Churchill’s Suit Fails

The ruling came down today, and it looks like Ward “Little Eichmanns” Churchill is getting no money and no job.

In a resounding defeat for ousted University of Colorado professor Ward Churchill, a judge decided Tuesday to neither give the controversial professor his job back at CU nor award him any financial compensation for his dismissal from the school nearly two years ago.

The ruling from Chief Denver District Judge Larry Naves, which was released this afternoon, comes in stunning contrast to a jury’s verdict from a civil trial Churchill brought against the school earlier this year, in which six jurors determined that CU had unlawfully stripped Churchill of his job for expressing his political beliefs in a controversial essay he wrote about the Sept. 11, 2001 attacks on the United States.

He’ll just shrivel if we ignore him. He’s always lived in a world of fantasy and pose; he always tries to make himself into a hero and a prominent person.

He served in Viet Nam, sure enough. But he was a projectionist and a truck driver. He claimed to have been a LURP.

He worked for the art and marketing department of Soldier of Fortune. He claimed to have written for them.

I doubt he more than had a nodding acquaintance with any of the “dangerous radicals” he claimed to be close to - particularly since they were all conveniently dead.

He won a $1.00 from a previous jury trial, this judge decided he would not get his job back or anymore money. The dollar might have been a tip of the hat to freedom of speech, and the dollar was a sign of how respected that stupid speech was worth.

Mine never did. Gyrocompass was bad for two years before I reported aboard ship, and two years later, when I left, it was still bad (and still on back-order). On appeal, he’ll have to prove that there was some legal error committed - it’s not like he gets a do-over on the basis of the original trial. It’s certainly possible that there was some reversible error committed, but normally appeals fail, because judges are careful to follow the rules. Appeals can only succeed if the rules have been broken - it’s not like you get to argue your case again.

You’re right - it ain’t quite over yet. But the chances of this being overturned are pretty slim. The main reason for filing appeals is to delay final judgment - sometimes, to keep a client out of jail a while longer; in this case, probably, to keep a client in the spotlight a while longer. Ultimately, though, he got his compensation from the University already - a whole dollar - and he accepted it.

Maybe we could start a campaign to get people to mail him some of these items so he’s better able to defend himself.

I think that dollar was taken away by the ct’s granting the defendants quasi judicial immunity defense as a matter of law. As I read it ,no dollar no job, ergo no recovery of attorney fees or costs, which had to be greater than $5-600,000.I doubt Church paid it , so his lawyer is out that money. I wonder if Colo law allows the defense recovery of their costs.

Heh. I was on shore duty in Newport RI and the Valdez and Miller were reserve units. So they only had skeleton crews until the reservists came aboard for their two week active duty. I got Shanghaied! The CO of the Miller, Valdez, my CO and Dept head came looking for me! Each frigate only had one guy each that knew anything about the -35 or -18!
So I had to go to sea! While on shore duty!

Larry Naves

Judge Larry J. Naves (born 1947 in Birmingham) is the chief judge for the Denver, Colorado court system.

Naves grew up in Birmingham and attended Ullman High School where he played tenor saxophone in the school band. His guidance counselor was John Rice, the father of Secretary of State Condoleezza Rice, who helped him get accepted to the University of Denver.

After graduating from Denver, Naves went on to earn a law degree from the University of Colorado and then begin his legal career as a criminal defense lawyer. It was then that he met and married television reporter Bertha Lynn, now an anchor.

In May 2006 Naves was appointed by Colorado Supreme Court Chief Justice Mary Mullarkey to preside over Denver’s 24 district judges.

Naves and Lynn have three children, Andrew, Maria Jo and Elliott.

The leftist culture in general is about being seen as cool. It all boils down to being a fashion statement or just another leftist poser of sorts. Churchill took the most popular route along the lines of Marxism which he mixed with other “cool” ideologies. Well, that was kind of the beginning of the AIM split - I was one back then who ended up in the Means camp, much like Ward did. However, Russell ended up coming to terms with libertarianism, while most of the others went down an even deeper socialist path. I will agree that he joined with others shouting about the Sandinista treatment of natives, but I believed back then, and I still believe today, that his sole purpose for doing so was to continue doing what his goal was - destroying the American Indian Movement.

According to Denver KHOW, 630 FM, afternoon talkers — both attorneys, one liberal, one conservative, but united in their antipathy for Churchill — judge overturned the jury verdict and the $1 based on fact U of Colo Regents acted in a quasi-judicial manner. Decision is carefully crafted so that, even if jury verdict is reinstated on appeal, still no job reinstatement or back pay for Churchill. He was expecting back pay and either a job or a payoff to go away. He gets neither. Attorneys think odds are 90-10 in favor of judge’s ruling standing up to an appeal. HURRAY! Sotomayor isn’t a bad person, and she wouldn’t make the worst possible judge. But she’s badly wrong on Ricci, and she’s wrong because she sees justice in terms of divvying up the racial spoils.

So will any judge Obama nominates. She should be asked pointed questions on the topic, asked to disavow the explicit racial spoils doctrine, and then reluctantly confirmed.

I have really mixed feelings on this.

So on one hand, you have suppression of free speach.. They actively tried to find a way of punishing him only after he spoke out. If you try and find a way of punishing someone for something they said you’re suppressing speech. What about the next professor who might have something controversial to say…. say something bad about obama? Will he have to worried about an in depth hatchet job to destroy his career? Will this prevent him from saying it? Will it temper what he says?

On the other hand, you have an administration that hires plagerizing nutjobs and doesn’t seem to care until someone takes notice. The administration of the school needs fired.


don’t get me wrong, I dispise churchill. I think he’s a loon. But I don’t feel comfortable about the way he was fired, and I sure as hell don’t feel comfortable about the vetting process that went in to hiring him and giving him tenure.

The dude is/was a poster child for what’s wrong with our colleges.

Sadly, I’d have to say that’s so. Most colleges have at least one or two of this sort, and oddly enough they tend to end up in court.

My own alma mater suffered through a lawsuit from a complete twit of a professor who refused to accept that not publishing anything wasn’t enough reason to deny her tenure. In the resulting ruckus, students were on campus carrying signs accusing a charming gay black professor (who’d earned his tenure) of being a ‘well-known racist’, since he’d been on the board that voted against her.

He was a good guy. He had a t-shirt made that said “Well-Known Racist”.
