O’Keefe ‘Race and Conservatism’ Updates

Andrew Breitbart has turned his “Big Journalism” website into an amazingly lengthy tirade demanding “retractions” from practically every media organization in America, for writing about the Max Blumenthal-One People’s Project report that claimed ACORN sting filmmaker James O’Keefe was photographed at a “white supremacist forum” in 2006.

There have been some developments in the story; David Weigel of the Washington Independent, who was at the same event as a reporter, walked back his first statement that he could “confirm all the details” about the story, and has posted an update here explaining which details he could not confirm: Clarification — and Mea Culpa — on James O’Keefe and ‘Race and Conservatism’.

Among some less important points, there are three key details from the Blumenthal-One People’s Project story Weigel now says he does not confirm: 1) that O’Keefe was manning a table of racist literature; 2) that the event was a white nationalist conference (Weigel now describes it as a debate); and 3) that O’Keefe was an organizer of the event (he wasn’t).

(Note that the veracity of the first claim, that O’Keefe was manning a table with literature from white nationalist groups, has not been decided either way. O’Keefe says it isn’t true, but One People’s Project hasn’t retracted it. More on this below.)

In the interest of accuracy, I need to respond to one point Weigel makes in this post about the story: Conservative Media Mogul Plays Defense on Racism Story.

The article trafficked around the web at a moderate pace. Because I attended the event, I wrote about it, and the Blumenthal story, here. Soon, other websites grabbed onto the story and added unsupportable spin. Little Green Footballs, whose editor Charles Johnson has made a splashy departure from the right, linked to the revelation about what he called a “white nationalist conference.”

That’s not an accurate description of what I wrote, and saying I “called” the event a white nationalist conference is not true. Here are my exact words:

According to a group called “One People’s Project,” ACORN sting filmmaker James O’Keefe was photographed attending a 2006 white nationalist conference titled “Race and Conservatism.”

It’s very clear that I attributed the “white nationalist conference” claim to One People’s Project; that’s what the words “according to” mean. And that’s exactly what the claim is at the One People’s Project page that started all this: HEY JAMES O’KEEFE, ABOUT THAT WHITE RACIST FORUM YOU ATTENDED IN 2006…

Interesting what could have been - or not have been - had we caught this four years ago. Back then, there was this white supremacist forum that we had called attention to and eventually attended…

So I do not agree with Weigel that I added an “unsupportable spin” to the story. I correctly attributed and reported the statement.

More importantly, it’s now incumbent on One People’s Project to put up the goods if they have them. They should release an uncropped version of the picture they said shows O’Keefe manning a table of racist literature, or they should retract that claim because they can’t prove it.

You know what though, there's more than enough crap coming out about O'Keefe. The real question for me is, why didn't this all come out sooner, and why didn't the people who glommed onto him (Breitbart) check him out? Or the MSM for that matter?

When the story was first posted and I realized the author of the story was Blumenthal I blew the story off. Blumenthal is a lying hack. When Darthstar posted the Weigel piece I was inclined to believe him because I think he's a fair reporter. I don't always agree with his positions but at least he argues from an honest position. If they can't produce the photo showing him at the event, without the badly done salon photoshopping, they should retract the story.

I have to say that there's so much crap in O'Keefe's past that to me it's immaterial whether he was manning a table with lit there or was there to engage in one of his other racial grievance stunts or whatever. All of his past activites should have come out sooner, and all of them-- like the ACORN stunts-- involve variations on his Rutgers stunts.

Awaiting the snowstorm sitting in my cubicle here in Manhattan. I must say I do rather enjoy snowstorms in the city, for the first 12 hours when the snow has yet to turn black. The noise of the city is almost completely muffled, it's quite breathtaking. It's even more fun when you enter a bar when skies are clear, and stumble out hours later into a blanketed city.

I got home a little while ago. It's barely sticking here in PG County. My local grocery store (a coop I belong to) wasn't mobbed and I was able to get the few things I needed and out in about 15 minutes. Big contrast from the supermarket I stopped by last night.

The liquor store had a huge line, but it was worth the wait. :)

I'm skipping my regular workout and getting on my bike (indoors on a trainer) soon. Then I'm ready to relax for the weekend.

Breitbart's defense on this is similar to his demands that people retract the bugging statements about o'Keefe. The difference between "bugging phones" and "interfering with phones while wearing a listening device" is pretty minor and unimportant. O'Keefe was at the conference. Where he was sitting when the picture was taken isn't really crucial to the story. He's still a douchebag who dabbles in extremist politics.

Can I come visit?

Singapore's subway system is one of the best I've ever used. Very clean too. I made it a point to eat where the locals eat rather than the tourist traps. Heck of lot cheaper and my beer was cold.

NYC to review hiring practices for prison chaplains. Currently all undergo a background check and are required to affirmatively reveal any criminal records.

But a conviction, even for murder, does not necessarily disqualify a candidate from a civilian job like a chaplain’s — though it does disqualify applicants who want to be correction officers.

The only “civil service required qualification” for hiring a chaplain, Mr. Morello said, is to obtain an ecclesiastical endorsement from the candidate’s denomination, which in the case of Muslims would come from the Majlis Ash-Shura of New York, in Wyandanch.

Here's a link to the pdf of the FBI affadavit; not sure what charges will be filed or prosecuted though.
Highlights from the affadavit:
Fraudulently entered representing themselves as telephone company repair people (uniforms, hardhats, and all)
Asked for access to the main phone, observed 'manipulating' it.
Asked then for access to the phone closet to 'perform repair work"
They were then asked for credentials and stated they 'left them in the truck'.
FBI agent states he believes there is probable cause to believe that they fraudulently gained access to Govt property for purposes of 'willfully and maliciously interfering with' a phone system operated and controlled by the USA.

That bolded one is the big problem for them, as none of the explanations they've come up with so far can explain why they wanted access to that.

O'Keefe is a dope, I heard him trying to justify this by saying something like 'Well, ABC news did an undercover sting at a supermarket'. I don't think he understood there is a legal distinction between a business or non-profit office and a senator's office on federal property. Ignorance won't get him off the hook entirely, but I think given the circumstances he probably won't get a very harsh sentence.

The complaint Killgore linked, which is everywhere, boils down to a charge of trespassing with the intent to commit a felony. They don't mention what the felony is nor do they mention anything about bugging equipment. If all the government can prove is the trespass then this won't even go to trial.

Trespassing starts at level 4. At a secure government facility brings the level to 6.
If that were all there was, the perps are looking at 0-6 months.

The kicker is "for the purpose of committing a felony". I'm no lawyer, but it seems likely from the language in the guidelines that the sentencing would be based on the felony they were attempting unless they backed out of it on there own. (getting stopped by the authorities before you actually commit the felony doesn't help).

Unless the charges specifically spell out the felony, I think its safe to say that someone throwing out a 10-year sentence possibility is just blowing smoke.

That's what I read as well that same day as the potential sentence for the charges in the actual affidavit. We can repost the affidavit if folks don't believe it. There's a PDF link to it that I put up in that thread. It was also backed up later by the presser from the AG or whoever is prosecuting this.

I don't doubt that he will get hit with something less than that, but that's the potential.

Depends on the felony attempted. If they were intending to rape Landrieu, then they're looking at 10 years. If they were intending to wiretap, 4-10 months. That all assumes they have clean criminal histories, not under parole/probation, etc.

Oh, he has a problem. There's no doubt about that. All I was saying is that (based on known facts) it seems highly unlikely that he's going to spend 10 years in jail. The 10 year figure strikes me as ridiculous wishful thinking. All of his friends can testify to their heart's content, but none of that will change the sentencing guidlines that federal judges are bound to. If he's convicted of trespassing with intent to wiretap (I *think* that's the worst that's being talked about) he is facing 10 months not years.
