Ward Churchill Wins, Awarded Princely Sum

Ward Churchill has won his lawsuit against the University of Colorado: Churchill Snatches Victory From The Slack-Jaws of CU.

The jury has reached its verdict: The University of Colorado at Boulder improperly fired Ethnics Studies professor Ward Churchill; the jury awards Churchill One Dollar in damages.

Since we’ve made no effort to hide our contempt for CU attorney Patrick O’Rourke’s mishandling of his defense of CU, it should come as no surprise to our readers that we now lay CU’s defeat directly at O’Rourke’s clown shoes. Churchill did not win this case; O’Rourke lost it. And since all problems can be traced back to management, CU is the ultimate perpetrator of this four-year (some would say 20-year) farce.

I have been listening to Caplis and Silverman, two local CO talk show guys who have given listeners a ton of info about Churchill over the years. Including audio that most people have never heard. (way beyond the 9/11/ little Eichmann essay) anyway - Caplis and Silverman are very restrained in their criticism of O’Rourke. but I can tell they want to lay into him. (they wont’)
So, in comparison, PB (Pirate Ballerina) is harsh. Really harsh. But I tend to agree.

A juror was just on the radio. That’s not quite true. The juror said that David lane, Churchill’s lawyer, really didn’t spend barely any time on discussing money.

Lane didn’t even mention money until closing arguments, and he sort fo blew it off with a statement (paraphrase) “Is this worth a dollar or 25 million, that’s up to you” but he didn’t give them any details on how they could gauge the amount.

The juror said that 5 of the 6 jurors wanted to award the 25 million, but the 6th juror convince them there wasn’t enough instructions and information from Lane for them to make that decision, so they went with the dollar.

A juror was just on the radio. That’s not quite true. The juror said that David lane, Churchill’s lawyer, really didn’t spend barely any time on discussing money.

Lane didn’t even mention money until closing arguments, and he sort fo blew it off with a statement (paraphrase) “Is this worth a dollar or 25 million, that’s up to you” but he didn’t give them any details on how they could gauge the amount.

The juror said that 5 of the 6 jurors wanted to award the 25 million, but the 6th juror convince them there wasn’t enough instructions and information from Lane for them to make that decision, so they went with the dollar.

That doesn’t make any sense. the vast majority of the jury was for $25 Million and since the defense lawyer wasn’t cogent enough they went for a buck?

Which, by the way, I rented recently just to see what it was about. It’s an extremely bizarre movie, almost pornographic in its depiction of violence, and yes, I think it is arguably antisemitic.

The lawyer didn’t prove up his damages. That’s required as a matter of law. What puzzles me about this assertion is that there’s a lot of space between $1 and $25 million. It doesn’t ring true that the jury was thinking only about one number or the other. If they went with $1 instead of $25 million, they weren’t exactly fired up about a big number.

Income tax will claim anywhere from 12% to 33% of it, leaving $0.67-0.88.

But in order to comply with the law (right, as if he cares about that), it’ll cost him more in his time, or someone else’s time, to fill out the declaration paperwork properly.

So, in the end, it still costs him.

Of course, CU probably still has to pay his attorney’s fees.

Yes it does. I was on a jury of eight deciding on a 16 year old male anal rape of a 14 year old male, in the county detention.

It was evident that the boy did it, but the state screwed up the paperwork and the investigation so big time (didn’t even spell the kids name right) that we had to let him go.

It was 7 to convict until I pointed out that the state screwed up and legal protocol was not followed. The 7 changed their mind.

Same thing happened here.

And I have heard the audio from the courtroom for the last month. Lane did not take his time and instruct the jury on the money.

I’m just relating fact, not opinion.

If the verdict stands, CU will have to pay Churchill’s legal fees and Lane says that could be hundreds of thousands of dollars.

The judge will now decide whether Churchill will return and begin teaching at CU again. His attorney, David Lane, says that is what Churchill wants. Lane says if CU opposes, there will be a hearing.

CU says it will oppose his return to the classroom, but wouldn’t provide specifics.

Lane says the judge has no choice but to let Churchill teach again at CU. Lane says if Churchill is reinstated and CU doesn’t give him back something equivalent to his old job, that would be grounds for another lawsuit.

I thought “Passion” excessively violent. All of Gibson’s stuff is excessively violent, however. I think he equates violence with passion. The movie had a lot of Gibson in it, and a lot less of Jesus.

By way of example, in the flogging scene, the Roman soldiers strike Jesus with a scourge (a whip with pieces of jagged metal embedded in it to tear flesh) approximately sixty (60) times. In real life, ten (10) strokes would cause unconsciousness. Thirty (30) would cause death. Yet Gibson’s Jesus remains conscious throughout, and is able to continue through to the crucifixion. Superhuman? Or exaggerated violence?

Many Christians found the movie uplifting. It was a bestseller at the box office. Gibson sold the story that he was blacklisted by Hollywood for trying to make a movie about Jesus, creating the impression that he’s a conservative. In fact, Gibson is a Democrat.

The U.S. House passed a $3.55 trillion budget blueprint that would clear that way for President Barack Obama’s major policy initiatives but which saw heavy criticism from Republicans for expanding the reach of the federal government.

The resolution would set funding levels for fiscal year 2010, which begins October 1. The bill contains slightly less spending than Obama’s $3.6 billion budget blueprint.

The House passed its version of the budget resolution by a 233-196 vote. No Republicans voted for the resolution.

And yes, if you watch Maher’s movie “Religulous,” he certainly does criticize other religions, including Islam.

People might get frustrated with the bailouts and stimulus spending but I don’t see a lot of people gravitating towards to alternative of letting the economy crumble. My apologies if my comments made you think that I was suggesting you’d use force. I agree it’s a matter of private advocacy. However- I think the “decline in morals” that you mention has more to do with a lack of personal responsibility on the part of the people. Preventing people from reaping the consequences of their decisions is harmful.

I spent over twenty years there and that time included a visit to the local civil justice system that culminated in a large award against my Company (evil corporation) brought by a small businessman who knew the turf well. Zero fault on our part met with zero sympathy from the super lib judge who admonished us thus: “while not directly responsible you, by virtue of having visited the plaintiff’s site, should have seen the problem and thus were obligated to make the complainant aware of the issue and you were thus compelled to have taken steps to repair the problem.” Huh?

The banks need to be saved. We can’t have an economic recovery without them. The TARP thing seems to be working ok so far. There will be some government regulations regarding hedge funds, and the uptick rule (about shorting stocks) is going to be put back in place soon. I’d also like to see us break up the huge banks. The world economy depends on about a dozen companies. I’d like to see that spread out to something like 100 so next time this happens we can let 20-30 of them go bust without crashing the economy.

But governmentally, it can be dealt with secularly. Failure is not always a bad thing- important lessons can be learned from it. I see too much prevention of failure occurring, whether it’s in schools or businesses. Take Killgore’s comments for example. I might agree that some stimulus is alright, but I do feel the democrats have gone too far. Some of these poorly run businesses should have to file bankruptcy. Bailing them out is only going to continue bad management instead of providing a learning opportunity to doing their business in a better manner. We learn from failure, and leftists work too hard at preventing it altogether.

They’ve got to do better than that!

Beck is slotted into a time that Fox has always had a problem with ratings. Basically I think he’s there just to fill up the space and try to generate ANY ad revenue. But governmentally, it can be dealt with secularly. Failure is not always a bad thing- important lessons can be learned from it. I see too much prevention of failure occurring, whether it’s in schools or businesses. Take Killgore’s comments for example. I might agree that some stimulus is alright, but I do feel the democrats have gone too far. Some of these poorly run businesses should have to file bankruptcy. Bailing them out is only going to continue bad management instead of providing a learning opportunity to doing their business in a better manner. We learn from failure, and leftists work too hard at preventing it altogether.

The banks need to be saved. We can’t have an economic recovery without them. The TARP thing seems to be working ok so far. There will be some government regulations regarding hedge funds, and the uptick rule (about shorting stocks) is going to be put back in place soon. I’d also like to see us break up the huge banks. The world economy depends on about a dozen companies. I’d like to see that spread out to something like 100 so next time this happens we can let 20-30 of them go bust without crashing the economy.


What difference will it make if the banks are still forced to make crappy loans through political coercion? Do we have any guarantee that the policies that led to this failure won’t be repeated?

No, I can’t say I have had that impression. But then, power is a mighty elixer, based on what I am seeing in government circles. The biggest impression I get is that truthers are in a conspiracy frenzy, the present one greater than the last, and that it seems that all conspiracy theories eventually end up in anti-Semitism.

There is one over-arching theme in the Old Testament: Israel is close to God, God blesses Israel. Israel moves away from God, God allows Israel to be persecuted, plunged into civil war, and eventually destroyed and scattered. This cycle, which is laid out quite clearly in the 2 Chronicles, is also presented in microcosm, many, many times throughout, through the histories of individuals. God works through history, and uses nations, even nations which are decidedly NOT Godly, such as Assyria and Babylon and Egypt, to do those things which he has promised again and again.

God has not changed. When his people (Christians, Jews) follow Him, the WHOLE LAND is blessed, and vice versa.

Also, these laws were in effect for the first couple hundred years of America.
Also, these laws are in effect on the community level. And on the family level. And on the personal level.

I think this may be what albusteve is getting at.

Now I’ve seen it, and I agree with the critics that it was a terrible movie from many perspectives. Grotesquely ultra-violent in a way that made me feel like I needed a shower. It was manipulative, gross, and as I said, arguably antisemitic — which means that it’s not clearly antisemitic, but a good case can be made that it is.

However, I’ve heard many atheists suggest that religion is the cause of all wars and evil in the world. That’s obviously ridiculous.

Also, the movement to remove “under God” from the Pledge of Allegiance and “In God We Trust” from our currency is an insane waste of time.

You won’t ever see me calling some leader or other “the AC”, like hundreds of churches taught about Gorbochev, Reagan, and even, yes, GW Bush. I know people who seriously thought that, and were told that, by their left-leaning churches. I don’t read the end-times books, since they all say something different, and all claim to be experts on the matter. I just keep my eyes open, or I try to.

It was manipulative, gross, and as I said, arguably antisemitic — which means that it’s not clearly antisemitic, but a good case can be made that it is.

Seems to be at the moment. I had another crown done but they did a root canal for that one. The one that hurts was just put atop the existing tooth without much work. Comfort Dental did that no less. I consider them the Just Brakes of dentistry.

Purely as a matter of numbers, there are definitely more immoral “Christians” than immoral atheists. That’s because there are more persons who self-identify as Christians than self-identify as atheists.

But if morality is defined by norms, as I believe it is, then norms (i.e., “Thou shalt not murder.”) are rooted in religion. Can an atheist adhere to religious norms? Certainly. But why should he? Norms are religious values. By definition, an atheist doesn’t believe in religion.

If the atheist’s reference for norms is to a legal system, then the legislature can change legal “norms” overnight. It can go from tolerance for Jews to outlawing Judaism. “There arose a Pharaoh who knew not Joseph.”

Judging groups (Christians or atheists) by their conduct is a valid way to compare them. But if Christians are indistinguishable from atheists (because they’re no better in the way they conduct themselves), they’re very poor Christians indeed.

I understand what you’re saying and don’t really disagree with you. However, a center party by definition has no (or little) founding principles. It stands for nothing. IMHO we don’t have enough delineation between our political parties, we need more contrast, not less. And we need at least one party to stand for limited government (and particularly limited governmental power), and make that principle stick. That isn’t going to be the Democrat party of Obama. The Republicans need to get a set of principles that appeal to right minded people, not just people on the right. They need to stand for things that will motivate voters to get out to the polls. And they especially need to grow a spine.

I know some people who were either atheists or agnostics who, when left to travel their spiritual path on their own through the course of their life, came back to God (for lack of a better term). Whether it was an experience with death, or the birth of a child, or something else. It one of the reasons I get uncomfortable with people pushing religion even privately in their personal time. People seeking a better relationship/understanding with God will do so on their own, in my experience. Pushing them causes backlash.

What a wonderful thing for my alma mater to hire an attorney capable of screwing up the school’s defense against a former professor that so obviously deserved his termination. He may have received a laughable compensation, but it appears entirely possible now that he will get his job back. If that actually occurs, I doubt I can stomach sending any of my four kids (three of them in high school right now) to that place. Great, just great. I hope other alumni feel the same way.

I also don’t think I can support anything going on at that school, including the football team I love to follow. A sad day in my book.

Good analogy. See the dentist. I had an ill fitted crown that I thought I would get used do…not, even after several weeks of pain. The crown needs reworked. When mine was redone (filed down) the agony was done with immediately.

Also, the movement to remove “under God” from the Pledge of Allegiance and “In God We Trust” from our currency is an insane waste of time.

As the daughter of a Biblical translator (he’s an ancient Greek expert), my counsel is to do some research into Biblical translation and the origins of the texts used. It is unwise, IMHO, to take some of these ‘end of days’ texts literally.

My belief in G-d is integral to who I am and I do try to live by example, although I know that I shall fail at times because I am human and therefore fallible. I don’t believe in a G-d who would destroy what He has created.

Hey Lizards! As I’ve said before I hit the parent jackpot when I was born. Just got a call from my 75 year old mom who was so excited she sounded 15. They had a CD mature and had wondered what to do with the money. Mom said since Obama is in charge, she doesn’t feel good about reinvesting. So, they bought a Segway for one of our wounded heros. She just got a call from Segs4Vets and invited to Walter Reed to see their Vet receive his Segway, learn to use it and meet his family. They are also going to be treated to dinner at Ruth Chris Steakhouse with the Vet and his family. Dad (decorated combat vet of Korea) got on the phone and got choked up. He said “Kid, we didn’t do this to be thanked, I just don’t know if we should go.” I assured him and mother that indeed they should go and enjoy. They’ve never been to DC before.

Perhaps, but the entertainment industry is not and they have much influence. They despise Judeo-Christain values (makes them feel bad). EXODUS and FIDDLER ON THE ROOF are never shown on TV. Amazing Grace, the historically accurate film about a white Christian abolitionist who gave up gambling and drinking, converted to Christianity and abolished the slave trade in GB, was one of the best of it’s kind ever made. It didn’t get a mention at the academy awards and was in theaters for only a couple of weeks. Munich, (historical fiction that is sympathetic to the terrorists) on the other hand, gets a best picture nomination.

CU dwelling on Churchill’s outrageous remarks would have further convinced the jury that CU’s firing of Churchill was motivated by those remarks rather than by outrage at his plagiarism, his unethical ghostwriting practices, and his historical fraud.

In physics class in our spare time, we tried to define an equation that stated the proportionate amounts of money needed to invest to get love and devotion from the other sex. So some bright patootie sparks up and tries to separate them into two separate equations .. one for women and one for gay men.

We got several plausible equation possibilities but no solution.

Hey Lizards! As I’ve said before I hit the parent jackpot when I was born. Just got a call from my 75 year old mom who was so excited she sounded 15. They had a CD mature and had wondered what to do with the money. Mom said since Obama is in charge, she doesn’t feel good about reinvesting. So, they bought a Segway for one of our wounded heros. She just got a call from Segs4Vets and invited to Walter Reed to see their Vet receive his Segway, learn to use it and meet his family. They are also going to be treated to dinner at Ruth Chris Steakhouse with the Vet and his family. Dad (decorated combat vet of Korea) got on the phone and got choked up. He said “Kid, we didn’t do this to be thanked, I just don’t know if we should go.” I assured him and mother that indeed they should go and enjoy. They’ve never been to DC before.

One thought on the Ward Churchill trial. Maybe the university threw the fight. The administration probably has the usual leftist orientation, but felt the political pressure strongly enough that they had to give Ward the boot. Now, however, they can point to the court decision as proof that they have to reinstate him with full honors, backpay, etc. We didn’t want to, but the court made us do it.

I think they presented a half-hearted defense for a simple reason — a full-throated defense would mean going to war against most of their race/gender/literature departments.

If they pounded his lack of scholarship and dearth of evidence behind his “work”, they would be holding him to a standard that many in their humanities departments cannot meet. It would fundamentally change the admin vs. faculty relationship forever. Many of them would see that they could be fired too, and would preemptively undermine the faculty from this day forward.

It would come down to a question — “Who runs the school?” And the faculty were afraid to find out.

Other than turning off the media, I’m not sure what sort of solution there is to this problem. I don’t support hollywood. I see very few movies, and when I do, they tend to be children’s films because I find them more entertaining and better written. I think too many adult movies are simplistic, rely too heavily on effects and not plot, and are generally lame. I spend my time in other pursuits that have little to do with TV and movies. Until more people speak with their wallets, hollywood won’t change.

I have a love of old movies thanks to my Grandma (on my mother’s side). I would spend time with her in the summers, and we’d watch all these classic films she just loved. If it weren’t for her, I doubt I would love Audrey Hepburn. I would love to see hollywood return to that era, but I doubt we ever will because people have been mentally trained to need more stimulation than a good plot. Frankly- I partially blame Sesame Street.

Which, by the way, I rented recently just to see what it was about. It’s an extremely bizarre movie, almost pornographic in its depiction of violence, and yes, I think it is arguably antisemitic.

After all, he might be the greatest American con artist ever. Consider that he fleeced CU out of fifteen years of salary and benefits, not to mention 12 years as a ‘thought-policeman’ before that. That’s a theft of ~two million dollars of CU’s money. Even better, when until he made his ‘little Eichman’s’ slur, his plagiarism and other transgressions were being overlooked by CU. Best of all, after all his lying and conniving, he still has defenders!

Purely as a matter of numbers, there are definitely more immoral “Christians” than immoral atheists. That’s because there are more persons who self-identify as Christians than self-identify as atheists.

But if morality is defined by norms, as I believe it is, then norms (i.e., “Thou shalt not murder.”) are rooted in religion. Can an atheist adhere to religious norms? Certainly. But why should he? Norms are religious values. By definition, an atheist doesn’t believe in religion.

If the atheist’s reference for norms is to a legal system, then the legislature can change legal “norms” overnight. It can go from tolerance for Jews to outlawing Judaism. “There arose a Pharaoh who knew not Joseph.”

Judging groups (Christians or atheists) by their conduct is a valid way to compare them. But if Christians are indistinguishable from atheists (because they’re no better in the way they conduct themselves), they’re very poor Christians indeed.

The flaw in that argument is that the religious believe that that the norms and rules are handed down to them by God, and originate from God. Atheists, who disbelieve the existence of God, nevertheless do believe historical records, and religious texts are, at least in part, historical records. And these records recount the adoption of various laws and codes of conduct, and show how the adoption of these codes benefited individuals and society, and how transgressions of these codes caused harm. But the atheist’s explanation for these codes would simply be that they evolved, as human beings wrestled with the problems of developing a functional civilization.

In a nutshell: the religious attribute their moral code to a Deity, the non-religious attribute their moral code to the cumulative experience of Mankind.

When there was the earlier note on the question of damages, I wondered if the jury was going to do exactly what it did. By doing this and awarding $1 in damages, it freezes Church from appealing. After all he won. By awarding only $1, they are not really going to penalize CU. CU will not appeal the ruling. Church can run around all he wants now saying he won, but he is still out of his job and none the richer. When my father got a divorce from his first wife, the judge awarded her $1 a month in alimony. That way she could not appeal anything.

On the surface it seems Church won, but in reality the jury fixed his wagon but good. It would have been better for him to have lost.

That seems like a really bad idea. The mere fact that Stevens was indicted tainted him and he had no shot at winning. Charges may have been dropped, but he’s still guilty as homemade sin.

It also doesn’t call for the expense and drama of a special election. No one has died, and there haven’t been any allegations that the election itself was tainted in any way. There’s no call to set aside the results.

If Stevens wants a do-over, he’s free to run again next time around.

Agree, but it wouldn’t be far right; it would be an extremist religious party, the American equivalent of the Taliban, attempting to ram fundamentalist Baptist religion down the nation’s throat.

The good thing about such a move is that it would finally flush a lot of the nuts out of the GOP, and allow it to pursue a true Conservative agenda that the majority of the country would openly embrace, and that the Democrats are in the process of co-opting. It might draw off enough votes to cost a couple of election cycles, but over the long haul it would be good for the GOP.

Meanwhile, Malkin and the rest can go off and natter about their Monster Raving Looney Party to their tens of followers.

I’m quite certain I’ve never mentioned my own religious conviction, or lack of them, here. I’d be curious to know why you have lept to the conclusion that I’m an atheist.

As for suicide bombing: terrorism takes many forms. Blowing yourself up in the marketplace is only one of them. Forcing religious doctrine down the throats of children against their parent’s wishes, and in violation of the Constitution, is certainly another.

The threat to personal liberty is the same either way.

I can recall reading a comment by a Lebanese Christian that the Aramaic in The Passion was in some cases pretty easy for a native Arabic speaker to follow without looking at the English subtitles.

I’ve only seen a few snippets of The Passion — on cable, at a friend’s house — and thought the scenes were beautifully filmed and moving, but I’ve never gotten around to renting it on DVD, in part because of all the bad reviews I’ve heard.

The portions I saw weren’t violent; the one that sticks in my memory is a flashback by a woman disciple who remembers Jesus intervening to save her from a crowd that was about to stone her.

Your response is intelligent, and well-argued. I think it wrong for three reasons:

(1) an atheist is as committed to the theological view that G-d does NOT exist, as a devout Jew is to the theological view that G-d DOES exist. Neither view is capable of proof, and hence, each must rely on faith.

(2) There’s an enormous amount of historical and cultural information out there. Assuming that the atheist carefully studies all of it, what objective basis does he have to prioritize it into more important and less important? Aren’t the priorities he sets necessarily his own? And don’t they, in turn, derive from his subjective opinions about what is important? The atheist risks complete solipsism, the notion that he makes all of his own rules, without regard to the interests of others.

(3) Like a hedgehog, religion has one big thing going for it: it has created a framework for moral living based upon belief in a spiritual dimension, and in a G-d perceptible only in part. That framework certainly can be examined and challenged by skeptics (and it should be), but it is a cultural and historical reference point susceptible of (relatively) rapid study, testing, and adoption or rejection. Another advantage: it already has been adopted by large numbers of people, so a common cultural language exists (in Judaism, Tanak, and in Christianity, the Bible) with which people can communicate abstract, moral, spiritual and mystical concepts to each other.

Way late to this thread but since I have old connections to CU I need to throw my 2 cents in: Churchill committed the offenses he was charged with, lost his job for it (justifiably), then turned the whole thing into a political circus. CU’s administration has bungled this from the day they hired Churchill through the trial. I am beyond disgusted, as an alumni and an academic, with the whole offal affair.

Your stated belief in “the Hebrew G-d” as the source of morality may be correct, but because your belief is faith-based I am sure there is no scientific proof.

On the other hand, you should realize that by shifting the argument from Christianity, to Judaism, to “the Hebrew G-d” you have at the very least implicitly conceded the possibility that even the very first humans had an innate sense of morality. Whether or not that innate morality was God given is of course another question entirely.
