YouTube Restores James Randi Foundation Account

Some small good news this morning: the James Randi Foundation account has been restored on YouTube.

Phil Plait explains that the problem was apparently related to a copyright complaint about video footage: The JREF YouTube Account is back online!

However, some videos that should be deleted, not due to copyright violations but out of sheer human decency, remain; for example, this psychotic antisemitic video and hundreds just like it. There are accounts on YouTube that post this kind of sick garbage regularly, and YouTube seems to have no interest at all in acting responsibly about them.

Well it shows where the Google "do no evil" corporate policy has taken them.

The concern over copyrights (which are dubious claims when the material in question was incorporated into another original work with a political message) rank much higher in the Google list of concerns than does recruiting material for violent, genocidal and nihilist organizations.

Clearly "evil" must mean something completely different to Google than it does to most reasonable people.

I believe there are. Also when someone issues a DMCA complaint to youtube about something you've posted, they take it down immediately with no proof required from the complainer so that you have to jump through hoops to get videos or accounts replaced if theres a bogus claim. The former MST3K guys at Rifftrax have had their youtube account yanked several times because of that.

Anecdotal evidence suggests that sometimes different entities claim copyright violations and they pull those clips. Happened to me once. Remember when they had that 'Burning Down the House' video during the election? Especially true for right-sided stuff. Other than that, I don't think they care so much.

I'd like to thank all our supporters once again for the outcry when this happened. But I'll also gently chide some of you: there were many rumors, accusations, and conclusions jumped-to when our account was taken down. As you can see, no one was attacking us, and no one acted unfairly - the complainants were within their rights, and YouTube acted according to their rules. In fact, when we started conversing with one of the complainants and with YouTube, everyone acted in a civilized and even friendly manner. The matter was resolved quickly and, I think, to everyone's satisfaction.

I've got to think "way too big to moderate", with the addition that they are vulnerable to relatively small fringe groups abusing their reporting system in an organized manner.

TOS violations are enforced haphazardly and without regard to the content or value of those videos that are left online. That the focus appears to always come down against those pointing out the stupidity of the clueless (like the Randi videos) or allowing jihadi videos while blocking anti-Jihad videos), it suggests that YouTube ( a wholly owned subsidary of Google) isn't doing a good job of policing content for real violations of TOS. Instead, they appear to let a few people harass and shut down opposing viewpoints, regardless of whether there are TOS violations or not.

I recently saw a job posted at Harley Davidson for a copyright investigator. Apparently the person travels around to rally, etc. and searches out un-authorized merchandise and confronts the people. You could not pay me enough to go to a biker rally and tell some Outlaw or Hells Angels guy selling pirated stuff that he is breaking the law. LOL.

First of all, a disclaimer: I am not a lawyer, nor do I condone any of the actions of Google/YouTube. However, I believe that most of the actions they take (or don't take, more often) that we find disagreeable are because they are afraid of losing their DMCA safe harbor immunity. That is to say, if they act in any fashion other than a simple medium of exchange - if they actively police their own content - they will be left open to lawsuits for DMCA violations. That being said, I do think they could do a better job of enforcing strict terms of service while still being able to operate under DMCA safe harbor.

That comes from relying on complaints to initiate investigation I'll wager. And the more complaints, the faster it gets looked at. It would be interesting to know the truth behind my supposition, but that's probably a closely held secret.

I posted a link when this happened to a story explaining that this was probably a DMCA copyright claim against jref videos. So there - not surprised. Still annoyed, though I'm glad Mr. Randi is back.

I'm just curious who it was. A lot of the complaints are spurious, of course, but they all have to be looked at, since it's a fucking federal law.

Here's a question: would it be okay for YouTube to run literal Nazi propaganda (as in, year 1938)?

I haven't gone looking for it, because I value my immortal soul, but I have run across "Triumph of the Will" and several questionable old-school Warner Bros cartoons.

I could see a social value in allowing evil on YouTube. For instance: Oliphant heaved a Der Stürmer cartoon onto our newspapers last week. But what's Der Stürmer? How can anyone know what the big deal is, beyond "it's ill designed aesthetically, and we don't like the content", if the historical allusions are lost?

YouTube gives us that historical memory.

Youtube made its way to the forefront of the internet video trend in part by breaking copyright laws on many levels during their infancy. Since being purchased by Google they've been over the top on policing their site for any appearance of copyright violations which are not equally applied.

Just watched Randi's latest video and my head is spinning from the amount of quacks that received the "Pigasus" awards. Jenny McCarthy receives an award for her current side show and for being "a threat to public health" for her anti-vaccination crusade.

There must be 1000's of copyright lawyers who do nothing but go through youtube videos all day long looking for copyright violations.

I've had videos with as little as 100 or so views removed for copyright violation because I used some little known piece of music. That's dedication. Either that, or someone keeps shopping me.
