Rand Paul Wants to Dump Section One of the 14th Amendment

In an interview with the Russian propaganda network “Russia Today” (a whacked out conspiracy show pretending to be legitimate news; RT often features Alex Jones and other conspiracy advocates), Rand Paul says we should forget that pesky 14th Amendment to the Constitution, and take away the citizenship of children born in the US to parents who are illegal immigrants.

These are the same people who want to deport all Muslims.

The one thing I can understand trying to prohibit would be a pregnant illegal immigrant making a mad dash for the border just so their child is born in the US.

But we'd have to have some well thought out plan for those situations which would cause someone to be deported to a country they essentially would be an alien in. The kid in that case was an innocent.

The Fourteenth Amendment (Amendment XIV) to the United States Constitution was adopted after the Civil War as one of the Reconstruction Amendments on July 9, 1868.

The Fourteenth Amendment provides a broad definition of citizenship, overruling the decision in Dred Scott v. Sandford (1857), which held that slaves and their descendants were not citizens of the United States and were not entitled to Constitutional rights.

With a shrinking, aging population, immigrants are going to have a lot more clout then they do right now. Everyone games the system, whether it's taking a tax loophole or deduction you technically shouldn't, or skirting the law in some other way. Hell, many Americans do it in reverse, going to Mexico or Canada for more affordable health care and prescription drugs.

If we're going to start focusing on stopping people from gaming the system, there are much bigger issues to look at than a few children born to illegal immigrants.

Using Google in French, all I could find was an approximate 500,000 in 2008, for a French population of about 65 million. There may be more or there may be less - by definition, an illegal immigrant is someone who more or less stays under the radar here. I'll keep looking and see what I can find.

There aren't really great numbers on illegals here, though. It really goes by how many people you catch. Then multiply by 1.3. Not exactly rigorous methodology.

In some places, the entire community is built around fishing/shrimping, and so everybody in the entire community is adversely affected. Maybe Randy might hire them for the next year?

It was a spot on the beach where the Bedouin rented out little huts built from Palm leaves. We were at the primitive outside bar. Hey Cliff, I finished my reading. I'm now much smarter. I linked to the gist of the articles in my pages. After looking through 4 pages of Google links on Birthright Citizenship Act of 2009, most constitutional scholars seem to think the Birthright Citizenship Act of 2009 won't pass constitutional muster and flushing Anchor Babies from the land will require amending the constitution. Of course lot's of folks disagree. Rand Paul, David Duke, George Will, Tom Tancredo and a host of other benign and not so benign web-o-sphere dwellers. So get to petitioning your congress critter, this ones not going to make it to the floor, and if it does, it will end up in the Supreme Court.

Interesting reading. My initial impression and reading of the 14th Amendment and subsequent court decisions when that mastermind Tradewind brought it up a few weeks ago still stands as it applies to this issue. So, of course, I will be returning to sarcasm, as that's all I got for this bullshit.

Top Kill didn't work, and BP knew it wouldn't work three hours after they started. There's no way to pump enough mud to stem a 16,000 PSI gusher...they can slow it down, a little, and reduce the hydrocarbon portion, but they're replacing that portion with a toxic mix of chemicals that aren't any better for the gulf than the oil is.

I've heard stories about how some of these babies get here, and sometimes they involve injury to the mother in her efforts to get here, usually there is more hospitalization than an average birth because there was no pre-natal care. I'm sure many people would think it's bad to spend a lot of money on these mothers and children, but I don't. I wish it was not so expensive, but I don't think the policy should be changed.

Bagua - hubby is in that group. We have no clue what the next 6 months hold for us. The rig he's on had their permit issued, then revoked, then re-issued, and he sent word yesterday, it's been revoked again.

There is no reason on the face of the earth for there to be this moratorium on new wells or continued operation of existing ones.

People who are in the drilling business knew by the end of the first week after the blowout what had happened and why. And they knew it was the result of BP making some very bad decisions, that most people in that business would not have made or gone along with.

This moratorium is nothing more than a political PR move.
And thousands of families are going to suffer.

Nope. The well could be kicking as high as 16K but the formation is about 13,000 and there is a drop somewhere as it is about 9,000 at the bottom of the BOP. There is a choke off in the BOP because it is only 400 psi above ambient above it. If the pressure drop was low enough in the well then a column of mud could kill it. That is what the relief wells are going to do, inject mud.

The problem is it is looking like the pressure drop is too high in the well to get a sufficient column of mud. 5,000 ft? Unless they found a way to go lower. If they could recover the drill pipe and it extends more than 5,000 ft, they could use it to inject mud at the bottom of the well and gain control of it, just as the relief well would. But this would involve letting the well free-flow at 9,000 psi while this was tried.

Remember, the well was held back previously by a column of mud before and after the various cement jobs. The mud and the likely faulty cement plugs were holding the formation pressure until the mud was displaced with lighter sea water. It didn't blow up full of mud.

I'm not sure about the composition of the mud, but it is said to be water based and non-toxic.

I'm not thrilled with granting citizenship, even on those conditions, to illegal immigrants. Permanent residency with no path to citizenship, but they'll be the parents (or at least grandparents) of citizens.

Looks like the was getting ready to stick the wrench back in the leak plume. It is wrapped in twine, and the robot holds it in the plume and occasionally pulls it out to bang it against the BOP.

People have speculated it is to see if either oil or hydrates stick to it, a primitive oil dip stick. My guess is it has some tubes secured to it and the wrench just is to hold it.

What you propose was likely it. If you've even worked retail when a delegation of high corporate officers is in the area, you've experienced it. The whole store becomes a dog-and-pony show, in which the most important thing is to have everything look to the execs. I've heard more than one validated story of someone fired because things went wrong in front of the brass.

Arkansas is not on the Gulf.
The Mississippi Gulf Coast beaches are man-made beaches, and not particularly pretty. The water there is muddy and dark. There you don't have shacks, but you have moderate-income beach "camps". Most of the folks living on the Miss Gulf Coast (Biloxi etc) work at those casinos there. We're not talking rich folks here.

Anyone with any money is going to go an hour further east, and get a condo in a high-rise in the Gulf Shores AL /Perdido Key FL area.

It is about 9,000 psi at the sea-bed just below the BOP stack, ambient water pressure about 2,200. The formation (reservoir) is about 13-14,000 psi. Injecting mud at depth is the best way to kill it. It is what the relief well will do and what they did to hold it back before any cement plugs were set. If the bore hole is intact, a full column of mud will hold back the formation.

Well here's the thing.

I hardly go out of my way to defend cato. Usually, we've had some really bitter and acrimonious fights. There is nobody I would support simply because they're on my poltical side, or because they were longstanding members of the community.

The latter is specifically what I was talking about. There are longstanding members of the community that can get away with a ton of really unacceptable behavior, specifically because of who they are and their record of being here a while (I'll spare us both specific examples as too divisive, but trust me I could bring some up). I find forgiving bad behavior on an internet forum for that kind of reason particularly annoying.

I have some really damn bad habits, but I don't think that's one of them.

Political tribalism, I'm sure you know what I mean. The best example would be somebody on here saying he hoped Obama failed because it would help the GOP in the upcoming elections. That's not such good thinking.

There won't be any more amendments to the Constitution. Not in this USA. You won't see 3/4 of the States agreeing on anything.

Well, the whole conversation is moot. Repealing a constitutional amendment requires - another constitutional amendment. And that takes ratification of the proposal by two thirds of the states. It would be dead the minute it leaves the floor of the Senate

Not quite. The USSC has never ruled that the 14th Amendment grants citizenship to children born to parents who are here illegally. Since that obviously wasn't the original intent of the amendment and also since the constitution also grants congress the sole authority to decide immigration and citizenship rules....It could be an interesting court case and argument.

Read the Supreme Court case US v. Wong Kim Ark. Our law on citizenship is based on centuries old english common law. If you are born in the USyou are a citizen. The only exceptions are children of ambassadors and children of enemy soldiers in hostile occupation of our territory. Everyone else born here is a natural born citizen. Period.

Living off the grid, so to speak. In my experience, alot of them are more of a drain on resources than contributing members of the US economy. It should have been repealed years ago. Every other country with mass immigration has stopped such nonsense. Ireland stopped it just in the last few years. Most of Europe has such, and if not they are in the process of stopping it.

If we have a guest worker program when they finally do the immigration reform, we cant allow in millions more "temp workers" dropping babies to then become permanent anchor babies. If they are allowed in they must remain "under the jurisdiction" of their home countries and unavailable for birthright citizenship per the amendment language.

The guys working for the landscaper off the books would still be paying sales tax on everything they buy-- and their kids, as American citizens, would be paying all the normal taxes that an American citizen pays. If you want to stop off-the-book employment of illegal aliens, look to the companies hiring them, not the people taking the jobs. It's really hard for me to get fired up about disliking someone because they're working a job for less than someone else will, enduring worse conditions. That mainly makes me feel sympathy for them.

Also, you apparently have no clue what 'off the grid' means, since it really doesn't mean ten people to an apartment.

Notice the word "assumed"? That's what you did. The question of whether the children of "Illegal immigrants" has not been explicitly answered by the USSC.
