The Justice Department says they will no longer describe the detainees at Guantanamo Bay as “enemy combatants.”

WASHINGTON (AP) - The Obama administration is abandoning one of President George W. Bush’s key phrases in the war on terrorism: enemy combatant.

In court filings Friday, the Justice Department said it will no longer use the term to justify holding prisoners at Guantanamo Bay.

No, "scumbags" is the accurate term, but I believe that labeling someone and "enemy combatant" confers a particular status that carries with it certain rights, or in the alternative, specifically does not confer certain rights. It is probably the later of the two if Bush called em' that, and Bambi is reversing. Not a national security lawyer, so my comment is about as worthless as anything these days.

Where to begin with this. This is a little like rearranging deck chairs on the Titanic:

Obama is willingly giving away his power as Commander in Chief to Congress? The authority to hold prisoners comes from US Constitution and the powers vested therein, and not from international law. Congress authorized the use of military force, and it is up to the President to prosecute the war. Obama is opting out of the prisoner phase? Asinine.

Bush had argued that the president as commander in chief could unilaterally hold prisoners without charge.

Obama still hasn't defined what he intends to do with those terrorists still held in our custody. He says he wants to close Gitmo, but provides no alternatives, leaving the only real option release back into the wilds where these terrorists can go on with their deadly business while Obama's fellow leftists can pat each other on the back for how evolved and civilized they are for following the Europeans down the primrose path.

The Justice Department says prisoners can only be detained if their support for al-Qaida or the Taliban was "substantial."

And how exactly are we going to define substantial? Captured on the battlefield by US forces as these terrorists are firing at us isn't substantial enough? Captured while in the presence of other terrorists isn't sufficient? What exactly is sufficient?

OT - New Yorker Accused of Beheading Wife in Honor Killing Pleads Not Guilty

The founder of a Muslim-American television channel has pleaded not guilty to murder in the beheading of his wife.

Muzzammil Hassan is charged with second-degree murder for the Feb. 12 death of his wife, Aasiya, at the offices of Bridges TV in the Buffalo suburb of Orchard Park.

I think there's some legal nuance here. He's vowed to close Gitmo (as did McCain) so this isn't really a surprise. I think just just halts the court cases of the detainees challenging their detention.

The copy editor who composed the article may not have gotten the intended meaning right, or complete.

But it strikes me that "authority comes from Congress" may refer to some sort of anti-Bush anti-Establishment concept that "War" was never "Declared."

What really bugs me is how self-indulgent all this is. Obama and his ilk just seem to want to make these ridiculous changes because it, personally, makes them feel all warm and cozy. The fact that it solves nothing and makes us look like spineless idiots is beside the point - liberals get to feel good about themselves, and that's all that really matters. It's like a discussion I had with a now former friend about Bush's pre-emptive doctrine - my friend's position was that it was better to let Iran or North Korea nuke Los Angeles rather than invade first, because we "need a reason" to respond and that "America should never start wars." It was more important for my friend to feel good about himself than for Americans to be safe. Naturally, he did not live in Los Angeles. By the same token, the liberals making these idiotic decisions will never be personally affected by the consequences. They get to walk around all smug while someone else pays the price.

Khawaja jailed 10½ years

The first Canadian charged under the new Criminal Code provisions of the Anti-terrorism Act has been sentenced to an additional 10½ years in prison for his role in helping a group of Islamic extremists plot to bomb London nightclubs and other targets in 2004.

In an Ottawa courtroom yesterday, Ontario Superior Court Justice Douglas Rutherford sentenced Mohammed Momin Khawaja, 29, to spend another 10½ years spread over convictions on seven charges, on top of the five years he has already spent in prison awaiting trial and sentencing.

Note this interesting detail:

Judge Rutherford also chastised Khawaja's parents, who submitted written statements before sentencing that painted "a normal family situation," the judge said. "There was no mention of the array of military style rifles, the crates of ammunition, the other weapons, the projectile-pocked human target on the basement wall [of the family's Ottawa-area home] ... It is impossible to think that the other members of the family were oblivious to Momin's preoccupation with and proclivity to participate in violent jihad."

It appears that way - and more to the point, he's claiming international law forces him to do this. How does this supposed constitutional law professor make that asinine leap? The US Constitution governs what the powers of the President are - and warmaking is a key one. It doesn't cede those powers to the Congress precisely because Congress can't generally agree on anything the way a solitary voice of a commander in chief can. In fact, the Constitution is explicit:

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any subject relating to the Duties of their respective Offices, and he shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.

Congress only has the power of the purse and to declare war. Once war is declared (and in the case of Iraq and Afghanistan the AUMF is sufficient), it's the President's ball game.

Obama is busy redefining what the war power is - and he's defining it to severely limit what the President can do - to appear as though he's completely unlike Bush. Of course, keep in mind that should the US be attacked again, or war declared against us (again), Obama or any following president will treat Obama's limitations like so many copies of the NYT - bird cage liner.

Enemy Combatant is a legal term that has definite meaning in a warzone and definition under the Geneva Convention. I will not attempt to describe what this is being a non lawyer but i am sure the legal contrubutors will be able to tell us what it means. Obama is busy redefining what the war power is - and he's defining it to severely limit what the President can do - to appear as though he's completely unlike Bush. But for now, it makes his moonbat follower happy, thats why he does it.

For a lawyer, the legal strategy of shifting the justification for detention from inherent powers of a sovereign nation making war to nebulous and legally challengeable legislative power is beyond stupid.

But truthfully, I blame Bush. He had the chance in early 2002 to hold summary trials and hang these miscopulated spawn of regurgitated dog feces and he did not do it. Anyone in Afghanistan in late 2001 was guilty Taliban support, extreme stupidity or a certified human rights worker. The human rights workers were a very short the list. Certainly anyone who had taken up arms should have been gone five years ago.

Perhaps President Obama can appoint Khalid Sheikh Mohammed to Represent US interests at the upcoming Durban II meeting; he is, in most regards, more loyal and dedicated to the American cause than his lawyers and the members of the administration seeking to turn 911 into a law enforcement issue.

The forces of law enforcement are not meant to fight pirates and illegal organizations making war against the nation. Trials are lovely things for people whose conduct fall somewhere within human normative behavior.

This is a twisting of the notion of justice and law.

It is guaranteed to do one thing: encourage our enemies to attack us again. There is no downside. Go to court. Turn your trial into a circus. Encourage like minded filth to also attack. Good for them. Bad for us.

This is why liberals should not be consulted on matters of national security. People are going to die as result of this stupid decision.

Not all of it, and the GOP majority would have to gear up for 2 ugly years of sending legislation to the WH to get vetoed and then have override fights.

If the GOP got congress back, they would also have to decide to not go hard core socio/religio con in choosing which bills to approve. I don't have a lot of faith in their ability to avoid that, unfortunately. Boy would I love to have them prove me wrong!

Hopefully they could save the parks that are still decent and profitable. The one in Atlanta needs to close. A couple of years ago some of their gang-banger employees beat another teenager to death (or near death...can't remember) in the parking lot. I believe the kid they hurt/killed wasn't gang affiliated, but they didn't like the way he looked or something. The park in NJ had a fabulous drive-through "zoo" with really neat animals, etc. We loved that, but would never go to the amusement side of the park. Hershey Park was a long drive, but it was clean, decent, and very family friendly.

Yup we're only 30 minutes away and have gone once in the last 14 years. Big mistake. If we have the money to plop down $40 a person for a visit we'll drive to Orlando first thank you very much. They need to get some security, sweep the drugs and the thugs from their gates and put in some family friendly acts.

Bates asked the administration to give its definition of whom the United States may hold as an "enemy combatant."

The filing back's Bush's stance on the authority to hold detainees, even if they were not captured on the battlefield in the course of hostilities. In their lawsuits, detainees have argued that only those who directly participated in hostilities should be held."

The Department of Speech will fill the long standing need to provide a central repository for all correct terms.
