Law Firm Partner Resigns, Will Continue Defending DOMA

‘Lawyers must defend unpopular causes’

One of the partners in the law firm that just pulled out of the DOMA case, Paul Clement, has resigned, and will continue pursuing the case because he says lawyers should defend “unpopular causes.”

Which is indeed a noble principle, when applied to causes like ending slavery, for example, or fighting for civil rights for African Americans. Fighting for an unpopular cause in the name of justice is one of the loftiest goals a lawyer can aim for.

When applied to the “Defense Of Marriage Act,” though, the word “unpopular” is a distorted rationalization. The objections to this bigoted piece of legislation have nothing to do with its popularity. In fact, DOMA is very popular with the religious fundamentalists who inspired it in the first place.

Let’s say it like it is: the sole reason for the existence of DOMA is to deprive American citizens of rights. And there’s nothing noble about defending that.

Well, the thing is, a government lawyer *does* need to represent the State (Or resign). This is a private law firm and a private lawyer. They can, for the most part, pick cases, especially of this sort.

Good afternoon from sunny London, folks. (I’m here for a couple of days on business.)

As was noted in the earlier thread, I am sure that the lawyers inside K & S went crazy when they saw that they were taking on the defense of DOMA. Big law firm politics can be pretty hairy, and I’ll bet this was a real donnybrook.

I appreciate Clement’s view, but there is no enshrined constitutional right for bigoted laws to have the best SCOTUS advocates in the land (he’s one of the top six or so). But give DOMA’s advocates points for being observant, if nothing else: they saw what Boies and Olsen did to Prop 8 and they got religion (no pun intended) about getting the best lawyer they could find. No more politically-correct but legally-weak lawyers for them!

There are several possible reasons for why he decided to take the case to start with and take this step now. I can’t say for sure which one or ones drove these choices. At the end of the day, however, he’s doing it and that’s mostly what matters here.

I have mixed feelings about this. On one hand DOMA is an offensive piece of law that should be taken out back and set on fire, but on the other hand the US is uses an adversarial justice system, and attacking lawyers and law firms that defend wrong, evil pieces of shit weakens the system.

I feel that attacking lawyers for who their clients are is out of line.

Remembering the fees thread from last week, I seem to recall that he was getting less than he usually does. This guy is top shelf: he has all the work he needs, and I am absolutely positive that his private clients pay more than what he is charging the GOP.

It is very unlikely that this is about the money.

It would seem that way, except that a major partner at a large firm like K&S would likely have junior associates who will go with him in his practice group. He was the head of the appellate practice group in DC, which means that some of those juniors at the group might split with Clement, or stay on with whoever is replacing him (opening up new opportunities).

Well, I agree with the latter part of your statement. On the former, well, there’s reason for them to feel that they can still win, despite how things look now. For example, at the time of Roe v. Wade, there was some thinking that anti-abortion feelings were on their way out, so it was just a natural step on that part. Look where we are now on abortions and reproductive rights.

Another is capital punishment In the early 70s it was also thought by many people to be dying out. The Supreme Court stopped executions for 4 years from 1972 to 1976…after which the use of capital punishment started to jump to levels far above where they had been prior to them being stopped. It was back with new support. Now, most states still have the death penalty still on the books (Even if they rarely/never use it), even though almost every other country in the world has outlawed it. Even Russia doesn’t do executions anymore. And yet, it still enjoys strong public support in the U.S.

No, they’re not fighting back because they think they’re doing it in vain. They’re fighting back because they still think they can win.

There is no legitimate reason to deny gays and lesbians the right to marry. The only objections are religious ones, and that’s not a good enough reason to deny someone their rights.

This happens all the time in law firms. A lawyer brings in a big client or large file. The firm cannot work on the file due to a conflict (more common) or a philosophical opposition to the client or file. Lawyer takes the file to a new firm and at the same time carves him or herself a really nice partnership deal and or signing bonus for bringing the file with him. There is nothing wrong with it, regardless of how you feel about the particular legislation. I think the lawyer’s point about lawyers taking unpopular cases is fine, and that explains why his firm dropped it. I don’t think he is saying the only reason he took the case or file was because it was unpopular, I think he objects to his firm dropping it because it is unpopular. That is a worthwhile debate (not really in this circumstance IMHO, but perhaps for others) and I have no issue with this. Lawyers don’t bring claims of this sort. Clients do.

Meanwhile, searching Easter and proclamation at the GWB White House archives reveals about the same as Obama. Lots of Easter Egg Rolls. It show that Bush made Easter Greetings but no official proclamations as I indicated above. Bush did so in one case on April 13, 2001 which was not Easter Sunday.
