Jim Hoft, First Things, and Libelous Accusations

Hateblogger Jim Hoft replies to my post pointing out that he linked to an antisemitic, anti-America Bulgarian conspiracy website, by lashing out and accusing me of “supporting child porn:” A New Low… Charles Johnson Now Supporting Child Porn in Classrooms & Fisting Kits at School Functions.

Please note, Mr. Hoft:

Eugene Volokh, professor of law at the University of California at Los Angeles’ School of Law, said the case serves as another reminder that online anonymity does not automatically provide immunity against libel charges.

Individuals who libel or defame others online, anonymously or otherwise, are just as exposed to lawsuits as they are in the physical world and cannot expect First Amendment rights to automatically protect them.

“Saying you’re a lousy professor is one thing. But saying you molest 13-year olds is completely different,” he said. Though one might use a pseudonym to conceal their true identity a court can force an ISP to unmask them in such cases, Volokh said.

Judges in other cases have shown a willingness to do just that if, in their opinion, the complaints had merit.

This Neuhaus sometimes spoke as if faithful Catholics had a positive duty to vote for the Republican Party, and he strongly encouraged the American bishops to deny the sacrament of Communion to pro-choice Catholic politicians. This Neuhaus was proudly authoritarian, bullying in temperament, and staunchly traditionalist.

Are you ging to sue him or are you seriously contemplating it? I ask these questions because if you make a big deal about his libelous claims and then do nothing, it only emboldens him. In my opninon, you need to move on this lawsuit ASAP, otherwise, you will seem like a paper tiger. If you have a strong case (I'll venture to guess that there are more than a few lawyers prowling around LGF who can advise you), sock it to him.

It has been pretty much settled that hosts are not responsible for content posted by their members, just as blogs are not liable for comments that appear on their pages. So legally, there's probably not much that can be done against the hosting service.

Most services, however, have a fairly strict policy on what sort of content they will allow on their sites, and they are perfectly within their rights to shut down accounts that don't comply. My guess is that postings of this nature quite likely violate the hosting agreement, so notifying the hosting service directly might be a quick way to get content yanked.

I'm not certain if it would be beneficial to take such a route if one is interested in pursuing legal action against the actual perpetrator. "My ISP shut down my site before I even heard there was a problem, nyah nyah nyah!" is one possible response. Lame or not, I'd consult an attorney before taking any such actions. No point in muddying the legal waters.

I know of at least one case in which it was done. Interestingly enough, that same service provider has since apparently changed their terms of service.

Depends, many of the truly illegal sites/spammers use bullet proof hosting. It's turned into a real criminal service, with groups like Russian Business Network.

Others do use legitimate hosting providers, but in many cases they are so large and resold through so many layers that they can't actively police content on their servers, and only take action when a complaint is made.

Other cases fall somewhere in the middle, some hosts take free speech very seriously, and will only remove content with a court order. Others drop stuff with a simple email.

The internet really is the wild wild west some days.

Not necessarily. Some TOS's are not rigorously enforced. And they don't typically have force of law behind them.

It's rare, but not unheard of.

Someone copied a photograph from one of my web pages and published it, without acknowledgment, on their own. I contacted the ISP and told them about it, they had me fill out a short form stating that the work in question belonged to me and was being used without my permission, and they pulled the whole page down, all in less than 24 hours. In fact, it came down less than an hour after I emailed their form back to them, suggesting that they didn't even bother contacting the offender once they had my complaint in hand.

But of course, your mileage may vary depending on who runs the service and what the actual complaint consists of.

It doesn't work that way. The hosting company usually gives the person in violation of their TOS the opportunity to first remove the offending content (unless it's child porn or something like that.) Typically they'll suspend the offender's account until they do so. Usually it takes repeated violations before they'll lose their account entirely. (I'm only talking about cases involving libel, harassment, and the like.)

As to legal action, I can assure you from personal experience that if you've gotten the libelous material removed or deleted, it only further bolsters your legal case that the person did in fact harass you or libel you.

Now, some teens may ask an older friend to purchase this stuff for them. It happens that teens get access to sexually charged materials that their parents would not approve of. It simply happens. Even as old as I am, I found "stuff" when I was a kid! And I'm not permanently scarred.

These materials are written in such a way that they are not things I would have wanted my kid exposed to, whether dealing with homosexual or heterosexual sex. But there are parents who think differently than I do; they can support whatever they want for their kids.

Mr. Moon loved Fallout 3 and we're RPG players, not first person shooter people, but F3 was a nice combo.

We've played WoW and EQ and there's pluses on both, however, Sony has put no money into EQ for years. I'm guessing the lost $ from the popularity of WoW.

It does not look to me like the GLSEN site is about pedophilia, nor is it about "recruiting" people to be gay, as if that was doable, anyhow.

It appears to be a site of resources for teens trying to come to terms with their sexuality during a very difficult period of time in any teen's life! As I said earlier, some of the material is written in such a way that I would not have wanted to buy the stuff for my kid, whether it dealt with homosexual or heterosexual sex. But the site has a variety of information.

Well said. Legit news orgs will follow-up and report on stories first broken by bloggers. But only if the "evidence" meets the same standards the org operates under for the stories they break on their own.

Most media outlets pay attention to bloggers to see if they found anything good (I have a friend in the biz.) I'm sure most or all are well-aware of the Jennings stuff. There is a reason it has been met with deafening silence. (And no, it is not because they want to "protect" the guy. Breaking a big story for most reporters or editos is more important to their career than protecting anyone.)

hehe The first game I played was on a Wang system I worked on as a word processing operator. It was called Colossal Cave and written by Roberta... what's her name? I think she created Sierra Games. Anyway, it was text based. Took us 2 years to get through it (we played at lunch). I still have the map!

I had fun with Fallout 3. I've never gotten anywhere near finishing it, but I definitely enjoyed playing it. These days, I'm working my way through Assassin's Creed 2 and enjoying it quite a bit. The boyfriend is spending a lot of time playing Borderlands, which is a shooter/RPG hybrid. He's having a lot of fun with it. I think he even likes it better than F3, especially because of the sheer number of weapons in the game that you can find.

Some of the material did seem objectionable regardless of the orientation of the material. When Gateway Pundit posted that stuff, it was related that these materials made their way into curriculum. No problem covering orientation in a sex ed setting, but materials straying into the pornographic shouldn't be part of a curriculum. Now if GP's sources are bunk, if the materials were made available to individuals who sought them out and recordings made without the understanding the recordings were made--well, then, I can see holding Gateway Pundit to account.

I do have to say, I've seen some comments in GP's stories that were rather nasty toward Charles--like this one--comment #16 calling Charles gay and hoping he has AIDS. Kinda bad form to leave it up after all this time. And that was before this most recent spat.

Such behavior speaks for itself.

It's not all b.s. because I'm assuming media outlets often have to use the unnamed source because it is the only way to convey valuable information.

Of course, it is b.s. sometimes. I don't like Palin, but all the post-election crap about unnamed sources coming out to call her a dumb diva was horseshit. Unnamed sources are for information valuable to the public, not for petty insults.

Using unnamed sources is always problematic. It used to be completely unacceptable, for the simple reason that there's no way for the public to distinguish between an unnamed source and a work of pure fiction. Before the Watergate story was published, the editorial board at the Washington Post had serious misgivings over going to press with a story based solely on unnamed sources, fearing it would damage their credibility*. Although their use is now more common, it is still viewed somewhat askance, and stories based on named, verifiable sources carry much, much more weight. At best, use of an unnamed source should never be more than a stepping stone along the way to verifiable sources of information; the risk of abuse remains high, and argues against their use.

Felt had an obvious axe to grind, having been passed over for promotion to head the FBI after Hoover's death, and had he been cited as the source of the Watergate story, it's credibility would have been questioned on those grounds.

Hubby went through Fallout3 like greased lightening, no quests, just rushed to finish the game. Then he went back and did all the back story. He liked it. They give you a bobblehead and a lunch box to boot!

I meant EQ2 actually plus expansions. We've been playing recently and they only upgraded one thing in 5 years that I can tell. There's a lot of misc content that needs tweaking. WoW is a better game as games go, but the EQ series still has appeal.

Heh. We have that version of Fallout 3 as well. I'd put the bobblehead alongside some of my other bits of geekdom when I get my new desk, but I'm planning on this Enterpise being the main decoration and will be shuffling things around to make sure it stands out.

I played EQ2 for a while when it came out, then quit and went back to it about a year and a half ago. I lasted six months, maybe. I've played WoW, too, but never for very long. I might give it a whirl again when the new expansion comes out, but these days I'm patiently waiting for both Star Trek Online and Star Wars The Old Republic before I commit to anything again.

3) Stop endorsing candidates. It used to be valuable when people had limited access to info. That's no longer true. Refusing to endorse anybody sends a good message to the public.

I don't think there has ever truly been non-biased news. I'd rather my news sources come out and state where their political orientation lies with endorsements. That way I can treat stories that line up with their biases with appropriate levels of skepticism. Agree with points 1 and 2.

I agree that unnamed sources ought to be severely limited.

As far as bias goes, though, I think the media ought to drop the pretense that they are somehow unbiased and objective sources of information. This is, and always has been, a lie. The days when the Atlanta Constitution would fire a cannon on their rooftop when the candidate they had endorsed carried the day may be long gone, but at least they were upfront about their biases and let everyone know about them. The same with Hearst/Pulitzer - despite their headline wars and yellow journalism, it's unlikely that any readers didn't know where each stood on the issues and weighted their obvious biases accordingly.

The claim that the media is somehow magically free of bias is a huge jawdropper of a lie, and they ought to stop pretending it isn't one.

It is kind of sickening how much fun these people are having in cynically preaching to their chorus of idiots. Most of them know the bullshit they post isn't really true, hell even a few of their readers do, but mostly they are just having fun either feigning or being mislead into outrage.

What if our side was working on issues instead of pretending to be outraged over Christmas ornaments? How much better could the healthcare reform bill mess have been if we had been actively involved in helping to draft and correct it? If all your concerned with is politics then maybe that is a good thing in your opinion. For the rest of us who actually have to live in this country without government supplied health benefits and wanted healthcare fixed it is a complete failure.

This party of "NO" bullshit has to stop, our leaders are actively trying to make the country worse so that it can be blamed on the party currently in power. Maybe some people are to ignorant to see that, but many of us are not, they aren't going to get my vote by trying to make my life worse. The only way they are getting my vote is by leading us out of this deadend of debt and unfinanced spending that they have helped to lead us into.

The "stories" I read simply assert that they were banned simply for disagreeing. But they don't include the comment leading to their banning, or give any context and in fact, they don't even say what their LGF nic was. I guess giving their LGF nic would make it too easy for others to verify whether their "story" is true or not.

Are you ging to sue him or are you seriously contemplating it? I ask these questions because if you make a big deal about his libelous claims and then do nothing, it only emboldens him. In my opninon, you need to move on this lawsuit ASAP, otherwise, you will seem like a paper tiger. If you have a strong case (I'll venture to guess that there are more than a few lawyers prowling around LGF who can advise you), sock it to him.

I have been registered at your site for awhile and have been a daily reader for a couple of years. (Full disclosure: I am a liberal Democrat, and also read ThinkProgress and TPM daily).

I have never commented before, but there is something that's been on my mind awhile. I think you are doing a terrific job, with one small exception. I think you are giving way too much stature to your more nut-job critics. Responding to every foolish thing they say can mislead people into thinking the nutjobs are on a par with you. Dawkins says it better than I can, in his explanation of why he doesn't debate creationists. [Link: richarddawkins.net...]

The situation that inspired this particular post is probably an exception; it's so egregious, it merits public scorn and a lawsuit. But for the most part, I think you'd do better to ignore the bottom-feeders, or dismiss them with a one sentence post like: "more silliness from Hot Air" or something.

Just my opinion, but I'd like to see more of your substantive analysis on other issues.

nothing worse than losing because you picked a case too carelessly; they'll feel they have a free license to have at it..
