Federal Judge: Don’t Ask Don’t Tell Is Unconstitutional

A federal judge has declared that the US military’s ban on openly gay servicemembers is unconstitutional.

RIVERSIDE, Calif. A federal judge in Southern California on Thursday declared the U.S. military’s ban on openly gay service members unconstitutional.

U.S. District Judge Virginia Phillips granted a request for an injunction halting the government’s “don’t ask, don’t tell” policy for gays in the military.

Phillips said the policy doesn’t help military readiness and instead has a “direct and deleterious effect” on the armed services.

The lawsuit was the biggest legal test of the law in recent years and came amid promises by President Barack Obama that he will work to repeal the policy.

Government lawyers argued Phillips lacked the authority to issue a nationwide injunction and the issue should be decided by Congress.

FAA reporting that no plane crash reported. It appears to be a natural gas explosion...more details to come when I have them.

I think I can predict what will happen next. DOMA will be challenged in Federal Court under the Full-Faith and Credit Clause, which even Robert Bork has admitted will be an impossible argument to defeat.

DOMA will be overturned and the result will be a renewed push for the Federal Marriage Amendment; the constitutional amendment that defines marriage as a union between one man and one woman.

The FMA could be a big issue in the 2012 Republican primaries if this trend continues (if it does, the independents will drive in droves towards Obama).

That is no plane crash. Smoke would be much blacker if it was due to jet fuel. FAA would also have known pretty quick. An airplane going down causing that kind of fire would have been radar contact and the FAA would have know instantly.

I have several, actually, I used to do a ton of logo design and lettering gigs for local businesses, weddings, non-profits, etc

They're really hard to use well, it got easier to just build the logos and fake it in Freehand or Illustrator. Which is nowhere near as cool but has the advantage of making it so I don't have to redo the job from scratch when the client inevitably changes their mind

I was in the military for twenty years and I never saw very much anti-gay sentiment. If anyone actually was a homophobe we would very likely pretend to be queer just to rattle him. There was occasionally some talk about who might actually be queer, but nobody really cared. The old-timer who used to run my reserve club was always getting angry at the gays, and would not shut up about it when Heath Ledger died. We all just assumed he was in denial, but nobody thought any worse of him for that.

I'm all for the repeal, but for some reason there's this notion rattling around the back of my head that people in the military have somewhat curtailed Constitutional rights. Now that I say it out loud, it sounds preposterous. But what about, say, the First Amendment? There are a lot of things that civilians can say and do that would land a soldier in military prison.

I'm just wondering if the "unconstitutional" argument is sound.

According to the constitution the congress and the president have the sole authority in determining the rules for the military. The judge overstepped his bounds even though I agree with the sentiment. Secondly, where does this judge get the expertise to decide that DADT "doesn’t help military readiness and instead has a “direct and deleterious effect” on the armed services". I believe DADT needs to be tossed aside but it needs to be done correctly, with the president and the congress doing their jobs. This judge needs to be told keep her nose out of other peoples business.
