barry was actually "in" the New Party or not is irrelevant. He voluntarily posed for their photo-ops, and that is enough.

I agree scrubjay, the messiah could have put this totally to rest a year ago and produced a valid certificate with no alterations however, like virtually everything else about this guy we know nothing. First, I promise not to "promote this garbage".

But as a point of information (makes for interesting civics, actually) the quote in #416 above is from a Department of State web site, and explains this part of it. But if this were for-real, I'm not sure the "in wedlock" part would even apply, due to the alleged bigamy (the out-of-wedlock reqts on the same page are met).

The "garbage" part is believing the unlikely story of someone who is supposedly Obama's grandmother, who could just be some crazy old lady for all anybody knows - even if she is the real grandmother. And the believing the teller of this tale. Charles has vouched for the authenticity of the birth certificate images released that say BHO was born in HI. This, obviously, serves to disprove what is allegedly crazy ol' Granny's story.

In genealogy all kinds of stories come out. Usually there's some grain of truth, but always it serves to protect some psychological need. In this case, the "need" is to try to elevate the stature of their miserable little country by claiming it is the birthplace of a man they presume will be a U. S. President. And that's just if this is real genealogy, and not just desperate political power games.

Clinton was a draft dodger, used pot, and was involved in more scandals than I can count.

Bush (#43) used harder drugs, and was a drunk at one time.

How can you even ask that?

We the People, are supposed to elect an Electoral College that we can trust to elect a guy worthy of better-than-Top Secret clearance. The polls say we're actually doing far worse than usual in this regard, I'd say.

Aside from Berg, here's the telling part of the court's decision:

Judge Surrick: "If, through the political process, Congress determines
that citizens, voters, or party members should police the
Constitution’s eligibility requirements for the Presidency, then it is
free to pass laws conferring standing on individuals like Plaintiff.
Until that time, voters do not have standing to bring the sort of
challenge that Plaintiff attempts to bring in the Amended Complaint."

In short, there's no mechanism to confer standing on citizens in this matter. As presently constituted, no person or entity shall be granted standing - other than Congress acting as a body, which is unlikely to rush into the breach.

This "standing" issue is also consistent with the recent ruling handed down by the Supreme Court in the suit against Ohio's Sec. of State: Plaintiff lacked standing.

In practical terms, we are citizen/voters without a country - given that Constitutional mandates are more conceptual than enforceable.

Moral: The founders (Adams) knew exactly what they were doing when they established the two party, electoral college.

I haven't posted comments here is months. I do, however, occasionally check out what is being posted here.

Since Charles has asked that no links about this subject be posted here, I will just make a few statements and ask a few questions.

The factcheck.org website has a copy of what many have already deemed as a fake birth certificate. There are many reasons for such a belief, but I won't go into detail about all of them.

I am currently doing research about the following point:

In 1961, the father's race would NOT have read "African" - it would have been written as "Negro" or "Colored." Remember, Obama was born in 1961 - when those terms were used! "African" wasn't used back then...was it?!

That's sounds reasonable and logical to me. If anyone can prove that "African" was used back in that era, then I stand corrected. The factcheck.org b/c has the term "African" written for race.

About Philip Berg being a "9/11 truther." Is it possible that he was wrong about 9/11 but correct about Obama?

How difficult would it be for Obama to present his "vault" long birth certificate (as John McCain had done when he was questioned about it months ago!) to quell the Internet storm going on about this issue?

The American people deserve to know where Obama was born and deserve to see the absolute proof.

There are 7 or 8 additional lawsuits being filed in other states. Even if Berg's past "truther" affiliations make his pursuit of proof about Obama's citizenship status for POTUS questionable, the fact that seven other lawyers in other states are questioning it now, too, should make us all alarmed and concerned about this issue.
