After government prosecutors appealed his light sentence, Ahmed Ressam, convicted of planning to explode a huge car bomb at Los Angeles International Airport, has been re-sentenced to the same amount of prison time.

Dec. 4 (Bloomberg) — Ahmed Ressam, convicted of plotting to blow up Los Angeles International Airport, was sentenced to 22 years in prison yesterday, almost two years after an appeals court threw out an earlier term of the same length.

U.S. District Judge John Coughenour in Seattle handed down the sentence yesterday. Ressam, who was convicted in 2001 of conspiracy and carrying explosives, was sentenced in 2005 to 22 years in prison. A native of Algeria, Ressam was arrested in Port Angeles, Washington, in December 1999 as he drove off a ferry from British Columbia with a trunk filled with bomb-making materials. After his conviction, Ressam cooperated with prosecutors until early 2003.

In January 2007, the U.S. Court of Appeals in San Francisco ordered that Ressam’s sentence be recalculated because the court threw out one of his convictions, a count for carrying an explosive during the commission of a felony. That charge carried a mandatory minimum sentence of 10 years under federal guidelines. Prosecutors asked Coughenour to consider a 45-year sentence because Ressam reneged on his cooperation.

You would think that just one incident like this in the context of a post-9-11 world would wake people up to the importance of fighting Islamic terrorism like a war rather than a criminal case.

But I fear it will take more (gods forbid, successful) examples to stir some from their apathy.

What happens when an unrepentant, bent on destruction, radical terrorist is released in 22 years, his "debt to society" paid? Will he think to himself, "Oh, what a tolerant and just society, I have seen the error of my misguided ways, I will now seek to integrate myself into their enlightened masses."?

Or will he just laugh to himself, and try to find a way to finish what he started, and continue his path to ultimate martyrdom?

This was a malicious prosecution & the prosecutgor even withheld info on the drug dealer from the jury.

Somewhere, who knows where, I read a suggestion that their sentences be commuted, rather than pardoning them. They did violate procedures and tried to cover it up. What is their time served, about 2 years? That might be appropriate.

If an individual performs the same act against armed, trained, and prepared military personnel, he would have been given a death sentence. (by the rifle in the hands of the U.S. soldiers).

Let me try this again. Absolutely, the prosector should be tried.
It is illegal to withold info that is exculpatory and/or mitigating.
The guy that got shot is a hard core criminal who regularfly smuggled drugs into the US. The prosecution presented him as a poor man who was just trfying to feed his family.
If the jury had all of the facts the verdict probably would hve been different.

Integrity is important. Letting a known violation slide is very bad, it leads to normal people, not just the conspiracy nuts, losing faith in the system, a faith that the system relies upon.

We really just got lucky with the millenium bomber, he was captured pre-9/11 when we were asleep. A female border agent sniffed something odd just from experience and that's why he failed.

How Mumbai can be used to advance peace and democracy in the Subcontinent.

OK right now two nuclear powers are at high alert and even the suspicion of an impending attack could trigger a nuclear exchange in which 15 cities and 200 million people die.

Defusing the crisis is in everyone's interest.

Pakistan cannot be allowed to do nothing about the attack. The LeT operates from their territory and they must respond to an illegal and outrageous act by some of its citizens. Pakistan's internal politics will not permit extraditing to India. What should happen is India and the US should present a reasonably detailed bill of particulars against the guilty and demand their arrest. However, instead of extraditing them to India, they should be extradited to an international court located in a country or territory owned by France or Britain to face trial for killing those countries' nationals but with the proviso that if they are convicted by the international court, there is the future possibility of extradition to India.

This buys time for things to cool down. It address the specific needs, India for justice and Pakistan's being made to pay a price to harboring terror and it allows the Pakistani government to face its people and say their respected their concerns.

And it will never happen because even this intelligent and reasonable solution is beyond Pakistan.

This is truly heinous, 22 yrs for attempted mass murder is just so wrong on so many levels it's ridiculous. Most of it comes from congressional slackitude, they should have come up with tighter terror sentencing guidlines, better guidelines and laws for trying non-state enemy combatants - e.g. by my estimation at least half of gitmo deserves the death penalty, and that's one way to clear it quick, but no good guidlines exist. They came out with something half-ass in 2006 that truly did not pass muster.

The saddest thing about this is that R's were in control of congressional and executive branches during the period we could have moved on this.

True, but my original point was that because we consider them "jihadists", etc., we are taking them OUT of a relm that we know how to deal with. By calling them "jihadists" we create a gray area which has only worked to confuse us, and make it harder to fight our enemy. We rearrange the chairs on the Titanic, and debate what to exactly call the iceberg. Thus, I suggested that we just default to an old term, so we can move on.

So I'm in complete favor of self defense. However, the U.S. is a fabulous place for Jews (and everybody else) to live if they rise to the occasion and participate fully. I'm not in favor of any Jewish organization teaching kids that they are a downtrodden victim group in the U.S. Because we aren't, even compared to Europe where you would think they might have cured this disease they have amongst them since hardly any Jews live there anymore. And lots who do have migrated there from the FSU countries where it is apparently even worse than the EU. Our Jewish kids need to be friends with everybody around them and need to know that just like everybody else, they've won the lottery of life to be living here in the U.S. and they have a duty to make the place a little better than it was when they were born.

If Obama splits the difference and mixes lukewarm praise with lukewarm condemnation, the stunt will be seen rightly as meaningless.

You would think that just one incident like this in the context of a post-9-11 world would wake people up to the importance of fighting Islamic terrorism like a war rather than a criminal case.

But I fear it will take more (gods forbid, successful) examples to stir some from their apathy.

What happens when an unrepentant, bent on destruction, radical terrorist is released in 22 years, his "debt to society" paid? Will he think to himself, "Oh, what a tolerant and just society, I have seen the error of my misguided ways, I will now seek to integrate myself into their enlightened masses."?

Or will he just laugh to himself, and try to find a way to finish what he started, and continue his path to ultimate martyrdom?

So I'm in complete favor of self defense. However, the U.S. is a fabulous place for Jews (and everybody else) to live if they rise to the occasion and participate fully. I'm not in favor of any Jewish organization teaching kids that they are a downtrodden victim group in the U.S. Because we aren't, even compared to Europe where you would think they might have cured this disease they have amongst them since hardly any Jews live there anymore. And lots who do have migrated there from the FSU countries where it is apparently even worse than the EU. Our Jewish kids need to be friends with everybody around them and need to know that just like everybody else, they've won the lottery of life to be living here in the U.S. and they have a duty to make the place a little better than it was when they were born.

Yes, they need to "be friends"--with people who are friendly. They also need to be able to recognize hostility, and be willing and able to respond to the hostility as such, without knuckling under to it.

And if they have "a duty to make the place a little better," they have a duty to do so as Jews, and in a Jewish manner.

I'm not saying they should knuckle under to anyone ... and they do pick up on the rare hostility and have so far stood their ground. Rare is the key. If it weren't so rare, I wouldn't have developed the attitude I have about it.

I'm curious what you're thinking of in addressing "duty" in a Jewish manner... (I've been considering this myself as "duty" seems to be an old fashioned concept in the lefty Jewish community I'm in, and I'm wondering whether it is coming from my military brat upbringing rather than being a Jewish concept. But I think it is both and I want to figure out how).

Statement by Ambassador Alejandro D. Wolff, United States Deputy Permanent Representative, on the Libyan Vessel, in the Security Council Chamber, December 3.
Thank you, Mr. President. We are confronted today by a most unusual situation. The Council has been asked to meet by a Council member to react to a situation of its own making. Libya, a country that does not have relations with Israel, which can’t even acknowledge its existence in the letter it sent to the Council that brought the issue under consideration to our attention, and which has an openly hostile attitude toward Israel took the remarkable step of attempting to send one of its vessels through waters patrolled by Israel off Gaza in an attempt to land at a port which is not open to international maritime trade.
Given the current heightened international sensitivity to unpredictable and uncoordinated maritime activity, what country around this table would not have reacted as the Israeli Navy did in this case? The way Libya went about this was dangerous and irresponsible. Mr. President, to the best of my knowledge the Charter unfortunately has no provision to deal with the folly of states.

Mr. President this is not a meeting about the humanitarian situation in Gaza. However, if the objective of the Libya action had been seriously to provide assistance to the people of Gaza, there are several ways to do so that do not involve such provocative, confrontational acts and that would certainly have had a greater chance of allowing that assistance to get through. The manner in which Libya chose seems almost designed to guarantee that the assistance would not be delivered.

Now there are several viable alternatives used by every other state interested in providing assistance. First, member states can directly approach the Palestinian Authority, the legitimate government of the Palestinian people, and inquire about how best to deliver their proposed assistance.

The Arab League Council, for its part, issued a November 26 statement calling on Arab countries to send humanitarian assistance to the Gaza Strip and assigned specific responsibility to the Arab League Secretariat to coordinate with the Egyptian and Jordanian authorities to ensure the entry of that assistance to Gaza. Why did the Libyan authorities not coordinate this in that manner? We are specifically aware, for example, of a shipment of Jordanian assistance that was successfully transferred through the Kerem Shalom crossing into Gaza on November 27.

Second, member states seeking to provide assistance to the people of Gaza can work through the existing institutions and programs of the United Nations that have the mandate and the capacity to provide humanitarian assistance in Gaza. These UN institutions include UNRWA, OCHA, and the World Food Program.
One is therefore left with the impression that provocation and perhaps even propaganda was the intended objective of the Libyan vessel’s activity. The real lesson here is the need to avoid the repetition of such irresponsible action in how assistance is delivered. Under the circumstances, with the terrorist group Hamas controlling Gaza and perpetrating repeated violence and acts of terrorism against Israel, it is fortunate this incident of Libya’s making did not escalate.
Our understanding from media accounts emerging from Tripoli is that after Israeli vessels turned the Libyan vessel back on Monday, the Libyan vessel tried once again to enter the port on Tuesday without Israel’s consent. Under these circumstances, Israel was justified in escorting the vessel beyond the territorial sea and into international waters. It cannot be said that Israel’s actions constituted piracy under the Law of the Sea Convention. Piracy has a very specific meaning under international law, including that the act been by a private ship for private ends.

Indeed, the Israeli navy simply approached the vessel, flagged by a hostile state, and instructed it to turn around and not continue in Gazan waters. It then ensured that it did not return to its original course. The Israeli navy fired no shots and did not insist on boarding the Libyan vessel.

Mechanisms are clearly in place—as I have mentioned—for the transfer of humanitarian assistance to Gaza by member states that truly want to do so. These non-provocative and non-confrontational mechanisms should be the ones used. Direct delivery by sea is neither appropriate nor responsible under the circumstances.

The United Nations recently issued a Consolidated Appeal for the West Bank and Gaza for $462 million, to help the people of Gaza and we would encourage all member states to respond generously.

Finally, let us not forget the underlying reason this humanitarian crisis exists. The legitimate Palestinian government’s authority was usurped in the Gaza Strip by the terrorist organization Hamas. Their instigation of violence through the construction of surreptitious tunnels from Gaza into Israeli territory of the type used to kidnap and kill Israeli soldiers; their indiscriminate rocket attacks on southern Israel and on the established humanitarian aid crossing points all continue.

The Palestinian representative’s lengthy prepared remarks would have enjoyed more credibility if he would have been able simply to repeat his leadership’s own known views on this. Once this situation-- created by Hamas—is addressed, we are confident the humanitarian suffering resulting directly from Hamas’s illegal acts will also be remedied.

Security costs for Brunner, Jones-Kelley reach $73,673

COLUMBUS — The Ohio Highway Patrol has spent $73,673 on around-the-clock security protection for Secretary of State Jennifer Brunner and Helen Jones-Kelley, director of the Ohio Department of Job and Family Services, according to information the patrol provided to the Dayton Daily News.

Gov. Ted Strickland approved security for the two officials, both Democrats, after they received threats during the heated presidential election campaign.

State law authorizes Strickland to direct the highway patrol to provide security to state government officials.

Investigations into threats against both Brunner and Jones-Kelley still are open, although security for Jones-Kelley ended on Nov. 25, according to the highway patrol. Security for Jones-Kelley began Nov. 5.

Costs for Jones-Kelley's security through Nov. 22, the last date for which information was available, were $20,458. Jones-Kelley of Clayton is currently on a one-month suspension without pay for her role in the "Joe the Plumber" case and for using her state e-mail account to raise money for Democrat Barack Obama.

Security for Brunner, which started Oct. 19, continues. Brunner's security needs will be reassessed after results of the Nov. 4 election are certified, said Jeff Ortega, a Brunner spokesman.

Costs for Brunner's security through Nov. 22 were $53,215.

In Brunner's case, police have charged Dana McArtor, 51, of Columbus with threatening a public official, a felony that carries a maximum penalty of five years in prison and a $10,000 fine, according to Franklin County Prosecutor Ron O'Brien.

A preliminary hearing for McArtor is set for Dec. 10, according to O'Brien's office.

McArtor allegedly threatened to kill Brunner during a cell phone call to her office on Oct. 17. Brunner's office got McArtor's number on caller ID, O'Brien said.

No arrests have been reported in the Jones-Kelley investigation. Two threatening e-mails were received in the governor's office referring to Jones-Kelley, according to a Nov. 1 highway patrol report.

In addition, Jones-Kelley reported that she had been receiving harassing e-mail, according to a Nov. 3 report. The reports were filed shortly after newspaper stories appeared that said Jones-Kelley had authorized searches of state databases for personal information on Samuel Joseph "Joe the Plumber" Wurzelbacher. He became a key figure in the Ohio presidential campaign after he questioned Democrat Barack Obama's tax plans.

Ohio Inspector General Tom Charles found that Jones-Kelley improperly authorized the database searches of Wurzelbacher of suburban Toledo.

Arab-American hate crimes down since 9/11

WASHINGTON (Reuters) - Hate crimes against Arab Americans have decreased steadily since the September 11 attacks but are still more common than they were before the hijackings, a civil rights group said on Thursday.

The American-Arab Anti-Discrimination Committee said it received an average of 120 to 130 reports of ethnically motivated attacks or threats each year between 2003 and 2007, a sharp decrease from the 700 violent incidents it documented in the weeks following the 2001 attacks.

But that figure is still higher than the 80 to 90 reports it received in the late 1990s, the civil rights group said.

Incidents tended to increase after other terrorist attacks, such as the 2005 London subway bombings, the group said. Many incidents did not begin with a clear motivation of bias, but assailants would use racial or ethnic slurs as the situation intensified, the group said.

Incidents range from harassment and vandalism by neighbors to death threats from co-workers. One Arab American man in Alabama was shot by a customer who had been yelling racial slurs at a Middle Eastern restaurant in 2006, the group said.

Law-enforcement authorities for the most part have thoroughly investigated these violent incidents, the group said.

There are roughly 3.5 million people with Arab roots in the United States, slightly more than 1 percent of the population.

I have a friend in Israel who used to live here. She showed me her kitchen both here and in Israel. 100% kosher. But they did eat with us at our house. And we've had Israeli shlihim stay with us who were 100% not kosher (even though I made sure the meat was in a drawer away from everything else in the fridge - but that's only a small nod to kosher compared to what my friend in Israel does). So it is all very jumbled. I need more classes on this (or a good book or online class).

The other one, Brunner, was in charge of the elections and the ethics behind the vote on the day you register stuff - with all the ACORN fraud that she didn't want to do anything about and petitioned to be absolved to have any responsibility for and all that. It was irksome and frustrating. the -Kelley gal was the one who used state equipment to fish for dirt on the Plumber and also used State systems to campaign and donation beg for 0...it was all very smelly - and the complaints that escalated into "threats" became the reasoning they used for round the clock body guards on the state tab. :)

The captain of “Al-Marwa”, Hassan Juily, said to the Libyan press agency (JANA) that the Israeli ships continued on Tuesday their monitoring of the ship in international waters, specifying that the crew received fresh clear threats on behalf of the Israeli ships.

Mr. Juily noted that Israeli ships uttered threats to the members of crew by wireless means of telecommunications and in Arab language indicating that “Al-Marwa” could be the target of Israeli weapons, if it would not change direction.

The Libyan Funds for Assistance and Development in Africa, which dispatched this boat, called on the international community to assume its responsibilities so as to help the humanitarian aid transported by the Libyan cargo liner “Al-Marwa” reach the Palestinian people in the Gaza Strip.

The director general of the Funds, Mohammed Kouni, urged the international community to protect the Libyan cargo liner and its crew following open threats voiced by Israeli naval forces.

Israeli warships intercepted the Libyan cargo liner “Al-Marwa” on Monday morning as it entered into Gaza territorial waters.

The Libyan boat transports more than 3.000 tons of foodstuffs and medicines for the population of Gaza suffering from a severe embargo imposed by the Israeli army

Some autoworkers can get paid without leaving homeNEW YORK - For more than two decades, many autoworkers who lose their jobs have been able to enjoy one of the best unemployment benefits in the nation: receiving nearly full paychecks without even leaving home.

Since the 1980s, the industry's "jobs bank" has allowed thousands of laid-off workers to get paid for staying home or sitting in a union hall.

The practice began as a way to entice the United Auto Workers to accept robots on the assembly line. Now it appears headed for the scrap heap as the union takes drastic steps to help automakers get a financial lifeline from Congress.

"I don't think they conceived of themselves as ever having to worry about this," said Gary Chaison, professor of industrial relations at Clark University. "I think their view was that they could still produce sufficient capacity in the United States to satisfy the market need."

In Washington, desperate automakers seeking a $34 billion bailout renewed their pleas to lawmakers Thursday, a day after the UAW offered concessions that included ending the jobs bank program, which has become a much-maligned symbol of Detroit's largesse.

The program started in 1984 as something both the United Auto Workers and their employers supported to promote factory automation and innovation, according to labor and industry experts.

"It raises morale," said Harley Shaiken, a professor at the University of California at Berkeley who specializes in labor issues. "You avoid losing experienced workers, and you ensure that workers have an incentive to improve productivity."

The bank continues to compensate about 3,500 laid-off union employees with the hope that they can eventually be rehired.

The original intent was to allow factories to be modernized with robots and other improvements, so Detroit could better compete with overseas manufacturers without jeopardizing employees' job security.

In the past, employees could stay in the program indefinitely. At its peak, as many as 7,000 to 8,000 workers at General Motors Corp. were in the jobs bank. That figure is now down around 1,400, according to the UAW. After a new contract was approved last year, some strict limitations were put in place.

The terms and conditions vary by automaker, because each labor contract is different. But GM factory workers who get laid off start out at "sub pay," in which they receive unemployment benefits, and GM pays the difference, up to most of their salary, for 48 weeks.

After that, laid-off employees go into the jobs bank, where they have the option of taking 85 percent of their base pay - which averages almost $62,000 a year - plus benefits, without reporting to work. In the meantime, the company tries to find them jobs elsewhere.

Or workers can get 100 percent of their pay by reporting to either the union hall or the plant, where they may be called upon to perform tasks around the factory or sometimes community service work.


And the head of GM made something like $24 Million last year.
And they want US, the Taxpayers, to continue to pay them to not work and not manage.

The Libyan Funds for Assistance and Development in Africa, which dispatched this boat, called on the international community to assume its responsibilities so as to help the humanitarian aid transported by the Libyan cargo liner “Al-Marwa” reach the Palestinian people in the Gaza Strip.

The director general of the Funds, Mohammed Kouni, urged the international community to protect the Libyan cargo liner and its crew following open threats voiced by Israeli naval forces.

Israeli warships intercepted the Libyan cargo liner “Al-Marwa” on Monday morning as it entered into Gaza territorial waters.

The Libyan boat transports more than 3.000 tons of foodstuffs and medicines for the population of Gaza suffering from a severe embargo imposed by the Israeli army

The people of Gaza are not suffering from any humanitarian shortages other than self-imposed.

My brother runs a weekly eukert - (sorry about the spelling)
game for a bunch like that. The stories he tells me about those games keep me in stitches. They complain if the cards are old, so he buys them new ones out of his own pocket. Then they complain the cards are too slippery. They fight over the pencils. They say they put in their quarter when they didn't. And they cheat.
