CBS to Rather: 'Defies Logic and Common Sense'

CBS lawyers are scoffing at Dan Rather’s idiotic lawsuit, which claims that CBS’s independent investigation was a “sham.”

Dan Rather’s conspiracy theories about CBS make about as much sense as a two-story outhouse, the network says.

Rather and his old bosses were facing off in Manhattan Supreme Court yesterday, where the former Evening News anchor was seeking documents he says will prove his storied career there was sacrificed to appease the Bush administration. ...

“We allege this was a sham investigation on be half of CBS so they could mollify the right” and get rid of Rather, who’d been a thorn in Bush’s side, Gold said.

In their court filings, CBS states, “Rather’s position defies logic and common sense.”

“Rather’s theory is that CBS News commissioned a costly panel, in order to criticize itself, exonerate Dan Rather, and give themselves cover for doing something that it had a contractual right to do anyway,” which is remove Rather from his anchor seat, the filing says. CBS lawyer Jim Quinn said that while the report found Rather did nothing wrong, it “excoriated CBS.”

“If that’s a sham, it’s the dumbest sham I’ve ever heard of,” Quinn said.

I actually agree partially with Rather here. It was something of a “sham,” but not because they were trying to “mollify the right.” It was a sham because it didn’t conclude what any objective observer could see was the truth—that the documents in question were obvious frauds. To admit that would have opened a bigger can of worms, and called into question CBS’s basic journalistic integrity.

Instead they issued a sort of “graywash,” that came to no firm conclusion about the veracity of the documents. This left the door open for other news media to continue pushing the falsehood that the memos were never really proven to be fakes — and saved them all from confronting the ugly truth, that these documents were intended to skew a presidential election at the last minute. It was nothing less than an attempted media coup.

They got their coup in the current election and I believe learned a partial lesson. Instead of pushing obviously fake information, they instead sandbagged for a candidate, abdicating their responsibility and putting someone into office by refusing to investigate them.

Not that they are beyond pushing false or fake info. I do think though they figured out they could manipulate the situation passively rather than actively. This is the year the old media died. We now have to be vigilant because it's obvious they are not going to do the job they are supposed to do.

In the end I think that's good. Citizens should look after themselves and not rely on an organized structure, such as the government and media, to do it for them.

Democrats are sitting back and laughing at the McCain vs. Palin in-fighting, but that'll fade soon enough. We, on the other hand, have had this little "fake-but-accurate" entertainment going on for four years.

What they refuse to realize is that, like someone ignorant of basic martial arts, every move they make is turned against them by their opponents. Eventually, their anger takes over, and their one-track minds lead them to too many mistakes for a recovery.

Then again, what can we expect from a bunch of irrational, feel-goody types?

Wrong from the Beginning
From the March 14, 2005 issue: Even in 1963, Dan Rather was a poor excuse for a newsman.

Eddie Barker, for one, remembers. The news director for CBS's radio and TV affiliates in Dallas at the time of President Kennedy's November 22, 1963, assassination, Barker is widely credited with first reporting on the air that the president was dead, having received word through a doctor acquaintance directly from the hospital ER. Rather, then based in Dallas as a reporter for CBS's national news broadcast and working out of Barker's newsroom, later took credit for the scoop, Barker says. The error is repeated in historical accounts often enough to annoy the now-retired Barker, though he says the falsehood was later acknowledged by Rather.

It was a different lie--one delivered on national news, and at the expense of children--that caused Rather trouble at the time. As reporters from around the world descended on the Texas city, Rather went on the air with a local Methodist minister who made a stunning claim: Children at Dallas's University Park Elementary School had cheered when told of the president's death.

The tale
was perfect for the moment, reinforcing the notion among distant media elites that Dallas was a reactionary "City of Hate." It slyly played to a local audience, too: The school named was in upper-income University Park, one of two adjacent municipal enclaves that shared a school district and a reputation for fiercely protected, lily-white privilege. Finally, for the ambitious Rather--a native Texan and then a Dallas resident--the account represented the very sort of revealing, local dirt that the throngs of out-of-town competitors would have to work far harder to get.

Except that it wasn't true, and Rather knew it, Barker says.

Dan Rather has drifted from being an iconic figure, to being a Rasputin, to being pitiable. If he believes the charges he makes in this lawsuit, he's delusional. If he doesn't, he's still delusional, because in that case, he somehow thinks a court will fall for it. Unless, that is, he's still a Rasputin and he knows that the court in question will pretend to fall for it.

CBS didn't have to resolve the question of whether the memo was a forgery. All it had to do was to establish that Rather and his team had not exercised due diligence in vetting its authenticity.

But they chose to do so without using the most obvious of reasons: that the memo itself was a brazen and obvious fraud.

I have yet to see him link or engage the "point of view" of some other ethnic cleansing or neo-fascist group - like Al Qaeda (except to condemn it). At some point one must be able to universally condemn the politics of ethnic / religious supremacy. If you condemn it for one set of races/religions but ignore it for another, then you aren't really against ethnic supremacy - you just want your ethnicity to come out on top.

You need to look at your contract. They probably can charge for for a TON of things is you try to walk away from it. A lot of those timeshare folks are vultures. It's not pretty what they can try to suck out of you.

Yes - the "educated person" meme gets my blood boiling. A person who has an education should be able to communicate an idea to a person without an education clearly and without trying to overwhelm the listener with bullshit. A truly educated person can speak plainly and describe complex ideas without resorting to pretense.

I think PJM is excellent - and I particularly like Richard Fernandez, Austin Bay, and Victor Davis Hanson. I generally get far more news from online sources than anywhere else (that started when I learned I could pick stories up at LGF days ahead of traditional sources). I also don't think MSNBC, CNN, and others are going away any time soon. I just hope someone, somewhere, realizes how much they have departed from what journalism is and how dangerous that is. The content of a press release or what a spokesperson says is just half the story. I want the whole thing. Is the press release just framing something? Is it a diversion? What are the people involved really saying off the record?

Perhaps I'm a stupid idealist...

Yes - the "educated person" meme gets my blood boiling. A person who has an education should be able to communicate an idea to a person without an education clearly and without trying to overwhelm the listener with bullshit. A truly educated person can speak plainly and describe complex ideas without resorting to pretense.

I know a lot of 'educated persons' that definitely cannot communicate ideas to people, sometimes even to other people with an education. Being a good communicator isn't always something that can be taught in a classroom; and for a lot of people it is never needed because they have a talent for it.

I didn’t agree with everything she said on the campaign trail. I am not convinced that it is communications skills when the "educated person" actually doesn't understand an idea that they regurge incoherently. That is often why they can't explain it.

It is relatively easy to get through college and a masters program. Teaching credentials are plug and chug. The war in Iraq Was/is a complex event, but a teacher can explain it by a neutral allegory if she actually understands what led to the war. From there, people can question the quality of the assumptions, decision making and the risk assessment.

Rather than demanding that university graduates be able to rigorously analyze and then resynthesize ideas, our universities now accept that if one can adopt a moral stance that supports or condemns an idea then they are sufficiently educated.

Truly sad. The quality of higher education in this country has deteriorated considerably in the last generation, IMO.

Either they're just clueless, or...well, I was gonna say maybe they're hoping Obama will pull them us out of the ME so daddy doesn't have to be there, but the girl said her parents were voting for McCain.

I guess I'm just going to go with the clueless angle.
First of all, as a military family they should at least be upset that that horrible woman tried to convince their daughter that her father would be "in Iraq for 100 years". Everyone knows deployments are 12-15 months at a time, and they must be home 12 months before they can go back. And even if he was career military, he would likely only be in 20 years max.

If that was my daughter, I would have to restrain my husband from beating that woman's face in.

Reminds me of the effort here in California 10 years ago to classify "Ebonics" as a distinct language so that kids who spoke it would be treated as "ESL (English as a Second Language)" students.

I will say that our teacher shortage here in California would make what you are talking about a hard goal to hit. For instance, my son has two teachers at his High School that are native German speakers. One happens to be his German teacher, so that is good. The other teaches AP Chemistry and is a great teacher. The kids call her "Frau" which she takes with humor. Sometimes her accent is an issue but I wouldn't want her out for it.

The whole issue of domestic ethnic identity via accents is a problem that does need to be addressed - to the degree that it is cultivated it is intrinsically exclusionary to the students who are not of that ethnicity.

And......... poke fun at CBS's legal efforts for mismanaging the firing of ole Dan in the first place (the memo's were not proved to be false/fake, and tied directly to Rather/Mapes in their initial efforts) - not embroil you in any further manner w/ CBS.

Funny how telling the truth in the first place always is the best and most simple method in life! Let CBS enjoy, and continue to pay for the litigation and all this attendant publicity - and Rather, as well. They surly deserve each other.

I just watched to the video again, and I didn't hear anything wrong with her speech -- just the content.

My sixth grade teacher at Kadena AFB in Okinawa was a heavyset black woman whose accent sounded a lot like the teacher in the video -- she tended to soften or completely drop the "g" from the "-ing" verb ending, and when spelling words she said the letter "r" with two syllables: arr-ruh. But she was a highly professional teacher, and well educated. (And needless to say, since it was a DoDDS school, she wouldn't have bullied a pupil over military policy!)

Anyway, it's just a pet peeve of mine when the features of someone's spoken dialect are taken as a marker of poor education. The fact that this woman said "pullin' for" doesn't make her dumb or uneducated, any more than it makes Obama smart when he says "Pah-ki-stahn."

On the other hand, come the early months of Obama's term... the MSN could still wind up losing big-time when people realize the full magnitude of their failure to check into all the flaws of this guy prior to the election. If the details of his ties to radical causes and stuff become painfully obvious, and at the same time it become obvious he's not a moderate but a full-on Leftist that believes in higher and higher taxes... the MSN could well be toast.

It DOES rather mean we of the Alternative Media must keep plugging away at revealing the truth, and keeping all of that truth in the forefront, though. Things like this Throbbing Memo and other things of the same magnitude that come along after it.

In short, the MSN can be brought crashing down... but only so long as WE do OUR collective homework, regularly and diligently... nose to the grindstone...

That was not what I meant. I meant, first, that the teacher's grammar is bad, and second, that she has a thick "black accent"--which, like it or not, does not provide an example of Standard English, which is what any public school should be seeking to impart to its charges.

Her grammar sounded impeccable to me. And if her black accent does not provide an example of Standard English, then neither does a Texas accent or a Baltimore accent or a Chicago accent.

No school should give a place to a teacher who is speaking in a thick ethnic accent, at least not if the teacher is teaching anything to do with English-language subjects. This is true whether the teacher is of the same ethnicity as her charges, or whether the class is "diverse"; in the first instance, the teacher is telling the students that an accent that will keep them down is "OK," and in the second instance she is inflicting that accent not only on children of her own background but foisting it on children of other backgrounds, which violates the sanctity of those children's "diversity" at the very least.

Um. WTF? My little white boy ears weren't "violated" by my sixth-grade teacher who spoke black-accented English, nor by my fifth-grade teacher whose consonants were all slightly "Hispanic," nor by my third-grade teacher's nasal Texas twang.

Rather and CBS (and their allies) would not be able to re-write history if you would commemorate this item every year on your blog. The left never shuts up about Watergate, Vietnam, etc. - so the left's version of those stories prevails. If we would beat Rathergate like a dead horse - commemorate it, talk endlessly about it, etc., the truth about Rathergate would prevail instead of the left's lies. I hardly see any mention of this on your and other major blogs, despite the obvious historical significance of this event.
