Supreme Court Declines to Hear Nirther Conspiracy Cases (Again)

Two more “nirth certifikit” lawsuits brought by 9/11 Truther Philip Berg have been rejected by the Supreme Court.

WASHINGTON – Supreme Court Justice Anthony Kennedy has rejected two more efforts to get the court to consider whether President-elect Barack Obama is eligible to take office.

Kennedy on Wednesday denied without comment an appeal by Philip J. Berg, a Pennsylvania attorney, that claims Obama is either a citizen of Kenya or Indonesia and is ineligible to be president because he is not a “natural-born citizen” of the U.S. as required by the Constitution. Another appeal from California, based on Berg’s claims, also was denied.

I know you won’t listen, but it’s over, Nirthers. Time to move on.

My official stance on the Obama birth certificate issue is I don’t care. Thus, I haven’t really followed it closely enough to know if there is anything to it, but it does have the whiff of a conspiracy theory. Even if there is something to it, I think the rule that the president has to be a natural born citizen is stupid. What’s it supposed to protect against? Electing someone foreign who doesn’t have America’s interest’s at heart? If someone like that was about to get elected by the American people and the only thing stopping it was a little rule in the Constitution, we’re pretty much screwed already, as there are plenty of people without America’s best interests at heart who are natural born. Frankly, I’m for letting the American people elect whomever they feel like electing.

Furthermore, Obama was elected pretty resoundingly so, it doesn’t help conservatives to try to overturn that on some technicality. We actually have to win on the arguments one of these days.

You can call me a nirther because I would just like the Supremes to say, "We've seen a certified printed copy ourselves and yes he was born in the U.S. and yes everything is ok." I also would like voters to have to show a picture id (drivers license or state id - either requiring birth certificate to get the first time) in order to cut down on voter fraud. We voted it in in NM and the state government refused to do it because they say it is "unconstitutional." And now the Supremes have said that requiring photo ID is NOT unconstitutional. But they still refused to do it.

OR I'd like us to just open the borders, let everyone vote, get services, etc. without any limits. One or the other. Require all or none to follow the law. If I had to show a regular birth certificate to get a license and passport, so should he to be president if it is specified in the constitution. So instead of spending all this time rejecting these cases, they should just ask Mr. Obama for the one piece of paper and then tell us to stop worrying, it's all in order. It's like the outer limits.

Personally, I think it would have been in Mr. Obama's favor if he had released his college apps and a copy of the vault certificate. It would have removed this cloud entirely.

Also, why is the NOT an issue? I've heard ramblings on both sides, but have no coherent grasp of either side, mainly because I am indifferent.

I really don't think we need a Whitehouse scandal even before the guy gets sworn in. He's got enough facing him as it is.

I guess I'd like to know what is so far up their backsides that they are going to the SCOTUS, and I'd also like to know why they are being written off without them being heard.

Is the threat of riots and chaos reason enough to ignore such an important yet simple task to verify a President-Elects eligibility? Or do they need to wait until the Electors themselves fail to ensure his eligibility before the court can intervene? Either way, what *is* the process for challenging and then verifying an elects eligibility? This is something I think the SCOTUS should have acted on even if to rule him eligible, at least the issue would be heard and closed without question. Simply dismissing without hearing the case only fuels more rabid theories and furthers more dissent and distrust in the system...

We have a Constitution, let's use it...for the SCOTUS to ignore this is a monumental dereliction of their duties to uphold the Constitution. It may be bunk, it may be all for nothing, but at least they would have done their jobs...

I think I picked up on a thread here a while back when people were discussing the nuances of the "natural born citizen" law that even if he was born abroad he would still would be a citizen. I might have gotten that wrong, anyway the nirth certificate is another conspiracy theory not unlike that of the truthers and yes it gets annoying.

The Globe and Mail has obtained a 22-page declassified summary of the Project Spawn conclusions, which show the Mounties reviewed files from 2005 to 2007 and concluded that hundreds of people were suspected of involvement in smuggling during that time - 298 of whom were current or former airline employees.

Obama?Soetoro? is hiding something big. And calling all advocates of making him come clean 'nirthers' and 'kooks' is a huge generalization. Do take time to recall all the other things he's been less than forthcoming about before you start smearing thousands of sensible and reasonable people with your very broad brush.

Of course, Charles specifically singled out the folks pushing the birth certificate nonsense. . .he made that pretty clear in the article up top. In fact, he's posted several articles about other items Obama has been 'less than forthcoming about' over the past few months. He's not smearing the reasonable folks here.

You can call me a nirther because I would just like the Supremes to say, "We've seen a certified printed copy ourselves and yes he was born in the U.S. and yes everything is ok." I also would like voters to have to show a picture id (drivers license or state id - either requiring birth certificate to get the first time) in order to cut down on voter fraud. We voted it in in NM and the state government refused to do it because they say it is "unconstitutional." And now the Supremes have said that requiring photo ID is NOT unconstitutional. But they still refused to do it.

OR I'd like us to just open the borders, let everyone vote, get services, etc. without any limits. One or the other. Require all or none to follow the law. If I had to show a regular birth certificate to get a license and passport, so should he to be president if it is specified in the constitution. So instead of spending all this time rejecting these cases, they should just ask Mr. Obama for the one piece of paper and then tell us to stop worrying, it's all in order. It's like the outer limits.

I agree. If this part of the Constitution can be ignored just because people voted for the messiah, then what other parts can be ignored? I do not understand the attitude here about this. It is not that I do not like The One or that I did not vote for him, but it is the point and the precedent that matters. How hard is it for BHO to simply show his birth certificate? Or release the list of his campaign donors?

That is just a certificate of live birth. That is not a birth certificate. That CLB is given to people whose babies are born outside of the hospital.

We're the suckers? You're the one who believes Obama is ineligible to be President. Even the link you posted hints that, the semantic differences between not hearing a case and sending it to conference aside, it is unlikely to be heard by the Supreme Court.

You're engaged in a bout of wishful thinking, starboardhelm (and so is Berg, apparently). Fact is, the Supreme Court DID refuse the injunction. Fact is, there's an obvious lack of substance to Berg's case, given the readily available Obama birth certificate that has been verified by the State of Hawaii.
