Oklahoma Bans Sharia, Inadvertently Outlaws 10 Commandments

Oklahoma Republicans can celebrate the passage of their measure banning Islamic law (shariah) from ever being used in court cases (it never has been, but that’s a minor point when you’re saving America from the Moslem Peril).

But as they’re cracking open the champagne, someone should mention to them that they also banned the Ten Commandments.

Oops. Didn’t think of that, I bet.

Oklahoma voters on Tuesday approved a measure that bans the application of Islamic law and orders judges in the state to rely only on federal law when deciding cases. State Rep. Rex Duncan, a Republican, was the primary author of the measure, which amends that state constitution.

For months, legal experts had lambasted the initiative as biased toward a religion and potentially harmful to local businesses that engage in commerce with international companies. It also presents potential constitutional law problems, experts say. Is Oklahoma’s state constitution now in direct conflict with the U.S. Constitution’s First Amendment, which states, “Congress shall make no law respecting an establishment of religion…”?

There has never been a previous case in the state in which Sharia law was applied, said Rick Tepker, the first member of the University of Oklahoma School of Law faculty to try a case before the U.S. Supreme Court. Tepker called the passage of the measure “a mess” with implications unknown until a case that challenges it arises.

“Many of us who understand the law are scratching our heads this morning, laughing so we don’t cry,” he said. “I would like to see Oklahoma politicians explain if this means that the courts can no longer consider the Ten Commandments. Isn’t that a precept of another culture and another nation? The result of this is that judges aren’t going to know when and how they can look at sources of American law that were international law in origin.”

I'm quite sure these folks don't consider the Ten Commandments to be 'outside' U.S. law in any way.

Why would Oklahoma courts look to the Commandments anyway? Those we use are enshrined in American law, and those we don't don't come up anyhow.

A lawyer friend of mine said the more serious problem is actually that, constitutionally, treaties are the law of the land, and this law forbids judges from considering treaties in some circumstances; that is unconstitutional.

I think they are serious.

Let's look at the GOP way the GOP treats the third world. Getting rid of a ban on Murder or murder by proxies when you prop up a dictator is good for business. Getting rid of the ban on adultery means no hard questions for Newt and so many others who can't keep their peckers policed. Not doing evil in the name of G-d - well you can tell why Robertson would need to get rid of that!

And don't covet, don't steal! This is the GOP, "greed is good" corporate tycoon party!

Fox really benefits from getting rid of the commandment not to bear false witness.

I think they are deadly serious in making this law because it gets rid of all that "mere" morality the GOP hates so much.

So yes, quite obviously courts can no longer consider the ten commandments in their rulings since they are a major part of Sharia.

Same problem with "international" law, does that mean the Magna Carta and Olde English "Common Law" can no longer be cited in a judges ruling? (as it currently is thousands of time a day within this country). It will be interesting watching the courts try to figure out how to make this nonsense work, hopefully it just gets overturned as unconstitutional and saves them the effort.

Oh. Eh...that wiki seems like it's crossing a few lines.

There is certainly a good deal of Gospel support for the notion that Jesus instructed me to give without regard to my current situation, to help without first making sure that i got mine, etc.

The promise was that God would reward selfless giving not in riches, but by at least ensuring that the selfless individual would be provided for.

However, some of the folks on the Wiki list aren't "prosperity theology" proponents, whatever one might think of their other beliefs. So who knows how much of this is confusion between what i wrote above and people actually preaching that actual riches will flow in response to tithing activities.

Joel Osteen, for example, has said in more than one interview that "I feel like that [characterization] gives [him] a bad rap because I don’t in the least bit consider myself a prosperity-type preacher. I don’t think I’ve ever preached a message on finances."

Interesting that there is a term for this, now. I hadn't heard it before. Thanks!

I don't think he's ever explicitly preached on financial issues, but I've heard several of his sermons and read a couple of his books, and he DOES talk about faith in God leading to what he calls more favor, including things like a better job, or better opportunities coming your way or whatnot.

I don't know if I'd put him in a straight Prosperity Gospel category. He's more of a pop-psychology/Law of Attraction type preacher with the Gospels thrown in for good measure, at least as far as I can tell.

I just got an email forwarded from a Muslim friend. It seems that the American Muslim community is finally starting to stir from its slumber and realize that people need to be more aware of the seriousness of the political happenings/climate in this country, AND more knowledgeable about what Islam actually teaches WRT being aware of what's going on in the larger world around you (i.e. trust in god, but tie your camel).

IOW, participating in the Muslim community, doing good deeds, spending time learning to recite the Qur'an, and learning about the finer points of all the little rules we have to follow is fine—and even important—but if you do that to the exclusion of all else, then very bad things may happen while you're not paying attention. Time to get with the program and figure out how to take charge of your own destiny and maintain your beliefs while working within the American system. There's gonna be some serious soul searching required.

I wonder if this is a result of this week's elections and the Oklahoma law...

Well, sure. Christians are instructed to have a joyful heart. And a positive, happy, upbeat outlook on life is beneficial across many facets of one's life. I don't read his stuff, but i'm vaguely familiar with the premise, and as far as i know it's a good approach.

Again, if anything, i'd say that pastors don't focus enough on the fact that we are instructed to be joyful, happy, caring people. It's a vastly better proposition than being an angry conservative, right?

1. Move into the right lane on 95. If you are beside the same car in the passing lane for more than, oh... say ten minutes... slow down or speed up and move to the right.
2. When you are driving on a two lane road, and six cars are stacked up behind you, because 45 just doesn't seem safe to you; please find a safe place to pull over for a moment. Give the folks with somewhere to be an opportunity to get there.
3. I understand that the posted speed limit is the fastest that you are able to drive on a road. But it has turned (in most people's minds) into the speed that is recommended for that particular road. Please try to maintain that speed or see 1. & 2.

1. Move into the right lane on 95. If you are beside the same car in the passing lane for more than, oh... say ten minutes... slow down or speed up and move to the right.
2. When you are driving on a two lane road, and six cars are stacked up behind you, because 45 just doesn't seem safe to you; please find a safe place to pull over for a moment. Give the folks with somewhere to be an opportunity to get there.
3. I understand that the posted speed limit is the fastest that you are able to drive on a road. But it has turned (in most people's minds) into the speed that is recommended for that particular road. Please try to maintain that speed or see 1. & 2.

I'm just glad I'm not bitter.

I'd support those rules. :)

And add one after considering moving left a lane to make it easier for merging traffic to... merge.

I just got an email forwarded from a Muslim friend. It seems that the American Muslim community is finally starting to stir from its slumber and realize that people need to be more aware of the seriousness of the political happenings/climate in this country, AND more knowledgeable about what Islam actually teaches WRT being aware of what's going on in the larger world around you (i.e. trust in god, but tie your camel).

IOW, participating in the Muslim community, doing good deeds, spending time learning to recite the Qur'an, and learning about the finer points of all the little rules we have to follow is fine—and even important—but if you do that to the exclusion of all else, then very bad things may happen while you're not paying attention. Time to get with the program and figure out how to take charge of your own destiny and maintain your beliefs while working within the American system. There's gonna be some serious soul searching required.

I wonder if this is a result of this week's elections and the Oklahoma law...

I think that there is a lot too that.

It would help a great deal for all involved if a real grass roots movement of American Muslims sprung up with the simple message of communicating everything that is noble and kindhearted about Islam.

You need something like what B'nai Brith and the ADL used to be.

ADL has gone a little batty lately.

CAIR really can't do it because of way too many shady people with very unpleasant ties running it.


The absolute best thing that American Muslims can do for themselves is exactly what any follower of an Abrahamic faith believes G-d wants of them. Make it a habit of doing good deeds and being compassionate. Be reasonable and see other sides. Most importantly, let others see you do this.

As of now, the Islamic community has made the grievous error of letting terrorists and foreign governments runs by theocrats and slightly more legitimized terrorists speak for Islam.

The message of the Jihadi is loud and very clear that they hate the West and they hate everything we stand for. They have made it abundantly clear that not only do they ant to murder us and will revel in our deaths, but they will stoop to any depth to do so.

The Muslim community by being too quiet in this nation, has left the only loud and easily noticed speakers for Islam become decapitation pornography, stories of honor killings and blown up busses. This is one thing that Fox can not be entirely blamed for. The whole point of the Jihadi is propaganda and instilling terror. The Jihadis got their message out very loud and very clear long before Fox. It could be argued - well I believe - that 9/11 made Fox.

So I repeat, do what you have been doing yourself personally. You speak eloquently and show yourself to be a kind person with kind views. You are unabashed about your faith - and nor should you be. Eventually, enough of that will help turn things around a little. However, the damage has been done sufficiently already that it will take generations for the Average American to return to totally neutral on Islam.

For that as a representative of a race that always has someone saying the meanest possible things about us - I sympathize.

I switched over to one from a Saturn sedan for slightly better visibility, AWD for the snow where I lived in western PA (hilly), and having better cargo capacity (like hauling a few 2x4s or camping equipment.)

Of course, I ended up in eastern PA almost immediately after buying it. So the AWD is less important, as is the cargo since I'm no longer doing house maintenance. And I also currently have a walking commute to work.

I rarely take the time to make a proper pizza but I often make bruschetta for lunch. It's just toasted bread. rub a clove of garlic on it (just 2-3 swipes). A drizzle of oil, cheese, tomatoes or whatever is lying around.
Takes about 5 minutes.

I think a big part of the problem has been denial. Not so much denial that extremism exists, but sort of... I guess a head in the sand attitude. Like, "That's not us, so maybe if we just stick to ourselves and keep a low profile everything will be okay." Obviously, that's not working out.

Another problem is that the Muslim community in the U.S. is not only very culturally & ideologically diverse, but also only very loosely connected on a secular level.

In addition, there is no central authority or representative from either a religious or temporal perspective. Individuals typically don't have the clout outside of Muslim circles to make themselves heard and, as you said, that leaves only smaller organizations (like CAIR) and the extremists with the megaphone. This minority is what non-Muslims see & hear most often, along with the fearmongering from Fox & the far right, so it's really no surprise that they are confused and afraid.

The silent majority desperately needs to find its voice and make itself heard loud & clear. It's a huge task fraught with difficulties—not only from a logistical standpoint (including financial), but also because one wrong move or unvetted rouge element could create a PR disaster. Still, it's better than just sitting in the corner praying & trusting God to make things better. If any Muslims are reading this, let me repeat the hadith one more time:

Not really. Doing that to the Roma is more of a European phenomenon. It's a stain on Sarkozy, but sadly its a popular thing on the Continent. France does not treat the Roma well at all, and the treatment they get is worse than what Latinos get in the US. I do not defend that action of his at all.

Well, that's where the Roma are, in Europe. So yes, it's a 'European phenomenon'. However, Sarkozy and the French are currently competing with Romania and Italy to see who can treat the Roma the worst. Other countries in Europe, like Scandinavian countries, manage to attempt to fix the problem, rather than shifting it away.

Sarkozy's threat to strip citizenship from any French-born citizen who threatened a cops' life or committed a variety of other crimes is also contemptible. You can't solve a country's problems by deporting every criminal-- it easily fails the Kantian test.

No, I think he's looking for solutions and found he had to go against the left on that issue. But he's going to have to run for re-election from the right (after ramming through a raise of the retirement age, the left in France hates him), so look for him to make further moves in that direction. He is extremely statist, and very fond of executive power. His expulsion of the Roma, his attempts to remove citizenship from citizens, his constitutional reforms, are all actions that are in favor of a strong executive in a very strong central state. Not to mention that he's followed the GOP example of increasing spending while giving out tax cuts.

I like some of the things he's done-- he's great on global warming. But he is in no way definable as 'left' or 'right'; that scale simply does not work beyond self-identification.

Not a bigoted statement. They look more alike than the flower children at Woodstock. That came to me when watching Korean schoolchildren in their uniforms spectating at a tennis match in Seoul. In definable ways they look a lot more alike than their counterparts from Seoul American High School.

It really is that simple. If you want a vote that doesn't break down according to ethnic, cultural, and racial demographics then stop dividing people socially along those lines and blaming them for all the world's problems.

Funny how he (and my sister) can plainly tell me that neither of them could even handle it for half a day without going nuts, yet my asking for a short break after two years proves I am an unfit caregiver. Now I am just sorry I ever asked the family for some time off and cannot take it even if they do ever get their shit together and manage to offer to cover my absence. What do you mean "function effectively?" I can't know for sure, but it may be possible to downsize slowly without calamitous results. It may also be socially desirable to the Japanese to have a somewhat lower population density. They are incredibly crowded (think Cali with 4x as many people).

We Texans were very used to non-natives in the 70s and 80s because of all the transplants from the upper midwest and northeast. So my accent was nothing compared to all the newcomers.

I have to be honest and say these posts of yours are deeply disturbing. I'm no professional therapist, and can only base my response on what you've shared, but I have to say this:

- your family (again, based on what you've said) sound callous, selfish, and completely useless. I can't help but be reminded of news stories where caregivers are accused of neglect - would they do something like that to you, especially if the pressure got so great you burned out completely? Would the case of "no good deed goes unpunished" you're suffering through right now really get taken to that obscenely unjust extreme? Based on what you've said, I fear it would and can only echo what ozbloke said - take care of yourself. If the only way for you to get a break is for your parents to go in a long-term care facility, that's absolutely no negative reflection on you - you've done far more than others would have, and screw anyone else who tries to guilt-trip you in any way.

Perfectly understandable. The discussion can easily go wrong. I was just trying to analyze the data; I certainly wasn't making a comment on one race compared to others.

As a nation we've been having a variant of this conversation, often badly, for decades. But that won't end soon, the demographic changes ahead of us are even bigger than the ones behind, which is saying a lot.

OK, let's try it this way. There is a correlation between education level, comfort/income level and birth rate. Higher education level, and/or higher income level correlates with smaller family size. This isn't based on any value judgment but the desire for upward mobility. Upward mobility requirements don't always fit in with large family size.

Maybe the newer populations will adopt the same or at least some of the social norms of the host nation. I see it everyday here. Muslim women driving cars, listening to music players, wearing jeans, not wearing a head scarf, wearing only a head scarf. I wish we humans lived longer lives. It would be interesting to see how it changing populations affect cultures over time.

The United States has been one wave of new people bringing new stuff and adopting older stuff from the beginning.

My particular sob story is that my dad was a workaholic who viewed his diabetes as a character deficiency best ignored in service of austere stoicism. He lost both his legs after his feet became gangrenous. My mother, an RN no less, let all this happen. After my dad died, my previously Leave-It-To-Beaver mother astonishingly hooked up with an amazingly hard-core alcoholic half her age. One Friday she told me she was going out of town for the weekend, and that she would be back the following Sunday. That was the last time I saw her, 19 years ago.

Charles, you'd go ape on any judge who used the 10 commandments as the basis of a ruling. The same should be true of judges using shariah.

Unfortunately, there have been cases in other states where judges did cite shariah as a factor, and some haven't been pretty - justifying lenient treatment of wife abusers, for instance.

So a law in Oklahoma is good news. If it also prohibits the 10 commandments, and forces judges to focus on American law - better news.

Gahh...another day another fight with my brother, I was trying to clean dads ass so I can recover his bedsores (almost completely healed now! YEH!!!) while also arguing with my brother about how I can't take proper care of both mom and him when (if) she makes it home from rehab.

If it wasn't so pointless and frustrating it would almost be funny, I've already been taking care of both of them for close to two years with hardly any assistance. Now because I let my guard down and told him how burned out I was and how much I needed a short (2-3 day) vacation he has decided that I am somehow unfit to do it anymore.

Funny how he (and my sister) can plainly tell me that neither of them could even handle it for half a day without going nuts, yet my asking for a short break after two years proves I am an unfit caregiver. Now I am just sorry I ever asked the family for some time off and cannot take it even if they do ever get their shit together and manage to offer to cover my absence. Goddamn what a bunch of assholes...I am sooo fucked. :(

I've said this before, and if you do this it will be very hard to do. However, to best care for your parents, protect yourself (which is the same thing in this case), and keep your siblings in their place, you need to--

a) Call your local Senior Services agency (by whatever name) and get a case worker to help you NOW. You need an objective and caring observer to assess the situation and hopefully be on your side.
b) Talk to a lawyer. You need to document everything now. You also may need to get your siblings out of the picture--or helping. If you don't have a power of attorney, this is the time to get one. And no, your siblings don't get included in this. You've carried the mail, you should have the authority.
c) In conjunction with a), you need time off. Tell them that you're burnt out. Believe me, you won't be the first to tell them that.
d) Prepare to get your parents into an assisted living facility. You've done your best.
And e) If your siblings object, tell them to f*** off.

If you think no one is on your side, you're wrong. We're here, and I'll bet you have other people out there.

Actually, since several of the 10 commandments have been written as US law, judges do use a few of the 10 commandments when ruling from the bench.
