Poll: Majority Expect Sotomayor to Be Confirmed

The latest Rasmussen poll shows 90% of voters expect Sonia Sotomayor to be confirmed.

Following the first two days of confirmation hearings for Judge Sonia Sotomayor, voters overwhelmingly expect her to be confirmed for the U.S. Supreme Court but remain divided as to whether she should be.

Ninety percent (90%) now say her confirmation is likely while only four percent (4%) say it is not.

A new Rasmussen Reports national telephone survey finds that 37% of voters now favor her confirmation while 43% are opposed. Importantly, those who are undecided have a positive view of President Obama and are probably willing to give him and his nominee the benefit of the doubt.

Let’s see what kind of results we get with a couple of LGF polls:

She will get in and unless she is hiding some terrible secret that has not surfaced, she should be confirmed. She meets the requirements. NOW, do I think she will be a good Justice? Maybe, but I doubt it. But, she is replacing a bad one. I just hope she is no worse than Souter was.

Curiously, Charles' own poll is tracking the Rassmussen poll - with 91% saying she'll be confirmed. The rest think she wont or have no opinion.

Looks like just about everybody (including me) agrees: She will be confirmed, but we aren't happy about it.

Otherwise, I'm feeling grumpy this morning, because I desperately need to make an update to the Holdren essay (about the White House statement), but can't do so because traffic overload prevents me from logging in or even accessing zombietime. Sooo frustrating.

I disagree. Sotomayor is a qualified hack. She doesn't have the intellectual firepower of Roberts, but few of us do. She's replacing a like-minded member on the Court, but I don't expect her to pen decisions that will stand out over time for their insight and reasoning.

It's not that she's "unqualified" -- she has the experience. It's just that many of us strongly suspect she'll have a political and personal bias to her rulings for the next 25 years straight.

If the question is should she be appointed the answer is unequivicably yes. Regardless of her political slant she is the nominee of the current President of the United States and no evidence has come to light that would disqualify her from serving in that appointment.

Now if you had asked would I like to see a more conservative judge appointed to that position...

I think if the Senate (and I mean both Democrats and Republicans) held her feet to the fire and really questioned her constitutional knowledge then I would be certain one way or the other. I voted "undecided" on the second question because right now I am not even seeing anything that a typical pretty easy job interview wouldn't bring out.

There's the difference right there. The Democrats have no shame and will gladly and willing politicize a confirmation hearing to the hilt. The Republicans are unwilling. One reason is the Democrats, in a show of amazing gall and hypocrisy , would scream bloody murder if the Republicans did to them what they routinely do to the Republicans. The Double Standard is in the "ON" position in Washington, DC.

It's even worse than that over here. I spoke to my mother yesterday evening, who announced she had spent all day watching the Sotomayor hearings and the news coverage about her confirmation. After 8 hours of soaking up information, she thought that --

a. The Republicans were grilling her merely because she used the word "Latina," which as racists they found offensive;
b. That she had ruled in favor of the white firefighters in the Ricci case, "because they were in the minority and she likes to help minorities";
c. That Supreme Court appointments only last until the next election.

Old people. What're you gonna do?

I'm holding out for Tony Jaa to replace Breyer. Imagine the deliberations!

No, it's a BIG important update, which affects the whole essay -- the White House and John Holdren's office have issued statements in response to my post. Just not one little detail. And the reason it's so frustrating is that zillions of people are currently accessing the old version of the essay, unaware of this new update -- which I can't upload because so many people are accessing the site!

Elections have consequences. I believe that, baring some major ethical or competency issues, any President's Supreme court nominee should be ratified. That is what "advise and consent" means to me. When you vote for a man who has little regard for the constitution you will have to live with his nominees. Of course the President himself would disagree... were he not the President.

You're completely off-line right now. I'm getting an instant 'server not found' message, which means your DNS is down too.

There's only so much traffic a single server can handle. But one thing you can do to increase that is to limit the size of the images on one page -- for example, the Holdren page was several megabytes in size. If every request for the page has to serve several megabytes, it doesn't take long at all until the traffic forces the server to give up.

One way to approach it would be to use thumbnail images linked to full-size ones, so the main page isn't so huge...

There's only so much traffic a single server can handle. But one thing you can do to increase the amount of traffic you can handle is to limit the size of the images on one page -- that Holdren page was several megabytes in size. If every request for the page has to serve several megabytes, it doesn't take long at all until the traffic forces the server to give up.

One way to approach it would be to use thumbnail images linked to full-size ones, so the main page isn't so huge...

Yeah, that's true -- though it's too late now, because I can't even get in to the back end to make any changes along those lines.

Though, your design wisdom does bring up an interesting dilemma. I believe that one of the key reasons why various past zombietime reports (and my photo essays in general) have proved so popular is that ALL the information is right there in front of you right off the bat -- no clicking required, no effort involved. I think it's a subconscious thing on the part of the reader -- people don't really want to have to do anything to see the content. They just want it to be there.

I realize this flies in the face of much modern Web design theory, where "interactivity" is promoted as the best way to go and what readers want, and Web sites in general are more and more requiring visitors to click on something or do something to access various components of the content. I, on the other hand, presume laziness on the part of my visitors -- Just give me the pictures, they seem to say. And so I do.

(The Ajax doohickeys on LGF are another brilliant solution, because it gives the content without having to reload a whole page. But that is way out of my skill league.)

95% of the time my approach is never a problem, because most of the time zombietime/zomblog is "just another blog" whose server resources are not overtaxed or even challenged. It's only a few times per year when some post of mine "catches fire" and my picture-heavy pages cause a meltdown from too much traffic.

I think actually that even if I had smaller images on the front page of the essay, I'd still be overwhelmed and offline, because the amount of linkage and traffic heading my way today and yesterday is simply ungodly. I might have been able to squeeze in a few more visitors if I had smaller jpegs in the essay -- but on the other hand, if I had smaller jpegs, then the essays wouldn't have been so popular in the first place!

Rock, meet hard place.

At this stage, I think I'll just have to sit back and weather the storm, and post the update later when things calm down a bit.

Yeah, but -- Adobe products kick ass. Illustrator crushes the competition as far as vector graphics (i.e. "drawing") goes, and Photoshop crushes the competition in the pixel-by-pixel manipulation category. And in just about every other instance, the Adobe version of any particular style of graphic application is better than any other.

Sotomayor is suffering from a split personality. The first person could be a lovely neighbor with whom one shares a cup of tea. She was charming, relaxed, polite, and respectful to the questions being lobbed at her from Graham. In fact, she seems absolutely likeable.

However, her answers to the simplest questions are vaque and evasive to the point of being almost painful to observe. How can she not know that the Puerto Rican Legal Defense and Education Fund was taking the extreme position of equating the denial of abortion funded tax dollars with slavery in the briefs the organization filed. Perhaps it is true that she never actually read the briefs, but certainly we are not supposed to buy the story that as a board member she was just concerned with fundraising for an organization but unaware of their political and legal positioning?

This smacks of intellectual dishonesty to me.

Her connections, her comments, and even some of her rulings cause me very great concern.

I think we are going to get a real eye opening experience when this lady hits the Supreme Court bench.

I was upset by the fact that they think that somehow, spending LESS time with your family is a way to ENHANCE your experiences.

At any rate, their "enhancements" include:
having one single family reunion at a central location that works for everybody (which may actually have been one of the 4 visits the inquirer had with the family), and they can tell you how to hire a great Russian comedian! - seems like that could be as costly as a road trip, but what do I know?

You can compress the .jpg images to make them smaller filesize wise without making the smaller physical size wise. I do this alot with my pictures. Living in a rural area I don't have access to true high speed internet so in order to send pictures I compress them first which reduces the quality of the image but not the size. The quality reduction in many cases is unnoticeable while the kb size of the image is greatly reduced.

My problem with the second poll question is this: what does "should" mean? Take it in the abstract, and the answer is no. The new justice should be Miguel Estrada. But that's not going to happen. Suppose she's voted down, which seems infinitely improbable, but suppose.

Who will we get next? Most likely, a vengeance nominee, designed to teach Republicans a lesson. Not even the shadow of a nod toward conservatives.

Sotomayor is at least bright and she doesn't have a reputation for corruption. Among the several who Obama will name, she'll be above average. Pray she's not way above that average.

You can compress the .jpg images to make them smaller filesize wise without making the smaller physical size wise. I do this alot with my pictures. Living in a rural area I don't have access to true high speed internet so in order to send pictures I compress them first which reduces the quality of the image but not the size. The quality reduction in many cases is unnoticeable while the kb size of the image is greatly reduced.

Oh, I've been doing that since Day One. Maximum file size for any jpeg embedded in a zombietime page is 68kb. I always decrease the files sizes while trying to maintain the highest quality at the desired dimensions. It's just when you need 30, 40 or more pictures on a page, they add up, even if moderately sized.

If anything, I think it just pisses people off, because their family isn't enjoying all those fun times the TV is telling them they should. The reality is, unemployment and underemployment are incredibly stressful. Any tensions in the family are magnified times 100 as you're wondering just how long you can keep going. When you've had to give up cable TV, you are probably all just sitting around staring at each other resentfully, not playing charades and having a taffy pull like the people in the commercials.

Our family has been scaling back for several years. We have found ways to make our own fun, but we used to do that anyway. However, being frugal with the hopes of eventually being able to afford that small vacation or special treat in the future is much easier than being frugal because you hope to be able to afford school supplies and gas to drive to the bus stop in two months.

You are dead on. I was hoping to do some badly needed home repairs this year, but that's not happening.

Every time I read an article about Sotomayor, I'm more bothered by her record. But this morning I read the article about the innocent man she let languish in prison for six extra years when it had been made crystal clear he was not guilty of the crime for which he was convicted.

Our corrupt judicial system is one of the things that enrages me and keeps me awake at night. She's a part of the corruption, and not a single member of the GOP is going to hammer it. Why? 1. They're afraid of being called racists. 2. The DA in the case who connived with Sotomayor to keep this man in prison was none other than Jeanine Pirro who went on to become a GOP establishment politician. 3. They know she'll be confirmed anyway, so why take the risk?

People don't know what a horrible judge this woman has been. I doubt Obama even knows. He chose her for aesthetics alone. Disgusting.

Sometimes it does, sometimes it doesn't. Depends on the setup your host has. Generally they keep it separated so that DDoS attacks against the web server don't also take down the administrative email accounts.

Many in the GOP were scratching their heads at that one. She wasn't qualified, especially when compared to who Bush eventually chose (Roberts and Alito), which magnified just how unqualified she was. While a President can pick and choose whoever he wants as a nominee, the President still needs members of the Senate to go along. That didn't happen with Myers.

Gonzales was a mess, with conservatives noting that Gonzales supported abortion rights, but more importantly was his conduct as AG. That made his possible pick all the more troublesome, since it would bring still more attention on the AG during the GWoT and the activities of the AG's office in dealing with terrorism and the legal opinions the AG provided the Administration.

I think Sotomayor is not the worst choice we can get by any means for an Obama SCOTUS nominee. And I don't see her as a "racist", as some have claimed. However, I was taken aback by the sheer mendacity of her explanation of the "wise Latina woman" remark. In essence, she said that she intended to mean exactly the opposite of the plain meaning of her remark; and this despite the fact that (so I've read) on other occasions she used essentially the same remark to make essentially the same point, both verbally and in writing.

The legislation unveiled yesterday would place additional taxes on households with more than $350,000 a year in income and calls for further increases if the measure doesn’t hit a target for cost savings. The provisions are intended to raise $544 billion over 10 years.

There's a requirement to buy health insurance and for employers to provide insurance:

The House is also proposing a mandate on Americans above a certain income level: People would be penalized as much as 2.5 percent of their income for failure to buy health insurance. Most employers would be required to insure their employees or pay a penalty equal to as much as 8 percent of their payroll.


1. Know how you get our from under the 2.5% individual penalty? Have no declared income (i.e., work off the books).

2. Know how businesses get our from under the 8% penalty?
Have no employees. Suddenly everyone is a contractor.


This is going to be a train wreck. Tax revenues will plummet, unemployment will jump and costs will explode.

But the Democrats will succeed in punishing success and transferring some wealth to their voting base.

My father owned a downtown hotel where we lived and I doubt that I saw a baseball until my teens. I'd need the plate maybe 30 feet out, because I can only aspire to throw like a girl in my dreams.

My only Paris experience is the Hotel Cayre (K&K Hotel), which we found quite nice. Probably 200 euros a night or so (dbl). Great location, Metro is down the bloc, and walking distance to most of the major sites.

Like I said, it's the only hotel I can recommend, and you're paying for the location - centrally located and walking distance to the Louvre, Orsay, Place de la Concorde, etc. Great shops, restaurants, etc.

I've got a much better choice of restaurants than I do hotels... so let me know if you need ideas...

Myers got crossways with Bush's base - who found her credentials seriously wanting. Forget the fact that the left didn't like Myers as a choice. Many in the GOP were scratching their heads at that one. She wasn't qualified, especially when compared to who Bush eventually chose (Roberts and Alito), which magnified just how unqualified she was. While a President can pick and choose whoever he wants as a nominee, the President still needs members of the Senate to go along. That didn't happen with Myers.

Gonzales was a mess, with conservatives noting that Gonzales supported abortion rights, but more importantly was his conduct as AG. That made his possible pick all the more troublesome, since it would bring still more attention on the AG during the GWoT and the activities of the AG's office in dealing with terrorism and the legal opinions the AG provided the Administration.

Like I said, it's the only hotel I can recommend, and you're paying for the location - centrally located and walking distance to the Louvre, Orsay, Place de la Concorde, etc. Great shops, restaurants, etc.

I've got a much better choice of restaurants than I do hotels... so let me know if you need ideas...

That would be HS fencing class for me. The girls realized they could win a round by committing one strategic foul at the start and the guys would spend the rest of the time protecting their most vulnerable spots to the detriment of their fencing.

LeMarais is not a gay as all that. It's also home to Paris' old Jewish quarter. Go figure. This website lists lots of places. The concept is that private individuals who own small apartments in Paris rent them out. There are units all over the city. The website acts as a broker. We had a very positive experience, but the room was very basic.

I've stayed in that area many times, but I don't remember the names of any of the small hotels that I stayed at in that area. The last time I was there, 2 years ago, the rate was about 55 euros.

That area is packed with 2 star hotels. They are clean but small. If your interest is having a place to clean up and sleep, then this is what you want.

The Gare de Lyon, on the east end of Rue de Lyon, is a major train station for high speed trains to the east, the RER (suburban trains) and the Metro (subway). The yellow line (#1) runs through there, and that line gets you to most of the attractions from east to west, along the Seine. You are only 20 minutes away from most of the major attractions by Metro Line #1 (Notre Dame, Hotel de Ville, Ile de Cite, Louvre, Musee de Orsay etc.

You are also with in walking distance of the Marais, which is the old Jewish Quarter of Paris, full of wonderful little shops and cafes.

Really, if you don't HAVE to have the biggest and the best in hotels, then this area is one of the best bargains in town.

Ha! I compared it to Toronto's Jarvis & Wellesley district. Now that's gay!

It just happened to be where we found a place in our budget at the time. It was on the 5th floor, no elevator, so by the end of a week we calculated we had climbed an equivalent to the top of the Eiffel Tower. Having the kitchenette was great as we bought food from local markets & boulengerie and saved a bundle. We still ate out once a day, because the restaurants are great.

Next time you're in Paris, if you want to get that medieval "forcibly converted" feeling, stay at the Hotel St. Merry. On one side of the hotel, the buttresses from the adjacent Gothic church literally come right into the rooms. (It's kind of cool.)

Yes there is, about a 2 1/2 hour trip. I taken the TGV from Gare de Lyon out to Burgundy. LYon is the second largest city in France, and it has a lot of neat Roman ruins (of course the largest ruins are in Arles).

I find the 12 district around the Gare de Lyon as one of the best deals in Paris.

All this talk of Paris is making me want to go back. I was in Europe on work and sent my new girlfriend a plane ticket to meet me in Paris. I took the TGV from Geneva to Garre de Leon, then I met her at Charles de Gaul. We had a week of fun, food and f... well you know.

We got married a year later and we now refer to that trip as our pre-moon.
