Sotomayor Confirmation Hearings Begin

Oh boy! Several days of political grandstanding and opportunistic pandering, masquerading as a “confirmation hearing!” I know you’re as excited as I am. Andrew Malcolm has the opening statements from the usual raft of blowhards: Sotomayor hearing: All senators’ opening statement texts: Leahy, Sessions, et al.

Yawn.

The wiser-than-you Latina will be confirmed.

2 CIA Reject  Mon, Jul 13, 2009 10:05:50am

Is there an ice cube's chance in hell that she WON'T be confirmed?

So why do we even bother watching?

3 Kosh's Shadow  Mon, Jul 13, 2009 10:07:00am

When does Stuart Smalley Al Franken say to Sotomayor:
"You're good enough, you're smart enough, and doggone it, people like you to be on the Supreme Court."

4 Randall Gross  Mon, Jul 13, 2009 10:07:04am

This is a done deal, the Randall Terry types are all out there agitating against confirmation, but if Sotomayor isn't confirmed the replacement nominee will be worse, and will be confirmed. Elections have consequences is the saying I believe.

5 lawhawk  Mon, Jul 13, 2009 10:07:19am

Unless Sotomayor opens up and drops some kind of bomb on the proceedings, she's getting confirmed. This is all about Senators getting a chance to grandstand before microphones under the illusion of asking "questions". And who exactly is going to get in the way of the stampede to the microphone?

6 Bob Dillon  Mon, Jul 13, 2009 10:07:47am

"Today, we consider the nomination of Judge Sonia Sotomayor to be a Justice of the United States Supreme Court. Our Constitution assigns just 101 of us the responsibility to act on behalf of all 320 million Americans in considering this important appointment. The President has done his part and made an historic nomination. Now it is up to the Senate to do its part on behalf of the American people."

Anyone believing that - I have a bridge in NYC - Cheap.

7 reine.de.tout  Mon, Jul 13, 2009 10:07:52am

I believe I will skip watching it, and just wait for the news confirming the confirmation.

8 lawhawk  Mon, Jul 13, 2009 10:08:29am

re: #4 Thanos

She's getting confirmed even if the GOP goes all out against her. They don't have the numbers. So, unless there really is a skeleton in the closet, this is a done deal.

Elections do have outcomes. But we already knew that...(paging mandy in 3...2...1...)

Have they thought of the environmental impact of this? All the lights and cameras in the hearing room; all the warming caused by the hot air. These hearings are an ecological disaster! Where's Al Gore?

I actually feel kinda sorry for the media on this one- it's like having to cover an election back in the old Soviet Union.

OK, I lied. I DON'T feel sorry for the media...

11 _RememberTonyC  Mon, Jul 13, 2009 10:08:52am

there is nobody in their right mind that would bet on sotomayor not being confirmed.

12 VioletTiger  Mon, Jul 13, 2009 10:08:57am

Althought the outcome is already certain, I hope intelligent and fair questions are asked...and answered. The process is important and nobody should be in a position to say 'we did not know'.

13 Honorary Yooper  Mon, Jul 13, 2009 10:09:15am

We'll see what comes of the hearings. I only hope they ask decent questions regarding her judicial experience and decisions and make the best decision based on her credentials rather than politics.

OK, I want a fantasy world where politics are left out of these decisions.

14 Pianobuff  Mon, Jul 13, 2009 10:09:45am

Lindsey Graham said this morning that it would take a meltdown for her NOT to be confirmed.

From the little I watched on C-Span, this woman had some pretty dramatic shifts in body language as the baton was passed from D to R and back.

This is about as slam-dunk as it gets. Looks like the R's might be laying down some rhetorical markers for future nominees though...

Well, it seems the questioning is going as anticipated:

Senator Sessions: "Could you please clarify your "wise-latina woman" remark?"
Senator Shumer: "What's your favorite color?"
Senator Coburn: "What are your thoughts on judicial activism?"
Senator Boxer: "Do you like puppies or kitties better?"
Senator Graham: "What is your position on Heller v DC?"
Senator Franken: "Who's your favorite Saturday Night Live alumnus?"
Senator Cornyn: "How do you feel about Roe v Wade?"
Senator Durbin: "Knock, knock!"

(Well, it could go like that ya know.)

Exactly! Ted Kennedy opened this box in "88 when he stood on the Senate floor to smear SC candidate Bork. Demand that the Repubs play by the DEM rules for review.

By her own numerous printed and written statements, Soto violates the SC oath of office.

If the beltway Rebus like Graham cut a deal this time, listen real soon for Palin to "take it to the people" regarding the stink of waffling on such a disqualified candidate.

The issue here is the "rule of law", not the opinions of a supposed "wise Latina". Remember what the DEMS did to Estrada - no vote permitted.

(Fox News stating that Left is attacking/smearing New Haven Fife fighter, Frank Ritchie - he who just prevailed over Sotomayor in the USSC.)

73 Shr_Nfr  Mon, Jul 13, 2009 10:27:23am

She is probably too smart to repeat Bork's mistake. That mistake was to not observe the 90/10 rule. To get confirmed, you let the Seniletors (sic) spout off for 90% of the time and you only talk 10% of the time. You also do not get into mass debates (sic) with them. If they say something that you disagree with you just say "You raise an interesting point", and then proceed to talk to something else. Bork argued too much.

Did you guys see that the Democrats are going after the New Haven fire fighter? They want to do to him what they did to Joe the Plumber.

Unfortunately for him he picked the wrong time and place to have a case overturned in his favor by SCOTUS. He has a history of job litigation that is going to make Joe the Plumber look like a he was having a walk in the park compared to this guy.

This is going to get really ugly soon.

Carley is a disaster. She ruined Lucent and HP. I would have a very hard time voting for her for dog catcher.

Boxer is a vastly worst disaster and has been for her entire tenure in the Senate.

She represents only a small fraction of the state. She runs very dirty campaigns that rely on gross distortions of her opponents. Matt Fong was a highly qualified candidate and was as middle of the road and level headed as they come. She destroyed his public career with character assassination and gross policy distortions.

But California deserves Boxer - most people don't think when they vote here - they just "feel". And the Democrats are always compassionate and the Republicans are always borderline criminal sociopaths that want to pollute the state, eliminate employment, kill the poor and hold compulsory revival meetings. And the press dutifully plays along.

Whether the stimulus package is working or not depends on what its real purpose is.

Sadly, we know what the purpose is not. It isn't to support competition, free markets or private enterprise.

re: #69 buzzsawmonkey

While we're looking at the Sotomayor Spectacle, let's take a little look at what Cass Sunstein, Samantha Powers' husband, wants to inflict on the US.

Powers, you will recall, is the Harvard whackjob who advocated using US troops to force Israel to give the "Palestinians" a state.

Sunstein seems to want to make blog sites accountable for the words of their commenters.

I wonder what Latina wisdom has to say about the Obama inner circle's hostility to free speech.

From the article:

. .. Cass Sunstein, a Harvard Law professor who has been appointed to a shadowy post that will grant him powers that are merely mind-boggling, explicitly supports using the courts to impose a "chilling effect" on speech that might hurt someone's feelings. He thinks that the bloggers have been rampaging out of control and that new laws need to be written to corral them

I wonder who he envisions will be making the decisions that any particular piece contains something that might hurt somebody's feelings? wah-wah-wah.

. . .

In "On Rumors," Sunstein reviews how views get cemented in one camp even when people are presented with persuasive evidence to the contrary. He worries that we are headed for a future in which "people's beliefs are a product of social networks working as echo chambers in which false rumors spread like wildfire."

He thinks the public is too stupid to sort through information and form its own conclusions; instead, he seems to want to ensure that "persuasive" (not necessarily factual) evidence can change people's minds.

Here may be a partial answer.

President Barack Obama’s nominee to fill a Supreme Court vacancy was one of a trio of appeals judges who last year rejected the First Amendment claim of a Burlington student penalized by school administrators for using foul langauge in a blog she wrote at home.

re: #113 buzzsawmonkey

Terrifying, no? And this is a "respected Harvard law professor."

The mental rot in the academy is truly mind-boggling; as with Holdren, there are any number of "respectable academics" in any number of institutions who serve to validate such opinions. And, as with the Middle East Studies departments which have been given over almost entirely to rabidly pro-Arab (and, need I say it, anti-Israel) points of view, when there is a unanimous chorus from the "respectable" sources that such and such is the correct opinion, countervailing points of view...vanish.

It is absolutely terrifying.

These people are so convinced that they are correct, and everybody else is wrong, nothing is too radical for them to use to make sure we all get the "correct" message and nothing but the correct message.

Speaking of conservatives, a new Gallup poll show the POTUS's popularity by groups. He's over 90 % with self identified liberals, and 16 % with conservatives. Maybe that's why the country is so polarized.
The other stats show his strengths and weaknesses with other groups.

153 Rexatosis  Mon, Jul 13, 2009 12:06:26pm

Just a couple of points on the elevation of Judge Sotomayor to the SCOTUS.
1. She is far from an intellectual heavy-weight and will probably have little more impact than Justice Souter, basically a vote. Justices with impact are the ones who write the opinions.
2. Given her health issues it is doubtful she will be on the court for thirty + years (ala Justices Stevens, Douglas, White etc.).
3. Given that "elections have consequences" it is actually surprising Pres. Obama did not go for a more substantial liberal intellect who could possibly dominate the court for the next thirty years (say what one will about Justice Ruth B. Ginsberg but the woman can write an opinion and is THE dominant liberal intellect on the court)
4. In all this choice is far from the worst/best that could have been made.
