If Dan Rather had put a tiny fraction of the effort he’s expending on his lawsuit against CBS into verifying those fraudulent Bush National Guard documents, he might not be in this predicament: Rather Wins a Round in Lawsuit Against CBS.

Dan Rather won significant victories Tuesday in his suit against his former network, CBS. He won access to more than 3,000 documents that his lawyer said were expected to reveal evidence that CBS had tried to influence the outcome of a panel that investigated his much-debated “60 Minutes” report about former President George W. Bush’s military record.

Mr. Rather also won an appeal to restore a fraud charge against CBS that had been dismissed. Martin Gold, the lawyer representing the former anchor of the “CBS Evening News,” called it “a very successful day for us; we got everything.” Mr. Rather called it a “good day” for his side and — referring to the name for the CBS headquarters — “a bad day for Black Rock.”

Jim Quinn, the lawyer representing CBS, called it “a minor skirmish in a long battle” and predicted that the fraud charge would be dismissed again because “it’s frivolous.” He added of Mr. Rather’s day in court, “Was it favorable for him? Yes. Was it meaningful? No.”

CBS said in a statement: “Today’s rulings by Judge Gammerman were on technical and procedural issues, not on the merits of Mr. Rather’s allegations. Most of Mr. Rather’s claims already have been rejected by the court and that has not changed. We are similarly confident that Mr. Rather’s re-pleaded fraud claim will be dismissed once the court reaches the actual merits. We also await the appellate division’s decisions on pending motions which, we believe will further curtail his claims.”

There’s something pathetic about Rather pursuing a fraudulent suit against CBS (for fraud), after trying to tilt a presidential election with fraudulent documents — when neither Rather nor CBS have ever admitted the documents were obviously faked. They’re all scoundrels.

He's hoping that CBS pays out, but the more this case sticks around, the more I'm hoping that CBS pulls out a throbbing memo in a Powerpoint presentation to show just how dishonest Rather and Mapes were in pushing this nonsense in the first place.

Rather is hoping to get sympathy from a jury that finds CBS pushed the Thornburgh panel to issue the results that it did (and which never went nearly far enough to show just how dishonest Rather and Mapes were from the outset pushing these unsourced and poorly (read as not) vetted documents, which are bogus and could never have come from the sources as claimed in the piece.

As Charles says, there are no winners here, only scoundrels.

Two old canards in that... first the "fake, but accurate" meme. Doesn't matter that the documents were forged, it was the truth.

and second (my fav) someone (Karl Rove) set this all up to make democrats look bad.

Of course the better explanation is that a person, who is known to hate GWB, forged some documentation and sold it to a predisposed CBS, who in turn not only did not use any critical thinking, or even question the source, but also tried to cover it up with lies ("I know the source") .

Dan Rather was the replacement for Walter Cronkite, remember.

Dan just saw the accolades the media heaped on Cronkite when he died.

Dan had planned all along to be similarly idolized when he passed to the Great Beyond. He sees the treatment Cronkite got, and he sees what he thinks he deserves. And he knows in his heart now that when he eventually dies of old age, his passing will barely be noted -- a footnote in history. And the pain of not going down in the annals of the media as one of the all-time greats is simply driving him crazy. He blew it big-time. And his downfall? The Rathergate memos.

(One might argue that Cronkite doomed LBJ and forced him to withdraw from the race after the public believed Cronkite's lie that the Tet Offensive defeated the Americans and that the war was lost. And that Rather wanted to repeat that "success" at determining the outcome of a presidential race. But in truth, I think LBJ had already decided to not run by the time of the Tet Offensive anyway.)

This is a classic fishing expedition. Rather's lawyer knows he can't win this case, so he's demanding every scrap of paper he can lay hands on from CBS, hoping to sift through it all and find the ordinary discrepancies, contradictions and omissions that plague day-to-day life everywhere, then attempt to blow them up from molehill to mountain size. Or, find something else to sue for. In the back of his mind, Rather's attorney is shuddering at the thought of putting the tinfoil-hat wearing provider of these documents on the stand to testify as to their provenance, and is hoping to change the subject before that happens.

In some jurisdictions, a client would have the right to demand compensation from an attorney obviously milking them for attorney's fees in place of a cut of a settlement that is never, ever going to materialize. Although Rather's probably happily goading him on and bankrolling the exercise.

For a little background:

Eddie Barker is a legendary newsman here in Dallas. He was a reporter, and later anchor for the old CBS affiliate KDFW (KRLD back then), which is now the local Fox station. Barker has integrity. University Park Elementary is in University Park, one of the island cities (the other being the even more upscale Highland Park) surrounded by Dallas.

Wow, here's something cool at his site:

Before 60 Minutes fame, Don Hewitt produced the Cronkite News and some JFK specials. Even then he was the idea man.

A good example: Lee Harvey Oswald used the name "A. Hidell" when he made the mail order purchase of the Mannlicher - Carcanno he used to kill the president.

One day the phone rings and it is Hewitt: "Eddie I want you to see if you can buy a Mannlicher - Carcano through the mail using the name "A. Hidell" and try and get the same post office box that Lee Harvey used."

To the task; I got a magazine full of mail order rifles and went to work. I ordered 12 Mannlichers from 112 (sic) different mail order houses using the name A. Hidell. The old post office number was not available. I used money orders to order the rifles.

Well, it didn't take long for results. A total of 11 M-Ns came in and a note from the 12th dealer saying it wasn't in stock.

Of course the rifle wouldn't fit in the post office box so I had to take the paper in the box to a window to retrieve the rifles. Not once did anyone at the post office bat an eye or look like either or the name was familiar to them. We did a story showing all of the rifles and how we got them.

Homeland Security had its problems then, too. So, what to do with 11 Mannlicher-Carcanos?

(1) Charles is completely correct to call Rather a narcissist. Charles also accurately points out the dazzling irony of suing for fraud but never admitting the "first fraud" of the faked documents. By the way, which blog was the one to catch Rather and CBS news? I can't remember. ;)

(2) Not to deny anything above, but Rather has now officially "won." He is trying to "save his legacy," as political animals do. With some microscopic court "victories" by his high-priced legal team, he -- and his future biographers -- can parse and obfuscate the matter. With a minor favorable ruling (that most likely will amount to nothing in the grand scheme of things), Rather can insist on being in the right all along. Sadly, I think he will actually believe this warped fantasy himself.

Well Rather keeps bringing this up, so I don't think he cares about the documents or of people thinking he is stupid. I think he is showing the early signs of dementia and truthfully he no longer knows or cares. His end goal is to pin this whole thing on CBS and get the dirt off his reputation before he dies.

Take Dan Rather. In Bias, the book about CBS by former CBS reporter Bernard Goldberg, the author describes telling Rather about a soon-to-be published article citing a CBS News report as a particularly onerous example of left-wing bias. To Goldberg's amazement, "Rather's voice started quivering, and he told me how in his young days, he had signed up with the Marines--not once, but twice!"

Again, Burkett comes to the rescue with the truth. Rather signed up with the Marines only once, and "never got through Marine recruit training because he couldn't do the physical activity," Burkett says. And he notes that Rather was "discharged less than four months later on May 11, 1954 for being medically unfit." And yet, Rather has been known to brag about his "career" in the Marines.

Rather has "made such a big deal out of this 'I'm a Marine' thing," Burkett says. "This is like a guy who flunks out of Harvard running around saying he graduated from Harvard. "You're not a real Marine until you get out of basic training. And Rather never did."

Even worse, the network anchor who ferociously attacked both Vice President Dan Quayle and President George W. Bush for avoiding Vietnam service himself took steps to avoid service in the Korean War. While a student at Sam Houston University in the early 1950s, Rather joined the Army Reserve, "thus avoiding the possibility of being drafted," Burkett notes. By the time Rather graduated, the Korean War was history.

"The second the Korean War was over, and he wasn't in jeopardy anymore, he dropped out of the Army Reserve," Burkett says. And that's when Rather enlisted in the Marine Corps.

Check out this site, Australian and New Zealand Military Imposters (ANZMI), for the equivalent phenomenon there, it's a problem not confined to the USA. The Brits have a term for them, "Walts", as in the Walter Mitty character.

So far, a superficial search turns her up blogging for The Nation and a post at Huffington Post re: Tiller's murder.

Anyone else? I'm too lazy to go further. That was from first 3 pages of searching "Mary Mapes" on Google. Seems she's faded into the woodwork. Good riddance, IMO.
