Illegal 'Joe the Plumber' Searches - Update

As we reported Friday, shortly after the third presidential debate Ohio government computers were used to look up personal information on “Joe the Plumber.”

Today, one of the people involved in checking the state child support system to try to dig up some dirt has been outed: Inspector general investigating access to Joe the Plumber’s personal information.

Ohio’s inspector general is investigating why a state agency director approved checking the state child-support computer system for information on “Joe the Plumber.”
Helen Jones-Kelly, director of the Ohio Department of Job and Family Services, confirmed today that she OK’d the check on Samuel Joseph Wurzelbacher following the Oct. 15 presidential debate.

She said there were no political reasons for the check on the sudden presidential campaign fixture though the Support Enforcement Tracking System.

Amid questions from the media and others about “Joe the Plumber,” Jones-Kelley said she approved a check to determine if he was current on any ordered child-support payments. Such information was not and cannot be publicly shared, she said. It is unclear if Wurzelbacher is involved in a child-support case. Reports state that he lives alone with a 13-year-old son.

“Our practice is when someone is thrust quickly into the public spotlight, we often take a look” at them, Jones-Kelley said, citing a case where a lottery winner was found to owe past-due child support. “Our practice is to basically look at what is coming our way.”

And if you believe that, maybe I can convince you the moon landings were faked.

Because Helen Jones-Kelly also happens to be a maximum $2300 contributor to the Barack Obama campaign. (Hat tip: Ace.)

This is a little glimpse into a very dark future, in which the power of the government is used against private citizens who dare to criticize the anointed One.

And more news on this front, via Michelle Malkin; a Toledo police clerk is being charged with performing an illegal search of Joe’s records: Clerk charged with unlawful search of Joe the Plumber.

Toledo Police have confirmed that a TPD records clerk is accused of performing an illegal search of information related to ‘Joe the Plumber.’

Julie McConnell, has been charged with Gross Misconduct for allegedly making an improper inquiry into a state database in search of information pertaining to Samuel Wurzelbacher on Oct. 16.

Yesterday, the mayor of Toledo admitted that the request to search police records for dirt on Joe the Plumber came from the media.

Toledo Mayor Carty Finkbeiner admitted yesterday that a member of the media made the request of the Toledo Police Department for Joe ‘the Plumber’ Wurzelbacher’s records, NewsTalk 1370 WSPD is reporting. The comments were made in response to questions during an unrelated press conference.

Finkbeiner did not say which news outlet, nor which reporter, made the request. He also did not identify the individual who ran the report.

Which is still only a distraction from the main story: when asked point-blank, "Are you a commie?" Hussein Husseinovich replied, "yes, as a matter of fact I am"! What was done to Joe the Plumber is secondary, but yes, deeply disturbing on a personal level (what did this man do to deserve this?), and given how close Husseinovich is to the Presidency, on a national level as well.

Actually, her statement was that anyone "abruptly thrust into the public eye" was checked out on general principles.

As to how she can be fired- not going to happen. The only hope we have is that Mike Crites, the GOP candidate for AG, beats "Tricky Dick" Cordray, the Dem candidate (and State Treasurer, just now) next Tuesday.

If Cordray wins, look for all this to quietly go away.

Actually, that policy makes sense. If the government agencies ignored someone that suddenly became highly visible, like Joe the Plumber, and it was found out later that he had a warrant out, or was a 'deadbeat' dad, then the agencies involved get a PR black eye when someone asks, "How did you not see this guy, He was all over the news?"
The results of the search however, should remain as private as is required by confidentiality protections, and that is where the partisan bias really shows. If it is a Republican, you can bet that everything will be leaked, and if it is a Democrat, you can bet that nothing will be leaked, but just "reported on."

According to the Columbus Disgrace Dispatch Sunday, McCain leads The One in SouthEast and South Central OH, but The One leads McCain in the north half of the state. Specifically, in Cuyahoga Co., the Cleveland area.

Twenty years ago, that would have meant it was all over, as the Cleveland area repeatedly showed that it had enough "voters" (I use the term advisedly) that anyone running for a statewide or Federal office could take Cuyahoga, blow off the rest of the state, and still win.

But for the last decade, Cleveland and Toledo (our two Mistakes On The Lake) have been losing population at a steady rate, as shown by the last two census (1990 and 2000). While the south part of the state has been gaining- slightly.

So, this could mean that The One might take all the "traditional" Dem strongholds in the state, and still lose. Or, it could mean that the Dems (specifically Miss Brunner) have enough "undocumented" (nonexistent) voters to give the Messiah the Oval Office.

We shall see.

Two people were arrested Monday afternoon after an altercation led to five Republican campaign workers being sprayed with Mace at their headquarters in Galax.

Galax Police Chief Rick Clark said officers were dispatched shortly before 1 p.m. to the Galax Republican headquarters on East Grayson Street when a caller reported someone had sprayed office workers with Mace.

Responding officers arrested Daniel Cason Meinecke, 29, and Cara Annis Hindman, 26, both of Galax.

Meinecke was charged with one count of misdemeanor assault, Hindman was charged with five counts of misdemeanor assault.

Galax Republican Chairman Mike Stevens said he was one of the volunteers sprayed. He said a man and woman came into the office and asked for campaign yard signs for the Democratic ticket of Barack Obama and Joe Biden.

After being told the Obama-Biden campaign office was up the street, Stevens said, the man said he was aware of that, but that he thought Democratic signs were being stolen and “stashed” at the Republican office.

Stevens told him that nobody there had stolen signs, not were they “stashing” any in the building.

A confrontation escalated and, Stevens said, the man began to use some four-letter words.

1) More money spent by one of the candidates thus far than by any two in the past.
2) Much of that money raised from a website designed to accept fraudulent charges that evade campaign finance laws.
3) Overt election fraud in at least ten states on behalf of that candidate.
4) The vote fraud winked at and connived at by elected officials and appointed judges displaying blatant partisan bias.
5) Law-enforcement officials forming a "Truth Squad" to intimidate advertisers on the candidate's behalf.
6) Massive media cover-up and suppression of the candidate's record.
7) Massive and blatant media bias against the other candidate.
8) Efforts at intimidation and silencing directed at media entities and individuals who disagree with the candidate.

10) Rampant vandalism by the candidate's supporters, as well as attempts to intimidate or shout down supporters of the other side.
11) Public officials misusing their positions to investigate and target ordinary citizens expressing opinions contrary to the candidate.

All this and more, without the candidate having any formal power in the office he seeks. If he gains his objective, is there any reason that these abuses will decrease? No.

Many of these actions are perilously close to police-state behavior; in some cases, the only thing that makes them not police-state behavior is that they are not (yet) national policy or the policy of the highest official in the relevant jurisdiction.

Abner Louima alleged that one of the police who brutalized him said, "this is Giuliani time" as he was being assaulted.

I do not remember whether that allegation was subsequently proven false or not. But if, on November 5th, we awake to "Obama time," anyone who today says that he or she "is Joe the Plumber" is going to find that he or she is Abner Louima.

Any lawyers out there care to weigh in on whether this constitutes reasonable search?

Also - aren't the people doing this, particularly whatever media flak made the other request, who spend vast amounts of time whining about terrorist lists and passenger delays caused by them? How does a groundless search of personal records sit with these folks, I wonder?

Overzealousness of all kinds isn't exactly rare. But this story needs to be watched. Such over-the-top abuse requires stern punishment of those involved.

Government agencies like child support do look up to determine if people who come into money (like lottery winners) own on their child support. However, that wasn't the issue with Joe the Plumber. Just being in the news isn't a justifiable reason to look at state data on him. There was no indication that there was any recoverable money for the state. Fire the b*tch.

I know a lot about Lottery systems. Every Lottery system I know (and it's more than a few) checks big winners (those requiring a claim - usually $600 and above) against what's called a "deadbeat" file provided by the other State agencies (Dept of Revenue, Social Services, DMV, etc.)

The vast majority of the Lotteries in the US run exactly the same software which is provided by a company named GTech. Deadbeat checking is built-in.

Gtech has run the Ohio Lottery since 1985. But they recently lost the contract (see below for how they lost it)

Every Lottery I know can tell you stories about the poor shmuck who walked in thinking he hit the jackpot only to walk out with nothing.

The idea that the Social Services department scans the newspapers looking for names to run through their db is absurd.

I haven't look at the Ohio Lottery for a while so I did some quick research:

A new company recently won the upcoming Lottery contract (worth around $170M over 10 years to the winner - Ohio Lottery is a $2.2B/yr business). A new company just won, Intralot

Ohio Lottery long-time contractor complains about rival's winning bid

The Ohio Lottery Commission changed the bid requirements at the last minute to allow companies that operate smaller lotteries in the United States to participate. The request was made by one of Intralot's lawyers, David Leland, a friend of Gov. Ted Strickland.

So, they just put a $2.2B per year business in the hands of a company based in Greece, with virtually no large scale US Lottery experience... humm... Glad I wasn't part of that selection process becuase if the screw up during the conversion, which has happened, that's potential of hundreds of million in unrecoverable lost revenue for the State of Ohio. But Strickland knows the firm's lawyer so everything must be okay...

You are correct. Many people in this country need to get their priorities straight. If a known terrorist calls someone in the US, and the NSA listens to the call, the liberals all go in a tizzy and talk about invasion of privacy. But an appointed administrator in Ohio can perform a background check on any private citizen she deems necessary, without a warrant, without probable cause, and without oversight and it is O.K. by our Governor, and probably most Democrats. What a mix up in priorities they have! And where is the ACLU? If the roles were reversed, they would be all over this like flies on you know what.

This is an assault on free speech. By blank headed government officials who can't tell that their efforts are bad. This is indeed the future if Sen Obama is given power.

The average Joe will then know that to acquire any type of public note is then to have your life revealed to the media by the government for political purposes. Maybe the Obama campaign and his supporters can't understand this. These government officials need to be slapped very hard even if they thought they had the appropriate decision making ability.
