Amish homeowners: Religion trumps building codes

Attorneys acting on behalf of the Amish argue they have a constitutional right to religious freedom. They don't have to conform to building regulations that require them to use architectural drawings, smoke detectors, quality-graded lumber and inspections, Steve Ballan, an assistant public defender assigned to the Amish in Morristown wrote in court documents.
"They should be allowed to practice their religion and their religious traditions without interference from the government," he said in an interview.
The Becket Fund for Religious Liberty, which has taken up the Amish's cause in Hammond, plans to file a federal lawsuit in New York in the next few weeks arguing that.
The Amish advocates have a strong argument, said University of Michigan law professor Douglas Laycock.
The government must show a strong reason why regulations outweigh religious freedoms, he said. Building officials argue permits and codes ensure structural safety, but Amish homes aren't falling down, he said.
"People aren't getting hurt," he said.

That is nice...still hovering around the $1.50 range here. We filled our trucks up with diesel on Friday for $1.95...that is the cheapest I have seen diesel in many years...YEA!

My brother-in-law (professional engineer) built his house; he had trouble meeting code because he was making things better than the mandated one-size-fits-all regulated way of doing things.

This is in Florida, BTW. A few years back, when a hurricane hit the neighborhood, his was the only house without any major roof damage.

In a surprising rebuke to the warriors who fought for him through tough times, Sen. John McCain (R-Ariz.) on Sunday sided with President-elect Barack Obama and scolded the Republican National Committee for fanning the Illinois corruption scandal.

On ABC’s “This Week,” host George Stephanopoulos asked: “The chairman of the Republican National Committee, Mike Duncan, has been highly critical of the way President- elect Obama has dealt with this.
"He's had a statement every single day, saying that the Obama team should reveal all contacts they've had with Governor [Rod] Blagojevich. He says that Obama's promise of transparency to the American people is now being tested. Do you agree with that?”

McCain replied: “I think that the Obama campaign should and will give all information necessary. You know, in all due respect to the Republican National Committee and anybody — right now, I think we should try to be working constructively together, not only on an issue such as this, but on the economy stimulus package, reforms that are necessary. And so, I don't know all the details of the relationship between President-elect Obama's campaign or his people and the governor of Illinois, but I have some confidence that all the information will come out. It always does, it seems to me.”
Just this morning, the Republican National Committee released a Web video called “Questions Remain.”

“The video highlights the evolving explanations delivered by President-elect Obama and his advisers concerning their contact with the embattled and scandal-plagued Illinois Governor Rod Blagojevich despite Obama’s promises to instill greater transparency and confidence in government,” the party’s announcement said.

Just finished up trimming this years Christmas tree. Looks good. Whats a good add to the water for keeping the tree fresh.?I bought it at the town fire dept as a charity type donation, but the tree is a bit dry. don't want it drying out too prematurely. And we did trim the trunk for a fresh cut.

Add a little water with sugar to the tree and a little egg nog with brandy for yourself...the tree will look even better once that's done

I have been building homes and commercial buildings for years and in that time I had a building inspector that is on the "International Code Board" he and I use to get into friendly arguments all the time, sometimes I won other times he did, what I am saying is sometimes you have to hold your ground and prove what you are doing.

We had a small mosque here that had similar problems. They legally occupy a former ranch-style house on a major road. They submitted plans to the city for a big ol' minaret and got shot down (it would have been higher than any church in the city and would violate the height ordinance). Then they submitted expansion plans that were also rejected for various legal reasons. This time they just went ahead and built what they wanted anyway. They tried to get it grandfathered, but the city demanded they remove the improvements. It dragged on for nearly a year and the leader was threatened with jail before they finally complied a couple of weeks ago.

I had to show a building official at the planning department that bolting a metal saddle for a patio cover beam to a stucco wall with studs behind it would hold just as well as removing the stucco first and bolting to the stud. He finally relented.

I still get a weird feeling seeing their horse-drawn buggies rolling down the road, about what it must be like to live that way, especially for the children. But we were told that when the children turn 18, they are allowed to go out into the "real world" and see for themselves if they'd like to live in it.

McCain reminds me of a guy that hits his head with a hammer over and over and then complains about a headache. In all the years he "reached across the aisle" to work the dems...they never miss a chance to knock him, embarrass him, or oppose him. They are all happy to deal with you, just as long as it's going to where they want...if it's the reverse, forget it...all of the good graces and brownie points you thought you had with them do not count. It's a one way street and McCain is too stubborn or too stupid to notice.

You wouldn't get away with that anywhere, much as you might like to use alternative methods. There are minimum requirements for outlets per x amount of square feet. Why should one group be exempted?

That is the conundrum for me. On one hand, you have this quiet, private group of people who has always lived a certain way, peaceful, harming no one, and up until very recently, they have been allowed to live like that, with really no problems.

Then you have the realities of every day, laws that apply to everyone. It is a tough question, as I think the law should apply equally, but OTOH, these folks have happily and freely lived like this for centuries, and have harmed or bothered no one doing so. As the article pointed out, you do not hear of Amish buildings falling down, quite the contrary, they are extraordinarily well crafted.
I do not think you should be required to have electricity if you do not want it in your home, same with running water. If you do want it, then by all means follow the codes and standards.

There are several reasons, the two primary being a desire for "moderation" and for the ability of a voter to pretend that they vote for the candidate not the party.

Tom Campbell, (may spit forever fall upon him), pushed for the open primary in California specifically to break the conservative (Reagan) Republic hold on the party. I was there when he started that. I fought against him and that abortion. It was ugly.

Here in Washington, where they already had an open primary, voters supported it because they liked to be able to refuse to explicitly side with one party or the other. I would be OK with the Washington model if that meant that the Party could select its nominees with out it going to any kind of public vote.

Open Primaries are an abomination to Party politics.

One really has to ask the obvious question: If Obama’s economic policies work so well, why isn’t Detroit a paradise?

In 1950, America produced 51% of the GNP for the entire world. Of that production, roughly 70% took place in the eight states surrounding the Great Lakes: Minnesota, Wisconsin, Illinois, Indiana, Michigan, Ohio, Pennsylvania, and New York.

The productive capability of this small area of earth staggers the imagination. Virtually everything that rebuilt the industrial bases of Europe and Japan came from those eight states. Cars, planes, electronics, machine tools, consumer goods, generators, concrete - any conceivable item manufactured by industrial humanity poured out this tiny region and enriched the world. The region shone with widespread prosperity. People migrated from the South and West to work in these Herculean engines of industry.

The wealth, power and economic dominance of the region at the time cannot be overstated. Nothing like it has existed in human history.

Yet, a mere 30 years later, by 1980, we called that area the “rustbelt” and it became synonymous with joblessness, collapsing cities, high crime, failing schools and general hopelessness.

What the hell happened?

Obama happened.

Of course, not Obama personally but rather the same ideas that Obama espouses. What those ideas did to the Great Lakes states, they can do to the entire country.

What did they do wrong?

First, unions: Without any serious economic competition, unions could force virtually any salary, benefits and pensions they wished from manufactures. Worse, however, they could set work rules and conditions, effectively dictating the organization of a business and what technology, processes and methods it used. Since increasing productivity, by definition, means doing more work with fewer people, unions froze companies into the methods used in the mid-1950s and refused to let them adapt. Companies rode high for over 15 years, but by the late ’60s they faced increasing competition and needed to change and adapt. The unions blocked this.

In the end, however, strong widespread unions turned out for workers to be merely a case of robbing Peter to pay Paul. Unions got workers in factories better wages, but the people who built the workers’ houses, cars, consumer goods and stocked their groceries also had strong unions and the price of everything went up. Strong public-sector unions kept taxes high and public productivity low, so workers’ taxes went up. By the time they paid all the increased cost of union labor in everything they consumed, the unions gave them little if any real increases in income.

Second, invasive government: People who grew up during the New Deal and WWII believed that government could solve almost any problem, and they supported high taxes so that government could fix society. Unfortunately, the supposed benefits of an expansive state, good schools, solid public infrastructure, low crime, etc. failed to materialize while zoning and land-use restrictions drove up housing cost and taxes and crime destroyed small businesses. Strong public-sector unions blocked tax cuts and reforms that could have saved them.

By the early ’70s the states that once served as the industrial engine for the entire planet began to fall apart. Then came double-digit inflation and the energy crisis (both caused by leftist policies). By 1980, the industrial heartland of America lay in virtual ruins. People called it the “rustbelt” in analogy to the “dustbowl” of the Great Depressions. Even today, nearly 30 years later, the region lags behind the rest of the country in job creation and is steadily losing population to internal migration.

It can happen just that fast. A worker who entered the factories in 1950 at the age of 25 saw 20 good years before things looked bad. At 45 he saw repeated layoffs, and by 55 he was out of a job and his children had little hope of finding one.

Obama clearly plans to try to extend the rustbelt model to the rest of the country. “Card check” will let unions use intimidation to control workers. High taxes on capital gains will slow investment. Environmental regulation will starve workplaces of electricity and mandate inefficient modes of production. Great new bureaucracies will arise to restrain the freedom and creativity of the people.

Obama has no concept of business as a creative and experimental endeavor. On some deep unconscious level, he assumes that material wealth is something akin to a natural phenomenon for which no group of humans can take credit. Therefore, he sees distribution as the only serious economic issue and ignores how politics interferes with the actual process of wealth creation.

We may soon be living in a repeat of ’70s and looking back at the years 1984-2007 as a golden era.

Video shows the president's lead agent rushing to the podium, but the president immediately and subtly motions to him that it's OK. The agent backs off.

The market futures are still pointing slightly up for tomorrow's open. The market expects another discount rate cut by the Fed's.

ECONOMIC PREVIEW
This is what a really bad recession looks like

Almost everyone expects the FOMC to cut its target for overnight interest rates from 1% to 0.50%, but almost no one thinks the rate cut will do much good in the current environment of fear and risk aversion. Households and businesses aren't borrowing because interest rates are too high; they aren't borrowing because they are afraid the recession will worsen, and because they can't get a loan from banks that are even more afraid than they are.

The problem is the bad news keeping coming in waves. Eventually that will stop, but until then investors are spooked bad. Right now they are buying treasuries with a yield of zero.

With this next rate cut the Fed's will be about as low as they can go. The next step is to buy up securities from banks at a premium, thus pumping even more money into the banking system. Many of these banks are swimming in cash but they still are just sitting on it.

Simply put, it's an attempt by the Fed to flood the financial system with so much cash that some of it will have to be lent out. The Fed would do that by "purchasing long-term Treasuries and agency debt and possibly financing a wider range of asset-backed securities," said economists for BMO Capital Markets.

At some point, all that loose cash would begin to be inflationary, and that's the whole point. The Fed is trying to avoid a sustained drop in asset prices that could leave every borrower under water. Eventually, the Fed will have to mop up all that money, but as Bernanke said, that's a worry for another time.

Inflation
The Fed has nothing to fear now about consumer price inflation.
On Tuesday, the Labor Department will report on the November consumer price index. With gasoline prices falling another 30% or so, economists surveyed by MarketWatch expect the CPI to fall 1.4% after a 1% drop in October.

A decline of 1.4% would be the lowest since 1938, and if it falls even a tenth more than expected, it would be the lowest since February 1933, when Hoover was packing his bags to leave the White House.

Once all that cash starts getting lent out, you will see an economic expansion of about 10 times that amount. Since out production capacity can not handle that much, we will have way too many dollars chasing too few goods, and inflation will ensue.

CHICAGO (MarketWatch) -- GMAC Financial Services has once more extended the deadline for its offer to buy or exchange debt notes issued by it and its subsidiaries, as it seeks to qualify for federal aid under the Wall Street bailout program.
GMAC extended the delivery time to Tuesday 5 p.m. Eastern Time, in what it said was a "final" amendment to the offers.
This time, however, the company said that it has an "agreement in principle reached with representatives of a substantial portion of the outstanding notes."
That, in turn, "represents substantial progress toward attaining the estimated overall participation that would be required to satisfy the condition for a minimum amount of regulatory capital in connection with GMAC's application to become a bank holding company," although more buyers will still be needed.

The last thing the Fed's are going to do at this point is let GMAC fold.

Afternoon all- I could use some printer help too! I have an HP 5610 all-in-one that is 2 years old. Works well EXCEPT copying or scanning gets me a lengthwise black stripe about 3/4" wide near the middle of the printout. The printer function works fine, so I am guessing it's either a physical problem with the scanner or a software glitch. I've tried the on line help tips but to no avail. Anybody know anything about this, or is it time to pop for a new machine (the time is not ideal for that, but...)

Please don't. Mrs. Rancher has been living in Cruces for the last 7 years and now that we're back in central NM she is having a rough time adjusting. We got snow but worse are the 50 mile per hour winds. Maybe Obama will make it economically feasible for Pickens to plant some windmills here. If we got anything in my little town it's wind.

I don't have enough info, IMHO. If your disk loads, and runs the install program with no errors-it should be listed when you view "show all programs" on your start list. If it shows, it should be up and running. The next step is to open your control panel, and click on your printer icon. Check there to see if the right printer is selected, and listed as primary. Then check to see if the PC shows the printer as actually connected and present-ready status. That's about all i can think of, unless your printer port got changed, or a cable is messed up.

Is the Scan input tray the same as the fax input tray? If so try sending a fax to someone that can give you feedback. If they see the same thing, I'd guess you have something lodged inside that is causing the problem, but since it isn't interfering with paper feed, it isn't giving you a paper jam indicator.

Afternoon all- I could use some printer help too! I have an HP 5610 all-in-one that is 2 years old. Works well EXCEPT copying or scanning gets me a lengthwise black stripe about 3/4" wide near the middle of the printout. The printer function works fine, so I am guessing it's either a physical problem with the scanner or a software glitch. I've tried the on line help tips but to no avail. Anybody know anything about this, or is it time to pop for a new machine (the time is not ideal for that, but...)

Yes- I get the same results from both the flatbed scanner/ copier/ fax and using the document feeder. I haven't tried sending a fax, but looking at the scanned file (which I believe should be the same?) i get the line there as well, even without printing it out.

You may have a problem with the CD that isn't registering, so the Manufacturer might have a download that would work. I've had to fall back on that a few times for software/drivers.

It would give the taxpayer the rebate, Detroit their money, deplete inventories and save jobs. Re the Brussels Journal thread earlier, it has been shifting around in my brain. I think Charles should take a bow. All the Euro threads last year allowed the ooze show itself when the oozers were trying to camouflage themselves in international dealings. It is amazing how the shape of it reappeared (never did disappear after WWII, just hid) on LGF and since then has filled itself in. It is a public service, Charles. I can't think of an actual electrical problem that'd do that-but I don't have a schematic of your copy/fax/scan circuitry. My first guess would be something blocking the optical reader inside. Try looking down as far as you can, to see if that is the case-PRINTER UNPLUGGED from power-Safety first!

Codes do require some information on plans for electrical wiring, but for a single house, most of the conformity to safe practice is achieved by passing the inspections — the building department sends out an inspector at several stages of construction, and for "just a house" the plans can be quite minimal.

Amish houses might not have wiring at all, however.

Oh yeah! I know how to fix yer problem. Bring the printer/fax/scanner to basement or back yard.Have large sledge hammer nearby. apply sledge hammer freely to printer/fax/scanner. Repeat as necessary. throw remains in nearest trash receptacle. Go to computer store. buy new printer/fax/scanner. Problem fixed, no more lines :)

Actually I first saw the glacier during a visit in 1996. It has since receded over a quarter mile since then. But, last winter, the glacier had a positive snow pack gain at the higher elevations.

300 years ago the spot where my house is located would have been under the glacier.

Had a T45 that I kept propped up for many a year. (I can fix most anything electro-mechanical.) Finally let it go and bought a 6310 all-in-One; network compatible, flatbed scanner, direct memory card and camera inputs. $150. Well worth it.

Good show. I hate modern software, because I don't know it well enough. I prefer the good old DOS days, where I could pull out my DOS manual, and fix most bugs. They use to have ERASER, a free program that would totally eliminate the uninstallable-but they charge for it now, IIRC.

I'm furious, and I felt as soon as I heard it that it was a reporter who dissed our Pres.. Another lizard asked where was MSNBC - I'd not be surprised if an anti-Bush Iraqi newsman was given a pass by the MSM so this incident would occur, the way Code Pinkos are given passes to Congressional hearings to disrupt the action and steal the headlines.

In this case the magnificent headline of a status of forces agreement was very effectively buried by the shoe-thrower. The AP and pals are running joyfully with the ''Iraq Bush Hatred' meme as the final memory of Bush's accomplishment in the ME: al-Queda's butt humiliated and rejected in the heart of the Arab world, by Muslims.

Bush genuinely deserved this day of recognition. Not that the MSM would ever tolerate leading a news cycle with that enormously important headline. Heaven forbid those military-haters from leftist journalism academies might let the world discover that something great could emerge from a war.

It is literally unbelievable that the Secret Service was unable to intercept the first projectile and stop the attempt. Drudge reports that the President waved away his agents, but it seems that only occurred after the attack was completed. The only reasonable conclusion is that this incident was not unexpected, either by the Secret Service agents selected for this job, or by those who did the screening for this meeting.

As soon as this man BEGAN to remove his first shoe, the Secret Service should have been observed on the move. It's beyond comprehension how this entire scene transpired, in a room occupied by the two most important men in the US and Iraq, without some fancy footwork.
