Kagan to Be Confirmed, Nuts Go Into Overdrive

Today’s the day Elena Kagan will probably be confirmed to the Supreme Court, and the loons’ heads are exploding all over the Internet.

The most absurd and bigoted piece I’ve found yet is at Andrew Breitbart’s “Big Peace” website, where anti-Muslim fanatic Christine Brim has a ludicrous article accusing Kagan of being “pro-sharia:” Shariah Comes to the Supreme Court.

This is what bigotry looks like when it reaches a terminal stage; Brim’s brain has completely rotted away, leaving a core of blind hatred that’s operating on automatic. Brim is also one of the biggest boosters in America of European fascist groups; she’s completely convinced that neo-Nazis and white supremacists are her friends in the battle against the evil Muslim horde. Deranged doesn’t even begin to describe her.

I haven’t seen anyone post why they think Kagan will be a great USSC jurist other than because it pisses off the other side of the aisle. Is that all we really care about? I got down dinged for saying it but she’s a twin of Alito. Another big government jurist who will vote to consolidate more and more power within the federal government at every opportunity.

I think the president is entitled to his pick and she’s not out of her mind so she should be confirmed but that doesn’t make it a good day for anyone.

I have no idea if she will or will not be any good….I’m not sure we ever really know until one has been there for awhile.
She seems brilliant.
Can’t do worse then Thomas.

She’s smart, has a strong legal background and is a constitutional scholar. She knows the law and constitution, seems level-headed and even handed.

I am a little hesitant in her lack of experience as a judge, but not really that much. Being a supreme court judge seems fairly different from almost any other judicial position. At least from my armchair…

Because they’re all pro-state jurists. As long as it doesn’t come down to a contest of who has the power, the people or the federal government, they’re fine. The left side of the jurists will vote for individual rights, as long as it doesn’t conflict with a perceived federal power and the same with the right side of the aisle in regards to property rights.

Because they’re all pro-state jurists. As long as it doesn’t come down to a contest of who has the power, the people or the federal government, they’re fine. The left side of the jurists will vote for individual rights, as long as it doesn’t conflict with a perceived federal power and the same with the right side of the aisle in regards to property rights.

I don’t have an answer to fix it, just complaints. grumble/grumble.

I have to think about that.

Off the bat, I’d say the Court is mandated to protect the nation as well as the individual. In an age of instant and mass communication, ‘insurrections’ of both the minor and major variety. The power of the individual has escalated with technology. There has to be a way to protect the interests of the nation.

Let me use an analogy.

It used to be that if one wanted to harm another state, huge armies were needed and great amounts of weaponry had to be assembled. Nowadays, a few chemicals, a guy with a mask, a wooden spoon and a bathtub can kill millions.

The courts have to be prepared to address those kinds of realities, to protect other individuals and the state.

Most of the other ‘liberal’ justices champion the rights of individuals— especially when it comes to privacy— inconsistently. Just as Thomas is incredibly inconsistent, tending to side with police and prosecutors in almost every case.

It’s the wimpiest of assaults, because it was not one. To the contrary, I believe that Dean Kagan is highly intelligent, articulate and ethical, and will serve the nation well, regardless of her political view point. I also believe that a President is entitled to tremendous deference in his or her choice of nominee.

I was merely musing about the tendency of presidents, on both “sides of the aisle”, to place a premium on avoiding bruising confirmation battles. Some might say that the system has been working, by forcing presidents to avoid extreme nominees, but I rather suspect that the nation is also being denied the services of some of our brightest scholars - of both the left and the right — as a result.

“Among” the best and brightest is a relative term. Compared to me, she brilliant. As a legal scholar, she’s upper tier, but there are better.

It’s a price the great American system pays for the check and balance of the legislative confirmation process upon the power of the executive.

Don’t forget Newt and his prediction that gay marriage will now be mandatory because of the *cough*lesbian*cough* kagan.

OK, if being over 50 and single means you’re gay, a hell of a lot of people have just been “outed”. Marriage isn’t for everyone, including a lot of people who are married.
