The newest computer can merely compound, at speed, the oldest problem in the relations between human beings, and in the end the communicator will be confronted with the old problem, of what to say and how to say it.

We're going to talk about Casey Anthony being released so that we don't have to talk about our corporate parent being investigated for hacking people's cell phones.

25 Gus  Sun, Jul 17, 2011 9:17:15pm

You gotta laugh. Perhaps this scandal won't bring down News Corp however it's still enjoyable to watch the wingnuts squirm over this. Their stock has been taking a major hit and it keeps dropping. It will likely fall in the DOW come morning. Arrests are being made. People are resigning or being fired. News of the World is shut down for good. News Corps was hacking 9/11 victims families (allegedly). Not just ordinary victims families but families who lost loved ones when we were attacked by terrorists on September 11, 2001. All of this with Fox News and the faux patriots that follow them to the point of behaving like members of a deranged cult. Laugh-out-fucking-loud!

Herman Cain: Communities can ignore first amendment

Republican presidential candidate Herman Cain said Sunday that communities have a right to ban Islamic mosques. (ed: as opposed to Catholic Mosques or Shinto Mosques?)

Appearing on "Fox News Sunday," the former Godfather's Pizza CEO said protests and legal challenges to a planned mosque in Tennessee city are an example of local residents pushing back.

Cain said his view doesn't amount to religious discrimination because he says Muslims are trying to inject Shariah law into the U.S.

Using that logic, we should see about banning churches due to Christians injecting biblical law into the US.

I read an article a day or two ago about the jurors in that case. Apparently, when the verdict was read, they couldn't look at Casey because they didn't want to see her glee at the verdict. It seems they believe she's in some way involved in Caylee's death - but the bottom line was that the prosecution did not do its job of proving what that involvement was.

That's it from my reading as well. They didn't like Casey, but they felt that she had not been proven to have killed her daughter. It was tough call, but in my view the right one. A modern version of 12 Angry Men, in some ways.

There was no evidence, as I understand it. In such cases, if no one talks what can a jury do? They aren't serving on the jury of a witchtrial.

I think it's clear the whole family is bat-shit crazy, but that doesn't mean they are criminals--until proven so.

Really, what could they do? The prosecution bet the farm on murder 1, when they had no murder weapon, no eyewitness to the murder itself, and no motive that didn't rely on Casey being a habitual liar. She wasn't Mother of the Year material by any stretch, but they totally failed to prove her guilty of premeditated murder.

You shouldn't worry about that here. Here, Fox has a perfectly legal First Amendment right to propagandize the gullible.

Did you read about the Indiana Supreme Court case a while ago? The judges decided you have no right to resist police who enter your home illegally. Take it up with the courts later (if you can afford a lawyer).

The opinion was written by a Republican judge appointed by a Republican governor in a Republican state. The Attorney General said the court might have gone somewhat too far; otherwise, hardly a peep afaik: the situation doesn't fit anyone's partisan narrative.

It can't happen here--until it does. You bet I worry.

No Right to Resist Unlawful Police Entry: Indiana Supremes

The court issued its 3-2 ruling on Thursday, contending that allowing residents to resist officers who enter their homes without any right would increase the risk of violent confrontation. If police enter a home illegally, the courts are the proper place to protest it, Justice Steven David said. “We believe … a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence,” David said. “We also find that allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties involved without preventing the arrest.”

Scary to say the least.

"Hey now, everybody's getting hacked, so why does anybody care? And it happened back the past, so why are you worrying about it? Why isn't the media paying attention to the Pentagon getting hacked? And we're on the edge of default (except when we argue that we're not)! Can't you see that there are things far more important, like how Casey Anthony got away with murder?!"

I love how corporations being hacked is on the same page as a corporation hacking 4,000 cell phones. I'm not saying one is worse than the other, but they're two very different things.

You got a case name, I wanna look it up.

1. A couple of people have beat me to it. Note that the police intrusion during the events under consideration seems legal. The court went out of its way to mandate the expansion of police power.

2. A county sheriff immediately declared that the decision authorizes him to conduct house-to-house searches.

Sounded to me like one line whine about why people are paying attention to this story, instead of to more "important" ones. While at the same time trying to downplay hacking as something that "everybody" is having done to them, so why is this some big shock? You can practically taste the desperation.

I have a great tape collection, but a lot of it I have no idea who's on it. Guy named Rick Allen would bring in his own stuff on the overnight shift. I would put in a tape and record before I went to bed and listen the nest day. A lot of times the tape would run out before he came back on to say what he played. Over a couple of years I figured out most of it, but there are a couple dozen irreplaceable songs that I just can't ID.

Very true. It's still all a bit of a wait and see game, as even if Murdoch gets tossed out on his ass, the investigations may continue. If the allegations of hacking the phones of 9/11 victims families is shown to be even somewhat true, then expect the inquisition to go into full swing.

re: #81 reine.de.tout

I read an article a day or two ago about the jurors in that case. Apparently, when the verdict was read, they couldn't look at Casey because they didn't want to see her glee at the verdict. It seems they believe she's in some way involved in Caylee's death - but the bottom line was that the prosecution did not do its job of proving what that involvement was.

The jury should be commended for doing their duty despite their personal feelings rather than publicly condemned by opportunistic whores like... Well.. pretty much every fox 'journalist'. It's a shame. With every propaganda piece Fox runs, a certain segment of the population becomes ever more dangerously stupid, and increasingly a threat to our democracy.

All these right wing nutbags in congress didn't come from nowhere. Fox created the atmosphere of breathtaking ignorance that has made their elections possible.

Phyllis Chesler has a piece up (at Fox no less), about the way we respond to these cases when it's women, as opposed to men to kill their children.

I'm absolutely convinced that the mother in that case was guilty, but the law is the law, and a jury does not exist for society to take out their impulses for revenge through them.

You wouldn't believe that by reading the headlines the last couple days. Two I read today basically said the same thing, but the second went further. Both agreed that the GOP's latest gamble, namely their "Cut, Cap, & Balance" bill is likely to fail in the Senate. But supposedly McConnell's Hail Mary plan to give the president the authority to raise the debt between now and next November is getting serious discussion.

At this point, I think the GOP's pretty spooked at what an Aug 2nd with no deal is going to look like for them, but are trying to drag this all out til the 11th hour, in the hopes of saving some sort of face with the Tea Party base. The "Hey, at least I tried!" defense.

My mom later found out about a class action suit against US Steel Corp. and received a settlement on her pension, but it was a patch on what was owed to her and did not replace the money we needed in 1967.

Growing up there gave a unique cultural and social education, taught me a lot about race relations beyond complaining about people who live on the other side of the tracks.

And it taught me a lot about how far we should trust the Captains of American industry to look out for our interests.

And had it not been for FDR and his Social Security system, we woulda been tossed out on the street.

That's part of the story. But there are still plenty of role models in those parts of town because those parts of town are still de facto segregated. Doesn't matter what city you go to in the country, the patterns are still intact -- some from the 1800s, some from the 1900s, some from the war, some from postwar....you mentioned something similar upthread, earlier.

In fact, we in the suburbs spent our free time (for my parents it was church- and family-related) in the urban areas. It's not like white and other communities that try and distance themselves from their roots. That's not a part of the ethic. We have much different assimilation patterns.

Oh yeah. That. Was thinking about that a couple of days ago. No not gone totally. But it's just vestiges. 30 years from now it will be gone save for special access. Eventually most of the stuff we type and post will be archived in some obscure location. It won't be that easy to access. Just like most photography will be lost IMO. Ah, 56K, such memories. Remember the blazing speed of walking away in the morning while downloading a 10meg file and comes home with another 20% to go. I feel a special kind of pity for folks out in the internet boonies who are still relying on dial-ups because the "free market" is still dragging its heels with regards to broadband.

Reminds me of the shock I got when I went back to visit my mother's family for the July 4th weekend. I actually saw places in town advertising "free wifi" for the first time. Mind you, this is a place that, half a decade ago, was thrilled that DSL was becoming available.

I once called a help desk to get an home internet connection up and running. I was bitching about the 105 temps in my area, when the help gal on the other side said it was something like 120 where she was.

I asked where the hell she was, and she said Delhi.

"As in 'India'?" I ask.

"Yes." she says.

I was floored, 'cuz she spoke better "American" english than most Americans in my area.

Yeah, but even all that was made with materials and tools that the previous greats could only dream of. Not saying that computers will replace the old ways entirely, but instead simply give folks who previously would have toiled away in obscurity a new wider audience and a chance to win that 15 minutes of fame.

My favorite was the sites that would half load before the computer said "Frak it" and gave up. Or trying to play any kind of online game during peak hours. Email attachments that took so long to upload, you hit the "Send" button and then went to make coffee.

Plus my German now SUCKS so unless one keeps it up, it's for naught, unless one is really good at languages.

Shit - just saw that I made front page of the stalker blog!!

Hey stalkers!!

I bet your dates on match.com love when you tell them that you spend every night stalking a relatively small blog they've never heard of because you can't get over your ban!
And at least you know that if they can get over that and sleeping in your mothers basement, they love you for who you really are!

(Idiocracy reference.)

I look at it this way. We complete the stalker's sad little lives. They live their sad little lives vicariously through ours. They'd have nothing if it were not for us. Thus, I'm serving a higher purpose.

I find that German is really great for describing abstract constructs, my big problem is just making myself understood to the folks at the local shops.

English is fine for everyday conversation, which is one of the things that makes it a world language, but relatively hard to grasp in the abstract.

I never got to the point of being able to think in German, only took regular undergrad German and theological German, but I did get into it. It really does open up your mind for big-picture concepts. If your mind has already been geared for systematic thinking (ironically like mine was in Fundagelicalism), it really gives it a boost.

Zizek considers himself a Christian Atheist.

I was actually reading a book called Nietzche and Levinas recently which was a series of academic essays drawing out similarities between the two intellectuals. For those of you who dont know, Emmanuel Levinas was a pretty influential Jewish phenomenologist who was deeply religious.

I do a lot of volunteering at young adult shelters and the other day a young black guy I know who frequents our shelter recognised the "amor fati" on the back of my sweater as coming from Nietzche. First person in maybe 6 months to do so (and tell me). He said it was the closest to his personal philosophy at the moment.

A lot of North American academic departments dont teach Nietzche anymore so even they would miss it.

I think I know what Zizek means by that. At least, my own version is, I call myself a cultural Black Protestant nontheist.

Sounds pretentious as eff, and takes five years to say, but it's the most accurate thing I can come up with. One stops believing. One does not just stop being culturally what one is.

Levinas (and of course Derrida) had a big impact on me. Well, all of the phenomenologists did. It was the times, what could I say.

It's a very Black/blues attitude. We have a phrase: when some asshole tells you you have to do this or you have to do that, the answer is, Uh-huh. I don't have to do but two things: be Black, and die.

The Macro. I think Afghanistan, Iraq and Pakistan will continue to hate the USA once we're long gone. We may have won the battle but we didn't win the hearts. You can't change a culture like that. Iraq had little to do with 9/11. The rest is history. Afghanistan has some to do with 9/11 but not that much. Most of it was centered in Pakistan and Saudi Arabia and remains so. Water under the bridge though. I voted for Bush in 2004 only because I didn't want to see a civil war in Iraq. Strange but true. But that's how bent I was in the aftermath of 9/11. Water under the bridge though. I voted for Bush in 2004 only because I didn't want to see a civil war in Iraq. Strange but true. But that's how bent I was in the aftermath of 9/11. But looking back Bush was actually a rather moderate Republican compared to the current Republican state of mind. We're still living in strange times.

Hell, if you take the time to dig through the archives here, you'll find that I used to be one of those with his head firmly planted up backside when it came to Bush and the Right. In a way, Charles and I both sort of went through the same transformations, first being "mugged" by 9/11 into signing into a lot of the anti-Islam BS for awhile, then a reevaluation after seeing some of the noxious shit coming out of the Right in the wake of '08. I voted for Bush in '04 because I honestly thought he was taking the "War on Terror" seriously, and in retrospect I don't regret that vote. Because you're right, Bush is like his old man and Reagan in that they are far more moderate, level-headed men than the loonies who claim to be "Republicans" now.

Nina Simone will blow.your.mind.

She went crankodoodle in her later years. But musically, artistically, intellectually, she was a true A lister. I relate to her story a lot.

You know how it is. We have "faith" in people. We judge people by who they are regardless of whether they're Christian, atheist, Jewish, Muslim or anything else. None of those associations determine how well they will respond in a positive affirmation towards our being and towards the world amongst us. I've seen good and bad from all of the above. That's the irony I guess. It doesn't matter what people believe in the end. It's who they are and how they respond to you in the affirmative when the going gets rough. That means the most to me.

Ooo, "Who Am I", the Bernstein piece. That's a good one. Wait till you hear her Bach-based jazz.

There is a recent bio of her which I haven't read yet, Princess Noire. I have heard good things about it - [Link: amzn.to...]

Her autobiography is a good place to start - [Link: amzn.to...]

Also I'd recommend the Live At Ronnie Scott's DVD - [Link: amzn.to...]

Her studio years on Philips are the best produced and most polished. But every time you find a new CD, do get it because even if you think you have 10 versions of one song all eleven will be performed differently each time. I should say - be aware it's really easy to get obsessed with Nina Simone. She really sticks with you.

Yeah, it's kinda funny to watch things now and see the historical parallels. I keep hearing the wingnuts tell me that Obama's the new Carter, that he's an utter failure and that he'll go down badly next year. Personally, I keep looking at him as Reagan, circa 1983: A fairly moderate (by today's standards) president who was trying to nurse the still ailing economy along against strong opposition from a very vocal Democratic Party. And we all remember how '84 worked out, and it wasn't the loonies who walked away with victory.

I think you're right about that. The thing I keep dealing with is these disgruntled PUMA types who voted for him and are now pouting about everything he does, as if Hillary would do much different. I even had one tell me, we should not have voted in the black, we should have voted in the woman. Then we wouldn't be having all these teabaggers. /eyeroll

That's such a joke. No president is like the other. Obama for one has far bigger balls than Carter. I could add more. And people keep complaining and thinking "well if we elect a Republican president we'll be much better off." Not hardly. We're dealing with an international economy now. Greece effects the market as does any other "little" European country. President can't wave their magic wand and make things better for us. People just aren't clued in. The fact is that the government doesn't run the economy in the USA or the world. It's the private sector. It's the banks and the investment bankers. In the USA it's also what the Fed decides which is almost outside the influence of normal democratic decisions. So if Romney won in 2012 it really wouldn't make a spit of difference. Totally agree. This isn't the America of our fathers generation, or their fathers. We are not only a nation that is one among many instead of the king of the mountain, but we're also a nation which seemingly has ceased to have a functioning government. Really, if next year the GOP were to have a perfect sweep and take not only the White House, but both houses of Congress, they'd still not have anywhere near enough of a majority to rule by fiat. And after the last 10+ years, do folks in the GOP ranks honestly believe that those Democrats still in power will just roll over and allow themselves to be ordered how to vote?

One of the questions the British MPs are reportedly planning on asking Murdoch and Murdoch is rather big.

4. Why did News International not hand over e-mails containing evidence of alleged illegality by its staff to police in spring 2007 when it gave them to solicitors Harbottle and Lewis for review?

This question asserts two things: that News International may have committed a crime by not handing over that evidence of illegality to the police, and that it gave those items to solicitors for review, which would probably be a rather high-level decision to make.

Social Security has got to be on the table. Discretionary spending doesn't have an automatic increase built in. The trend we're on, our entitlement programs, taken together and combined with the demographic trends [more old people, fewer well educated high earners] will sink the budget no matter how drastically we cut discretionary spending.

That was a quick reversal.

Sources say that he was confronted with new information about the friendship between the two men who have known each other for many years.

Assistant Commissioner Yates is unlikely to go quietly.

This morning he told friends that it would be "outrageous" if he was suspended and - as I posted earlier - that he would only resign if his judgement was found wanting by the official inquiry to be chaired by Lord Leveson.

More garbage from the already tarnished Wall Street Journal....
A tabloid's excesses don't tarnish thousands of other journalists.

When News Corp. and CEO Rupert Murdoch secured enough shares to buy Dow Jones & Co. four years ago, these columns welcomed our new owner and promised to stand by the same standards and principles we always had. That promise is worth repeating now that politicians and our competitors are using the phone-hacking years ago at a British corner of News Corp. to assail the Journal, and perhaps injure press freedom in general.
....
Phone-hacking is deplorable, and we assume the guilty will be prosecuted. More fundamentally, the News of the World's offense—fatal, as it turned out—was to violate the trust of its readers by not coming about its news honestly. We realize how precious that reader trust is, and our obligation is to re-earn it every day.

608 Holidays are Family Fun Time  Mon, Jul 18, 2011 7:24:17am

Caring for the Baby Boomers is getting really, really expensive for individual families --in time and stress . . .

"On top of this, there's a shortage of paid home health aides. Last week, the Obama administration joined labor groups calling for the creation of 2 million more jobs in home health care, plus a new visa for immigrants willing to enter the field.

Mintz has grappled with the problem in caring for her husband, who has multiple sclerosis. Earlier this year, she had trouble finding someone to change his catheter twice a week while she was at work. So she says she resorted to something a little crazy.

"With Steven's permission, I actually put a note on the neighborhood Listserv," she says.

Sure enough, a man who works from home said he'd be willing to try it. He's been doing it ever since — for free.

Mintz says we need to expand our definition of "family." Next year, she plans to launch a recruitment drive to match those in need with volunteers.

"It might be, 'I can drive her to PT for the next five Thursdays,' or 'I can bring meals for the next six months,' " Mintz says.

In other words, create a community of caregivers — an old idea for a new age."

Even Ed Morrisey is critical of the WSJ editorial but still warns against politically motivated witch hunts....

Demanding exotic prosecutions based on stretching statutes to the breaking point should threaten anyone working in the First Amendment sphere. It’s too bad that the Journal didn’t just stick with that argument today, because it’s a valuable reminder that government regulation of media won’t solve any ills, but instead will introduce a lot of new and much more malignant problems. Unfortunately, they buried the lede.

I think this has always been done by good neighbors. The problem is that we don't know our neighbors like we used to. We move around a lot with few spending their lives in the same town. We live in paranoia - or maybe just "convenience" - opening our garage doors remotely to get in the house without ever going outside to engage with our neighbors.

Since I moved into an RV park from my house of 20 years where I knew my neighbors only well enough to wave at them a couple of times a year, I have really experienced this difference. I now go out and walk my dogs every day and talk to folks. When I got sick a few months ago and was flat on my back for 2 months after 3 weeks in the hospital, my neighbors were amazing. They took shifts walking my dogs several times a day, they fetched my groceries and did my laundry. I had a constant stream of visitors just stopping in to make sure I was OK.

I dunno where I'm going with this exactly but I know I'm onto something.

Luckily, my parents could afford a CNA for the short-time my Dad needed one. I have a girl friend who moved her mother in with them, they (out of her mother's dwindling money) pay for a "mexican lady" to come in during the day while they work. Her mother get's excellent care. Since they were able to sell her house, she should be able to afford it until she is gone.

In the nursing home that my dad was in after his stroke for "rehab" all the CNA's were immigrants. Every caregiver, I've met thru my girlfriend has been an immigrant.

They make a decent hourly wage, but like preschool teachers, way, way less than I think they are worth.

The spin on this is that this is a government ploy to curtail freedom of the press.

Sort of like arresting a criminal for breaking and entering is a government plot to restrict his freedom of travel...

You're invading my fair city??

Aw, shit...you live there? Pilot! Turn this bucket of bolts around!

Rich only exacerbates some illness, doesn't equal Evil.

Evil is Jeffrey Dahlmer.

Levi Aron is made out of the same Evil.

Needless to say he hasn't eaten any babies . . .

The consumption of infants for sustenance has always been more of a satirically scholarly affair more than one for the mentally deranged.

Some twistedness is beyond the diagnosis of any illness. . . .

White Supremacist Picks A Fight With Black Guy, Black Guy Happens To Be Boxing Champion

28-year-old white supremacist Daren C. Abbey began threatening Marlon Baker at a Boise, Idaho bar because “blacks are not welcome” there. Baker decided to leave but Abbey followed him to his car screaming racist things at him. Abbey then tried to punch him, but little did he know Baker was a champion boxer. Baker knocked him out with one punch. When Abbey woke up, he was arrested and charged with misdemeanor battery and felony malicious harassment.

Weird.

What I said was that the dude wasn't even an ex-professional boxer. Just an amateur. which makes what he did all the sweeter.

He tried to defuse it by walking away, yet the racist followed. I'm glad the cops didn't do the too-frequent thing of arresting everyone involved.
