Herman Cain Thinking of Suing Politico; Harassment Victim Offers Statement

Cigarette Smoking Man Mark Block told Fox News today that his boss Herman Cain is considering a lawsuit against Politico for reporting facts.

What a terrific idea! I strongly encourage Cain to go ahead and sue.

(Reuters) - Republican presidential candidate Herman Cain, facing sexual harassment accusations, is weighing a lawsuit against the news outlet that first reported the claims, a spokesman said on Friday. …

“It is being discussed,” Cain’s chief of staff Mark Block told Fox News on Friday, when asked if the campaign was considering suing Politico. “The Politico article, if it was held up to the same standards as the code of ethics of journalism, the people involved would be fired.”

Meanwhile, one of the women Cain accuses of lying is about to make a statement.

(Reuters) - A woman who accused Republican presidential candidate Herman Cain of sexual harassment Thursday offered a statement telling her side of the story, in a move that could further undermine his 2012 campaign. …

“This is absolutely fabrication, man,” Cain told conservative talk radio host Sean Hannity, adding later: “We’re not going to get distracted. As of today we’re back on message and we’re going to stay on message.”

One of the women said earlier this week that she wanted to talk publicly about accusations that Cain had sexually harassed her, but she has since changed her mind and wanted to make a written statement through her lawyer.

The woman’s lawyer, Joel Bennett, gave the statement to the restaurant group, said Sue Hensley, a spokeswoman for the restaurant association.

The trade group’s lawyers were reviewing the statement to decide whether to lift a confidentiality agreement that she signed when she left the association. It is likely to conflict with Cain’s version of events.

What are the grounds? Clearly, it's reporting based on facts; there were claims of harassment that the Cain campaign has conceded. So it can't be that the reports were biased or false. The further revelations that multiple women were potentially harassed makes this (the campaign considering a suit) even harder to believe.

Sounds like they're trying to sue on sour grapes and that's not going to cut it.

Besides, once they open the door on a lawsuit, they'll open Cain up to all kinds of discovery - not the thing you want to do during a campaign. And all the other media outlets will be circling like vultures.

It looks to me that the best the NRA can do is allow the now slandered woman ("she's making it all up!") to make her statement and then get the hell out of the way. It appears to me that non-disclosure has been nullified by Cain's statements and the NRA has been put into the position of having to justify its actions, i.e. giving the women settlements. The association wouldn't seem to have anything to gain by supporting Cain.

It's not frivolous in that someone in the Cain camp may they think that the lawsuits would essentially put a gag order on everyone - since their words and actions would come under the purview of the case at hand.

I think they're going to be sorely disappointed - and they were even walking back the notion of a suit yesterday.

I just...I cannot wrap my mind around this. I mean, I suppose I may be (And probably am) highly underestimating just how little the average person understands the law, which when combined with partisanship may make this an effective bluff for political purposes.

But seriously, Politico must be licking their lips at this. More publicity and traffic. The possibility of discovery. Getting legal fees and quite potentially additional awards should the Cain camp actually go through with this.

The WaPo is calling for the Cain campaign to put forth its lawsuit promptly. They've got to put up or shut up - and shutting up isn't an option.

But here’s why you must follow through on the vague “legal options” threat you outlined to a Washington Post reporter: A good old civil complaint will break this info-logjam that has burdened the media and the National Restaurant Association all week long.

A suit will allow extensive discovery privileges to both parties to the case. That means that Politico could avail itself of court authority to bust loose all the documents that refuse to out themselves. The separation agreements, internal restaurant association memos on the disputes, and maybe even some killer e-mails — they’d all land in a court docket for public inspection.

These confidential documents are proving stubborn. Every major media outlet in the country has been hustling to get them, with marginal results. When news breaks on this story, it’s often based on anonymous sources that few appear to believe. Only a judicial proceeding can force all of this into the light of day.

Good thinking, Cain campaign. File that suit. I’ll even volunteer to run it down to the courthouse for you.

I was involved in propagating an internet meme about Michael Savage years ago, and as a result I was served with a lawsuit demanding $3 million in damages. After the lawyer advising me told Savage's lawyers what we would be asking for in discovery, they very quietly dropped the suit.

It would have revealed a lot of info that Savage apparently didn't want people to know about.

Yeah I agree but he won in a landslide against a guy who ran a tight race with him for AG just two years prior. All I am saying is do not underestimate him. He's a smart politician. Miserable politically especially on choice. I've seen him twice these past two weeks protesting the clinic restriction bill he's going to sign. He's not stupid like George Allen was and won't call a kid a bigoted slur.

I don't know the case honestly but I googled and I saw alot about Manassas. That's Marshall's turf since McD is based out of the Richmond burbs I believe. Marshall thankfully I doubt could reach high office here. Breaks my heart to think we nearly got the Cooch out a couple years ago. Telling ya, working with the campus Dems has really showed me how important local politics is. Helping the guy running aisnt Dave Albo tomorrow actually. Jack Dobbin's a good dude.

Can't stand them both either. Speaking of Gilmore, man what a flop. South Dakota, which for some reason is always ahead of the curve on these things, did so in 1970.

That sounds like a good read too. My bulk of history interest/reading is from French revolution to the present by and large. I've never been that into Greek and Roman history. I mean it's not boring but it doesn't grapple my imagination the way the World Wars and other things do.
