Arizona Birther Bill is ‘Set Aside’

Arizona’s Birther-inspired bill that would have required presidential candidates to show their birth certificates has been, uh, “set aside.”

They gently set it aside, then everyone backed away slowly.

With legislators working toward adjournment of their annual session, the sponsor of the bill says it won’t get a state Senate vote because some fellow Republicans don’t support it.

Republicans who don’t support a Birther bill? Be still, my trembling heart.

Almost. Louisiana is the primary producer of oysters, crabs, shrimp, red fish (drum), and snapper in the US. The irony is that the production platforms are a large part of that fishery. They act as artificial reefs. Big Oil giveth, and in this case, Big Oil taketh away. If you have a home in Sarasota or Sanibel Beach, how does this make you feel about drilling off the west coast of Florida?

I spoke with one of my customers today who likes the AZ immigration bill, SB 1070. He’s Hispanic, a retired firefighter, and works part time as an EMT who gets called to border incidents every week or so. He spoke with a friend of his who lives in Tucson and is a first generation legal immigrant from Mexico, and a high-achiever, and that guy also likes SB 1070.

Just can’t pigeon-hole anybody anymore! /

The way I see it, Lohan is in medical trouble and when you’re literally crazy it’s no fair calling your political ideas crazy. Of course they are, but that’s not the point.

I would too, but not this way, necessarily. The firefighter is well acquainted with law enforcement, but I’d like the opinion of someone IN law enforcement in the area, who isn’t one of those “already profiling” kinds of persons.

I had a young man working for me who is Hispanic, who used to complain about the local cops profiling. He said he’d wear a cowboy hat so the cops would think he was white. Thing is, the cops he was complaining about were also Hispanic. Things just aren’t always simple….

That’s not terribly surprising. But I still think this bill is just too open for potential abuse. Arizona is going to pay out a lot of lawsuits if they try to enforce this.

A handy tip for gardeners: Garlic
I’ve been experimenting on my slugs lately and by far the most effective way to remove slugs is with garlic. I’ve used baits, poisons, beer traps, etc but garlic beats them all. A few days ago I could count dozens, if not hundreds of slugs crawling around. Now I’m lucky to find 2 or 3. It’s easy, cheap and best of all, it works.
Just grind, mash, blend, blitz or mush 1 bulb of garlic in about 2-3 cups of water and let it sit overnight.
Strain the garlic water through a paper towel or strainer into a spay bottle or one of those large pressure sprayers. Top off the bottle or sprayer and spray your entire garden. It takes me 3-4 minutes. Even in the rain your slugs will be motivated to leave or die. Here’s the science: New Research Finds Garlic Kills Slugs

You want to see them, size up their body build etc. But on top of that, it doesn’t hurt to know that Asians and whites are at greater risk. You factor that in if you’re serious about getting the right estimate.

You’d be nuts to just say “at risk” the moment you learned they were white, though. That’s just one ingredient in making the call, and one of secondary diagnostic value at that. If you made the call on that basis alone you’d be inundated with false positives.

As in the case of medical issues, the best policy for selecting people for interrogation or investigation, or audits if you’re the IRS, is the one that strikes an effective balance between avoiding false negatives, avoiding false positives, finding true positives, and holding down costs. The price, to law enforcement and to the individual selected for interrogation, of an initial stop-and-question, should be minimized. Everything polite, everything done so as to impose minimal delay, and compensation if the inconvenience is nontrivial.

A lot of us have been on the receiving end of false positives, even us palefaces. Pulled over for further checking at airports, given a grilling while reentering the U.S. all grubby from canoeing, or what have you, it’s annoying but one must keep a sense of perspective. The guys hassling you really aren’t doing it for a hoot. They aren’t out to get you. And if you just smile and keep up the confident straight answers, they’ll eventually realize that they’re barking up the wrong tree.

Precious few of us have never been legitimately stopped for a traffic violation. The officer making the stop doesn’t know whether this is just another stop like almost all the others and nothing more than another five minutes of calling stuff in, or whether it’s going to escalate into a fight. We civilians can hold down the cost [in high blood pressure, for starters] to ourselves and them by keeping everything polite and calm on our end too.

Absolutely. Delay ran the redistricting after the 2000 census and we got Congressional Districts that the WaPo described as looking like a “cheap pin-striped suit”.

Accurate. It went to court, and accommodations were made, but Austin is still the largest city in the country, and the only State Capital, that doesn’t have a US Rep in the City core. We are divided up into three Congressional Districts.

(Take that, People’s republic of Travis County!)

The bill says they can question you after any “legal contact” In other words, they simply need to come up with a reason to stop and question you. To the best of my knowledge, a cop can stop and question you just on suspicion, like asking why are you in this area if you seem out of place. i.e. a white guy in a BMW parked near a crack house, or gang bangers in a up scale area.
I could be wrong, but legal contact seems pretty broad.

that’s been my impression. on its face, the po-po need legal contact…but legal contact is pretty easy to come by.

so then i took FBV’s advice (yeah, yeah) and thought about what i’d recommend instead.

can a state pass a law which expels an illegal from their border? how about just saying that people convicted of a crime in excess of a simple ticket will prove their immigration status or be kicked the F—- out of the state?

I spoke with one of my customers today who likes the AZ immigration bill, SB 1070. He’s Hispanic, a retired firefighter, and works part time as an EMT who gets called to border incidents every week or so. He spoke with a friend of his who lives in Tucson and is a first generation legal immigrant from Mexico, and a high-achiever, and that guy also likes SB 1070.

Just can’t pigeon-hole anybody anymore! /

I don’t dislike the bill on its face. After all when I go to Europe, I’m required to show my passport and in many places a visa as well.

However, I can guarantee that I’m not going to be asked to show any documentation in Arizona. They’re not going to ask because I’m white.

I don’t think any of our Canadian or English, German, Dutch, Indian or Irish friends need to worry about it much, either. Even if they’ve overstayed a student or H1B visa.

This is a law that’s designed to harass Mexicans.

If they enforce it fairly, it’s also going to harass white people.

The ultimate irony is that the same people who are pushing this crap are also worried that Obama’s got FEMA camps and that Real ID is the mark of the beast - and that’s what bothers me the most. One law for me and for thee should be the way things work here. If Mexicans or Guatemalans or people who might possibly look like they’re Mexican need to show their papers, then Arizona should just welcome Real ID, too.

Buy fresh ones, and the funny part is when you release them at dusk, many people recommend spraying them with soda pop (Coke) which makes their wings stick for 24 hours , so they stick around! I haven’t bought Ladybugs here, TONS of larvae! They’re weird looking, but Ladybugs are good!

Have you read the law? It’s a carte blanche for any “legal contact”. How many white guys in BMW’s will be pulled over and asked for their Birth Certificate or Passport (the only legal documents that pass muster under the law) if they drift out of their lane while on a cellular call? How many soccer moms in Land Crushers?

The Pima County sheriff was on MSNBC saying that this law lets the public SUE the police , if they believe that they are not enforcing it.

How do you figure out if they ARE enforcing it?
Is there going to be a certain quota of illegal immigrants caught?
Are people going to be waiting outside work sites to make sure the day laborers get caught? Will they file a lawsuit when they find out they been arrested?

This law is impossible to enforce without profiling racially.
The governor of Arizona knew it when she bullshitted about seeking “training” for the police.

It’s the brainchild of Kris Kobach, a totally loathsome character, and it has no place in today’s America.

Buy fresh ones, and the funny part is when you release them at dusk, many people recommend spraying them with soda pop (Coke) which makes their wings stick for 24 hours , so they stick around! I haven’t bought Ladybugs here, TONS of larvae! They’re weird looking, but Ladybugs are good!

i was shocked out of my skin the first time one of those asian multicolored ladybugs bit me. didn’t run into them as a kid…it’s not very painful, just surprising - freaked me out!

In my opinion something has to be done. This AZ bill is better than requiring employers to verify work eligibility. Currently the Feds tell us we must accept 29 different forms of documentation, many only in combination with others, including day care records. Come on! This is total BS! The Feds must get control of the border. If the Feds cannot or will not do it, then the local police are the next best option. They are certainly more qualified than I am.

I don’t think the AZ bill gets employers off the hook at all, does it?

Look, dude, I don’t want to say that stupidity has become a National Sport, but the Law requires that Arizona Law Enforcement, visually, determine who is likely to be an illegal immigrant in a State that is 35% Hispanic and includes language to *sue them* if they don’t.

And it requires that anyone stopped either have have a US Passport or a birth certificate, as they are the only documents that will pass muster.

Actually, yes, I believe every state has some provision that requires you to have your ID on your person if you are out in public. I have broken this law many times while out on a run, but somehow escaped prosecution.

Perhaps, but the courts have ruled that is “legal contact” I once turned around from one because traffic was backed up and I thought it was a accident. I was chased down and had to do the whole sobriety test.

Not all states use the Social Security number as the DL number. Iowa just switched to a different number letter combination. I don’t have it memorized. If I hadn’t had to use my SSN as an id in college I wouldn’t have it memorized either.

It’s open for scads of abuse. After a police officer stops you for an infraction, he can, based on “reasonable suspicion” not “probable cause”, consider that you may be here illegally. That’s why that driver in Phoenix last week didn’t get off the hook even when he showed all the proper paperwork, including his dr license. He was detained until he produced his birth certificate, if I recall the story.

It’s putting the duty in the hands of the cops and it’s not their job to make such determinations.

The reason a birth certificate isn’t is that it doesn’t prove that you are the person to whom the certificate was issued.

Like I said, my birth certificate is 2 names out of date and even if it had a picture, I don’t look 3 days old anymore.

That is why employers cannot be expected to be the front line of immigration enforcement. In my view, it is a job for professionals.

Not all states use the Social Security number as the DL number. Iowa just switched to a different number letter combination. I don’t have it memorized. If I hadn’t had to use my SSN as an id in college I wouldn’t have it memorized either.

California doesn’t put the social on the ID cards. I just know mine because I wrote it out on eighteen different college applications.

Yes. They’re eligible for employer-paid disability.

It’s also a number that is so frequently used as ID that non-work-eligible aliens can get them to (such as people on a student visa).

OK. So no ID is suspicious, and they have to bring you in? Fair enough, although at this point we run into a fine problem having to do with whether we enforce this evenhandedly, which will be a supernatural pain in the behind, and swamp the cops, or whether we only enforce this if we think we may actually have an illegal, in which case other problems—the profiling problems—come into play.

OK, random school story to break up the tense atmosphere:

My school has a Latino Club, and they do different school activities through the Spanish department of the school. “Latino” in our school means, almost exclusively, Mexican and Salvadoran.

The Spanish department teachers are all Peruvians.

This has occasional consequences. This past winter, as the Latino club set up their shrine to the Virgen de Guadalupe, I heard the head of the Spanish department ask “Does it have to be roses? Can it be other flowers?”

The Peruvians know jack about Mexican custom, and why should they? But they have to organize the kids to do all of this, because, gosh darn it, they are the Spanish department. Meanwhile, we have a bunch of Mexican-American teachers teaching math and stuff, but that’s not their department’s JOB.

Right now, they’re suffering through the Cinco de Mayo preparations. This would be easier if they were 100 percent sure what goes into guacamole—a dish they pause before pronouncing.

For me the real question is what constitutes “criminal suspect.” An infraction isn’t a crime, I don’t mind the police inquiring about anything odd or out of the ordinary that makes them suspect a real crime. Once they have someone in custody for suspicion of a real crime I don’t mind satisfying any questions of legal presence before release. But what happened here isn’t easy to classify, as it hasn’t been made clear what “crime” the guy was ever suspected of. The term criminal suspect starts to become meaningless if it is used, as it appears at first look to have been, to harass, cuff and arrest a licensed and legal trucker for driving while brown.

Earlier today I wrote about Noah’s Flood and the message to take away being that it is possible for humans to corrupt the Earth literally. I was asked - but what about the sins of humans - surely you don’t mean that carbon is a sin like that?

I do not. I tried to explain this earlier.

When I put this in the context of global warming, my intent was to point out that the sin is the exploitation of humans in third world countries and that those sweat shops that we fund dump huge amounts of carbon as part of the value added. When we wage wars or install brutal dictators and theocracies in order to continue burning fossil fuels, part of the value added to that sin, and the suffering we cause is a larger carbon footprint.

But hey, you get to drive your SUV to Wallmart right?

What made the story of Noah so interesting to me was that in it we have sin have a physical manifestation. This is not a concept unique to the Noah story in the bible. What makes the connection today though is that Americans and Westerners rarely calculate the true cost, the true human cost of our consumerism. However, the way that we do it, has a physical manifestation - that will ironically bring floods.

This is not something that any Jew should ever try to sweep under the rug. We are not yet in a nazi state. This is true. However, very real Nazis were behind this bill and helped to pen it. They were not in a nazi in some pejorative sense, but actual bona fide, love Hitler neo-nazis.

As Jews we owe it to our history and the respect of our dead to stand firmly against this evil before it can manifest to the level that you just quoted. What serves no purpose is to guard the suffering of our murdered relatives as some sort of “we suffered more trump card” in the face of concern over a very real and very rising evil.

I’m not sure I agree. A big part of this bill seems to be an attempt (albeit wrong-headed and way overboard) to force Washington’s hand. Scapegoating does not seem a primary objective.

Right after the Presidential election I attended a meeting of the Jackson County (MO) Republicans where Chris Stigall was the featured speaker. I later found out that he was a personal friend of my niece’s husband. He seemed like a very reasonable, thoughtful guy. I appreciated that he didn’t seem to be a bombastic, egotistical Glenn Beck or Rush Limbaugh type personality. I was disappointed when I joined his Facebook page and found that he just spouts the (Tea) party line on everything.

Louisiana, a beautiful state with great people which I just visited, is likely in for devastation that will dwarf Katrina, and will continue to impact the state for a long time to come.

Agreed. The bill is wrongheaded and seriously over the line. The GOP will pay the price with Latinos for this. That’s a small bit of why I would not support Crist over Rubio. Rubio, for all his faults, understands why this bill is electoral poison. I’m hoping he can get the rest of the party to understand this. Every time the Republican base gets into a frenzy over immigration, there are fewer Republicans when the dust settles. They need to be made to accept reality.

Between the Arizonans and their laws, my own Congressman (Hunter) with his statement about wanting to deport children born in this country, and this guy James and his “roadway safety” bullcrap… I’d say the GOP has had a rousingly good xenophobic week, eh?

Also if the son of a bitch was actually crazy enough to do this they’d no longer be in compliance with federal regulations, the good news for anyone in any of the other 49 states is that we can use the money we won’t be sending to Alabama to pay down the national debt!

Luckily there’s an easy two part solution for the GOP

1: Turn down the hate so that it becomes permissible to vote for a democrat.

2: Run credible candidates so democrats/independents might want to vote for them…

when this subject was last agitated under bush, some northern tier state tried to enforce the existing laws by raiding businesses that employed lots of illegal workers

that lasted less than a week before it was discreetly quashed

I think you’re thinking of Butler County, Ohio, the county immediately north of Cincinnati. Sheriff Richard Jones has been very vocal on the illegal immigrant issue, and unfortunately very active. He and State Rep. Courtney Combs (also Repub, also from Butler County) are trying to meet with AZ lawmakers to see if they can get Ohio’s legislature to pass a similar bill, despite Ohio’s lack of proximity to a border and relatively minor problem with illegals. Governor Strickland (a Democrat) says he’ll veto any such legislation. Now Sheriff Jones says he’ll push for a statewide initiative to bypass the governor.

BTW, Butler County is also the most populous county in the district “represented” in Congress by John Boehner. I lived up there for 14 years and never once voted for Boehner, even though I tend to vote Republican in Congressional, Senatorial, and Presidential races. Make that tended.
