Dr. Tiller's Murderer Still Advocating Via the US Mail

According to ABC News, Scott Roeder (the fanatic suspected in the murder of Dr. George Tiller), has been using snail mail from his jail cell to stay in touch with the extremist anti-abortion network: Abortion Doc Murder Suspect Advocates Via Mail.

A man charged with shooting a prominent Kansas doctor who performed late-term abortions has been advocating through mailings from his jail cell that such killings are justifiable and communicating with individuals on the fringes of the anti-abortion movement, weeks after suggesting others might be planning similar attacks.

Scott Roeder, 51, is charged with first-degree murder and aggravated assault in the May 31 death of Dr. George Tiller — an attack that reignited the national debate over late-term abortion and gave Roeder icon status among extremists in the anti-abortion movement.

From his cell in Sedgwick County jail, Roeder has been sending anti-abortion pamphlets that laud Paul Hill, who was convicted of murdering an abortion provider in 1994, as an “American hero,” and include examples of Hill’s writings about how the killing of abortion providers is justifiable.

Hill was executed in 2003 for killing Dr. John Bayard Britton and his bodyguard outside a Pensacola, Fla., abortion clinic.

Roeder has also been corresponding with Rev. Donald Spitz — whose Army of God group’s Web site celebrates Hill and who says he sent Roeder seven of the pamphlets at Roeder’s request — and Linda Wolfe, an Oregon activist who has been jailed about 50 times for anti-abortion activities and who is close friends with a woman convicted of shooting Tiller in the arms in 1993. She says Roeder mailed her one of the pamphlets.

No one has accused Roeder of breaking any laws because of his jailhouse correspondence. But local and federal law enforcement agencies took seriously a threat Roeder made during a June 7 interview with The Associated Press that there are “many other similar events planned around the country as long as abortion remains legal.” A judge raised Roeder’s bond to $20 million, citing his comment to the AP, after a prosecutor argued Roeder’s ability to get his message widely disseminated should lead a reasonable person to believe he is engaged in “alleged acts of American terrorism.”

Angel Dillard, a Christian-music songwriter from Valley Center, said she's been questioned several times since striking up a friendship with Roeder after the Tiller shooting.

"They just wanted to check us out and make sure we weren't some nuts that were planning to pick up where Roeder left off," Dillard said. "We have no plans to do anything of violence to anyone. We are reaching out to someone who we know is totally alone right now."

Dillard and her husband have exchanged several letters with Roeder and spoken to him by phone, and she said she plans to visit him next week. She said Roeder has not spoken about Tiller's killing, and has only shared scripture and asked her to pray for an end to abortion.

Spitz — whose Web site likens Tiller to Hitler and features multiple essays supporting "defensive action" and justifiable homicide — said he had never heard of Roeder until Roeder's arrest and said they have never spoken specifically about the Tiller shooting.

Spitz said he sent Roeder seven pamphlets advocating justifiable homicide that Roeder wanted to mail others. He said authorities had not contacted him about Roeder and that he has no plans to kill an abortion doctor himself.

Wolfe said Roeder mailed her a pamphlet after she mailed him a $20 money order and a letter telling him why she no longer believed killing abortion providers was justifiable.

She said Roeder asked her to pass the pamphlet along to someone else if she agreed with it, or to mail it back to him if she didn't. She said she threw it out.

I don't see any mention of email in the article. It sounds like he's using the good old USPS, snail mail. The article also states that all correspondence is being monitored.

Would there be legal issues with trying to restrict his access to the regular postal service?

Ruby always reminded me of Boston Corbett, the Union soldier who claimed he shot John Wilkes Booth when Booth was cornered in the barn. (The jury's still out on whether it was Corbett's bullet or one from Booth's own pistol that did the latter in.) Corbett claimed he was acting on "orders from G-d", and IIRC made reference to "sparing Mrs. Lincoln the ordeal of a trial".

My own theory, FWIW, is that there's something about "high-profile" murders in general, and assassinations of political leaders in particular, that really brings the hardcore kooks out of the woodwork. Often even before the dust settles.

/The scarily weird part is, before I logged on, I'd just finished watching a tape of Alfred Hitchcock's Rope (1948), which was of course based on the Leopold and Loeb "thrill killing" in Chicago in 1924.

Opening your mail (unless it is mail to your lawyer) is probably perfectly legal. I'm not a lawyer (nor a Prisoner. I am a free man:-), but this looks OK to me.

When you are in jail, you have very few rights. They can strip search you at any time on suspicion of intent. Toss your cell on less "evidence". Opening your mail (unless it is mail to your lawyer) is probably perfectly legal. I'm not a lawyer (nor a Prisoner. I am a free man:-), but this looks OK to me.

Sure they can search your mail, but can they stop you from being able to send and receive it if it's not something on a predefined list of banned subjects, ie pornography?

Jail officials typically check incoming mail for contraband such as pornography or drugs but do not attempt to read all of the more than 97,000 pieces of mail inmates get each year unless there is a specific concern, such as in Roeder's case. Outgoing mail is normally sealed by inmates and not read by prison officials.

Other than communication with your lawyer they can do pretty much anything that they want, I believe. Prisoners do have some rights (the right to cable television and now, perhaps internet access), but they are very much more restricted than people on the outside. I wouldn't think that you could make a case for prisoners having a "reasonable expectation of privacy". They can't even take a shit where the guards can't see,

As a general rule, any communication "designed or intended to further or facilitate criminal activity, including conspiracy to commit crime(s)" can be sequestered and, under certain circumstances, be entered into evidence at trial. (Ohio Revised Code, 1974, and AFAIK the statute hasn't changed, as it is based on the Federal statute.)

The problem in most cases is proving that a criminal conspiracy, or the intent to operate same, existed at the time of the communications. This was a common feature-and stumbling block- of prosecutions of organized crime figures in the past, going back to Genovese and Luciano.

Some such didn't even bother to try to manage their empires from jail, notably Raymond Patriarcha of the New Jersey mob. He'd already given his boys their marching orders before he was indicted, and they knew that if they didn't carry them out to the letter, a matched set of busted kneecaps would be the least of their problems.

Could be. He could mail letters to his lawyer and the lawyer remail them to the people he wants to contact. I'm not positive, but I think that is illegal. Lawhawk could let us know, if he's around.

It sounds more like he's being allowed to mail people directly like any other inmate but his communications are being monitored. Since it can all be used against him in court and it give the FBI new people to add to watchlists it's probably not that bad an idea.

I'm pretty sure monitoring prisoner correspondence is a timeworn method of intelligence gathering, but maybe I just watch too many movies.

The award is given annually to the person who provides the best material for columnists facing deadlines. Palin, who became a national political figure overnight last year when Sen. John McCain selected her as his running mate, beat out former Illinois Gov. Rod Blagojevich.

I attended a funeral Wednesday. It was dignified. Everyone there had known the deceased personally. There were funny moments, there were sad moments, it was very touching, and left me very pensive and resolved to live a better life.

When I go: no tickets, just dignity.

I attended a memorial last Saturday for a REAL home town hero; a policeman that watched over us "hoodlums" in a small beach town in the 60's & 70's...........he'd take you home (with a meeting with the parents) instead of jail. He was a saint.

NASHVILLE, Tennessee (Reuters) - A well-known restaurateur is fighting back against Tennessee's newly enacted law that allows gun owners to bring their weapons into bars and restaurants that serve alcohol.

Randy Rayburn, owner of three top-rated restaurants in Nashville, filed a lawsuit on Wednesday challenging the state law's constitutionality, arguing it creates a public nuisance by threatening the safety of the public.

"If it's called a 'nuisance bar,' with shootings, it normally gets shut down. But in Tennessee, we apparently are going to have 225,000 vigilantes shooting in bars," said David Smith, Rayburn's attorney.

At least 200,000 Tennesseans have permits allowing them to carry their guns concealed while in public. The new law that takes effect on July 14 also specifies that persons who bring their guns into an establishment cannot drink alcohol.

he was always at odds with PM because he had more dough at the time and PM resented it....can't blame him but money talks...since then of course PM went on to purchase his own publishing empire and it's huge...he owns 'Happy Birthday' for example...or did...I don't know anymore but it was an interesting story at the time...whole blocks of artists...show/Broadway music etc

BTW, sent the boys off with their uncles to the rodeo and carniival. My SiL is riding herd on that three ring circus! I am kicking back after bagging 200 plus pounds of cherries for my 15 year old to sell over here on the west side of Wa state to pay for his drivers ed. He did most of the picking. Cherries are going from 3 to 7 bucks a pound!

Why should the criminal actions of another person interfer with my rights. The law specifically says you cannot drink while carrying. Besides, the main focus of this law was to allow people to carry in places like grocery stores and resturants where alcohol is sold and served.

That said, at the bar I used to "work" at damn near everyone carried a knife. Could someone have been carrying a gun? Sure. We didn't have metal detectors at the door (which are kind of silly anyway), and never turned a patron away because of how he or she was armed (we had one big old boy come in wearing a 3-4 D cell maglite on his belt. I was right happy when he left the bar :-)

Best I could make out is that she intends to play point, her natural position when she played hoops. Interpretation: she intends to play for the team, to advance the ball/GOP position. Point guard hands out assists. She is going to work nationally to advance conservative causes/select politicians is my take. I think it is both bold and a good move if she can take a leadership role as she evidently intends to do. God knows no one else is stepping up.

If they are doing their concealed carry properly, no one will know they are carrying a gun anyway. That's the way it is now, except you can be prosecuted if you are caught with one in a place where alcohol is served. This takes away the legal ramifications for permit holders.

It is pretty consistant with the way the State has been moving for some time. We have a law on the books that says that you can't be prosecuted for using a gun in self-defense at all, not even if the gun was illegal or you couldn't legally own a gun.

Pretty cool.

Other states allow this and blood has not run in the streets. It's still illegal to carry while you are consuming alcohol in public. Since concealed carry owners tend to be a bit more law abiding than the average citizen, they are not the problem. The problem is the people who were violating the law before and will violate it in the future. I suspect this guy has a problem with announcing to the criminal class that his patrons are unarmed. Since he has such a negative view of firearms, he needs to just suck it up and take his chances.

Only in movies. And maybe Tombstone Arizona. Most of what we "know" about the Old West is just plain wrong. I don't know that movie makers really set out to make it that way, they just tried to spruce up the story until the story bore little resembalence to the historical record.
