Start-up publisher OR Books has announced plans to publish Going Rouge: Sarah Palin An American Nightmare, a collection of essays about the maverick Republican with a title — and cover design — remarkably similar to Palin’s upcoming memoir. What’s more, OR’s paperback tome will be released on Nov. 17, the same day that Palin’s own Going Rogue: An American Life hits shelves — and one day after Palin’s just-announced, first-ever appearance on Oprah Winfrey’s show.

He might be. I’m not outraged but I am irritated. Publishing a book like this is a low tactic. OR Books shouldn’t be doing that. They should make the cover sufficiently different as to not step on her book. I do have a question to ask:

Not so sure. Theres enough plausible deniability in the photo, (main and background) and inverted title/ sub title

If nothing else, it’s not a clear cut case and would make Palins publisher look petty even if they won.

I’ve had more experience with copyright issues than I really wanted — software, music, trademarks, etc. — and I promise you: there’s no copyright violation here. The standard for copyright violation is much higher than just having a book cover that looks similar.

I think its more like piracy. Sure they will sell copies to people who know exactly what their book is about, but I’m guessing they also know X number of people will pick up their book by mistake. They can’t assert that unless they actually trademarked it. You can’t just claim a trademark, you have to have it legally registered. And trademarking common words is not easy to do, and many times the trademark will be denied.

No, they couldn’t sue for Copyright Infirngement. However, the publishers of Palin’s book could certainly sue for Trademark. It’s called ‘Trade Dress’, and protects the look and feel of a certain product. It took me a few seconds to realize that I was seeing two different books, and not the same book with a slightly different cover. I mean, they both have the same “40 Year Old Virgin” type of photo.

Of course, it may be to bring a lawsuit intentionally. What better publicity for a book than that?

Yeah, the publisher would definitely need a pretty robust legal basis for a trademark claim on the subtitle of the book, and I seriously doubt one exists. Doesn’t mean they won’t try, though.

I gotta say, when I first saw her (on tv) addressing the convention, she scared the bejeeesus out of me (me being one of those “dems”). She was articulate, a fresh face, seemingly likeable. I thought she connected with the crowd well. She seemed like a real asset to the ticket. After the Couric interview, meh…not so much. After looking into her background a bit more, I realized she was more of “rogue” than I thought even John McCain could deal with. At that point, some of her background scared the bejeesus out of me!

I think the underlying problem is that there little comment windows we write in aren’t set up for scientific argumentation.

To put it another way, the back-and-forth has a level of effort requirement, which this milieu doesn’t provide.

Sorry about that,

yes I read through the reviews M.G. Bulmers book and will be ordering it through Amazon.

While I use statistical analysis daily as an appliance, my side fascination is in the combination of human psychology and statistical analysis, focusing on the influence and causes of bias, as I believe you picked up on.

For example, I’m currently reading Risk - by John Adams, and The Psychology of Risk by Ari Kiev and Ken Grant and the same title by Glynis M. Breakwell.

The R project is also of interest, though I don’t code the software I use I am in the process of having some made and will pass this on to my programmer.

I made very, very clear on numerous occasions on several threads that my challenge to you was not a disputation of the underlying science, rather, your reporting/representation of the science. It is simply outrageous that you twist that into a claim that I am calling the science misleading or fake.

Example 1. If the science, by which I mean the literature, arrives at a conclusion that under a certain set of circumstances there is a 66% probability of a certain event occurring, it is misleading to then report that the literature states that that outcome is certain, which directly implies a 100% certainty. For you to say that we need to do this because lives are at stake is a case of exaggerating and overstating the facts to suit a political purpose. Fake but accurate. or. Fake but moral.

Example 2. If the literature states that we have a 90% confidence that A causes X, it is misleading to state that we are certain that A causes X or that we know A causes X. Again, it suits your agenda to do so and you insist this is the moral imperative, perhaps, but again, Fake but Accurate or Fake but Moral.

Example 3. If I dislike a certain journalist or animator because his argument is not sufficiently developed in my opinion, insisting that he must be perfect and that any such criticism is a lie is a case of supporting “fake but accurate.” In other words, as long as the persons intention is correct, and their basic premise is correct, then it is above critic. Thus the “fake but accurate” comment.

So what have I said as a certainty?

I have said for instance, that it is certain that if we do not change course at all, and that if we trip the bogs past a tipping point, we will eventually loose both caps and Greenland completely.

What is “fake but accurate” about that?

What is uncertain?

How do you back your claim?

This is where you get in trouble. If you look at the things I call certain, you will find that they actually are certain.

Thus when you go and call it fake - and for that matter snark about all of the comments, you slander the science I ma bringing. That is deeply insulting and wrong of you.

Those posts remain and you may go back and ponder them. In general, you almost never answered them appropriately as I have detailed elsewhere.

However, I am standing by my choice to not debate with you further as you refuse to retract or even agree to refrain from gutter insults, such as calling me an asshole, prick, little shit, and so on, with those example just in the last few days. In addition to the unpleasantness of such exchanges, I also find that those so afflicted suffer from beliefs and bias which are the source of their anger and low self-esteem and make them unreliable.

Fair question. Less what she has done as much as what she represents. Understand where I come from. I come from the world of DC politics. Grandfather was a US Congressman (D), have many contacts in political circles, have family in various branches of government, etc, etc, etc.

What this means to me is I have little awe over the federal government and understand what a President can and cannot do. Any direction has to be carried out by career civil servants. Therefore the right person with the right team can do wonders. An inexperienced hand is sometimes better and less shackled with bureaucratic inertia than an experienced old timer, etc.

So, Palin represents tapping Main Street USA instead of going one more time into the Political Industrial Complex that has ossified DC thinking. The place needs new blood courageous enough to think outside the box but not a wild Ox bashing things up and creating resistance.

I think Palin has shown a common sense, middle of the road approach. I like the way she took the power brokers in Alaska (oil, old time GOP pols, Media) and just shook them up and put the people first. She turn Alaska into an asset for all the people. Yes, oil companies and others get a take, but after the people get their needs taken care of.

Simply put, she is not a creature of DC and she has shown little shyness in taking on the power brokers. That’s what I am looking for in the new leaders of either party for this country.

It also is about time to bust that damn glass ceiling as well.

If they had used a different typeface, it would probably not be as bad. But this was an obvious attempt (especially considering the carefully synchronized release date) to fool people into buying the parody book when they mean to buy the original. I know if I was Palin’s publisher, I would be getting a cease-and-desist letter made up today.

Fortunately for them, a lot of books were preordered, but unfortunately, I know the people who work at Barnes and Noble, and they will be hiding the real Palin books in a dusty corner. The parodies will be on the New and Noteworthy table.

If the government hands out cheap cars you get Trabants. If you work your tail off and do well you can own a nice ride. Real choice.

Perhaps you and I are looking for vastly different things. You indicate you’re looking for someone outside DC who can think outside the box. I’m looking for someone who can restore fiscal conservatism as the leading edge of the party. You’re looking for someone to cast in a role, and I’m looking for a leader to step forward. I went from being highly supportive of her to highly disappointed. She’s not “the next Reagan”, and we need to let go of that fantasy and deal with reality as a party.

You said earlier you thought her “far right credentials are overblown”. Except there is actual evidence to support the claims she’s associated with Dominionists and the Birch Society. Since last year she’s shown she can quit her job, use her child to lie about a national debate, and make really poor choices with her associations. I fail to see how this record impresses anyone.

The data is published and of course it shows warming, the scientists - real scientists, not crazy people, say the data shows warming, and even the most ardent political foes of AGW are silent on your claim.

Well ‘lipstick on a pig’ I forgot to mention class too. And yes, articulate fits. Sarah uses a lot of words that seem to stick, like them or not. They get press. The use of ‘Death Panels’ put into focus and crystallized the idea that not enough health care workers and other expenses means allocating resources. Of course that will have to happen.
