Bachmann Suggests Obama Told KSM to Plead Not Guilty

Weird • Views: 2,977

Rep. Michele Bachmann (R-Mars) suggests that President Obama or Attorney General Holder advised Al Qaeda leader Khalid Sheikh Mohammed to plead not guilty so he could have a show trial in Manhattan. Sometimes it seems as if right wing politicians are in a contest to see who can uncork the wackiest accusation.

It appears this video was shot during a special orders session. You know, the ones where - when the CSPAN cameras take a wide shot - the only ones on the floor are the ones speaking.

That thumping sound you can hear in the background is the only other person in the chamber - the poor slob who was assigned the chair for this session. If the cameras took a shot, you’d see that sound was being made by his head repeatedly hitting the desk.

Early OT, and apologies for it:

But I’m reading about the utter chaos that is Haiti right now, and I just cannot imagine how relief is going to be gotten to the people who need it.

Ships can’t come in because the Port is ruined; so they have to rely on flights coming into a partially acceptable airport. There is no infrastructure to support even the most basic assistance efforts. Nowhere, really, for those people to go except OFF the island. This is hundreds time worse than NOLA after Katrina.

My heart is weeping for those people.

re: #42 webevintage

No reason given, but video coverage is at the court’s discretion. Many courts feel it is potentially too disruptive, particularly during high profile trials, and limit coverage to traditional press (newspapers, magazines).

52 Gus  Thu, Jan 14, 2010 12:34:56pm

Ms. Bachmann’s claims that this will be a show trial are not justified. There will be no cameras allowed in the courtroom and Khalid Sheikh Mohammed will certainly not be given free reign while taking the stand.

The rest of her pablum reeks of a conspiracy theory wherein she lays out an imaginary scenario as to why it was decided that Khalid Sheikh Mohammed should be tried in a civilian court.

Another thing to note. Khalid Sheikh Mohammed did not formally plead guilty. He sent a note stating his intent to plead guilty near the end of 2008. This was left unresolved as noted in the NY Times article referring to the unlikely source of a military judge:

But the military judge, Col. Stephen R. Henley of the Army, said a number of legal questions about how the commissions are to deal with capital cases had to be resolved before guilty pleas could be accepted.

Thus she is not only putting out a conspiracy theory regarding AG Holdren and President Obama but she is lying about the so called guilty plea.

Wherever you live, you could be hit by a natural disaster of some sort. You know where you live, so you know what is likely. It will probably be at least three days before outside assistance arrives at any disaster, so do not count on aid arriving 30 minutes after the disaster.

The time to be prepared is now. Even if you have nothing else, store a little bottled water. Here are some web sites that list off a few supplies you could store. (In a backpack is a good idea.)

The court ruled they didn’t follow procedure. From the ruling:

“We are asked to stay the broadcast of a federal trial. We resolve that question without expressing any view on whether such trials should be broadcast. We instead determine that the broadcast in this case should be stayed because it appears the courts below did not follow the appropriate procedures set forth in federal law before changing their rules to allow such broadcasting. Courts enforce the requirements of procedural regularity on others, and must follow those requirements ourselves.”

re: #55 marjoriemoon

Consider 3 stages of disaster relief: emergency, short term, and recovery. The emergency phase (which we’ll be in for the next few weeks) will focus on search and rescue, temporary shelter, medical services, food and water.

I figure among the priorities will be:
1) reopen the port facilities and clear damage from ports so that heavy container ships and relief can come by sea, including the necessary fuel and vehicles needed to clear rubble from damaged areas;
2) get an airport control tower operating to get critical patients to other hospitals and bring in fresh emergency personnel and aid.
3) triage patients and provide basic care and services;
4) clear debris from primary roads;
4) distribute tents and basic goods to those now left homeless
5) clear debris from secondary roads.

Some of those can be done concurrently as food and water can be airdropped and roads can be reopened while distributing food, shelter and water to survivors. Clearing the victims from the rubble will take time.

The Haitians are in for a world of hurt for a good long time to come.

I have to say that reading the blogs about the trial has certainly been an eye-opener for me. I’m a het, married woman, so the issue isn’t not one that effects me personally. But like so many people I know, or am related to people who are gay.

The discrimination aspect of not allowing people to marry never really hit home with me until I started following the trial. I was never opposed to same-sex marriage. I’ve attended two “ceremonies of civil union” and they felt like weddings, but the fact is that they will NOT have the same rights as the rest of us enjoy hadn’t hit me quite so hard till now.

The trial is a real gamble, with a lot of opposition on both sides. It fast-tracks a Supreme Court decision, and on the one hand a victory there would be a slam-dunk for proponents of gay marriage, effectively legalizing it in every state, while a defeat would slam the door on gay marriage for the foreseeable future. Given the current makeup of the court, this may not be the most opportune time to bring such a case.

re: #84 JoyousMN

I have to say that reading the blogs about the trial has certainly been an eye-opener for me. I’m a het, married woman, so the issue isn’t not one that effects me personally. But like so many people I know, or am related to people who are gay.

The discrimination aspect of not allowing people to marry never really hit home with me until I started following the trial. I was never opposed to same-sex marriage. I’ve attended two “ceremonies of civil union” and they felt like weddings, but the fact is that they will NOT have the same rights as the rest of us enjoy hadn’t hit me quite so hard till now.

Quite true. Even if “civil unions” are extended to gays everywhere, granting them the same legal protections and responsibilities as a marriage license does, they will still be living an equal but separate existence. It’s like allowing them to drink the same water as everyone else, but from separate fountains.

Either grant everyone marriage license, or grant everyone civil unions. We can’t have a legally divided nation.

re: #90 JoyousMN

Yeah, this is covered pretty extensively in an interview with the attorney’s in The New Yorker magazine. (I don’t have the link handy)

But their point is that “yes, we could wait for all this to percolate through, but in the mean time people are being discriminated against.”

I do see both sides, and I was more on the side of let it work it’s way through until I read the testimony of the plaintiffs.

Attitudes on this issue have shifted with amazing speed, and I think we’re just a very few years away from nationwide legal acceptance of gay marriage. If this case blows up, that day could be delayed substantially.

I agree that it must be onerous to wait, and that a victory here would help to resolve the matter more quickly. The stakes, though, are very high.

I think that’s the better solution. It makes the distinction between the rights protected by the state and the religious ceremony of marriage within a church separate and clear. The use of the same name for these two very different things, I think, has been part of the problem for some time.

Yes, I know, I get it. I understand the logistics. It just blows my mind the difference in level of care. Hundreds of Haitians are being dug out of the rubble alive, and many of them need medical care. What wouldn’t they give for a European passport right now?

Early OT, and apologies for it:

But I’m reading about the utter chaos that is Haiti right now, and I just cannot imagine how relief is going to be gotten to the people who need it.

Ships can’t come in because the Port is ruined; so they have to rely on flights coming into a partially acceptable airport. There is no infrastructure to support even the most basic assistance efforts. Nowhere, really, for those people to go except OFF the island. This is hundreds time worse than NOLA after Katrina.

My heart is weeping for those people.

NOLA had warning…you can’t evacuate ahead of an earthquake. Help was closer. The people were in better shape to begin with.

Haiti has just been living too close to the edge for too long.

I don’t have an answer for your question, but it prompts one of my own questions.

Is there a LGF etiquette for upding/downding? I’m asking because I have been using it pretty casually as an agree/disagree tool. But it seems like maybe I should be more restrained in my downdings?

Is there a post that explains this, or can someone help me out?

It’s all about staying true to whom you are. Being consistent in to whom one up or down-dings can be interpreted differently by different people, so the best thing to do is to be fair when handing out the goodies/coal. Personally, I frequently up-ding comments I like and have only down-dinged any comment twice so far. (Both occasions were saved for bigoted flounces.)

melanzane

A slur commonly used by Italians and Italian-Americans to denote a person of color. Melanzane in Italian means “Eggplant”, which itself is used as a slur against blacks because of the almost black color of an eggplant.

The word Melanzane (or Melanzana) derives from the words Mela Insana, meaning “noxious apple”. It is often pronounced “Moolinyan” and written as such.

I’ve decided to down ding on a direct insult basis. I have seen down ding pile ons on something I also did not agree with, but since I wasn’t involved in the conversation/argument, I don’t down ding. I use it sparingly and will be ready with a reason when I do.
I up ding on a much more casual basis. Agreement, a funny, acknowledging the the courtesy of a reply even if I don’t agree with it.

Torah has that war thing in it? even mentioning a tree with “one green leaf left”?! I had no idea, otoh, my few Muslim friends are better versed than my few totally secular Jewish friends.

Some author on NPR a while back wrote a book making the case that the Koran was just a collection of “best practices” of Judaism and Christian local sects and practices. He went further to say its original language was Syrio-Aramaic-Arabic or something, the way merchants at port cities today speak a dialect that is a mish mash of languages. Its later translation to classical Arabic created misunderstandings and some of the more harsh quotes.

re: #30 reine.de.tout

Early OT, and apologies for it:

But I’m reading about the utter chaos that is Haiti right now, and I just cannot imagine how relief is going to be gotten to the people who need it.

Ships can’t come in because the Port is ruined; so they have to rely on flights coming into a partially acceptable airport. There is no infrastructure to support even the most basic assistance efforts. Nowhere, really, for those people to go except OFF the island. This is hundreds time worse than NOLA after Katrina.

My heart is weeping for those people.

The Marines are due to arrive shortly with a large-deck amphibious craft with a large fleet of helicopters on board. A carrier is also on the way, and will stop in Florida to resupply and stock it’s aircraft supply to full capacity, with an again emphasis on helicopters. They’ll have huge facilities located just offshore, with plenty of transport capability.

The Army (I think; perhaps another branch) landed at the airport yesterday for an initial assessment, and pronounced the runway sound, although the buildings are all damaged. Still, they can rapidly put ATC in place with military equipment. Limiting flights to only those involved in aid efforts will make the problem manageable, and heavy airlift can begin almost immediately.

Several other nations already have similar resources en route.

It’s certainly not a pleasant situation, and I don’t want to give the impression that we hold some sort of magic wand that will make everything better overnight. But there is a tremendous effort to get aid where it’s needed, and tremendous ability to accomplish that task, too.

Many of you have emailed in, questioning the veracity of her claim. Inquiring minds want to know…check out the First Lady’s on-line “planting plan”—no sweet potatoes listed! If, indeed, sweet potatoes were never grown in the garden, how did FLOTUS and the competing chefs pull sweet potatoes out of the ground at the White House? No I think it was done as a rhetorical question with in her speech. Kind of like when you come home late and you tell the wife “should I just have taken the ditch to get around the traffic then?”

Obviously something happened, a decision was made to change venue and plea, and place KSM in civilian court. That decision could only come from the defendant and the White House/Attorney General.

With that in mind it could be sated that both sides just happened to do each at the same time, after all anything is possible, however it is unlikely.

Oh, ok, then who else would have the power besides the Attorney General and The White House. Here are the facts;

1) KSM needed to transfer from DOD custody to Justice Department, the only two people with that absolute power would be the President and the Attorney General, Unless the supreme court ordered it, which they didn’t in this case.

2) KSM would need to change his plea, this would need to be accepted by the military commission or overruled by the Attorney General or dismissed.

3) The attorney general would have to establish venue with the Federal Court of NYC. He is the boss after all as the Attorney General.

4) The President and the Attorney General have come out and said they made the decision to put KSM on trial in NYC. The attorney general even testified before the Senate on it.

There was a time when the Republican party was not to cowardly to remove its cancerous warts. When “Republican” David Duke ran for governor and later US Senate, the rest of the party gave him no support or respect. No one of significance spoke on his behalf, iirc. Many Republican leaders spoke against him.

Why can’t we be as good today as Louisiana Republicans 20 years ago? Any speech by Bachmann should be followed by a half dozen Republicans pointing out she’s nuttier than squirrel poo.

MIlitary targets generate less sympathy.

I don’t think it’s as much that as it is the fact that pretty much everyone has seen eleventy-million photos and videos of each tower getting hit, the towers burning, the towers falling, the people running from the giant cloud of debris. Lots of people saw it in real-time, and that kind of drama makes an impression. That’s not to minimize what happened ni PA or DC, but those just haven’t been burned into the mind like the WTC was.

Michelle Obama’s garden ex`seeds’ her expectations

WASHINGTON (AP) — To Michelle Obama, her White House garden is more than a plot of land. It also is a soapbox, a podium from where she can send her message of healthy eating.

The South Lawn garden has given Mrs. Obama a platform to speak out about a major childhood obesity problem in the United States, extol the benefits of eating fresh food and teach children early to appreciate vegetables.

It also has offered Mrs. Obama another way to open the White House to people who do not normally visit.

This is contradictory. You give an example of a rehtorical question with the answer being ‘no’, but you insinuate the answer to this question actually is yes.

You’re just spouting bullshit, like Bachmann, as far as I’m concerned.

And this is how it works. Bachmann accuses the president of the United States of something ridiculous, underhanded, and I presume, illegal, with no evidence whatsoever, and people rush to not only justify her stupidity, but accept her premise. After that, it becomes sort of reasonable to think, because the man on the street said it…

re: #231 lrsshadow

Oh, ok, then who else would have the power besides the Attorney General and The White House. Here are the facts;

We’re not talking about whether Obama and Holder made the decision to try KSM in a civil court. They did. There is no doubt of that. What we’re talking about is whether they told the defendent in said trial to change his plea, for their own political purposes, which is a TEENY bit different.

I now proudly present “veggiegate”/ (From Michelle Malkin)

” For months, the Food Network ran ads about a forthcoming episode of “Iron Chef America,” its flagship chefs plus secret ingredient versus time competition. The show would take place at the White House garden, with Michelle Obama making a cameo and plugging her responsible-eating initiative. The network promised it would be its biggest episode ever. The buildup matched the reality: The Jan. 3 “Iron Chef America” drew 7.6 million viewers, the highest-rated show in network history. In it, superstar chef Mario Batali teamed with Emeril Lagasse, and Bobby Flay with White House chef Cristeta Comerford to cook five dishes using the secret ingredient: produce from the White House garden. Except for one thing: As first reported on AOL’s Politics Daily blog, the fruits and vegetables used on the show weren’t from the White House. They were stunt produce. Ringers. At the beginning of the two-hour special, the chefs were shown picking sweet potatoes, broccoli, fennel and tomatillos from the White House garden. Then the chefs were seen walking into Kitchen Stadium, produce in hand. One problem: The show is filmed in New York City.”

“oh so I guess that the attorney’s of KSM were called by the Justice Department or White House and they must have told them that they were going to change the venue to NYC and Jurisdiction to Federal Court, and they could now change their plea if they wished to, plus if they didn’t change their plea to not-guilty the trial would not go on. Then KSM changed his plea apparently, because he did in fact change his plea, I am I would like to ask my fellow congressman, what would have happened if the Justice Department announced the change in venue and jurisdiction only to find out KSM wouldn’t change his plea. That would be kind of embarrassing, so the only way they would move forward is if KSM changed his plea and guess what he did. I would like to know how much influence was involved in KSM apparent change of plea”

This is still libelous bullshit with nothing at all to back it up.

Please, learn to paragraph.

How do you imagine the world would have changed if KSM had maintained a plea of ‘guilty’?

Then I read that Dr. Tiller’s murderer is going to be allowed to testify that he thought he was protecting the unborn by gunning down the Cr. in church, and the judge will decide whether or not to instruct the jury on a possible verdict of voluntary manslaughter!

From what I understand of the voluntary manslaughter defense, it only requires that the defendant had a “unreasonable but honest” belief that what the killing was neccessary. If that’s upheld, the implications for anyone working in the abortion area are terrifying.

Another closed transparency meeting. I guess it’s a joke that never seems to get old for our gov’t.

[Link: latimesblogs.latimes.com…]

Unsubstantiated rumors that Vice President Joe Biden had suddenly gone a little loopy and ordered some of his official meetings opened to at least cursory public or media attention were just that — unsubstantiated rumors.

After a recent public sighting, fears had mounted that the one-time, long-term senator might rebel against traditional White House strictures and start acting on all the administration’s oft-promised promises of government transparency and official openness running back into 2008.

But the VP’s public schedule today puts all those fears to rest.

In fact, loyal Ticket readers will recall that one day last summer with no advance warning whatsoever Biden’s official White House schedule changed from listing frequent “private meetings” to listing frequent meetings that are “closed press.” Was this dramatic and little-noticed vocabulary change a sign of internal administration turmoil? What did it really mean?

No, of course not. And, nothing.

First season just seemed ponderous. I didn’t really get into it until season 3 and then later went back to see the other episodes. The writers had planned every major story element ahead of time and it all built up over time. Good writing there. It’s of course, not of ‘coarse’…here, let me explain it to you in language you’ll understand. Understanding is that thing people sometimes do when they actually listen to what others say and cognitively register the meaning of their words, which are these things I’m typing with the white space between them. Sometimes words can make sense, for example, when someone says, “Hey, it’s raining outside!” one can usually assume that they’re talking about the weather (which, of course—not coarse—you shouldn’t confuse with the word “whether”, as in “I wonder whether I should post another dumbshit defense of Michelle Bachmann?” (the answer to that, of course—not coarse—being a resounding “No.”. Anyway, back to what I was saying about speaking in terms I think you’ll understand (Understanding being that thing people sometimes do when they cognitively register the meaning of the words—those things we type with spaces between them)….

Oh, never mind (mind, as in the verb sense of “Don’t you worry your little head about it” and not mind, the thing which you’ve apparently abandoned in your quest to get under peoples’ skin).

re: #352 SanFranciscoZionist

Volokh covered this, and held out some hope that the defense would be denied; the statue mentions this:

(a) A person is justified in the use of force against another when and to the extent it appears to such person and such person reasonably believes that such force is necessary to defend such person or a third person against such other’s imminent use of unlawful force.

Since the doctor was performing legal abortions, his “imminent use of… force” was not unlawful. The defense shouldn’t be allowed. Here’s hoping?

Well what would not have changed was setting a precedent that any enemy combatant has full rights under Habius Corpus even if caught at a time of war in the battlefield.

So, let me unpack that. You have absolutely no evidence for what you’re saying, and neither does Bachmann, but you disapprove of Holder’s decision to try KSM civilly—as, BTB, do I, and many other people trying to reason with you here—so you figure you can say whatever you like?

Classic troofer rationale there.

Absolutely. The number of wackos who would risk life in prison or the death penalty is thankfully still pretty low. The number who would risk five years or less for the “cause” would be much, much higher. The lot of them are suffering from some sort of mental illness. I’m serious. There is a group-think that has enveloped them that keeps them from rationally interacting with those outside of their group. They can’t analyze information correctly. I used to think it was all just a schtick… and it may have started out that way, but now they have convinced themselves it is true. This is very similar to the creationists who when touring the Grand Canyon look at hundreds of feet of geological column composed of thousands of distinct layers and then, on site, proclaim it is evidence for The Flood.

True self delusion. It is no longer a schtick.

re: #358 SanFranciscoZionist

ug ok you guys can just hang out in your shells if you don’t understand the facts.

When you do something new in a legal capacity under court it is called a “precedent” once again here are the facts, all though none of you really care about the facts getting in the way of your point;

1) If you do something that has never been done before ever in court, ever in the entire US history of law there is not one case of bringing a Detainee capture, out side of the US, during war, than it creates a Precedent in the Legal System.

2) Once a precedent is set, it is prudent upon all legal considerations to give justification for deviance from that set judgment.

3) The White House and Justice Department have changed the Venue and Jurisdiction to full legal rights under “civilian criminal court” to include all rights afforded to any US Citizen charged with a crime.

4) There is no consideration at all by Eric Holder or the White House as to how KSM is different than anyone else caught on the battlefield during War. (see the senate hearing for which Eric Holder testified)

5) Without clear and legal differentiation between KSM and other enemy combatants how can you explain to the court why you are not having someone else go to civilian court. Why does KSM get special treatment when there are other detainees don’t?

If you cannot understand how this affects the current war on terror, in regards to evidence collection, witness identification, Miranda rights, legal representation, than maybee you should talk to some of those on the front lines right now who have to try an negotiate this mess to ensure some bad guys don’t get off on some technicality later on when or if they do go to civilian court.

good luck

I have my own tire story from this week

Had a slow leak. Took it to the tire store to be patched. They told me (and showed me) that the leak was on the sidewall from a nail, can’t legally be fixed. So I buy a new tire to replace it (it’s our older car so I took a belmish/ discontinued tire for $30)
Get the bill and they charged me not only for the new tire (plus junk fees) but $16.95 to ‘fix’ the flat and $9.99 ‘Road Hazard” on the new tire

10 bucks to insure a 30 dollar tire !?!?! ummm,, NO
$17 to “fix a flat they never fixed ,,,ummm,, HELL NO !!

Obama just sent out the following email to those on whatever mailing list I’m on:

(apologies for the length, figured it’s interesting enough.)

Thomas —

On Tuesday, a catastrophic earthquake struck near Port-au-Prince, Haiti. The full extent of the damage is still being assessed, but the death toll — already in the thousands — is climbing fast.

This is the worst earthquake to hit the area in more than 200 years. Entire communities have been ripped apart and as many as 3 million people have been directly affected, including tens of thousands of American citizens who are in Haiti.

Our neighbors in Haiti are racing to confront the enormous devastation — and the OFA community can help.

Click here for more information about essential relief efforts and ways you can help today.

Footage is pouring in of homes collapsing, Haitians carrying injured family members, and hospitals being overrun in what was already the poorest nation in the Western Hemisphere.

I have directed my administration to respond with a swift, coordinated, and aggressive effort to save lives. Personnel from the United States and our partners in the international community are on the ground in damaged areas right now, working side by side with the Haitian people. They’re providing much-needed food, water, and sanitation supplies, saving lives and helping local communities start to rebuild.

Despite the fact that we are experiencing tough times here at home, I encourage those who can to reach out and help. It’s in times like these that we must show the kind of compassion and humanity that has defined the best of our national character for generations.

Click here to find out what you can do:

[Link: my.barackobama.com…]

As this story continues to unfold, I hope you will continue to keep the people of Haiti in your thoughts and prayers, as well as the many Haitian-Americans who have done so much to enrich our country and who are worried about friends and loved ones in this time of need.

Thank you,

President Barack Obama

As to the whole situation, I put the first culprit as Bush, he should have told the left and the ACLU to pound sand and he should have moved forward with the military commissions and sentences. Instead he just kicked the can down to the next president.

The decision to try Khalid Sheikh Mohammed in civilian court was made outside of the court system therefore it is not a legal precedent.

re: #389 Kruk

Absolutely. The number of wackos who would risk life in prison or the death penalty is thankfully still pretty low. The number who would risk five years or less for the “cause” would be much, much higher. Even if this is rejected, though, I fear the nut-o-sphere will keep propagating the voluntary manslaughter idea to the people they get to do their dirty work for them.

It’s been a standard argument for pursuing violence against abortion providers for many, many years already.

Those promoting it don’t seem to make the connection that victory, in this case, is tantamount to declaring open season on Randall Terry, along with the prey they already have in mind.

But I don’t think that merely proceeding to court with this argument will change things much. Anything emerging from such a defense that looks even a little bit like a win, though, would be very bad indeed.

AMEN! All of the improvements we’ve made in Georgia state government in the past few years have involved very little in terms of capital investment and instead addressed busted processes. IN his State of the State yesterday Governor Perdue cited our customer service rankings that are comparable to the best in private industry and our employee sat ratings that have increased significantly even with salary freezes and furloughs. These are all due to pride in service and giving employees the tools they need to improve out of date processes.
We are making a mockery out of the excuse “we can’t serve well because we don’t have enough money”. The Feds need a reality check.

Hey Washington! Fix your processes and then automate them, otherwise you just end up with automatically bad processes!

Don’t the banks key their mortgage rates off of the Fed rate?

No. Mortgage rates are set mainly by market forces. Many mortgage rates are based on the rate of the 10 year Treasury note, but that’s issued by the Treasury department, not the Federal Reserve.

There’s a fairly good overview here. At best, the Fed rate and mortgage rates are weakly linked, but other factors play a much larger role.

Note that mortgage rates have been trending upward for some time now, while the Fed lending rate has remained flat at 0%.

You need a strong executive who thinks supporting state employees who succeed in fiscally sound and service oriented government. I know I work for the guy but this quote from Governor Perdue’s final State of the State address made me feel warm all over:

“We have already faced tough decisions with respect to our team of state employees. We have trimmed payrolls and asked employees to do the job that two or even three of their co-workers used to perform. We have asked teachers, caseworkers, law enforcement personnel and agency heads to do more with less. And their commitment to go the extra mile deserves recognition.

So, I want to take a moment to speak directly to my fellow state employees:

Wherever you serve, I want to recognize and thank all of you for putting in the extra effort and the extra hours to meet this challenge. Responsibility and workloads have increased and you have met the call with excellence … That doesn’t go without notice. I notice your good work. Your bosses notice it. Your fellow Georgians notice it. Thank you!

Now I want to brag on our talented state team a little bit. The men and women who make up our team have refused to make excuses and they have found a way to deliver great customer service in the face of cuts. That’s why, as I travel across Georgia, citizens continue to thank me for the services you deliver.

In fact, we’ve asked our customers, and they have given you a customer satisfaction rate above 76 percent*. That beats most private businesses and makes us one of the only states that compares favorably with the private sector. State employees will tell you their job satisfaction – which has increased 10 percent in the last two years – comes from helping Georgians.

High employee morale means a satisfied customer and a satisfied employee. I want to continue improving to make Georgia an “employer of choice” that can attract and retain top talent going forward.”

(*note this compares to Wal Mart at 74% and Nordstroms at 80% on a comparable measure.)

Gus you are incorrect, if the White House and Justice Department decided that they would file some or all of these cases in criminal court every decision made by a judge in that case is a precedent due to it never being done in US Court before.

If this was just another murder trial of some guy who lived in NYC and committed the crime in NYC you would probably not have a single precedent, because we have a whole lot of cases that have gone before the court involving murder in NYC by US Citizens, but we have none with an enemy combatant detainee captured at a time of war in another country. True, they set interest rates too low for too long which allowed the banks to get cash for practically nothing, thus indulging the greedy bankers in their get-rich-quick subprime lending schemes.

Not so much. The spread between what banks can borrow money for and what they can charge to lend it in smaller amounts has remained pretty constant at around 4% - 5% for a very long time.

What was new, among many other factors, was the introduction of heavily leveraged, mortgage-backed securities that defied mathematical analysis, but were extremely lucrative - as long as the housing market was trending upward. All that leverage magnified the gains, and in many cases the value of the tangible assets underlying the instrument were only a tiny fraction of market value, amplified by factors of a hundred or more.

Needless to say, when the inevitable down market appeared, all that leverage started amplifying the losses just as much as it had leveraged the gains, and banks found their capital drained away almost instantly as a result.

Interest rates, already fairly low when the collapse began, followed the market downward. They didn’t lead it.

All those bizarre mortgage-backed securities, by the way, are still out there. If anyone bundles them into some sort of fractional investment, similar to a mutual fund, I would seriously consider buying into them, since that leverage will once again go to work as housing prices rise over the next few years.

Learn to read, idiot. I explicitly said that Obama and Holder did change the venue, and made a decision to try in a civilian court, and if you were actually reading, you’d note that I don’t agree with that decision.

re: #496 lrsshadow

I know a lot of folks think trying him in the US as a criminal is a good idea. And if he has committed crimes in the US or on American airlines, ships, or over American airspace and you can gather the evidence to show it…that would be grand! But you cannot gather evidence that could be admitted in any decent criminal court in a combat zone. You just can’t. Any idiot who thinks otherwise has never watched a single war movie, let alone been on the spot. While you are “arresting” him (you’re not, you’re taking him prisoner, which is vastly different) the evidence is getting stepped on, swallowed, shot up, burned, and run over. What fool stops in the middle of a fight to gather up the spent shells? Furthermore, all militaries and most guerrilla groups train their operatives to resist interrogation. Our own military has a Code of Conduct which specifically states “…I will resist further questioning to the utmost of my ability.” Resisting such questioning is not wrong or unethical, quite the opposite. Nor is it unethical for the opposing forces to try to get the information it needs from its prisoners. They aren’t held to the same requirements and limitations as police (NOT talking about torture here) because they are not trying to gather evidence for conviction they are trying to gather intelligence to win in combat.
How then is it fair to try someone who ihas not been Mirandized?
How can you expect the preservation of legal evidence when that evidence is also intelligence?
Finally, I would like to point out the abuses at Abu G’rab were due in part to the disconnect between the military and intelligence interrogators/agents, and the Military Police who were in charge of the prison. POW camps were never traditionally run by MPs. Can we understand why? Criminals are criminals. Lawful combatants are lawful combatants. Unlawful combatants, have never been satisfactorily dealt with in our laws and treaties…and it doesn’t look like they will any time soon.
Wow, bet I missed a lot of the conversation while writing that little screed huh?

This case will set many Persuasive precedents and a number of Binding precedents.

This trial is not to decide whether or not KSM and any future defendant will be brought to trial in a civilian court or a military tribunal. It is trial based on the charges brought against KSM. It is not the US vs. US it is the US vs. KSM. Again, the decision to bring them to trial was made outside of court.

Definitions:

Precedent -A case or issue decided by a court that can be used to help answer future legal questions.

Stare decisis - Latin for “to stand by things decided.” Stare decisis is essentially the doctrine of precedent. Courts cite to stare decisis when an issue has been previously brought to the court and a ruling already issued. Generally, courts will adhere to the previous ruling, though this is not universally true.

There was no court ruling to bring KSM to trial in a civil court and that is irrelevant to the case. They are not endeavoring to decide how he got there but conduct a trial in which he has been charged with 2,973 counts of murder. If there were any legal doubt regarding Khalid Sheikh Mohammed’s capture, it would not have gone this far. At the same time, while Khalid Sheikh Mohammed will face a civilian trial, AG Holder announced that numerous others will face a military tribunal.

Ah, I see you’ve been following Breitbart’s idiotic insinuations that the President is hiding his own winnings somewhere in some effort to renege on his charity promise, and that it would be a violation of US Code.

He’s wrong about that by the way. See this WSJ Washington Wire post from back in October:
[Link: blogs.wsj.com…]

Most government employees are prohibited from accepting more than a certain amount of “outside earned income” from moonlighting in another job. They are also prohibited from accepting “honorarium” for articles or speeches. But a prize is not “earned” income and a 1992 advisory opinion from the Office of Government Ethics says that it isn’t an honorarium either.

Furthermore, Obama and Vice President Joe Biden are not covered under that statute. “He is expressly exempt from all of these rules,” said Ken Gross, a lawyer who specializes in federal ethics and campaign laws and has worked for both Republicans and Democrats.

The Foreign Gifts and Decorations Act prohibits government employees, including the president, from receiving any award from foreign governments or their agents. The members of the Nobel Committee who pick the prize winners are selected by the Norwegian parliament, but the institute itself is a private entity so there would be no restriction under that law either.

So, even though Obama could have kept those substantial winnings if he had wanted, he decided to do a good turn and promise them to charity, making Andrew Brietbart’s insinuations slimy as hell.

The Supreme Court ruled that it can’t be carried live on the internet, but several people are live-blogging it and it’s very compelling.

The link is for today, but you can go back to previous days. The trial has been a great learning experience for me on the discrimination aspect of not allowing gay people the right to marry, and on what the issues are on both sides of the debate. Really great use of the internet to keep people informed.

I read about that in Newsweek really impressed me, because it as about how a Conservative was actually standing up for Conservative principles like how smaller government should obviously mean the government not saying who can and who can’t get married rather than bending over backwards to appease the religious nut jobs.

But surely the supreme court would view the case based on the facts being presented and not their own personal biases!

The problem is that like most organizations, the politics tend to go toward big, monolithic projects that take years and millions and billions of dollars funnelled to whatever company is in the right senator’s or representatives state or district.

In my experience in the private sector, these projects never pan out. Small incremental changes with an overall set of guiding principals and goals to ensure things continue to communicate and work with each other tend to produce faster results.

Hadn’t seen that, thanks for the link.
Not sure that she’s paranoid, per se, and the post notes that Beck goes on to praise her for being paranoid of the media ‘catching her’ out. Palin’s been humiliated publicly so many times in interviews that she now attempts to control all aspects of her exposure to the media.
The truth is, Palin really is stupid. She’s so stupid that she doesn’t even know how to anticipate where her next fuck-up will be, or how to guard against it.
That’s why she’s desperately cramming info on the Statue of Liberty while she’s standing there with Beck, too clueless not to admit to him what she’s doing, and also too damned dumb to realise that if someone did try to catch her out like that, —- “How many windows are there in the statue of liberty and what do they symbolise?” —- it would be patently obvious it was an attempt at a ‘gotcha’, and answering with something graceful and funny off the cuff would work to her advantage.

But she can’t tell the difference. That’s the defining feature of the stupid: they don’t know how to filter information and process it. Can’t identify noise from signal.
Palin is stupid. Not merely ignorant or intellectually incurious: stupid. And that’s what this story shows, more than ‘paranoia’, imo.

Let’s really think through what she’s saying. She’s saying that KSM’s main desire was to have a platform to state his opinions. If that were the case, wouldn’t he come out right away after an attack and turn himself in to the country that has the most open penal system he could find?

Islamic extremists like KSM are completely different from the IRA or even the old PLO & Black September. Those groups (who I believe are repugnant for the atrocities they committed) were seeking to get a message out - in both cases they were seeking some sort of independence. They wanted to bring the world’s attention or one countries attention to an issue that could be resolved if enough political will was brought to bear. The IRA assumed that if enough people knew about their cause and were sick of the fighting that they would win. Black September assumed that if enough people knew about the Palestinians in the 1970’s that they would win.

Al Qaeda isn’t out to win a political victory. They are fighting for what they misguidedly believe to be Islam’s requirement that the great civilizations must go to war with each other, the Muslims must gather together, fight and defeat the non-muslims and then their messiah will come with the establishment of the caliphate. Their goal is war, not attention.

Bachman (and so many others) need to learn what the hell they are talking about or STFD and STFU.

Her public humiliation is a direct result of her stupidity. Her paranoia is also a direct result of her stupidity. I think we agree.
