Details of Sherrod’s Suit Against Breitbart

‘False and defamatory statements’

TPM has details on the lawsuit filed against Andrew Breitbart by Shirley Sherrod.

Three defendants are named: Breitbart, breitbart.tv head Larry O’Connor and a “John Doe,” who allegedly edited the original video of Sherrod’s speech, and “whose identity has been concealed by the other Defendants,” according to the complaint.

The complaint alleges that the defendants “defamed Mrs. Sherrod by editing and publishing an intentionally false and misleading clip,” which went on to do “extensive and irreparable harm to Mrs. Sherrod and her reputation.”

The suit asks for Breitbart’s post and the video to be pulled down by Breitbart and O’Connor, as well as for an order to prevent the defendants from “engaging in future tortious conduct against Mrs. Sherrod,” and seeks compensatory damages of no less than $5,001 and additional punitive damages.

Like I wrote yesterday, Breitbart is too narcissistic to not whine like a stuck pig about his “right” to lie and defame being infringed on. He will dig an even deeper hole than he has already - including all of his various remarks after this blew up at him, and it really is an open and shut case.

Proving malice is not difficult since he himself stated many times, that his goal was to destroy liberals, Obama and his administration. He has said such things many different ways and many different times. Of course one could argue that posting and bemoaning a tape so heavily edited from the original that it said the opposite of what the speaker said with the obvious intent to paint the speaker as evil is prima facie evidence of malice,

Proving it was a lie that caused damage is obviously easy.

Proving that he did not do due diligence journalistically is also easy.

I truly hope and I suspect that he is stupid enough to fight.

He will go down and it will be glorious. I hope the punitive damages are in excess of millions - and I further hope the various conservatives rally round him and spend millions on a fruitless defense. That is a win all the way around because it only heightens his fall from grace, shuts him down more completely and drains millions that could be put to electing assholes like Rand Paul.

I asked dad the attorney about that. The punative damages are awarded by the jury. It could go into the millions.

Consider that punitive damages in many high profile cases for lesser offenses were in the millions.

What I also hope is that Sherrod refuses a settlement even if he tries to cough one up. This could put Breitbart on the street actually if it goes poorly enough for him. Then he could be a nice cautionary tale to the wingnuts.

Dad siad such things would depend on the jury, how sympathetic Ms. Sherrod is and how much of a villian Breitbart can be painted as.

He laughed that if Breitbart gets a non-klan jury, then this would likely be millions.

I have no dog in this fight. I’d love to see Breitbart suffer appropriately for his actions, as I consider him to be a form of malignant, puss-oozing tumor on the face of our nation (along with a lot of other wing-nuts who get far more attention than they should). Yes, I’m getting that. It seems strategy to not ask for a specific amount, merely for punitive damages. They get assessed by a jury after they figure out how much he’s worth and how much it should hurt him.

I hope they hammer him and she gets a fat sum. Not only that, I hope she gets some, then they make him pay into a black farmers association fund (though they aren’t a party to this action).

Exactly and it isn’t as if he didn’t already dig himself a deeper hole when this whole thing blew up. There is scads of him saying stuff about how right he was and how of course she was an evil racist. Proving malice and intent to defame is especially easy given how stupidly he doubled down on his original lies.

And this is a very good thing, because a win for Sherrodgives the ability to show just how willing to lie the far right is.

Of course, like I said at the time of the original flap, that would require the Dems growing a spine. They didn’t then. Now they are getting a second chance to club a right wing media darling on the head. I hope they have the sense to walk through an open door and take the fight to the bad guys for a change.

Once you start showing they are mean lying bastards, you get to point out all the other mean lies and BS from a stronger position. I pray the Dems grow a pair for this and have the sense to speak uniformly on it. Of course, they aren’t likely to be that organized, proactive or courageous.

I’m currently reading “The Private Memoirs and Confessions of a Justified Sinner” by James Hogg. It’s a brilliant account/distillation of the inverted morality and disturbed psychology of the wingnut, especially but not confined to the religious type. The hypocrisy, misogyny, the stalking - it’s all in there in this Scottish novel from 1824. Highly recommended.

She’s represented by Kirkland and Ellis, which is the 7th largest law firm in the world, and they aren’t exactly going to take the case unless they considered the punitive damages element to be significant - ie in the millions or 10s of millions of dollars.

Note too that Breitbart will focus on the fact that the firm leans strong Democratic in their PAC monies/contributions. That doesn’t diminish her case in the slightest, and would suggest that they’re going to be even more zealous in defending Sherrod’s rights against Breitbart’s smears and hatchet job videos.

I gotta confess that when the arc of the world turns to justice, it is beautiful to see.

I remember talking to a rabbi friend when Arafat was in the hospital for the last time. I said, I know it is wrong to pray that even he dies - can I instead pray that the bacteria live well and multiply a lot.

We both laughed.

But this is more than just enjoying seeing the good guys fight for a change. This could be a way to seriously cripple all those wingnut smear merchants associated with Breitbart. A win here could lead to millions of dollars in suits against all sorts of evil folks. This could be the impetus needed to permanently shut down all sorts of noxious wingnuts.

Last week, Andrew Breitbart defended using Michael Moriarty as a contributor on his websites, despite the actor’s belief in Oklahoma City and 9-11 conspiracy theories, because he’s an “important” voice who “fled the United States to Canada because of the torment that he experienced trying to express his conservative beliefs.”

In a recently posted column, Moriarty makes clear that his conspiracy theories play a central role in why he’s fled the United States. Moriarty wrote on EnterStageRight.com — which is not produced by Breitbart — that the “unanswered questions over the Oklahoma City Bombing and Attorney General Janet Reno’s early reporting of it persuaded me to seek shelter in Canada. The unanswered questions of 9/11 have kept me here in Canada.”

Moriarty’s remarks came in response to questions from me about his past statements about 9-11 and Oklahoma City. In 2007, Moriarty said that his theory about 9-11 is that President Bush and the Bin Ladens conspired together before the attacks to get Bush probable cause to invade Iraq. When asked if he had any doubt that Oklahoma City was an “inside job,” Moriarty replied: “None! There were two seismic reports of explosions, there were no federal — there were no children of federal employees in the building at the time in the daycare center, and the ATF were nowhere to be found.”

I was not gonna bring this up, because this is going to be the backbone of Breitbart’s offense-as-the-best-defense.

He’s off his rocker. Always was. I remember back when I used to watch “Red Eye” and sometime he’d be on as guest. This was several years ago. He barely said a word and when he did it would be some sophomoric joke or some incoherent nonsense. I’d always be thinking “who the heck is this strange person?”

In other news, and I apologize for going OT, but what are people doing for Valentine’s day…

I just got done making some chocolate pots de creme…

You will need:

Demi tasses for espresso,
Big steel mixing bowl
sauce pot
whisk

1/2 cup good (I used Ghirardelli) 70% + dark chocolate.
1 cup heavy whipping creme
1/2 cup sugar
pinch of very finely ground good coffee
pinch of cinnamon
tiny pinch of cardamom
1 tablespoon vanilla extract
1/2 tsp hazelnut extract
tiniest pinch of salt

Chop the chocolate finely. Place in steel mixing bowl with all pinches of spices. When I say tiny pinch of salt, I mean very tiny.

In a pot heat the whipping creme over medium eat until nearly boiling. This takes several minutes. Stir constantly.

Add vanilla and hazel nut extract with the sugar to the creme while heating.

Once the mixture is near boiling, you will be able to tell because the surface of the mixture will be active, pour the creme mixture into the bowl with the chocolate and spices. Whisk vigorously for several minutes until there is a consistency of a thick chocolate syrup.

Pour into demi tasses.

Chill in refrigerator for at least four hours.

When they come out the consistency will be somewhere between a thick chocolate mouse and fudge.

When serving, put a small layer of lightly whipped creme (with a pinch of sugar in it) on top and dust with cocoa or cinnamon. It will look like a mint cappuccino, serve with a sprig of mint on the side as a garnish.

Speaking of Canada, I was at an Israel advocacy training yesterday where the speaker said that the impression you want to promote of Israel is ‘just like us, but exotic in a fun way’.

He said that some people insist that you want to portray Israelis as being EXACTLY like Americans, on theory that Americans will then care about Israel. “That must explain why Americans care so passionately for Canada,” he said.

Shawna Forde, Kid-Killing Minutewoman, Convicted of Murder

Shawna Forde, a founder of the anti-immigration group Minutemen American Defense Corps., has been convicted of murder in the 2009 slayings of an Arivaca man and his nine year-old daughter.

The Pima County jury now must decide whether Forde, 43, should face the death penalty.

Jurors reportedly deliberated for five hours on Friday before leaving for the weekend without announcing a verdict. This morning, after about two hours of deliberation, the jury returned its guilty verdict.

All men like a little trash every now and then, but I don’t think he called the baby racist names. I think Halle wanted a sperm donor who wouldn’t interfere with how she raised the kid, but instead of going to the sperm bank she wanted to inspect the merchandise. An old boyfriend of hers, said she tried to talk him into ‘giving’ her a baby, too. I knew Gabriel wouldn’t last for too long after the kid was born. Just sayin’.
