Negative Liberty concerns rights that prevent the government from doing things to you, i.e. No searches without a warrant, protection from prior restraint of speech. The Bill of Rights is almost entirely concerned with Negative liberties.

Positive Liberty concerns rights that cause the government to give you things, such as unemployement assistance, or health care.

One key difference is that Negative Liberties prevent the growth of government power, while Positive Liberties encourage or require the growth of said power.

WASHINGTON -- President Obama has ordered his national security team to investigate reports that U.S. allies were responsible for the deaths of as many as 2,000 Taliban prisoners of war during the opening days of the war in Afghanistan.

Obama told CNN in an interview that aired Sunday that he doesn't know what how the U.S.-allied Northern Alliance behaved in November 2001, but he wants a full accounting before deciding how to move forward.

"I think that, you know, there are responsibilities that all nations have even in war," Obama said during an interview at the end of a six-day trip to Russia, Italy and Ghana.

"And if it appears that our conduct in some way supported violations of the laws of war, then I think that, you know, we have to know about that."

Isn't unemployment assistance a form of insurance, in most states? I.e., workers pay a small amount monthly from their paycheck toward it? Not exactly a gift from the government.

We did Afghanistan the first time with two well funded CIA operatives and one military FAC, now we're at 38,000 troops, seasoned commanders are asking for more, and progress in the mountains and with the population is hard to come by.

Hi ggt! Heller is an incredibly interesting decision, in that it defines the Second Amendment as providing for individual rights, then cautions us to remember that it only applies to the Federal Government (as the case was brought in the District of Columbia - which is administered by the Feds.)

But, if Heller is that narrowly defined, the idea of the Second Amendment being an individual right means absolutely nothing so long as the States are not bound by it. If that's the case (no pun intended), then the Draconian firearm restrictions in certain parts of the country (think Chicago) are perfectly Constitutional.

And if that's the case - at least to my mind - the entire Bill of Rights means nothing at all, so long as the States - who, by the way, signed on to the Constitution - can toss 'em all if they so desire.

What a conundrum for those of us who want limited Federal government, but don't want the rights (even keeping the 10th amendment in mind) turned completely over to State governments - such as California!

Nonetheless, I'd much rather have a Constitutional Amendment on the Second Amendment, clarifying that individuals do indeed have the right to bear arms.

IIRC, the controversy over the Bill of Rights in which the Framers engaged, the (anti-federalists?) argued that it was redundent to guarantee pre-existing rights.

While I definitely believe we need the Bill of Rights, I see so many people believing that they "give" rights, not guarantee them.

Our way of government, IMHO is so simple, yet for those who don't study history, difficult to conceive.

"Mandated employee benefit" works well for me. That would fall into the category of Positive Liberties as I defined them. That would not, in and of itself, make it a bad thing, however. But it does expand government power, and that is seldom a good thing.

Hey Killian! Do you attribute that to those former employees being able to find new employment quickly, ignorance on their part that they could apply for uninsurance benefits or just luck?

While I definitely believe we need the Bill of Rights, I see so many people believing that they "give" rights, not guarantee them.

Couldn't agree with ya more ggt! Whether it was Adams, Jefferson, Paine, Hamilton, Madison, - hardly matters. The Founders were clearly all in favor of the rights of the individual, and from whence they came.

It took 233 plus years for us to elect morons who were only interested in how they could use the Interstate Commerce clause to bring us to the point where we no longer argue whether the government has the right to infringe on indivdual liberty, to to what extent.

"Mandated employee benefit" works well for me. That would fall into the category of Positive Liberties as I defined them. That would not, in and of itself, make it a bad thing, however. But it does expand government power, and that is seldom a good thing.

The government is mandating the transaction. The Government can also expand the length of time an employer has to provide benefits. The government's ability to mandate an employer's expenditure is a power over his property. Again, that does not make it wrong, but it is government power.

Hi PvtBinJammin! Only glanced through the other posts, but it looks - to me- like you've hit upon it. It's the best solution...to buy back - or replace - the object of her bad decision would only reinforce the idea that she could make the same - or similar - bad decision again. A few months on the bus may accomplish two things:

1. She may value the responsibility attached to owning her own mode of transportation and/or,
2. She may meet some wonderful folks who aren't as fortunate as she is, but have a higher set of personal standards. and learn from them.

(Well, okay, she may meet some lowlifes too - but that's a form of education as well.)

Either way, you're a pretty impressive young lady I might say.

I think Obama is leading America down a bad road, and doing a bad job of the leading at that, but he's not planning forced labor camps or roundups of those who disagree with him. I agree that we can't paint the guy like the left painted Bush, as a maniacal Hitler figure--but only because it is a distraction that paints us as crazy reactionaries. At the same time, I really don't see how the Obama policies set forth in the last six months set the country on a course that will not end in bankruptcy. They are hell bent on hamstringing the economic engine that--if it were to operate on levels that they themselves found indulgent--could never support the orgiastic spending and entitlements that they propose as mainstays of American life well into the future.

Hey Syrah - that is the million dollar (or these days, I guess Trillion dollar question) and my money's on the military pulling a coup. I read somewhere that the NORK military, although treated better than the NORK civilians in terms of food, clothing and shelter, has been getting really restless because their RELATIVES are still starving to death - and at rather alarming rates.

Sorry JohnAdams, I have to disagree with that. I think that with government control (the US is gonna own something like 60% of the stock in the New General Motors) Ford will have a competitive advantage - the Government will NO DOUBT have layers and layers of bureaucracy piled up just on WHO to pick to general design for certain lines of vehicles.

My GTO had a sad ending. I was off elk hunting and my new wife pulled out at an intersection and had the front end taken off. She was petrified and wanted to get it repaired while I was gone. The insurance company wound up paying to put a '67 GTO front end on it. The car was never the same. And, 38 years later, I still have the same wife!

I just think "we" the people lose a LOT when the discourse is either one sided, or non-existant. I think having open, honest discussions about ideas, is a BIG part of what our Democracy is based on. And ALL of us loose by not being able to have a civililized discussion about where we want our country to go. And I think it is a SHAME that we cannot be "civilized" enough to have friendly discussions on important matters. And I don't understand it, OR how to fix it.

Another thought on the Kim Jong-Il Pancreatic cancer.

If it really was the result of poor practices around fissile material, it would suggest that much of the circle of people in NK that were involved with the Nuclear weapons program would likewise have over exposure health issues. This could mean that a large number of people who were involved in the program and in the government could be very short for this world.

Well, maybe not. But I made an exception in this case for two reasons:

1. Taibbi's point is that no "reliable" business site has written a true dissection of what G-S has done to contribute to the current mess.

2. Taibbi's article has been out long enough that "reliable" sources from Time to Atlantic Monthly and dozens more have written scathing critiques of his critique. And he's responded to theirs. In a nutshell, nobody has questioned Taibbi's facts, only his "tone"...and they say he's "singling out" Goldman-Sachs for something "others are also guilty of." His response to that particular charge is classic, I think, though profane.

He's a muckraker by trade, but I learned a lot from his data. And when somebody shows his data is wrong, I'll amend my opinion of his pieces. Nothing to lose by reading them, I'd say.

Agreed. I find the pearl-clutching over his 'tone' to be significant, especially in the absence of substantive criticism of his piece.

Well, maybe not. But I made an exception in this case for two reasons:

2. Taibbi's article has been out long enough that "reliable" sources from Time to Atlantic Monthly and dozens more have written scathing critiques of his critique. And he's responded to theirs. In a nutshell, nobody has questioned Taibbi's facts, only his "tone"...and they say he's "singling out" Goldman-Sachs for something "others are also guilty of." His response to that particular charge is classic, I think, though profane.

He's a muckraker by trade, but I learned a lot from his data. And when somebody shows his data is wrong, I'll amend my opinion of his pieces. Nothing to lose by reading them, I'd say.

1. Ed, would you mind pointing me to one or few of those critiques of Taibbi? I wouldn't ask if I hadn't googled "Taibbi Goldman Sachs" and got little but huzzahs. Thanks in advance.

2. Other than the record of GS alumni in government, I didn't see anything in the piece that I'd call "data" in the sense that I could independently verify it.

3. When there's a systemic breakdown, everybody has an excuse and everybody wants a scapegoat. I tend to view GS kind of like the traditionsl Damn Yankees: hated because they're the clear best at what everybody else is trying to do.

4. Good for Taibbi for noting the Democrat connection. However, he didn't note the Democrats' political role in creating & protecting the housing bubble (or the GOP's failure to arrest it)--and in the possible carbon-credit bubble. (IMO the residue of the Internet bubble is a wired nation. I'm not sure that the housing bubble will leave anything but a lot of repossessed houses and dispossessed people.)

It's too bad this came up so late. I'm trying to regularize my schedule and have slipped again. Hopefully there will be other occasions for constructive discussions of this with you and Ice and others. Ideally we will learn as much when we don't completely agree as when we validate each other.

Satriani, like Vai, Malmsteen, Gilbert, Buckhead et al is insanely talented and largely unlistenable. I defy you to get through a whole album in one sitting. Angus Young shouldn't even be called a guitarist in light of these guys and yet Back In Black can be listened to song for song for the moment "drop the needle".

I spent a fair amount of my guitar years playing like (or trying to) Vai etc. Vernon Reid who like Van Halen got the shred/song ratio correct freed my fingers up to play what I was hearing in my head and not what expected. Even I can't get through War and Peace by Vai. I get it, you're phenomenal, now shut up.

jvic, here are the two most prominent critiques I've seen of Taibbi's infamous article: one is in Time's business section, the other is by Megan McArdle in Atlantic.

It's very instructive to read Taibbi's ongoing replies to the ongoing criticism, on his blog at TrueSlant.

I'll post other links as I run across them. Look forward to hearing your thoughts on this.

I have nothing fundamentally new to add to my previous post. Below, in no particular order, are random thoughts.

1. Basically, I'm with McArdle. She alludes to systemic failure:

But financial meltdowns don't offer villains, for the simple reason that no one person or even one group is powerful enough to take down a whole system.

So did my post.

2. Back at the time, I was completely taken in by the attacks on Brooksley Born. Heeding her would have averted much of the current mess. Wall Street and the nation owe her apology and restitution (via appointment to cushy "advisory panels", board memberships, speaking fees, and the like). Her recent Profiles in Courage Award is a step in the right direction, but it is only a first step. To their shame, the government and the Street have yet to be heard from afaik.

3. Taibbi creates his portrait of GS as ubervillain by leaving things out: the Hunt brothers' attempted corner on silver and other corners, Salamon's illegalities with US debt securities, the junk-bond orgy of the 1980s, Enron, LTCM, the 1990s debt crises, etc.

4. The RS piece could be easily upgraded by describing GS as an illustration--as the most visible example, even--of how the systemic dysfunction perpetuates itself. By making the article all about Goldman, Taibbi substitutes sensationalism for insight.

5. Taibbi's blog:

...a lot of people have been writing me asking me to respond to Megan McArdle’s bizarre freakout on the Atlantic website, where she lambasted my Goldman piece in curiously discombobulated fashion and then apparently spent the next couple of days jamming her feet in her mouth in the comments section...

It's hard to give a coherent explanation of why something is incoherent. Taibbi's editor should have said something like "Promising concept, but start over." For better and worse, Rolling Stone is not Foreign Affairs.

Sadly, Taibbi's piece is less than the sum of its parts.

I am not absolving Goldman Sachs. My opinion of them has materially worsened after reading Taibbi.

But Taibbi is not the Gibbon who is needed to chronicle this breakdown of the financial system.
