Line Item Veto Act of 1996

Presidents have repeatedly asked Congress to give them a line item veto power. According to Louis Fisher in The Politics of Shared Power, Ronald Reagan said to Congress in his 1986 State of the Union address, "Tonight I ask you to give me what forty-three governors have: Give me a line-item veto this year. Give me the authority to veto waste, and I'll take the responsibility, I'll make the cuts, I'll take the heat." Bill Clinton echoed the request in his State of the Union address in 1995.

The President was briefly granted this power by the Line Item Veto Act of 1996, passed by Congress in order to control "pork barrel spending" that favors a particular region rather than the nation as a whole. The line-item veto was used 11 times to strike 82 items from the federal budget by President Bill Clinton. [3][4]

However, U.S. District Court Judge Thomas F. Hogan ruled on February 12, 1998, that unilateral amendment or repeal of only parts of statutes violated the U.S. Constitution. This ruling was subsequently affirmed on June 25, 1998, by a 6-3 decision of the Supreme Court of the United States in the case Clinton v. City of New York. The case was brought by the then New York City mayor Rudy Giuliani.

A constitutional amendment to give the President line item veto power has been considered periodically since the Court ruled the 1996 act unconstitutional.

It would take a constitutional amendment to make it happen. I don't think Dems have the votes.

You have to get 2/3 of BOTH houses, then 3/4 of the states. Possible the votes are there, but would he want to devote that much time to just this issue?

I think it's more likely this is being used to lull folks into a false sense of his ability to control the economic turmoil.

Actually the OPE has been around since the early sixties, and has been used by every Republican President elected since Nixon:

SERVICES AND FACILITIES AUTHORIZED TO BE PROVIDED TO PRESIDENTS-ELECT AND VICE PRESIDENTS-ELECT

Sec. 3 (a) The Administrator of General Services, referred to hereafter in this Act as “the Administrator,” is authorized to provide, upon request, to each President-elect and each Vice President-elect, for use in connection with his preparations for the assumption of official duties as President or Vice President necessary services and facilities, including-

(1) Suitable office space appropriately equipped with furniture, furnishings, office machines and equipment, and office supplies as determined by the Administrator, after consultation with the President-elect, the Vice-President elect, or their designee provided for in subsection (e) of this section, at such place or places within the United States as the President-elect or Vice-President-elect shall designate;

(2) Payment of the compensation of members of office staffs designated by the President-elect or vice-President-elect at rates determined by them not to exceed the rate provided by the Classification Act of 1949, as amended, for grade GS-18: Provided, That any employee of any agency of any branch of the Government may be detailed to such staffs on a reimbursable or non reimbursable basis with the consent of the head of the agency; and while so detailed such employee shall be responsible only to the President or Vice-President-elect for the performance of his duties: Provided further, That any employee so detailed shall continue to receive the compensation provided pursuant to law for his regular employment, and shall retain the rights and privileges of such employment without interruption. Notwithstanding any other law, persons receiving compensation as members of office staffs under this subsection, other than those detailed from agencies, shall not be held or considered to be employees of the Federal Government except for purposes of the Civil Service Retirement Act, the Federal Employee’s Compensation Act, the Federal Employees Group Life Insurance Act of 1954, and the Federal Employees Health Benefits Act of 1959;

(3) Payment of expenses for the procurement of services of experts or consultants or organizations thereof for the President-elect or Vice-President-elect, as authorized for the head of any department by section 15 of the Administrative Expenses Act of 1946, as amended (5 U.S.C. 55a), at rates not to exceed $100 per diem for individuals;

(4) Payment of travel expenses and subsistence allowances, including rental of Government or hired motor vehicles, found necessary by the President-elect or Vice-President-elect, as authorized for persons employed intermittently or for persons serving without compensation by section 5 of the Administrative Expenses Act of 1946, as amended (5 U.S.C. 73b-2), as may be appropriate;

(5) Communications services found necessary by the President-elect or Vice-President-elect;

This sounds very much as if Obama intends to grab line-item veto power by Presidential decree over the monies appropriated by Congress.

If so, that is an appalling power grab. I know lots of people dream of the line-item veto as a way of controlling spending, but it undercuts the horse-trading that is necessary both within the Congress and between the executive and legislative branches if the President is not to govern as a dictator.

Or be impeached.

I agree with the sentiment expressed on this thread that the whole office of the president-elect thing lacks grace (not to mention humility).
What really worries me is what this man will do when faced with a national security crisis.

I keep a ray of hope alive here. Obama shows a very strong ability (eg, necessity!) to delegate. Whether we want matters of state delegated to Hillary W. Clinton, is another question, but 0 does seem to actually listen to his advisors, for good or ill.

IIRC, once the Congress passes a spending bill and the bill is signed by the President, the President CAN NOT withhold spending the funds appropriated in the bill by Congress. I seem to remember Reagan or Clinton tried to do this as a "de-facto" line item veto. I think SCOTUS ruled that funds appropriated by Congress MUST be spent by the Executive Branch.

Anyone have more info on this?

Seems like Obama missed the Executive Branch 101 Class in law school.

/Oh, I forgot, Harvard Law doesn't offer that class.

Problem is, Obama's idea of "delegation" not includes responsibility, but authority as well. That's a no-no. Obama is doing what he thinks is good for...Obama. He's always been the kind of guy who not only thinks he's the smartest dude in the room, but also the most popular. The only way he can stay that way is a) not make really hard decisions and b) get others to fall on their swords for him. Obama was a con man during the campaign, he's a con man today, and he'll be a con man tomorrow.

Unfortunately for Obama Lightwalker, there will come a situation, sooner rather than later, that he won't be able to con his way out of. And people are going to die because of it.

This sounds very much as if Obama intends to grab line-item veto power by Presidential decree over the monies appropriated by Congress.

If so, that is an appalling power grab. I know lots of people dream of the line-item veto as a way of controlling spending, but it undercuts the horse-trading that is necessary both within the Congress and between the executive and legislative branches if the President is not to govern as a dictator.

Very worrisome.


To be fair, McCain was also a proponent of line item vetos. To quote from the last presidential debate, "I would fight for a line-item veto, and I would certainly veto every earmark pork-barrel bill."

That said, I do agree with you. This country was founded on compromise. The three-fifths compromise, the Connecticut Compromise, etc. If someone tried to line item veto those compromises, the constitution would have never gotten the unanimous vote that it needed to pass. Same thing in Congress. Why vote for a bill if the additions you get added to it are liable to be removed?

The Obama plan:

1- Shut down the military to pay for all his financial plans.

2- Be nice to Guantanamo prisoners to disarm Islamist threat.

3- Fix the economy by creating 2.5 million welfare cases with phony workers getting paid 150 grand a year to do stuff like fix roads.

4- Extend un-employment benefits to out of work pavement contractors who currently take care of roads.

5- Raise taxes on the rich so they'll have less money to invest in the stock market.

6- Raise taxes on business so they'll have less money to invest in growth.

7- Use the history books describing what steps the government took before and during the great depression like instruction manuals for what to do now.

8- And if shutting down the military doesn't pay for all this fun, just crank up the money printing presses. Remember: money actually does grow on trees. Where do you think paper pulp comes from?

What could go wrong?

Look, I didn't vote for The One- but he is not going to shut down the military or make deep cuts in the Defense Budget while there is a shooting war in Afghanistan (along the Pok-i-stan border), Phillipines, Iraq and some other regions.

To be honest there are plenty of non-essential items in the Defense Budget that even John McCain can point to that are sheer waste. The Defense establishment is still buying expensive 3GW (3rd Generation Warfare) weapon systems and doo-dads while we are fighting a 4GW (4th Generation Warfare) conflict.

In talking with some people who work for a major defense contractor, the billions that get dumped into short-sighted and bone-headed projects is amazing.

Obama is a lot of things- but stupid isn't one of them.
