Rescind John Murtha’s Award from the Navy

Our outrage of the morning: the Department of the Navy has given Congressman John Murtha a “Distinguished Service” award. Yes, that’s the same John Murtha who accused the Haditha Marines of being murderers without evidence, before their trial, then refused to apologize when all charges against them were dropped.

Here’s a petition to try to reverse this utterly unmerited award: Don’t Honor John Murtha Petition.

To:  Secretary of the Navy

On March 5, 2009 Congressman John Murtha was awarded the Department of the Navy Distinguished Public Service Award by the Secretary of the Navy, Donald C. Winter. From the press release: It is the highest form of public service recognition bestowed by the Department of the Navy for a non-employee. According to the Department, nominations for this award will be limited to those extraordinary cases where individuals have demonstrated exceptionally outstanding service of substantial and long term benefit to the Navy, Marine Corps, or as Department of the Navy as a whole.

The Citation reads:
Congressman Murtha’s selfless devotion to the Nation’s Sailors and Marines ensured they were provided the resources necessary to effectively conduct the Global War on Terrorism. His courageous leadership, vision, and loyalty to the men and women of the Department of the Navy greatly contributed to their quality of life and helped create the most modern and highly trained fighting force in history. As Chairman of Subcommittee on Defense of the House Appropriations Committee, Congressman Murtha’s tireless advocacy helped maintain the Navy and Marine Corps team at the highest levels of combat readiness to meet the challenges of the 21st century. With grateful appreciation for his outstanding contributions to the Nation and the Navy and Marine Corps, Congressman Murtha is awarded the Department of the Navy Distinguished Public Service Award.

John Murtha deserves no such award. He has routinely and deliberately undermined the United States military, slandered servicemen serving in combat, and caused irreparable damage to our international reputation. While serving as a Representative from Pennsylvania, Murtha called Marines from 3d Battalion, 1st Marines “cold blooded killers” who “murdered innocent civilians.” Before an investigation into the Haditha incident was even conducted, Murtha went on numerous television news programs and announced that the Marines “went into houses and killed women and children.” He said, “There’s no question in my mind about what happened here. There was no gunfire, they killed four people in a taxi…24 people were killed.” When asked specifically if he claimed that innocent civilians were intentionally executed by Marines, he said, “That’s exactly what happened.” Not content to slander those Marines directly involved, he went on to claim that if these Marines were not punished, “other Marines would say well I’ll do the same thing.” Murtha then continued to use this incident to lobby for the immediate withdrawal of troops from Iraq, citing it as evidence that our military was incapable of winning the war.

Eight Marines were originally charged. As of March 17th, 2009 all charges were dropped against six Marines, one was found not guilty on all counts in courts martial. The prosecution has delayed the court martial of the final defendant indefinitely. The original allegations of a massacre and the statements of Congressman Murtha have been thoroughly discredited. Despite the facts, John Murtha refuses to apologize to those he slandered.

We the undersigned are appalled that the Secretary of the Navy would bestow the Department’s highest award for a non-employee to John Murtha after his vile and despicable attacks against U.S. servicemen. This petition is a vehicle to express our bitter disappointment at this betrayal of our combat veterans. Congressman John Murtha should apologize for slandering the Marines of 3/1, and for undermining the efforts of those servicemen and women who fought in Iraq. If he does not, the Secretary of the Navy should rescind this award as a sign of his unwavering support for those who served in combat during Operation Iraqi Freedom.

John Fucking Murtha deserves to be CENSURED for trying and convicting those active duty Marines in the Media, using the weight of his own experience and Congressional Office, to do so.
That they were all found not guilty certainly should qualify Murtha for a Congressional Censure, not a damn medal.

They’ll turn a blind eye to Murtha’s malevolent actions that were outright criminal - indicting, convicting, and sentencing the Haditha Marines in the court of public opinion without the slightest bit of evidence) because they’ve considered the importance of getting approvals.

The sad thing is that the Navy will end up getting screwed regardless because the Administration will find reason to cut Defense spending regardless of how much the Navy and the DoD in general tries to make its case.

I really do despair when it seems like so many of this country’s citizens are perfectly comfortable with traitors like Murtha. Comfortable enough to re-elect him after his Haditha infamy, not to mention calling his own constituents racists.
Add to that Harry Reid’s giving aid and comfort to the enemy with his ‘The War is lost’ proclamations. Add Dick Durbin’s comparisons of our miltary to Nazi’s and Pol Pot…..
Shall I go on?
I will continue to do my small part in fighting this lunacy but I do despair in the face of this. That old saying of getting the government you deserve is unfortunately seeming to come true. Not for those of us here, but when 52% of us think this is ok the rest of us get dragged along.
I’m just an old Army grunt but I do believe in and admire the spirit of Semper Fi.

Petition signed. We should not be rewarding selfish behavior and failure in leadership, as has been demonstrated by Mr. Murtha. Just because his current profession resides in the epicenter of that cultural norm, does not excuse him sufficiently to reward him.

If anything they should be providing a simple plaque with a bloody dagger and text reading “World’s Greatest Back Stabber”, and a note saying he needs to step up his game, as he will be getting some real competition from Obama in 2009.

Good question. I hope the Republicans in Congress have the stones, but I’m just not sure. I think if I were one of those at AIG receiving the bonus, I’d probably have done what many did - voluntarily return it.

However, if I were one of these folks, and I ended up singled out for this kind of treatment, I might consider suing - just on principle.

All for show, they screwed up big time and they know it. There is no way any judge would allow that to stand at trial, even a LLL judge. There are way too many constitutional issues with it.

What they can and most likely will do, is make a law for future bonuses.

Oh and here in CT, Dodd is toast. He might as well pack his bags and come back to his billion dollar cottage on the lake. Expect him to try and do the most damage he can in the next year and a half before he gets booted out.

It’s hard to believe a Colonel in the Marines (and an Eagle Scout to boot) could turn out the way Murtha has. Apparently none of the lessons of honor, honesty and duty soaked into his brain.

After all, there was nothing illegal about the bonuses. They were included in contracts before the bailout. The Fed knew about them. Geithner as head of the NY Fed, and architect of the bailout knew, or should have known, they were in there.

Now, after the fact, Congress wants to pass legislation taxing these people.

Sounds ex post facto to me, but I’m not a lawyer.

It does look like - at least at this juncture - there is precedent for upholding retroactive legislation regarding the tax statutes.

A contributing factor was that during the pre-war years miltary budgets were so tight that test firing of torpedoes was prohibitively expensive and thus discouraged. Those test firings would have uncovered the deficiencies of the American Mark XIII torpedo - which led to many American lives lost for no gain since the torpedoes were notorious for failing to explode even when they hit their target.
By contrast the Japanese “Long Lance” 24” torpedo was one of the most effective and devastating weapons of WWII.
More information than you probably wanted to know…..but underlines your point and further illustrates that tight fistedness with peacetime defense dollars is done at our peril. And I’ll give you one guess as to who was in charge of the purse strings during this pre-war period…….

Crap. It looks like you may be right. Took a look, and here’s just two snippets from Blackmun’s opinion in Carlton:

This Court repeatedly has upheld retroactive tax legislation against a due process challenge. See, e. g., United States v. Hemme, 476 U.S. 558 (1986); United States v. Darusmont, 449 U.S. 292 (1981); Welch v. Henry, 305 U.S. 134 (1938); United States v. Hudson, 299 U.S. 498 (1937); Milliken v. United States, 283 U.S. 15 (1931); Cooper v. United States, 280 U.S. 409 (1930).

And:

The due process standard to be applied to tax statutes with retroactive effect, therefore, is the same as that generally applicable to retroactive economic legislation:

“Provided that the retroactive application of a statute is supported by a legitimate legislative purpose furthered by rational means, judgments about the wisdom of such legislation remain within the exclusive province of the legislative and executive branches … .

It does look like - at least at this juncture - there is precedent for upholding retroactive legislation regarding the tax statutes.

It is - courts do tend to look for precedents, unfortunately.

Frankly, I didn’t think this sort of retroactive tax legislation had already happened before - a lot of the splutterings in Congress makes sense now, unfortunately.

I just signed it, the numbers were jumping every time I refreshed. I called his office early on in the scandal. As a combat vet from Afghanistan and a former Marine I was pretty irritated by the whole thing. I was respectful in tone and asked if an apology was forthcoming. His staffer was arrogant and condescending in tone, and quickly became confrontational. He of course refused to acknowledge any possible wrongdoing on the part of his boss. Murtha is corrupt and without honor. Obscene.
