Dead Horse / Modern Business
The tribal wisdom of the Dakota Indians, passed on from one generation to the next, says that when you discover you are riding a dead horse, the best strategy is to dismount.
However, in modern business, because of the heavy investment factors to be taken into consideration, often other strategies have to be tried with dead horses, including the following:
1. Buying a stronger whip.
2. Changing riders.
3. Threatening the horse with termination.
4. Appointing a committee to study the horse.
5. Arranging to visit other sites to see how they ride dead horses.
6. Lowering the standards so that dead horses can be included.
7. Appointing an intervention team to reanimate the dead horse.
8. Creating a training session to increase the riders load share.
9. Reclassifying the dead horse as living-impaired.
10. Changing the form so that it reads: “This horse is not dead.”
11. Hiring outside contractors to ride the dead horse.
12. Harnessing several dead horses together for increased speed.
13. Donating the dead horse to a recognized charity, thereby deducting its full original cost.
14. Providing additional funding to increase the horse’s performance.
15. Doing a time management study to see if the lighter riders would improve productivity.
16. Purchasing an after-market product to make dead horses run faster.
17. Declaring that a dead horse has lower overhead and therefore performs better.
18. Forming a quality focus group to find profitable uses for dead horses.
19. Rewriting the expected performance requirements for horses.
20. Promoting the dead horse to a supervisory position.

O’Rourke also encountered a very minor obstacle when he described the case as the second trial, a reference to the administrative review process already undertaken by the University of Colorado. Lane objected to O’Rourke’s characterization, insisting that defense counsel be clear that it was not a trial but a procedure conducted by an internal faculty committee. The judge overruled Lane's objection.
Yeah- don't let the jury know the U of CO found this man to be an utter fraud and that's why he lost his job and the only recourse he has is to invent a free speech violation. Good on the judge for not allowing churchill's lawyer to be a dick.

A top U.S. intelligence official says Iran does not have any highly enriched uranium, the fuel used to power a nuclear warhead.
[Link: www.haaretz.com...]
What are they talking about?
Simple. It's called conflating high enriched uranium and weapons grade uranium in all those earlier reports. Iran has high enriched uranium in sufficient quantities, but not weapons grade (above 90%). Iran needs time to process the high enriched uranium to make it weapons grade - the time depends on how efficient the Iranian centrifuges are.
The time frame for when Iran can achieve weapons grade is something of an open question - anywhere from 6 months to a couple of years. Since they're running the centrifuges and increasing their numbers, the time will be towards the near term.

Terrorist bombing in Sri Lanka.
And this time, it looks like the terrorists really were Hindus.
No. Really.
Y'know... instead of being... umm... somebody else.
This one stands out dramatically as a classic case of the exception helping to prove the rule.
http://www.iht.com/articles/2009/03/10/asia/lanka.php
COLOMBO: As the military in Sri Lanka pushed toward what it said would be a final victory over Tamil separatist fighters in the north, a suicide bomber in the south killed 14 people Tuesday and wounded 46 others, including a government minister, according to official reports.
The Defense Ministry's Web site said the bombing had struck a ceremony at a mosque 160 kilometers, or 100 miles, south of the capital, Colombo, and attributed it to the separatists, the Liberation Tigers of Tamil Eelam, or LTTE.More than 70,000 people have been killed since 1983 in the war for a separate homeland for the Tamil minority, mostly Hindu, which has been marginalized by governments dominated by the Sinhalese majority, which is Buddhist.
You'll note, however, that the Sri Lankan government (thuggy junta thought it may be) is on the verge of putting a stop to this once and for all. Like the less than warm-and-fuzzy military leadership in Algeria, it seems these folks understand perfectly well how to deal with terrorists. It was wonderful to see the word "annihilate" used in this story.
That's the answer, the only answer.
I doubt B. Hussein is listening.

In my state civil suits are most always tried by jury, and only a preponderance of evidence is necessary to decide, as opposed to a criminal trial where evidence must be beyond a reasonable doubt.

It depends on who is interpreting the data. Freeman, or someone who actually likes the US and Israel.
Actually, it might depend on what is meant by "fuel". Most agree Iran has enough low-enriched uranium to make a bomb, but only after it has been enriched further. I wouldn't be surprised to find that Iran has a secret enrichment operation to enrich enough to make a bomb.

Refresher from zombietime:
Between March 25 and March 28, Ward Churchill -- Professor of Ethnic Studies at the University of Colorado -- came to the San Francisco Bay Area and gave a series of speeches, primarily to discuss the controversy swirling around him, but also to promote his book On the Justice of Roosting Chickens: Reflections on the Consequences of U.S. Imperial Arrogance and Criminality. The first of these speeches took place on the evening of March 25 at The Women's Building in San Francisco's Mission District.

Not quite. He is claiming that his "controversial" viewpoints on several historical issues were "censored" by the university. Among these is his treatise on 9/11, but as I understand it, he also wrote something about a smallpox plague that annihilated some local Indian population as being a government covert operation or some malarkey.

And soon we'll all be out here on the reservation, living like Indians, and dressing like Indians, and doing all those simple, beautiful things you Indians do. Hey, got any peyote?

OT.
Wow! Saw this headline for a Howard Fineman piece on Obama. Gosh, I thought, they're starting to get the picture.
So in I jump, ready to hear Fineman's criticism of what's been going on. Ready to relish the role reversal of the reticent reporter! What fun!
Then I read this paragaraph:
Obama may be mistaking motion for progress, calling signals for a game plan. A busy, industrious overachiever, he likes to check off boxes on a long to-do list. A genial, amenable guy, he likes to appeal to every constituency, or at least not write off any. A beau ideal of Harvard Law, he can't wait to tackle extra-credit answers on the exam.
And I threw up in my mouth.

Am I correct in understanding that Churchill's case is based on his fake claims of Indian -- oops! Native American -- heritage being covered by the first amendment?
I don't know. But this reminds me of a dinner party I attended a while back, in which pretty much everyone in the room was a liberal except me. Someone mentioned a guy, let's call him Joe, who's married to a woman who fled Guatemala allegedly to avoid right-wing death squads. Apparently, Joe, who lives in Washington, DC, likes to say - without a hint of irony - that "I, too, am a political refugee."
Joe is a U.S. citizen, born and raised in California.
I laughed at this. One of the lefties tried to justify Joe's idiocy, saying, "well, you see, he really identifies with the refugees, so he feels justified in calling himself one." I replied, "and I've seen Schindler's List four times, but that doesn't make me a 'Holocaust survivor'. Words mean something."

Not quite. He is claiming that his "controversial" viewpoints on several historical issues were "censored" by the university. Among these is his treatise on 9/11, but as I understand it, he also wrote something about a smallpox plague that annihilated some local Indian population as being a government covert operation or some malarkey.
At that time, our military had access to otherwise unknown information about how to spread disease. A flux capacitor might have been involved.

In Canada, it's extremely rare (if ever?) that a civil suit is heard by a jury..from an article "The case for jury trials in civil suits:"
Any person charged with a criminal offence which carries a potential sentence of five years or more has the right to a jury trial under the Canadian Charter of Rights and Freedoms.
The Charter, however, is silent on the right to a jury trial in civil lawsuits.
Most civil lawsuits are tried by a judge without a jury.
The insurance industry, however, is fighting to have the right to a jury in serious personal injury trials declared a constitutional right.

RE# 46 Livefreeordie
If you look at any of these hyphenated studies departments they have almost no students in them. They fill their classes with underclassmen required to take some course designated to fill a "diversity" requirement in the core curriculum (which magically seem to only be in hyphenated studies departments). If Universities and Colleges are forced by this economic downturn to actually to some cost/benefit studies these "departments" are in deep trouble, they cost a ton of money (Chair, Full-time Profs, Full-time staff, etc.) taking a chunk of fixed cost (offices, classes, energy) with no or little return (tuition, fees, research monies).

The left mistake Liberty and Freedom for License.
Liberty is a two sided coin, on one side is Freedom on the other is Responsibility.
The left only looks for Freedom, and discards the Responsibility. The result is License, do what ever feels good in the moment without regard for ethics, truth, consequences or the liberty of others.

Correct. He's saying he was fired because of his politics, and that violates his free speech rights.
However, he was fired for academic misconduct (and it seems that there's not a form of academic misconduct he missed); that it took his politics to bring attention to the complaints of fabrication, plagiarism, misrepresenation and so on is neither here nor there.

FEMALE STUDENT #2: Because, well... we're not in a classroom! We're outdoors!
CHUTCH: Haven't you been listening? "Classrooms" are only cells in the big global prison run by The Man. The Man didn't build "buildings" to keep rain out, The Man built them to keep you in. See? That's why I'm holding today's rap lab outside, in the natural harmony of nature. It is the classroom of my people, the Arapazowee people. My desk is this grass, my chalkboard is this stick, my filmstrip is that sky.

Well I like some of the ideas he puts forth, but it could be because they are mostly smoke an mirrors.
Before he can do any of that, he'll have to get it by the Congress (and the NEA lobby). Then, since most of it is a form of encouragement to state governments, states would also have to buy in. And since a lot of states have been attempting to find ways around No Child Left Behind, that should be quite a feat.
Good luck with that.

Right. The remedy is to fire any other frauds of the same magnitude, if they can be found, not to bring Ward back in.
My university was one of several involved in a medical research misconduct case back in 2006 - the Jon Sudbø affair. At least that guy had enough shame not to sue the university after being found out.

Turn - thanks for recommend Taking Chance. I saw it last night - really well done. I urge all Lizards to see it if they have HBO.
Synopsis from HBO website
In April 2004, Lieutenant Colonel Michael Strobl, USMC, came across the name of 19-year-old Lance Corporal Chance Phelps, a young Marine who had been killed by hostile fire in Al Anbar Province, Iraq. Strobl, a Desert Storm veteran with 17 years of military service, requested that he be assigned for military escort duty to accompany Chance's remains to his family in Dubois, Wyo.Witnessing the spontaneous outpouring of support and respect for the fallen Marine - from the groundskeepers he passed along the road to the cargo handlers at the airport - Strobl was moved to capture the experience in his personal journal. His first-person account, which began as an official trip report, gives an insight into the military's policy of providing a uniformed escort for all casualties. The story became an Internet phenomenon when it was widely circulated throughout the military community and eventually reached the mainstream media.
'Taking Chance' chronicles one of the silent, virtually unseen journeys that takes place every day across the country, bearing witness to the fallen and all those who, literally and figuratively, carry them home. A uniquely non-political film about the war in Iraq, the film pays tribute to all of the men and women who have given their lives in military service as well as their families.

Interesting:
Citigroup CEO says bank operating at a profit
From the article:
Late last month, Citigroup and the Treasury Department agreed on a deal that will give the government up to a 36 percent stake in Citi. The government, along with other private investors, will convert some of their $45 billion in preferred stock into common shares. If the maximum amount of preferred stock is converted, current common stockholders will see their ownership stake fall to about 26 percent.
Question to our economic/business lizards: If stockholders see their stake fall to 26 percent, and see that the government is in the driver's seat, won't they tend to get the hell out?
I mean, if government can come up with something like the CRA for mortgages, might they not have the same "brilliant" idea for other forms of credit - like forcing companies like Citi to offer cards at low interest to the very same people who can't pay their mortgages now?
Oh wait, they probably already do that.

I suppose WC's advocacy of radicals getting haircuts and shaves, and donning suits and ties in order be more stealthy when carrying out targeted assassinations of cops, government officials and business leaders is likewise championed as constitutionally protected free speech, and a proper role for educators under the oppressive yoke of capitalism. Citigroup CEO says bank operating at a profit
Yah right. Same deal at BofA, they are "making a profit". Technically, this is correct, the problem is not in their operations but in their capital structure, thanks in large part to the "mark to market" rule.
The whole thing is madness. I'd say that neither bank is in any trouble at all - except that I'd say the same about Bear Stearns, Lehman Bros, and Merrrill Lynch, and each of those evaporated in one way or another, so maybe the trouble is real enough. Madness, I tell you. Vultures, vultures everywhere, be on your guard!

I made this point last night. My dad received an e-mail from somebody, which he forwarded on to everyone in his e-mail list. It was a copy of an article from some conservative web site, and the author had made a lot of really over-the-top statements--referring to Obama as a "foreign national" (showing he subscribed to the nerf certifikit nonsense), calling Abraham Lincoln a "criminal" and Bush 2 "ignorant" and "failed," taking thinly veiled digs at atheists and homosexuals, implying that the U.S. is a "Christian nation" and so on. I agreed with some of what he said but when common sense is surrounded by a lot of foaming-at-the-mouth ranting it is easy to miss or deliberately overlook.
We need representatives like Goldwater, Buckley, Reagan, who can present conservative principles in a calm, rational, yet passionate and persuasive manner. The facts are on our side ... why do we have to rant and rave? When you do that it makes people think you have no real argument.
Conservatives should just adapt Reagan's 1964 "A Time For Choosing" speech on behalf of Goldwater, and his 1975 CPAC speech "Let Them Go Their Own Way." These speeches perfectly encapsulate the conservative political/economic philosophy.

Yes, and unfortunately, too many insecure types on the right are allowing the Alinskyites to control their thinking about other conservatives; they swallow the line that collaborating in the polarizing and ostracising of the wittier, more incisive and more outspoken conservatives shows "good taste" or "thoughtfulness" and of course, that old favorite, lack of prejudice.

I was at Radio City last night to hear Coulter and Mahar. What a setup and what a farce. 90% of the "audience" were libs. The "moderator" was a lib. The questions were all liberal questions and talking points. And Coulter really has to get off evolution, religion, stem cell research and Jindal or it's gong to bury us all. I'll write more later when I get a chance and after I've taken another bottle of aleve.
She did score a few points when she spoke rationally. The point about not using Obama's middle name was a good one, but the stem cell comments about Nancy Reagan were over the top:
“Nancy Reagan was so madly in love with Ronald Reagan,” Coulter said, “if you told her that we could bring Ronald Reagan back to life, cure Alzheimer’s by disemboweling everyone in this audience, she would say ‘do it.’”

She

2) By agreeing to the ridiculous format where ALL the questions are Liberal
questions, she doomed the format from the get go.
3) She, and Bill Mahar for that matter, really should take a few remedial science
classes before they start discussing stem cell research and/or evolution.

This is going to be an interesting case. As usual, all the jurors who were willing to come forward and voice any thoughts, observations, or responses to the inquiries of the contending lawyers have been stricken from the case.
But going to the legal arguments---which are maybe irrelevant because anybody who can parse them has been thrown off the jury---this "causation" argument is fascinating. In the real world, events don't often have a single cause.
The ultimate cause of Churchill getting fired is that he wrote his Little Eichmann essay. But wait: from the point of view of the University, the cause is that third parties provided to the University information pointing to fraud and plagiarism. Why they provided this to the U. is no concern of the U. It's verifiable. I can be checked; indeed, it would be grossly irresponsible to ignore the matter. So the U. investigated, and it deemed the evidence sufficient to warrant firing. U. rules specify that plagiarism etc. are grounds for firing.
And now the lawyers for Churchill get their case going: look at all the other frauds and plagiarists on faculties here and there. They get a pass. The matter is proven, but U. committees look the other way and the storm blows over. Rules are disregarded. Why, then, did C.U. dismiss Ward Churchill over matters that by gentlemen's agreement do not apply to affirmative action hires? Because, of course, of the Little Eichmann flap.
And C.U. counters, that's not us. We weren't ever part of any such gentlemen's agreement, if any such thing exists. We have our rules, and they apply to everyone. Show us, then, another fraud and plagiarist on OUR OWN faculty, a cheat on the scale of Ward, who was proved to be such, and nevertheless kept on!
Now Ward's lawyers have a problem. They might win their case for Ward, but it would be a Pyrrhic victory. They'd have to produce another such professor, ruin him, and ruin Ward's reputation by conceding that yeah, he is a fraud and a plagiarist but he's been treated differently from others of his stripe. All that, to maybe win this case at trial.
