Another Nirther Case Thrown Out, Orly Taitz on Notice

Another Birther case has been thrown out of court, this one brought by a female Army captain trying to refuse redeployment to Iraq because she believes Barack Obama is a sekrit Moslem furriner.

And her lawyer, the whacked out queen of the Nirthers, Orly Taitz, has been warned that she could face sanctions if she continues filing these ludicrous, frivolous lawsuits.

Will this finally put a stop to the Nirther nuts and their crack-brained conspiracy theories? Don’t hold your breath.

U.S. District Court Judge Clay Land tossed out on Wednesday a complaint by an Army captain fighting deployment to Iraq by questioning the legitimacy of President Barack Obama.

Land also put attorney Orly Taitz, who represents Capt. Connie Rhodes and is a leader in the national “birther” movement, on notice by stating that she could face sanctions if she ever again files in his court a similar “frivolous” lawsuit — a document that at one point the judge states that a middle school student could find irony in.

“(Rhodes) has presented no credible evidence and has made no reliable factual allegations to support her unsubstantiated, conclusory allegations and conjecture that President Obama is ineligible to serve as president of the United States,” Land states in his order. “Instead, she uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper, an unlawful pretender, [and] an unqualified imposter.’”

I don't know if I've seen such a harsh rebuke since Judge Jones used "breathtaking inanity" concerning the Dover School Board. This is brutal.

It is brutal, maybe too brutal.
This kind of flowery, unprofessional language seems inappropriate. I would rather see a Judge use careful, precise, restrained language so as to avoid any appearance of grandstanding. The last thing needed would be for an appeal court to overturn the decision because the Judge caught carried away with his own language.

So do a lot of plaintiff's lawyers who file suits that have little basis in the way of legal, scientific, or medical fact. A few strong smackdowns and a few assessments of defendant's legal costs to the plaintiff might do wonders for our legal system.

I don't think I've heard of an appeals panel reversing a lower judge because of that lower judge's diction.

What gets me the most about this particular form of hypocrisy, is that the right are supposed to be the ones who understand the military and support it.

You can not support the military of this Republic and try to convince soldiers to violate their oaths or destroy the chain of command. And let's face it the real hard core nirther/deather/moronic convergence/come armed types are praying for an open mutiny.

This kind of language is used by a Court here when the Court is highly annoyed to the degree these nirthers are abusing the system. It is meant to send a message to Ms Taitz that she's facing serious consequences should she persist.

you would need something more than mere language. when i was externing at the court of appeals this summer i read some hilarious court transcripts of judges saying funny or inane things. bias is a much higher standard. you'd have the prove the judge went into the court with bias already, and for that you need facts (i.e. the judge is a member of anti-birther society or was an ex-husband of orly taitz).

As well there should be. I was still in the Army when the idiots started this stuff with Clinton. I didn't vote for Clinton, but to disobey orders based upon some complex legal standard does not fit with the defense of disobeying objectively immoral/illegal orders.

Re-read the 14th Amendment of the Constitution...also, 'natural born' has to do with where one is born and not the citizenship status of the parents which is fundamentally immaterial.

It is brutal, maybe too brutal.
This kind of flowery, unprofessional language seems inappropriate. I would rather see a Judge use careful, precise, restrained language so as to avoid any appearance of grandstanding. The last thing needed would be for an appeal court to overturn the decision because the Judge caught carried away with his own language.

I think the judge's language is careful and precise - it states exactly what one of Taitz's central problems is: the demand that the accused prove their innocence of charges, not to mention charges that have no evidence whatsoever backing them up. And, frankly, it seems restrained to me; I would have been much, much more harsh and imposed the strongest penalties possible on the spot for wasting the court's time with frivolous bullshit.

Good on the judge. His statement is spot on, and will hopefully serve as guidance for any other judges this idiot starts posturing before in the future.

My info about military medicine is outdated, but I'm guessing that it's a lot easier to serve an internship or residency as a stateside Army officer than as a bottom-of-the-totem-pole civilian doctor.

The US taxpayer paid Rhodes' way through med school. If she does not complete her service requirement, does she have to pay the money back? If so, I favor releasing her for conduct unbecoming and socking her with court costs for her maliciously frivolous litigation. If not, I hope the Army will be...thoughtful...about her future assignments.

Sadly the downside of free speech is that deplorable people can say reprehensible things. I was watching the news hour tonight on PBS and they were having a conversation about Carter's race question and I was a little surprised that nobody pointed to the birther movement as a focal point rather than the much weaker claim that Joe Wilson's outburst was racist (which I don't buy - it was stupid and classless but I think he's stupid and classless around white people too). In today's society even racists won't go around publicly using epithets and the like but they will tell Obama to go back to Africa (on signs) and claim that has nothing to do with race.
