Dan Rather’s Suit Against CBS Tossed Out

Dan “Fake Documents” Rather is not having a good day: Appeals court tosses Dan Rather’s $70M suit against CBS.

Bad news for Dan Rather: His $70 million lawsuit against CBS is no more.

In a 19-page decision made public Tuesday, a state appeals court dismissed the legendary newsman’s suit against CBS. Rather, 77, sued the Tiffany network in 2007 after his career at CBS collapsed in the wake of a “60 Minutes II” report about former President George W.Bush’s Vietnam-era military service. …

As recently as Sept. 21, lawyers for Rather said he would be vindicated and that Bush’s military service would be proven to be a sham.

A lawyer for Rather and a CBS spokeswoman could not immediately be reached for comment.

We had a major media figure trying (unconsciously, I think, by not questioning his own convictions) to influence a US presidential election by running a bogus story. LGF sniffed it out. Charles (and a few others) showed us proof that is was BS. If it happened, five, ten years prior, well, we would not be discussing this right now, would we? We may well have had a President Kerry. I see Little Green Football's has Michelle Malkin as his "Outrage of the Day!" and he has taken up the practice of using an unflattering screen grab from the Left to picture her. He also manages to work up a post attacking me on down.

I'm only pointing it out as he has so few readers anymore it's all too easy to miss. At least he'll get an extra year or two from that masturbatory fantasy of a webserver I picture him sleeping with these days.

A tsunami warning was in effect for American Samoa, Samoa, Cook Islands, Tonga and Fiji, among others in the South Pacific archipelago, according to a bulletin from the center.

A tsunami watch was issued for islands farther from the epicenter, including Hawaii and Papua New Guinea.

For those of you outside New York, that would be the equivalent of your highest state court, usually referred to as the "Supreme" court. As you can imagine, not a lot of cases get accepted by our Court of Appeals each year, but hey- Dan, I love the whole LGF morphing memo thing, so I think you should go for it. Good luck with the motion for leave to appeal. Make sure you get your papers in on time- you have to file with the lower court, and remember, you're using the same index number. And Dan? I know this has got to be costing you a fortune, so remember, you've got people out there rooting for you. Keep it going. In fact, get your own web page and set up a tip jar. I'm in for a sawbuck. The entertainment value of this is endless. Honest to God. Really.

Took the words right out of my mouth. (I presume there's no way a lawyer would take this case on a contingency basis.)

Note to Rather's lawyer: Since you're going to a higher court, that should mean a higher billing rate, no? Double sounds about right. I honestly don't understand how someone can lie about another person with sole intent to damage the other's reputation, know they're lying the whole time, and then be the one alleging they were wronged. It really feels like the consequences were too light for Rather and company, far too light.

I don't like the idea of outright, vigorous criminalization of slander and libel, but at the same time, it's very hard to say that self-governance doesn't suffer when people are allowed to attack each other any way they like.
