Birther Queen Fined $20K for Misconduct

The queen bee of the Birther “movement” (no, not the shrieking harpy, although the name applies pretty well in this case too) has been hit with a $20,000 fine for her idiotic frivolous lawsuits.

In an order today, California attorney Orly Taitz has been sanctioned $20,000 by U.S. District Court Judge Clay Land — double the amount he said he was considering.

“While the Court derives no pleasure from its imposition of sanctions upon counsel Orly Taitz, it likewise has no reservations about the necessity of doing so,” Land states. “A clearer case could not exist; a weaker message would not suffice.”

Land gave Taitz two weeks from Sept. 18 to show cause why he should not sanction her for filing a motion for emergency stay in a lawsuit he called “frivolous.” On the deadline, Taitz filed a motion for an extension of time.

Taitz told Talking Points Muckraker today that she isn’t going to pay.

I would've liked to see at least some sort of community service time. Taitz should be picking up garbage on the side of the road on her days off work (in an orange jumpsuit, IMHO).

I would enjoy that. Whenever I drive past one of those community service crews picking up trash, it makes me feel...like littering.

As a rule, judges can't suspend lawyers, only refer them to the state bar. The Bar Association its makes the decision to suspend or disbar.

Honestly, how stupid could a person be? Even in a jury case, it is the judge who decides what the jury gets to see and what they have to discard. If the jury is anywhere near competent (not a sure thing, but as a general rule, in low-profile cases, they're okay), they will fry your testicles for breakfast if the judge lays down strict rules that inhibit your case.

Technically, yes, they can. Generally, though, they refrain from such bluntness, and instead lay the smackdown in politer terms, leaving no doubt as to the meaning but not actually saying the word "dumbass".

You're probably right, but it would be a shame. If it doesn't come out of her pocket, than she's not being fined. The idea is to punish HER not her lackeys.

She doesn't want to pay? Fine. They'll slap a lien on everything she owns. And if she keeps it up, she may see some real jail time. One can only hope.

I think there is a good argument that this would be an ethical violation. Not that the judge would lose his position over one such insult or several insults like this, but if a complaint were filed, he'd have to respond. Once those wheels start turning, its a big pain in the ass. Also, personal comments like that could be used in her favor if/when she appeals. Bottom line: not worth the trouble.

Or by summarily finding in favor of the other party. I saw this happen one; one of the parties didn't show up, his attorney asked for more time, so the judge moved on with the next case. When that was finished, still no appearance, so the judge - very obviously pissed - told the other party they had just won as a result of the first party's demonstrated lack of respect for the court's time.

On another occasion, an attorney asked the judge for another in a long series of delays, for no apparent reason. The judge made it quite clear that he had done this a number of times already, told the attorney he had had plenty of time to prepare for trial, and the case was going to trial right now, let's hear your opening arguments. The attorney was completely unprepared to proceed, and wound up losing from the bottom of a smoking hole in the ground.

There's still hope. Remember, he was originally only going to fine her $10K, and doubled it because of her outrageous response to the show cause order. I half-way expect Orly not to quit when she is behind and to file an idiotic and offensive motion to vacate, and see if she can get her fine trebled!
