Judge Blocks Wisconsin Anti-Union Law

A restraining order against Scott Walker’s union-busting bill
Politics • Views: 30,656

A judge in Wisconsin’s Dane County has granted a temporary restraining order to block official publication of the Republican Party’s anti-union law.

UPDATE at 3/18/11 10:40:03 am

Far right loon Michelle Malkin thinks Walker should just ignore the ruling.

Jim “Dim” Hoft immediately started shrieking about radical left activist judges.

Since this is just procedural— that they didn’t give adequate notice— they’re likely to simply repeat the process, actually following the steps this time.

It’s nice to note, however, that while they’re decrying the Democrats absence as a dirty legislative trick, they’re blithely ignoring the actual rules when it suits them to.

This is going to the courts? No one could have foreseen that this crappy legislation would wind up in the courts!

Yeah, it’s a delay, not a victory. Barring a significant number of State Republicans getting a case of cold feet, this will pass again, this time following the proper procedure. The court battle has just begun.

Given the momentum of the recall efforts, that’s a distinct possibility.

It’s a gamble. They might be scared by the possibility of a recall into changing their votes, or they may decide that being recalled is reason to throw caution to the wind and vote how they choose.

10 dmon  Fri, Mar 18, 2011 10:13:56am

Even though they can vote again….this is going to force them to…….. how many people do you think will show up to protest with 24 hrs notice.

Reposting what I said in the Page:

I don’t think this will be the death knell for this law. At best, it will return the bill to the legislature. Something to look out is what effect will the recall efforts affect the Republican legislators (we know they are on the losing side of the recall efforts). If the court battle drags long enough, I expect the recall to have a strong effect.

13 Robert O.  Fri, Mar 18, 2011 10:15:34am

Time for WI to recall their Republican senators. I don’t live there but would be willing to contribute.

14 dmon  Fri, Mar 18, 2011 10:15:34am

Its highly possible that they will make some changes, make the law less objectionable.

I think they have to save face by passing something…. but may pass something that isnt as horrible

This is more likely. The GOP has been behaving as if they know 2010 was some sort of a fluke and they are trying to do as much damage as they can in the meantime. They can always count on losing in the next election, having the American people get frustrated with the Democrats inability to fix all of the damage in a year and win the next election cycle after that. Wash, rinse, repeat.

Besides if the Palin Model is not unique to Sarah Palin, you can suck at the job of governing, lose/quit and get rich on the wingnut welfare circuit as a conservative folk hero. Even if Scott Walker gets recalled he’ll have a book deal and a radio show in no time and Kasich can always get his old job at FOX News back.

I seriously doubt it. Walker has refused to budge, which means it would take a legislative mutiny to force his hand. Considering he’s gotten his way up til now, I don’t see that happening. This will bill very likely be resubmitted as is and pass, this time via the correct procedure.

20 Randall Gross  Fri, Mar 18, 2011 10:20:43am

Way back when this all first started I was ignorantly speculating whether NLRB would come into play, but since then I researched it: state workers are specifically excluded from the National Labor Relations act, so everything about this is going to have to work out at state level.

I don’t think see themselves as “sacrificial lambs,” I believe they seem themselves as helping Walker in his fight against the unions. This isn’t about budget problems or about union problems, it’s about an ideology that says that a “free market” cannot survive without employers having absolute power over all things that happen within their business. They’re not going along with him for the possible jobs or perks later on, they’re going along because they think Walker’s right.

I don’t know how this will all play out in the long run, but If it plays out the way I would hope, it will be the Wisconsin 14 that made it possible. By staying away for three weeks they kept this from being rushed and allowed sunshine in. Something similarly outrageous is happening in nearly every Midwestern state, the part of the country the GOP needed to win to take the WH back. I don’t think they will now and the GOP will also be badly hurt down ticket. It could be a hunch or just wishful thinking, but I would you want to go campaigning with Scott Walker or John Kasich in 2012 if you were the GOP nominee?

I had a heated discussion with a friend about this at the pub the other night. He bought the RW talking point that since he went on ESPN and spent a few minutes talking hoops, he was ‘ignoring Japan and Libya.’

My view was that if things were so dire to preclude him going on ESPN, he probably would have canceled the appearance. Obama going on ESPN indicated to me that the administration had done all they could do about everything else and the guy was taking a well-deserved break.

But no. My friend fully believed that he looked at all the international crises going on and said ‘Screw it, I gotta fill out my brackets.’ And this is a pretty smart dude I’m talking about here.

This is a classic case of “Who is really out of touch here?”

I’m pretty sure there are more people who follow March Madness closely (or have a significant other that does) than there are people who think that doing so is weird. Lots of people that don’t follow NCAA basketball closely still follow the tourney and enter a bracket pool.

So BHO wins this one: this makes his critics seem out-of-touch and weird.
