IIRC, the jury had to actually ask the judge to clarify some of the charges, I assume so they could understand exactly what they were being asked to convict on.
No doubt the prosecution will try to retry him on that.

California gay marriage case hangs on technicality
On Monday, those appellate judges set a hearing for December and put gay marriages on hold pending appeal. They made only one comment relating to legal issues, asking the pro Prop 8 team to say why the case should not be dismissed due to lack of standing -- a term for the right to appeal.
Strictly speaking, the California state government would be the proper body to represent the pro-Prop 8 case, but neither the governor nor the attorney general is willing to pursue it. The defense of the ban was so far made by an independent group that must prove its right to appeal.
The appeals court will make its decision on standing as the first step in its ruling on the case after the December hearing. If it decides that the Prop 8 proponents don't have standing, the judges won't even look at the main argument, following standard judicial policy of making rulings as narrow as possible.

Living around the DC area I got to know Berry's escapades pretty well. He made an interesting comeback a few years back to become a city councilman and I think he was the only member of hte council to oppose the attempt to allow gay marriage in the district. "Bitch set me up" remains my favorite busted quote of all time. So straightforward and so honest heh. Not to excuse Berry's corruption but he was more of a character than bowtie Anthony Williams and Adrian Fenty are.

I agree, but like I said yesterday, the 9th is well aware of their own reputation. I just don't see them handing the Supremes a reason to beat them over the head with it. Not on a case that's this important. I do think that they'll make Prop. 8's supporters try to jump through every reasonable hoop imaginable just for the LULZ.

CBS 2′s Marcia Kramer has learned it looks as if the developers of the mosque may be willing to budge and move away from the Park 51 location where they originally planned the construction.
So will the mosque be moving?
New York Gov. David Paterson plans to meet with developers of the controversial ground zero mosque as early as this week to offer them state land – at another location – for their cultural and religious center. Paterson told Congressman Peter King about the meeting, and King said the governor asked him to make it public.

Please... don't be jealous... I was sharing my happiness with LGF, not meant to make anyone feel bad. I was lucky in June/July, Kaiser decided to add a whole new process to the patient survey system I programmed for them three years ago. Up to now, patients were selected for interviews in regards to their doctors. Now Kaiser wanted to add a new process that selected patients to survey about the department they were seen in.
This required a few thousand dollars of programming time on my part. It was almost like I was programming for a living again, and the project made me really satisfied.
I've been doing on/off private contract programming for kaiser for 3 years now, and of course it helps, but it's never enough money to be considered a salary.
But once in a while, they have something major enough that makes me a little cash. My girlfriend and I were going to go to Paris no matter who paid what, but I feel really good to have enough money to make a decent contribution to the trip.

I was lucky in June/July, Kaiser decided to add a whole new process to the patient survey system I programmed for them three years ago. Up to now, patients were selected for interviews in regards to their doctors. Now Kaiser wanted to add a new process that selected patients to survey about the department they were seen in.
This required a few thousand dollars of programming time on my part. It was almost like I was programming for a living again, and the project made me really satisfied.
I've been doing on/off private contract programming for kaiser for 3 years now, and of course it helps, but it's never enough money to be considered a salary.
But once in a while, they have something major enough that makes me a little cash. My girlfriend and I were going to go to Paris no matter who paid what, but I feel really good to have enough money to make a decent contribution to the trip.
Oh, Walter, no - I'm very happy for you!
The Roi and I are planning a getaway for the fall, October probably (though it will be US travel).

Have a great time. I won't bother telling you that you have to see this, or you must see that...my feeling about vacations is, when you get there, do whatever the fuck you want and enjoy it as much as possible.
I know some of what we are going to do. I've been there 6 times in the last 11 years, I know the town like a native. When I was pulling in obscene money programming, I would haul off to Europe at a whim. Not any more. Like I said above, it will be 4 years Jan. 2011 that I've been in Paris.
Some of the already planned activities are Métamorphosis, le Théâtre de Magie de Paris, a barge on the Seine with dinner and then a magic show (I know the owner), we are taking a walking tour with a expat 80 year old friend of mine Arthur Gillette who does walking tours, a Paris medieval walk 13 the century city wall on the Left Bank, and the winter circus will be open, so we will be at the Cirque D'Hiver and since my girlfriend has never been to Paris (she been all around Europe, lived in Spain for a while), I recommend one of the overly touristy boat rides at night on the Seine. Too many tourist even in the winter, but a really nice way to see the city from a totally different angle.

We did that on a trip to Chicago. Were supposed to leave at 8am, the train didn't show up until 6pm and took 7 hours to complete what was supposed to be a 6 hour trip.
If I had been on a plane, I would have been screaming, but as it was, I was able to sit back and relax, walk around when I got antsy, and generally have a much easier time of it.

If I had an extra 1000 dollars, I would take a 24 hour trip by train to Bochum Germany to see the permenant installation of the Andrew Lloyd Weber musical "Starlight Express." The show has been there 22 years, and it's a dedicated venue built for the show.
But the round trip train fare is about 700 dollars for two people, and after the show tickets and a little food, that's a grand.

The justice system is expensive, true. That's not a valid argument for dismissing charges, however.
A mistrial on 23/24 counts means a retrial. That's how it works. Blago deserves his day in court. By that I mean, he deserves either an acquittal or a conviction. We don't just let people go in the US because the jury couldn't decide. That would be a very bad way to run a justice system.
It's not that they "couldn't find anything" on him. They found plenty. The jury just couldn't reach a verdict. Not the same thing.
A retrial is exactly the appropriate thing under these circumstances.

I personally prefer the Yusuf Ali translation, which is what I have on my iPad. Even then, without access to the footnoted "mini-tafsir" (commentary) analog version it can be hard to understand some of the verses.
One of these days I'm going to buy one of those 10-volume full commentaries. The problem is finding the right one in English... There aren't a lot of them available and I don't want to end up reading something written from a salafi perspective. Gotta be careful what I read, y'know?

Coverage of the News is worse.
When a legal story comes on i have to read EVERYTHING available to determine what the heck is actually happening, as the tv producer/scriptwriter/news model will inevitably fuck it up.

My husband learned his lesson a long time ago.
He did not like how long I left the wash in the washing machine (he's really picky about stupid stuff like that) and/or dryer and he complained one to many times and now he does his own laundry.
He never complains about the biscuits or pies or well...other things too....

(Larger bills had to be returned to the owner) This encouraged people to clean out their pockets before tossing your stuff on the laundry pile, and it made all the kids want to do laundry for money.
An excellent system I will use on my own kids one day.

The way that prosecutors have messed up complex cases in the past. Put the defendant up on too many charges that can befuddle and confuse even the most savvy jurors. Simplify the case - fewer charges and you'll more likely get the jurors to agree on the charges.

I used to passionately despise Bush, myself. Now I think he's just not all that bright, and did the best he could with what little knowledge he had. In other words, he was possibly the worst president ever, but I don't think it is because he is evil. He just never quite got what the role of the presidency was. He always seemed out of his league, so to speak.
I don't want a president that seems like fun to have a beer with. I want a president that makes me feel stupid by comparison.

My take on Bush...I kind of liked him but just couldn't bring myself to vote against Gore...I found alot of flaws with Al...
But after 911 I thought Bush Rallied America and was a pretty dang gone good leader in those days.
My oldest son asked me if I would sponsor him for a week to travel to Ground zero to help..It was a different time....I went to a local Catholic Church to pray about it alone..I cried my eyes out...You know in the middle of the day when you cry in church people move away from you..Probably figuring I was a mass murderer or something. It was a raw time and I think Bush did well..
I completely disagreed about invading Iraq.. It made me angry and effected our family. It's bad enough he steered our country to a 2nd war..But in hung out in the Bunker that last couple of years.. And every single fucking morning we awoke to news of more of our children dying for no reason and no leadership from DC...

But I did not then and still do not think that the war in Iraq was justifiable in any way. What needed to be done was in Afghanistan.
What did not need to be done was dive into Iraq with a raging erection and delusions of grandeur. I don't bear any ill will toward the man as a person, but many of the decisions he made were atrocious. Invading Iraq made no sense. Cutting taxes dramatically while engaging in war on two fronts made no sense.
Dishing out pain wasn't his job. His job was to protect us. Failing at that, his job should have been to fix the fucking problem. The problem was not in Iraq.
I think the failure of the right to re-examine 8 years of terrible leadership with fresh eyes is precisely the sourse of the madness we are seeing today. You don't double down when the things you are doing don't work. You change course. Bush failed abjectly at that.

I really gained a lot of respect for Bush when he didn't play the nativist card on immigration and worked with Ted Kennedy on that issue despite Kennedy's strong criticisms of him. Showed to me that Bush wasn't the spiteful guy I thought he was. I still wouldn't vote for him but he's a breath of fresh air compared to Palin, Gingrich, Huckabee, and the others.

I remember when I was in thrid grade going to the Baltimore one. Classmate of mine got to pet the dolphins. I was really jealous. Not to the point of being a jerk but dolphins were and are my favorite animal. Was on my vacation just this past month and swimming and the dolphins were only a wavelength away from me. It's a patiserria. They make their own gelato and pastry. They do that and coffee. The scoops of gelato are larger than my fist (and am a pretty large man).
They have eclairs larger than a man's fore-arm
They have one dessert which is a frozen pecan and cinnamon pie, flanked by two scoops of amaretto gelato and the whole thing covered in hot fudge.
I am sure that it is 300 calories just to look at it.
I remember purposefully fasting for a day (and this is when I was on the varsity fencing team) so that I could try to eat an entire collosseo by myself. A collosseo is a waffle the size of a dinner plate, and about 3 cm thick, with four scoops of gelato (each larger than my fist) hot fudge whipped cream and all the rest.
I failed.

If anybody ever wanted to set up a reef aquarium, I am a living encyclopedia on the subject. I set up my first reef tank when I was 9, ad at age 35, I'm still obsessively studying the subject of aquaculture. LOVE IT.

It's a weird list. First, they don't really appear to have a definition of what 'worst' means. Second, they've stuffed the list with a lot of people who may be schmucks, or not very good presidents or whatever, but it's hard to justify them actually making the 25 worst.

I saw it once when I was a little kid, but I don't remember much. That was before I was fascinated with all the different filtration system designs. I freaking love the aquarium hobby. The wizardry of the equipment and the chemistry fascinates me every bit as much as the inhabitants.
If anybody ever wanted to set up a reef aquarium, I am a living encyclopedia on the subject. I set up my first reef tank when I was 9, ad at age 35, I'm still obsessively studying the subject of aquaculture. LOVE IT.
I worked through college in aquarium shops and even part timed years after I had a "real job." Hell, I could probably talk for hours on tank-mate selection and which corals can safely be placed in the vicinity of one another (a topic that's currently vexing me, now that my bubble tip anemone has decided to take a trip across the tank...)

It's a weird list. First, they don't really appear to have a definition of what 'worst' means. Second, they've stuffed the list with a lot of people who may be schmucks, or not very good presidents or whatever, but it's hard to justify them actually making the 25 worst.

The girls there were looking to meet some boys, so they had a "dance" in their cafeteria which they had decorated much like a high school prom. The punch was nun approved non alcoholic and the nuns had virgin alert set to maximum.
The girls and the nuns were dancing, under the flashing lights, to Boom Boom Boom let's go back to my room. I saw a large nun (who was in her habit) shimmy to the song.
There were enormous brass (or bronze) crucifixes on the walls. They had those particularly emaciated and tortured looking Jesi on them. Under the flashing red and blue lights, the Jesi looked extra tortured.
The entire scene struck me ever after as something that should have been made into a movie.

It's tough to say who my favorite founder is. Paine and Jefferson are the best idea men to me. Franklin would be the most fun to hang out with at the taverns. If I needed a lawyer, I'd want John Adams defending me. I have a soft spot for Charles Carrelton since he was the only Irish Catholic singer of the Declaration.

STEVE AYLETT'S novel Atom is sort of like The Maltese Falcon meets Duck Soup, set in the world of Blade Runner, and narrated with cinematic flair in a prose that is the bastard child of Nabokov, Pynchon, and Oscar Wilde. It's tough to say who my favorite founder is. Paine and Jefferson are the best idea men to me. Franklin would be the most fun to hang out with at the taverns. If I needed a lawyer, I'd want John Adams defending me. I have a soft spot for Charles Carrelton since he was the only Irish Catholic singer of the Declaration.
I am, as a writer, dreadfully jealous of Jefferson's skills and style.
And I think Franklin definitely the Founder I would most have wanted to have an affair with as a naughty Philadelphia widow of a certain age.

Adams, Franklin & Jefferson - pragmatic, lusty & idealist - all of which were necessary to make the declaration, & all things after it, possible. I think that, as a nation, we were insanely lucky to have the amazing assortment of founders that we had.
It is an interesting point. There are certain times and places in history that become a sort of nexus of genius.
Bohr's meetings in Copenhagen or the Solvay conference had a density of genius that makes the group photos almost painful to look at.
The great artistic schools of the Renaissance in Italy or the Paris art scene in the 19th century, or the the Music scene in Vienna astound me. Even the pub in London that basically everyone from the Beatles to the Stones to Jimi Hendrix and the various present and former Yardbirds went to is an example of such a nexus.
Then there was such a nexus of genius in Philadelphia, on these shores some two hundred years ago- and thank G-d for it.

Haydn was best friends with Mozart & one of Beethoven's teachers. That's an insane nexus of genius all by itself. The rest of your comment is spot on as well, but that one always strikes me as the era of Bach to Beethoven was a musical explosion that reshaped the world. It was as if for a couple of generations every genius was a musician. That perhaps overstates it but listening to a Haydn symphony right now (the final one, #104) makes me feel that way.

Why not? They already dumped him like a hot rock. The RNC was ridiculous, they barely mentioned his existence. Laura, God bless her, took the stage and said nice things about his presidency, but that was it.
If I were him, I'd be polishing my legacy, not worrying about the party.
Maybe he is afraid they won't buy his book.

The easiest cure for complaints is this--"Fine, YOU do it." It's interesting that no one ever takes me up on that, be it at work, at home, or in my theatrical endeavors (mostly from prissy divas who can't conceive of lifting, assembling, painting, etc., since they are so obviously of nobler blood than we mere commoners).
"You don't like my cooking? Fine, you do it. With any luck it'll be almost edible."
"You don't like the results of your tax return? Fine, you do it, and give my regards to the folks at IRS when they audit you."
"You don't like my vacuuming? Fine, it's all yours. I'll go watch TV."
"You won't help put up the set? Fine, go act on a bare stage."
"You won't carry the ladder so the lighting guy can aim the lights?" Fine, act in the freaking dark."
"You don't like my driving? Fine, you do it. BTW, do you have any clue as to where we are or where we're going?"

Damn, I wish Carter would not only keep his mouth shut but stop writing sh**. Bush Sr. (and to a lesser extent) Clinton have done a good job of staying the heck out of the way except when needed to head up efforts after disasters. I don't trust Clinton a bit, but as time goes by he's done more non-self-serving things than I expected.
IMO GWB understands that his saying anything about anything is a no-win situation, even if he's on the right side. Those with BDS will accuse him of trying to upstage the President, those with ODS will call him a sellout. Give it a few years, and his opinions will garner more respect.

Yeah this is how I feel about Carter. I just don't see him as the devil incarnate. Of course I laugh at liberals who try to say he wasn't a bad president.
The people who say Carter wasn't that bad a President come in two varieties--those who never have anything nice to say about Republicans or anything bad to say about Democrats, and those who weren't alive or were under age 10 then.

Buchanan was from Pennsylvania.
The chain of Presidents between Jackson and Lincoln was made of hacks, military heroes with little idea of how to govern (or time to learn), and past-prime guys--Van Buren, Harrison, Tyler, Polk, Taylor, Fillmore, Pierce, and Buchanan.
