My bizzare-yet-great recipie for tonight-- one of my wife's favorites:

Thinly sliced steak on cucumber topped with wasabi mayonnaise or horseradish.

Can I just say that the more I research my lady lawyers, the more rockingly awesome the history of actual lady lawyers gets?

Laura de Force Gordon. What a woman!

Sounds good. Don't sweat the difference between wasabi and horseradish. They're actually the same thing with the addition of food coloring. Real wasabi is very expensive (about $100 per pound) and even most good sushi joints don't offer the real thing.

No, but she lectured on both spiritualism and women's suffrage, was the first woman to run a daily newspaper, was a leader in the court case that allowed women to practice law in California, was admitted to the bar, sued Hasting Law School, and went to Hastings law school, then started a legal practice in San Francisco.

Then after dinner, she read the kids a story and tucked them into bed.

Yeah, the difference is between using the horseradish mayo or just grated horseradish. Depends, really, on how fatty the meat is.

Sutter Creek, July 4, 1880

The orator of the day, Laura deForce Gordon, delivered a fine address, replete with humorous allusions to woman’s rights and the men for once having to take a back seat, interspersed with serious and patriotic references to the dark days of our Republic and the glorious future to which it will attain. The fair oratress was loudly applauded during her remarks, and at the close a gentleman—the first and only time one of that humbled sex even tried to speak—proposed that every man present join in three rousing cheers for the orator of the day, which were given with a will.

Here we go...

In the Constitution We Trust

I found out about this too late to do much about it, but just in case you hadn’t heard, The US House of Representatives is voting tonight on a bill to make "In God We Trust" the official motto of the US.

This is pretty shocking. Well, it’s not shocking in that everything the Republican-majority House has done in the past few months has been pretty antireality, but this is such a clear violation of the First Amendment that it’s, well, shocking. That Amemndent to the US Constitution says...

No surprise here....
Senators who oppose infrastructure spending are putting the rich’s interests first

When the Senate votes later this week on Obama’s plan for new infrastructure spending to create jobs, Democratic aides expect that not a single Republican Senator will vote for it — because it’s paid for by a 0.7 percent surtax on income over $1,000,000 that would impact a tiny minority of Americans.

Dem aides say they also expect a handful of Dem defections when the Rebuild America Jobs Act — whose goal is to create hundreds of thousands of jobs — is voted on this week.

I guess a drum circle is as good of a solution as anything else. We're so fucked.

So you base your future prediction on one DailyKos post? The American people are going to vote according to what's posted there? Let's take a look at a recent Gallup Poll:

New Low of 26% Approve of Obama on the Economy
Ratings on Afghanistan and foreign affairs have also declined
by Lydia Saad

PRINCETON, NJ -- A new low of 26% of Americans approve of President Barack Obama's handling of the economy, down 11 percentage points since Gallup last measured it in mid-May and well below his previous low of 35% in November 2010.

A lot of Republicans voted for Obama in 2008. I already spoke to an independent this summer who voted for Obama in 2008 and she said, at the time, that she was interested in Donald Trump. Which illustrates how wide American's are willing to "swing".

I think Mitt has a chance. His radical base is just as unenthusiastic as the left's. That leaves it up to swing voters who could go either way depending on press coverage. I'd say it's a toss up.

I'm happy to talk third party, as long as the conversation includes the very real reasons why third parties face an enormous goddamn obstacle in getting off the ground in the US and supporting them usually equates to non-participation.

And the only real way to change that would be to change how we vote in the US, or severely change campaign finance law so that party membership isn't the huge advantage that it already is.

And that would require the support of at least one of the major parties, if not both, making it a rather difficult road to hoe. I think the best chance of that would be in the wake of a splintering of the GOP and/or the Democrats.

re: #79 Obdicut

I'm happy to talk third party, as long as the conversation includes the very real reasons why third parties face an enormous goddamn obstacle in getting off the ground in the US and supporting them usually equates to non-participation.

And the only real way to change that would be to change how we vote in the US, or severely change campaign finance law so that party membership isn't the huge advantage that it already is.

And that would require the support of at least one of the major parties, if not both, making it a rather difficult road to hoe. I think the best chance of that would be in the wake of a splintering of the GOP and/or the Democrats.

So, to break the backbone of corporate politics, we have to get one or both of the corporate parties onboard. Gee, it doesn't sound that difficult once you explain it like that.

Nearly impossible. But there's no alternative other than total collapse and/or revolution.

For transparencies sake, I've done actual work for a third party, the Working Families Party. I encourage anyone interested in how 'third party' groups can actually affect elections. It is not, in the main, by actually running candidates in national elections, but by supporting the candidates inside the larger party who most closely adhere to their philosophy.

This is fixed now ... if the whole editing dialog won't fit, it has scroll bars to let you get to the rest of it.

Thank you, thank you, thank you. :) Seriously, after last night I greatly appreciate this bit of coding.

But we're looking at almost one year from today. Consider that the Iowa caucus is also 2 months away and the GOP has gone through several "front runners" without anyone casting a real vote yet. Straw polls are practically worthless. And the last result from the GOP Iowa caucus had Mike Huckabee as the GOP superhero. History tells the rest of the story.

Imagine being a black person casting your vote back in the early 1900s. Neither party favored full integration, but the Democrats of that day were doing everything they could to prevent black people from voting and the Republicans were actually appointing black people to government positions.

Must it have stung to vote for a Republican even knowing that they weren't going to fight for full integration? Probably. Was it still a damn sight better than voting for the fully segregationist, anti-black Democrats? Abso-fucking-lutely.

The seduction of Howard Dean
The liberal firebrand succumbs to Washington's money culture

Howard Dean has long cultivated an image as the plainspoken doctor who speaks for the left wing of the Democratic Party, a role he still plays as a pugnacious pundit on TV. But since his term as chairman of the Democratic National Committee ended in January 2009, Dr. Dean has taken on a less-noticed role: paid advocate for interest groups that would find few fans among the progressive voters once energized by Dean’s 2004 presidential bid.

Dean may not be the worst of the “buckrakers,” those prototypical capital characters who exploit their name and connections without regard for principle. But his recent political forays seem to have diverged from his trailblazing left-liberal past.

As senior strategic advisor at McKenna Long & Aldridge, a heavyweight Washington lobbying firm, Dean played a prominent role representing the biotech industry during the healthcare bill debate, staking out a position on biopharmaceutical drugs that was decried by consumer groups.

Pat Robertson is less "Christian" than I am, he invests in Liberian diamond mines and has a TV network that hypnotizes dumb people, his god is green paper, baby

Personally, I think the final choice will likely be from the short list of Republican governors who aren't quietly worried about an angry mob showing up on their front lawns. Probably somebody seen as solidly "socially conservative," i.e. so anally retentive that their eyes have turned brown.

I predicted, and have not ruled out some offbeat nominee...still time but it would have to be soon

Truly pathetic. Rape, sexual assault, is not an ideologically dependent crime. And we still don't even know the full extent of the allegations and rumors. My (admittedly jaundiced) opinion of these rape stories is that they are being used as the shiny bobble; they are the "hey, look over there" tools for those who don't want to address the underlying issues behind the concerns over financing and wealth and social disparity.

The right wing needs a new bogeyman because the Obama-as-Mancurian-Candidate just doesn't grip anymore simply because after 3 years in office President Obama has turned out (to the chagrin of real progressives) to be a pretty middle-of-the-road manager type without anything nasty coming up for all the digging into his background or any serious scandal in office.

So, OWS will fill in as the bogeyman for now.

Thing is, I don't see the sort of moderating personality in Romney that Bush had in the day, so a Tea Party/Republican Congress might be crazy enough to make a bid at abolishing the filibuster, or at least effectively neutering it.

l don't think there's really much that a GOTP congress can do, unless they get to the magical number of 60 in the Senate. The true height of hypocrisy would be the gop abolishing the filibuster after using it more times over the last 3 years than ever before in our history. At that point, you can't even make a consistent argument, no matter how hard you spin. Your only defense of abolishing the filibuster would be "we're doing it to save the country" or some b.s. like that. Otherwise, just IOKIYAR.

Romney showed a lot of willingness to moderate and compromise with the heavily Dem MA Legislature. Of course that was a lifetime ago and a million miles ideologically/culturally from the fanatics he'll be dealing with in this Congress.

Romney showed a lot of willingness to moderate and compromise with the heavily Dem MA Legislature. Of course that was a lifetime ago and a million miles ideologically/culturally from the fanatics he'll be dealing with in this Congress.

I've seen suggestions on how the filibuster might be effectively rendered powerless, including the infamous "nuclear option." And a Tea Party Congress stuck behind the brick wall might be more willing to throw caution to the wind and blast it apart with nitroglycerin, assuming that folks will be so happy with whatever they put into place that they'll not have to worry about being returned to minority status.

Herman Cane says China trying to get nukes. Really ???

HERMAN CAIN: My China strategy is quite simply outgrow China. It gets back to economics. China has a $6 trillion economy and they’re growing at approximately 10 percent. We have a $14 trillion economy — much bigger — but we’re growing at an anemic 1.5, 1.6 percent. When we get our economy growing back at the rate of 5 or 6 percent that it has the ability to do, we will outgrow China.

And secondly, we already have superiority in terms of our military capability, and I plan to get away from making cutting our defense a priority and make investing in our military capability a priority, going back to my statement: peace through strength and clarity. So yes they’re a military threat. They’ve indicated that they’re trying to develop nuclear capability and they want to develop more aircraft carriers like we have. So yes, we have to consider them a military threat.

As I understand it, China's put the ex-Varyag (no new name AFAIK) to sea and is planning to build two identical sister ships using native tech, then build on what they learn doing that to build a nuclear carrier to match our own designs.

Rather laughable, as their submarine fleet is state-of-the-art...for the 1960s.

That's likely because India and Russia are on fairly friendly terms, while the Bear and Dragon seem to be fighting it out every other year. Might have something to do with China buying one or two examples of a design, canceling the contract, then offering their own knock-off on the weapons market within a year.

BREAKING: Cain accuser got $35K, which was a year's severance pay [Link: thkpr.gs...]

Found this posted on another board I frequent:

Washington Post: Herman Cain’s accuser wants to tell her side of story, lawyer says

A woman who accused Herman Cain of sexual harassment in the 1990s is ready for her story to come out, her lawyer said Tuesday, even as the Republican presidential hopeful spent a second day trying to quell the mounting controversy and explain his conflicting recollections of the matter.

Joel P. Bennett, the attorney for one of two women who made the claims against Cain, said Tuesday that his client is barred from publicly relating her side because of a nondisclosure agreement she signed upon leaving the National Restaurant Association, where Cain served as president from 1996 through 1999.

Bennett is calling on the association to waive the agreement so the woman, a federal worker living in suburban Maryland, can rebut Cain’s statements this week that the allegations were false and baseless.

And if that isn't bad enough, word is that Mrs. Cain is in talks to appear on Fox this Friday.

300 ProGunLiberal  Tue, Nov 1, 2011 7:00:19pm

I just found this on TVTropes. From an Economist Article

EFFORTS to curb inflation in China are having some painful side-effects. A squeeze on bank lending has prompted some businesses short of cash to stop paying wages to blue-collar workers. Even the much-vaunted state sector is feeling the pinch. Work has all but ground to a halt on thousands of kilometres of railway track, and many of the network’s 6m construction workers have been complaining about not being paid for weeks or sometimes months.

If China flumes under, they lose the Western Half of their nation as the wolves to the West and South fuel uprisings and genocide in Tibet and Uyghurstan.

And the World Economy plunges into depression.

I've been a legal secretary the past 20 years, and the majority of settlement agreements I've been privy to have been for less than $35K. $35K isn't a significantly high number, but in my opinion it's maybe a bit higher than simple "go away" money.

That doesn't directly weigh on the truth or falsity of the allegations, but in my experience the higher the number, the more likely there is to be a *there* there.

If she didn't have a leg to stand on, back in the 90's a decent labor lawyer could have made a case like that go away for a lot less than $35,000.

No, they heard the screams of protests from their customers, closing accounts. 3 other banks rescinded their debit card fees, before BofA did. BofA thought they could lead the market, and found that (shocka!) the market didn't want them.

re: #246 Targetpractice, Worst of Both Worlds

I've seen suggestions on how the filibuster might be effectively rendered powerless, including the infamous "nuclear option." And a Tea Party Congress stuck behind the brick wall might be more willing to throw caution to the wind and blast it apart with nitroglycerin, assuming that folks will be so happy with whatever they put into place that they'll not have to worry about being returned to minority status.

In a country where people actually understood the filibuster, the GOP would pay a big political price for doing away with it. Of course we don't live in such a country, so the GOP may just go off the deep end.

Again, though, they'll be setting a dangerous precedent. Having no filibuster would just make it easier for the majority party to undo whatever the minority had previously done when in power. The Bush tax cuts wouldn't have even lasted their originally prescribed 10 years. Obamacare would have no chance of lasting more than a decade, as the GOP made it public enemy no. 2 (after Obama himself) despite the fact that the GOP used to be pretty united behind a market based reform system like Romney/Obama Care.

U.S. Army soldier arrested on suspicion of espionage

Specialist William Colton Millay, 22, was taken into custody at Joint Base Elmendorf-Richardson on October 28 following a joint espionage investigation conducted by the FBI and Army Counterintelligence special agents, Army spokesman Lt. Col. Bill Coppernoll said.

Coppernoll did not say who Millay, of Owensboro, Kentucky, was suspected of spying for or what sensitive information he may have had access to. He said the investigation was ongoing.

Hence why, despite the fact that nothing is getting done and the country is suffering for it, the Dems have not given into the urge to undo the filibuster. And why, back in the Bush Admin, Congress ultimately was able to compromise such that the "nuclear option" never went through. But with a Republican in the White House, I doubt the Tea Party could find such control within itself, and considers compromise to be a four-letter word.

I was reading about this earlier. Their original calculations showed that it was cost effective for them. Unprofitable customers would leave and the ones willing to stick it out would make up the cost with increased fees. Once they tested it out they noticed the math didn't add up so they changed their mind. It's just a numbers game and has nothing to do with anything altruistic like customer service. Just math.

Katchpole didn't stop there. When her petition started gaining traction (about 195,000 signatures) only a week or so after it was posted, she went to her local Bank of America with her petition in hand and closed her account. There's a limit to any sane price jump though, and it's about 10%. BoA already had a 34% jump on checking account fees this year and the debit card fee would have added almost 42% on top of that new higher rate. Netflix is suffering from this too. If you're going to raise rates do it quietly, keep the jump ≥ 10% and wait at least six months between increases. Look at Starbucks, they hit their customers with regular nickel and dime price increases and the bitching is minimal.

They are pissed that a lot of people are listening to what the guy in the mask is saying - or that even if they aren't agreeing with him , that the debate has been intensified.

As Netflix shows, customers are aware when a company goes too far in trying to get their money, and will react.

I'm dubious of the idea that the guy in the Guy Fawkes mask is communicating effectively to debate about bank scamming. At most, the guy in the Guy Fawkes mask and the guy closing his BofA account over the five bucks are responding to the same thing, (or perhaps are the same person).

After there's nothing left for her to pull up, nip and tuck, I fear she'll start drinking cord blood or something, so her body will regenerate from the stem cells.
But, then again, I'm not sure what I think, cause she hasn't told me yet.

Yeah, my folks will never die, if for no other reason than they wouldn't give the other the satisfaction.

I'm still stuck between cremation and being buried in a pine box. Between convenience and retro appeal.

I like the notion of going to one of those body farms, like the one in the Patricia Cornwell novels. Natural decay, you contribute to science, and the scientists have to come and visit you from time to time.

News that saddened me today:

American Orchid Society to close headquarters in Delray Beach

Orchid lovers, collectors and tourists looking for a glimpse of more than 15,000 varieties of orchid at The American Orchid Society greenhouse and gardens will soon have to look elsewhere.

The American Orchid Society, with its headquarters west of Delray Beach, is selling its building and closing the gardens and greenhouse to the public permanently. Longtime supporters of the nationally known, 90-year-old organization say it will be a major loss for the area.

"I'm very disappointed that they have done this," said Annette Jackson, former president of Delray Beach Orchid Society. "There's a bitter taste in everyone's mouth."

Declining membership and endowments hit by the financial crisis are to blame for the closure, Society President Chris Rehmann said. Going from a robust 30,000 worldwide membership when the building and gardens opened lcoally 10 years ago to about 11,000 was a real hit for the organization.

"I know people are disappointed," Rehmann said. "We appreciate the effort of everyone in the area who contributed to the success of the building. But in this economy, we found it very difficult to keep it going."

But even more, cultivars are lost. Many orchid cultivars have breeding history stretching back to the 19th century. Some orchids can take as long as humans to reach sexual maturity, and thus breeding programs can take decades.

I just want to rant that our society has become so short-term minded that multi-year and multi-decadal efforts are becoming rare in our society. During the power outage here in Connecticut, which is into its 80th hour (4th night), I learned two important things:

1) I can't live without my iPad

2) Starbucks wi-fi hot spots work through their store windows even when they have no electricity.

I found out #2 on Sunday when I needed to get on line to buy a month of 3G service.

501 Gus  Tue, Nov 1, 2011 8:57:23pm

HERMAN CAIN: I do view China as a potential military threat to the United States.

JUDY WOODRUFF: And what could you do as president to head that off?

Oh, I agree that the AOS has been poorly run for a while. I was a member for a few years, and I remember when they got an online forum. While it was informative in some threads (many knowledgeable people) there was often quite a bit of snobbery too. Lots of infighting and little political groups. I'm not surprised they couldn't get their act together.

The local orchid society (SDCOS) seems to be plugging along well enough. However, California has lost its long time orchid nurseries over the past 10 to 20 years, some that had history going back to an earlier period of the 20th century. As a business orchids just couldn't compete with the faster turn-around crops.

I don't do orchids anymore (since I rent now), and gave away my collection years ago. Yes, Taiwan is a source of many imports - it's hard to compete with low wages and indifference towards working conditions.

In the US, all the major orchid nurseries of which I know are run by families who simply don't want to exit the business and those families must have other means of support, I suppose. I can't imagine anyone today going into the orchid business or any floriculture business in the US with the expectation to be a thriving business. For cut flowers Proflowers and 1800Flowers have contract farms here in the US (even in San Diego county) but it's all labor based upon immigrants willing to work for almost nothing.

One of the more perverse things about this universe - that which is very important we reward very little, while the least necessary (say a professional sports star) get paid the most.

563 ProGunLiberal  Tue, Nov 1, 2011 9:25:50pm

Ah, here's what I was mentioning about Japan. Wikipedia covered it very well.

While there are currently no known plans in Japan to produce nuclear weapons, it has been argued Japan has the technology, raw materials, and the capital to produce nuclear weapons within one year if necessary, and some analysts consider it a de facto nuclear state for this reason. For this reason Japan is often said to be a "screwdriver's turn" away from possessing nuclear weapons.

Significant amounts of reactor-grade plutonium are created as a by-product of the nuclear energy industry, and Japan was reported in December 1995 to have 4.7 tons of plutonium, enough for around 700 nuclear warheads. Japan also possesses an indigenous uranium enrichment plant which could hypothetically be used to make highly enriched uranium suitable for weapon use. Japan has also developed the M-V three-stage solid fuel rocket, similar in design to the U.S. LGM-118A Peacekeeper ICBM, which could serve as a delivery vehicle, and has experience in re-entry vehicle technology (OREX, HOPE-X).

It has been pointed out that as long as Japan enjoys the benefits of a "nuclear-ready" status it will see no reason to actually produce nuclear arms, since by remaining below the threshold, albeit with the capability to cross it at short notice, Japan can expect the support of the US while posing as an equal to China and Russia.

"MOBILE, Ala (Reuters) - The owner of a large southwest Alabama car dealership derided as "Taliban Toyota" by a competitor has been awarded $7.5 million in damages after a jury trial for his slander claim.

Iranian-born Shawn Esfahani, owner of Eastern Shore Toyota in Daphne, Alabama, sought $28 million in compensatory and punitive damages from Bob Tyler Toyota, claiming employees at that Pensacola, Florida-based dealership falsely portrayed him as an Islamist militant to customers."

Owner of car dealership labeled "Taliban Toyota" wins millions
