Are the Ten Commandments Really the Basis for Our Laws?

Here’s an excellent essay by Phil Plait on a timely subject, as the Christian right pushes harder than ever before on many fronts to erase the line of separation between church and state: Are the Ten Commandments really the basis for our laws?

As we ramp up to the mid-term elections in November 2010 — sure to be just a warmup to the insanity that will be the Presidential election in 2012 — you can bet your bottom shekel that we’ll be hearing from a lot of “family values” politicians decrying our lack of morality. That’s de rigeur for any election, but every cycle it seems to get worse.

A lot of these claim that the United States is either a Christian nation — a ridiculous and easily-disprovable notion — or that it was founded on Judeo-Christian principles (the “Judeo” part is a giveaway that these politicians are Leviticans: they seem to keep their noses buried more in the fiery wrath of the Old Testament than in the actually gentle, politically-correct teachings of Jesus… more on this later, promise). Specifically, they claim quite often that our laws are based on the Ten Commandments.

I was thinking about this recently. People seem to accept that our laws are based on the morals of the Old Testament laid out in the Commandments, but as a proper skeptic, I decided to take a look myself. Why not go over the Commandments, said I to myself, and compare them to our actual laws, as well as the Constitution, the legal document framed by the Founding Fathers, and upon which our laws are actually based?

So I did.

As are the Code of Hammurabi, Roman civil and criminal law, the Code Napoleon, and multiple other sources.

Pick and choose? Revert to a notional, never-actualized Biblical law as a stealth basis for establishing a religion in this country?

precisely the point the author makes in the article. our constitution actually directly contradicts some of the more explicit commandments, including but not limited to "thou shalt not take the name of the lord your g-d in vain," and "there shall be no graven images."

They might then argue that "based upon" the Ten Commandments does not mean word for word adoption of all of them, but that the concept that law is handed down from on high is the important idea.

It is an attempt to counter the humanistic origins of law, that our laws are nothing more than mutual agreements among groups of peoples and between groups and individuals.

It's as tough an argument to counter as creationism, as besides being the same participants in the discussion, they attach the same magick-like quality to their beliefs of law as they do about creation.

Indeed, if you ever get into a discussion with a creationist about scientific "laws" you will notice similarities in their idea about the "laws" of science compared to laws about the items of which the Ten Commandments address.

I read the article, and anyone with a inkling of history understands that our "laws" are a combination of trial and experiments from 6000-10000 years of codes and moral underpinnings.

But, at the same time, this author is being pedantic is framing his article this way. As much as it would take a person lacking much education in the history of the world to actually believe that our laws directly stem from a foundation in the 10 commandments, it would also take and idiot to think that these points being made are some deep insight into the facts.

Cheap shots from all sides.

What I would find more interesting would be a discussion comparing the laws of pre-Christianity Europe vs. post-Christianity Europe vs. pre-18th century China vs. pre-Columbian South American cultures.

The underlying thinking is also important. Are all men, well, men, or are there men, slaves, lords, etc, and the mistreatment of each brings different penalties. What about women? Are we chattel or beings?

Are laws written down, or at the whim of the judges? What about society? To what extent do we carry the blame for the misbehavior of other human beings. (Before you say "hunh?", remember that there are families in the middle east in which the misbehavior or perceived misbehavior of one member of the family can shame the entire clan.)

I'm as interested in the roots of our thinking about laws, the value of people and property, and how we make amends, as the laws themsevles.

The basis? No, of course not. A basis? IMHO-Undeniably. Since the religious right insist on a craven overstating of the connection the writer has a point. But even they do not claim all ten! Hence the overstatements compound upon one another. As soon as you return to a rational view of the connection the article falls a bit flat.

On adultery- It was illegal for much of our history. Consenting adults does not change that in a historical sense. So that adds a point. Since even the religious right (as far as I have read) makes little to no claim on us even having laws about who or what or when we worship, those should not even be in the article.
As Cato points out western law has a number of roots. Each and every one has some merit and some flaws.

From the Hammurabi code which is one acknowledged root of our laws-
If any one bring an accusation of any crime before the elders, and does not prove what he has charged, he shall, if it be a capital offense charged, be put to death.

Fortunately we did not keep that one either. Shall we dismiss this connection here too if at some future time it is overstated?

martin luther king, jr., believed in natural law as opposed to positive law. in fact, that was a large part of why he condoned non.violent activism - he felt that the segregation of the south was in violation of inalienable rights of humanity which are independent of positive laws. but he certainly wasn't a proponent of biblical law as the law of the land.

i think there's a happy middle ground for people who can rationally hold two "opposing" ideas in their head at the same time and not explode into pixie dust, because rarely are the ideas as "opposed" as they are proclaimed to be.

however, people like that are a rare commodity. instead, we have winners like glenn beck and pamela geller yelling and screaming about "sharia law!" and "hitler!" and "social justice = nazis!"

we need great thinkers with power, again.

There is a categorization of Jewish laws. Some are specific to Jews. Some have religious reasons and meanings given in the Torah, and some are given, and we do not know why, but honor them as the word of God. There is also a category of laws which are common-sense laws necessary for a functioning society. The reasoning of the Talmud goes that while we may attribute our having these laws to God having given them, pagan societies also have such laws--civil and criminal--because the rational human mind would logically see a need for them.

First of all, there are 613 commandments, not 10.

And most Jews are completely baffled over Chr-stians who freely put G-d's name on bumper stickers, and put little statues of G-d, or his kid, all over their churches, while claiming to be obeying the "10 Commandments"

As a Jew, I'm glad that there's a separation of Church and State.

However, more interesting than the "10 Commandments" is the system of Jewish law codified in the Oral Torah, and written in the Talmud. While not the basis for our secular legal system, there are many fascinating legal arguments here concerning rights of property owners, debts and obligations, just treatment for workers, etc, that have counterparts in modern law.

And it's fair to say that, when studying the evolution of modern legal systems, certainly the Jewish scholars who codified the Oral Law would be part of the history of the evolution of laws and courts.

The "10 Commandments" is a trivialization of Jewish Law. And the supreme importance given to them is largely a Chr-stian invention.

Well, I'm the one who is always catching hell for pointing out the historical facts behind the texts... three whole religious schools of thought have been developed from mythical writing, yet people go through life in awe of the power of religion, the power to divide us, the power to motivate us to kill each other... the power to tear down, isolate, and provoke some of the worst behavior man has ever seen.

Yet all it takes is to be honest with yourself, to accept the easily discovered truth that the whole foundation of these religions are based on a book of tales and myths.

It would be like reading Tolkien and forming a cult around Middle Earth.

True, and that's fine. It does, however, rather underscore that when people say 'Judeo-Christian', they mean 'what Christianity derived from Judaism', rather than 'Jewish tradition'.

Well, I'm the one who is always catching hell for pointing out the historical facts behind the texts... three whole religious schools of thought have been developed from mythical writing, yet people go through life in awe of the power of religion, the power to divide us, the power to motivate us to kill each other... the power to tear down, isolate, and provoke some of the worst behavior man has ever seen.

Aren't you always struck by the fact that most 'interpretations' of the Bible certainly are not the Jewish, scholarly interpretations?

The issue of coveting, also, not the way our sages interpret it. It's not simply wanting something that belongs to someone else--you have to begin making concrete plans on how to get it.

I could go on, but the amount of misinterpretations border on absurd.

In my Scofield (scholars version) bible there is a footnote on that. "Thou Shall Not Murder". BTW for the curious, that bible is footnoted with the varying translations. I found that one fascinating for it's implications.

Then there's the fabulous Renaissance misprint that somehow made it through the proofing process--the 1631 Bible where the commandment in question reads "Thou shalt commit adultery."

True, and that's fine. It does, however, rather underscore that when people say 'Judeo-Christian', they mean 'what Christianity derived from Judaism', rather than 'Jewish tradition'.

When I think of Judeo-Christian, I'm more thinking of the way of seeing people and their proper relationships and justice, etc. The bedrock thinking.

For example, both the ancient Celts and the ancient Chinese, when they b
buried a great Chieftain, would bury human beings with them. I know the Celts sometimes buried a woman to be his wife in the next life, and I can't remember exactly who the Chinese buried. In the case of the Emperors, lots of people.

There is a thinking here about the value of people and their relationship to each other that is distinctly different than ours.

He never wore pointy ears, though, and he thinks the learning-Klingon thing is just weird.

Compare and contrast with various laws in Leviticus &c. requiring death for things that we now consider a matter of private concern.

There was a reason for that Roman law, which goes back to pre-Republican times. A deformed child could not serve in the army or be expected to bear healthy children. It would, if it survived, grow up to be a charge upon the parents and the state.

That's ok.... I went to bed before you posted your later comments... I saw them this morning.

I can't do any smithing. My ex-wife did. I have probably 25 small nice pieces of gem quality opal that I have cut over the years, but they are in gem containers sitting in a tray because they really need mounting in silver or something, and I'm not set up to do that, both artistically or financially.

Heck, that sterling silver half round that you see me using as the finals on the chokers goes for about 27 dollars for 10 feet, and it takes me a foot for each choker. Just recently I had to buy some to restock myself. The last time I purchased any, it was about 50 cents a foot, that was 6-7 years ago and I bought yards of it.

When I calculated the new cost of silver, it doubled the value of my existing pieces.

His big problem in sports was that he didn't know he needed glasses until his senior year. So he didn't play basketball until after that, although he played for fun later on.

I have no idea what he played in high school, but he made it as a walk-on to Oregon State's team (then dropped out after he took his first physics final, and decided he had to be serious about the engineer stuff.)

Track and field, too, although it was my uncle that did track and field in college.

GAZA CITY, Gaza Strip — A France-based satellite provider is halting broadcasts of the Hamas TV channel to Europe and parts of the Arab world because of concerns that it spreads incitement, a station official said Tuesday.

The decision will deprive Gaza-based al-Aqsa TV of most of its viewers, said the channel's head, Hazem Sharawy.

The Hamas station — best known for its children's programs glorifying violence against Israel — is the centerpiece of a growing media operation of Gaza's Islamic militant Hamas rulers. Losing the satellite provider will hamper the group's attempts to spread its message and raise funds abroad.

The basis for our laws are not based on scriptural based verses.

They are based on a singular event, the story and lessons of the Exodus. That event enshrined the notion that all men are created equal, slavery and tyranny are always unacceptable and that freedom is always worth fighting for.

We do not God to tell us killing is bad and to honor our parents. We can live in an ordered society with a Sabbath Day. We do need God and Scriptures if we want our lives to have meaning beyond a finite stay.

Faith is personal. When faith is fully integrated into a society, you end up with Yemen.

That the Founders may have been religious is admirable. Their ideas have helped shape this great democracy. That the Founders understood that faith must remain personal and separate from society is even more admirable.

Happiness is having a chain-saw. I got the tree my wife knocked over onto our neighbor's Jaguar pieced up and out of his way so he'll be able to park, and fortunately the only branches to hit the Jag were small ones, so aside from a cracked windshield and a broken side-view mirror, it doesn't look like there was any body damage...lucky, lucky fall, all things considered.

I suspect the tail-light housing on the X5 will cost more than the windshield and mirror for the Jag.

Tonight's speech would be a good opportunity for President Obama is instigate a reduction in pesticide usage up and down the Mississippi review, in all the surrounding farmlands and plantable areas that drains into the river. This would reduce the effect that pesticides have on the wildlife in the basin area. It's bad enough that the animals will have to now deal with oil on top of all the stuff that has been coming their way for years.

President Obama should mandate less pesticide use and the federal government should set up a farmers market agency which could help develop farmers markets up and down the Mississippi area, where people could buy food fresh from the farms, sans pesticides and other chemicals.

That's what President Obama should highlight in his speech tonight.

Looking at the way the tree broke off at ground level, it's safe to assume the next wind storm would have brought it down anyway. Funny thing is, she broke our tea-kettle yesterday when she bumped it against the sink when cleaning it, so when she called me at work this morning, she simply said, "Well, I'm still breaking things." I asked, "What did you break?" and she said, "Bob's car." I do love that woman.

Did you read the article? There are other commandments that clash with the Constitution.

Now, I can argue that this particular action was objectionable long before the Ten Commandments were etched in stone. Heck, even some other primates apparently can grieve over the loss of other primates. Also, people kill all the time, and it’s not necessarily illegal. Soldiers, for example, or killing in self defense. But either way, the Commandments can’t really claim first rights to this one.

However, I can’t rule out that our law is based on this Commandment; even if other civilizations had their own rules, ours may have a different pedigree. Just a little background on that long comment of mine. It was actually something I heard on Thom Hartmann's radio talk show today. Hartmann is as progressively left as Rush is radically right. The discussion was on what people wanted to hear from President Obama tonight.

That was only one of the lefty unicorn worshipers comments. They ranged from outlawing the use of petroleum starting NOW, to nationalizing all energy industries.

It was absolutely refreshing to be reminded that there is still a lot of crazy left... on the left. If you think the right is tanking, you need to pay close attention to whose rowing the boat.

Ok... this is a piece of "picture jasper" I polished... in they style of Georgia Totto O'Keeffe... the "picture" on the rock is a natural formation... I found the "image" and cut it out of a larger slab and polished it... (P.S. The other piece, the choker, is Matrix Opal)... "painted jasper" is a very interesting rock... makes all sorts of scenic sorts of "landscape" formations and the occasional "dirty" picture...

The EU was a mistake from the beginning, an unelected bureaucracy imposed when a majority of the voters opposed it. Having it collapse under its own weight and a return to the previous status quo would probably be welcomed by all except those who've made a fortune by fleecing the unwilling.

Exactly, only those parasites sucking the teat of unaccountable public money would suffer.

The EUrocrats warn of total collapse to frighten the voters, it is fear-mongering to protect their position on the EU gravy train. Each provincial government of the EU has its own courts, police and political structure. If the EU closed shop on Monday, nothing would change on Tuesday, life goes on.

What would be different is that new laws would have to be made by the provincial states which will have become nation states once again. They would regain democratic oversight according to their own laws.

Well, there would be one problem, namely the Euro. If the EU collapsed overnight, then would they still keep using a currency that's now basically become worthless until their old currencies have been reintroduced or what.

The Euro is a different story than the EU of course. The Euro currency would simply continue to float and be traded out for the replacement currencies. It would not go to zero.

It will be fact checked. Rather than say someone is lying and leave it at that, though, you should quote a specific claim of fact and then provide a refutation, together with a reason why Obama should be expected to have known better than to make the claim in question.
