Oklahoma Far Right Abortion Law Blocked By Court

The new Oklahoma law that blatantly violated state and federal constitutions, by requiring that detailed information about each woman who has an abortion be published on the state’s website, has been delayed by at least a month: Okla. Abortion Publicity Law Blocked by Court.

To challenge the state constitutionality of the law, the New York-based Center for Reproductive Rights filed a lawsuit on behalf of two Oklahoma women.

The center’s spokeswoman Dionne Scott said a temporary restraining order that stops enforcement was granted late Monday by Oklahoma County District Court Judge Twyla Mason Gray so that she could “look further into the case.”

The law, House Bill 1595, requires physicians to ask patients, described as “mothers,” up to 37 personal questions, including their age, marital status, race, years of education, number of prior pregnancies, reason for the abortion, method of abortion and payment and whether an ultrasound was performed.

Former state Rep. Wanda Jo Stapleton, an Oklahoma City Democrat who brought the lawsuit with Lora Joyce Davis, a resident of Shawnee, Okla., applauded the court granted reprieve.

“This is one of dozens of bills piled on year after year by the Oklahoma legislature to place obstacles in the path of women,” Stapleton said on Tuesday. “The bill points a public finger at women and is intended to scare them to death.

I am personally pro-life, politically pro-choice. This makes me a bad Catholic. (I'm sorry, a cafeteria Catholic, I guess.)

I can not, and never will, be able to see how anyone could think that a woman who makes the decision to terminate a pregnancy does so coldly. They do have enough problems; social shunning will not help. Women need better options, not public castigation.

Oklahoma state Rep. Dan Sullivan, a Tulsa Republican and co-author of House Bill 1595, told Women's eNews lied that the law is intended "to find out why people are seeking abortions and see if there is something we can do as a state to have a positive impact." He said further prevaricated there is no way to understand the demand for the procedures without good data.

Dr. Dana Stone, who specializes in obstetrics and gynecology in Oklahoma City, doesn't understand why the state needs to spend money on data collection and posting when the federally-funded Centers for Disease Control and Prevention, or the CDC, in Atlanta already does that.

The CDC has collected state-by-state abortion data, which is available online, since 1969.

Quite concur. I'm also pro-life, but that law was plainly an overreach. An internet list of those having abortions could become a hit list, and it also violates established rights to privacy. The goverment has no need to know or publish these stats, so they may not collect them.

So, under this law, if allowed to stand, what happens if the questions are not asked and answered? If the Doctor refuses to complete the form, which he should, is he subject to penalty? What if the woman refuses to answer, which she should, is she subject to denial of service?

I've long resisted coming down on one side or the other of the abortion issue, much preferring to cling to the nice, cushy fence rail. This is one of those mercifully few issues where our American standards of liberty are in direct conflict with our nation's deep-rooted Christian values. On the one hand, one's own body should surely be inviolate, so far as the state is concerned, unless you're actually incarcerated. On the other, I heartily seconded Michelle Catalano's incredulous disgust at a guest op-ed that appeared in the NYT a few years ago, wherein a "mother" nonchalantly aborted two of her unborn triplets, so as not to have to discomfit her urban hipster lifestyle. Peering into such a moral void nauseates me.

But good riddance to this overreaching Oklahoma law.

Are they going to post the names of the men that knocked them up too? Nahhh I'd love to see a bill introduced somewhere that only reported men who visited prostitutes, were arrested for drug possession, battery, et al., as long as they were Republican. Oh, but Republicans are such family values guys so that would *never* happen!

I think men caught soliciting prostitution are slapped with sex offender status, not sure but I've seen it done for less. That's all available online.

I'm about as anti-abortion as a person can be; but a requirement to publish personal life and medical details about a person on a public website is just absolutely out-of-the-question wrong.

Me too, but this seems to be a pretty clear violation of HIPAA, not to mention just plain old common decency.
